HomeMy WebLinkAboutOrange County Regional Mounted Enforcement Unit (OCRMEU) - 2019-07-16 OPERATING PLAN FOR THE ORANGE COUNTY REGIONAL MOUNTED ENFORCEMENT UNIT(OCRMEU) 1. PARTIES: The member agencies of the Orange County Regional Mounted Enforcement Unit (OCRMEU) are the Anaheim Police Department (APD), the Buena Park Police Department(BPPD),the Huntington Beach Police Department (HBPD), the Irvine Police Department (IPD) the Newport Beach Police Department(NBPD), the Orange County Sheriff's Department (OCSD), the Orange Police Department (OPD), and the Santa Ana Police Department(SAPD). 2. MISSION: The OCRMEU is a multi-agency Mounted Enforcement Unit. The OCRMEU trains together using common structure and techniques in order to deploy a joint force of member agencies at major events or disasters. This benefits each member agency by enabling deployment within each member agency's jurisdiction of a Mounted Enforcement Unit larger than each member agency's staffing capabilities. 3. PURPOSE: To memorialize the cooperative plans of the member agencies of the OCRMEU for training and the procedures in the event of a deployment. 4. DURATION: The members shall review The Operating Plan annually. Any member agency may opt out of the OCRMEU at any time. However, in order to prevent disruption of plans, the parties contemplate that any member who opts out will give at least thirty days notice to the other member agencies. Other law enforcement agencies wishing to join the OCRMEU in the future may do so by signing the Operating Plan and adopting the plans and procedures set forth herein. 5. RESPONSIBILITIES: Each member agency will designate representatives to attend regularly scheduled meetings that will be hosted by each member agency on a rotating basis. The designated representatives will consist of sworn personnel assigned to the member agency's Mounted Enforcement Unit. Issues pertaining to the OCRMEU will be voted upon. Each agency will have one voting member as designated by the head of the respective agency's mounted unit. A quorum will be required. The host agency will be responsible for the agenda (to include a copy of the last meeting minutes) and for maintaining the minutes of their hosted meeting(to include e-mail distribution of those minutes after the meeting). Representatives may contact the host agency to have an item placed on the agenda for an upcoming meeting. Notwithstanding any provision of this Operating Plan,each member agency's department head will retain final authority for all decisions affecting its personnel, animals and equipment, and the member agencies will remain free to depart from the OCRMEU plans, policies and procedures as they see fit. Nonetheless, member agencies that substantially depart from OCRMEU plans, policies or procedures may be asked by the other members to leave the OCRMEU. Each member agency retains full responsibility for the training, conduct and supervision of its own personnel, for the condition, training and behavior of its own animals, and for the maintenance and condition of its equipment used in OCRMEU training or deployments. Page 1 of 3 All personnel who train or are deployed with the OCRMEU will use sick, vacation and leave time in accordance with the policies and procedures of their employing agencies. 6. TRAINING: The member agencies of the OCRMEU will make every effort to train at least quarterly throughout the year. Each member agency will rotate the hosting of that training and provide the curriculum. 7. DEPLOYMENT REQUESTS: When a member agency requests deployment of the OCRMEU within its jurisdiction, the member agency's Sergeant, or his/her designee, will contact the Sergeants, or their designees, from one or more of the other member agencies. This request will be in the format of a-mails and/or telephone calls to the Sergeants, or their designees, detailing the event and requested resources. It will be the responsibility of each agency's sergeant to then notify his/her chain of command of the request and gain appropriate approvals. No member agency will deploy personnel or resources to the requesting agency's jurisdiction until approval is obtained from a participating agency managerial representative or his/her designee of the agency from which the personnel and resources would be deployed. There will be no penalty should a member agency be unable to deploy requested resources. 8. COST OF INTER-CITY ASSISTANCE: The members anticipate that the cost of inter-agency assistance will be borne in accordance with the Orange County Chiefs' of Police and Sheriffs' Association's Operational and Procedural Protocol #102, Section 7, to the extent it is applicable. 9. INSURANCE: Nothing in this Operating Plan is intended to create relationships of employee and employer or principal and agent between the officers, employees or agents of one member agency and any other member agency, or between the member agencies. Each member agency represents that all of its officers, employees and agents participating in the OCRMEU are doing so within the course and scope of their duties as an employee, officer, or agent of the member agency and are in no way employees of any other member agency. If an officer, employee or agent of an OCRMEU member is injured while participating in an OCRMEU training exercise or deployment, it is the intention of the members that the injured officer, employee or agent will be protected by the employing member agency's Workers Compensation Insurance or self insurance coverage, to the same extent as if the injured officer, employee or agent had been injured while participating in a training exercise conducted by the employing member agency or a deployment into the jurisdiction of the employing member agency. 10. OPERATING PLAN NOT A CONTRACT: This Operating Plan is intended only as framework within which the member agencies intend to pursue a common objective. It has not been reviewed by the governing bodies of the member agencies, is not intended as a contract, and does not create any mutual obligations. There shall be no legal sanctions available for its enforcement or for any alleged breach. This Operating Plan does not create any right or benefit, substantive or procedural, which is enforceable against the member agencies or their officers, employees or agents. Nothing in this Operating Plan is intended to expand or diminish the constitutional and/or statutory duties,obligations,rights and powers of the member agencies.
