STATEMENT OF ISSUE:
The California Legislature passed SB 2 (Atkins) in 2017 (aka the Building Homes and Jobs Act),
which added $75 to the documentary transfer tax, typically paid when a property changes
hands. Revenue from the fee would be apportioned to counties, and then distributed for use by
counties and cities to combat homelessness, provide for navigation centers, street outreach,
and housing efforts. The City of Huntington Beach's annual share of SB 2 funds is estimated to
be between $400K and $500K.
Generally, cities can access these funds for specified programs (again, relating to housing and
homelessness) and when a city has a certified housing element. Given that HB has pending
projects and needs associated with our homelessness efforts, I would like to see how we can
ensure that our City is eligible for SB 2 funds that would otherwise be assigned to us for these
important programs.
RECOMMENDED ACTION:
Direct the City Manager, Community Development Director, along with the City Attorney to
report back to the City Council with a plan on how the City can ensure that the City is able to
use the SB 2 funds that would be allocated to HB for homelessness prevention activities,
including providing funding for a Navigation Center locally or regionally.

Dear Councilmembers:
I write today in support of agenda item 25 scheduled to be discussed at tonight's city council meeting. Directing city
staff and the city attorney to find expedited solutions opening up SB 2 funding to the city seems an eminently
reasonable course of action.
SB 2 funds could be used to operate the city (or regional) navigation center once a suitable venue has been locked
down. An operational navigation center will help the local homeless community with ties to the city, but it will also
remove the sword of Damocles currently wielded by Judge Carter,giving the police department the ability to enforce
our anti-camping laws.
One strategy the city may follow is simply to wait for the next RHNA cycle to be complete, and then decide how to deal
with the new allocation in a new housing element. One could also wait for the developing appeals to the Boise decision
to come to fruition. Such a plan has a two-year timescale, during which time pending litigation with the state and the
Kennedy Commission could well be decided against the city.
If the city elects to wait out the RHNA cycle, then for the next two years Huntington Beach homeowners will be paying
taxes to fund SB 2, and that money will be distributed to our neighboring cities who have both certified housing
elements and Boise-compliant shelters. Thus,the surrounding communities will be free to enforce their anti-camping
laws, but Huntington Beach will become known as a "camping sanctuary" city among the entire regional homeless
community. The impact to the tourism business could be quite detrimental. Certainly, there are loud, angry, insistent
complaints almost daily at the HB Community Forum demanding that these laws be enforced. Those complaints will
only become louder, and have the capability to change the character of our wonderful beach city into something quite
different.
In closing, I urge you to carefully consider Item 25 tonight.

Dear Honorable Mayor Peterson and City Council,
As we discussed and wrote to you this past July, we strongly urge the council to approve a "housing
element" in the General Plan that will bring the city into compliance with the California Regional
Housing Needs Assessment (RHNA) requirements by identifying affordable housing units in new
development. This is a critical area of need to address the housing emergency crisis.
Once our housing element is recertified, the city will be eligible to receive $540,000 annually to
operate the Navigation Centers it is required to provide. HB will do what it stated in our last General
Plan approved in 2013 to satisfy our assigned RHNA numbers. We have constructed 2100 affordable
housing units and will create 400 more units so that we reach the required number of 2500.
Recertifying the housing element would greatly reduce city legal fees defending ourselves for years
against the Kennedy Commission and State of California lawsuits as well as a potential lawsuit if we
do not follow Judge Carter's mandate to build additional shelters. Our understanding is that It would
take, about 6 months to get recertified rather than years of litigious and costly battles with the state
and a federal judge.
Providing more affordable housing helps us all. Here are some negative impacts of not having a
certified housing element:
a. Businesses, especially the tourist industry, are losing business with unsightly homeless
encampments.
b. Police are unable to enforce anti-camping laws.
c. Businesses are unable to attract employees and if they do many employees face very long
daily commutes which is non-productive.
d. Our younger family members are not able to afford living on their own in Huntington Beach.
e. Our city's wallet continues to be negatively affected by the chronic homeless use of city
services (police, public works, health care, loss of revenue) Permanent Support Housing
(PSH) is cheaper than doing nothing for the chronic homeless.
Building 400 more affordable units does not require high density housing. It will mean re-zoning and
spreading the units out throughout the city. Joint projects with other cities are more likely to occur
once we satisfy our housing element.
In conclusion, a business-friendly town means a housing friendly town where police can enforce the
law. Wouldn't you like your own employees, employer, or family members to live close by? If you
had a homeless relative or friend, wouldn't you prefer they be housed in a shelter rather than living on
the streets? Wouldn't you prefer to follow the laStJPPILIEMENTAL
