Statement of Issue:
Residents along the Heil Avenue frontage road between Goldenwest Street and Gothard Street have
petitioned the City to establish a residential permit parking district, Permit Parking District "Z" in
Huntington Beach.
Financial Impact:
The provisions of Huntington Beach Municipal Code Chapter 10.42 requires that the residents
choosing to participate in a residential permit parking district pay a proportionate share of the cost to
establish or amend the district making the district cost neutral to the City. Typical costs include, but
are not limited to, installation of signs, curb markings, which are initially funded in the General Fund
Signs and Marking business unit 10085302, and staff time to issue permits, which are funded in the
General Fund Transportation Management business unit 10085301. The total cost for this parking
district is estimated at $1,121 or $59 per address.
Recommended Action:
Adopt Resolution No. 2019-71, "A Resolution of the City Council of the City of Huntington Beach
Establishing Permit Parking District "Z" Within the City of Huntington Beach."
Alternative Action(s):
Deny the recommended action.
Analysis:
Residents along the Heil Avenue frontage road between Goldenwest Street and Gothard Street
submitted a petition requesting a permit parking district be created due to commuter vehicle parking
impacts and related issues. The frontage road is located on the north side of Heil Avenue between
Goldenwest Street and Gothard Street and is shown in Attachment 1. Including the commuter
vehicle parking impacts, residents expressed their concerns with associated issues of late night

noise, littering, parking too close to driveways, and finding curbside areas to place trash bins on the
street on collection day. The requested permit parking restrictions are 6 p.m. to 6 a.m. every day,
including holidays
Following procedures in Municipal Code Chapter 10.42, Permit Parking Districts, staff validated the
petition, determined the concerns of the residents merit further consideration, and considered the
proposed area to be reasonable. Staff prepared and mailed letters to the affected properties
explaining the permit parking district requirements, boundaries, and included ballots for voting on the
permit parking district proposal. Per code a minimum of 75% of the property units shall vote in favor
of the parking district to move the request for further consideration. The voting results showed 79%
of the properties along the Heil Avenue frontage road in support of permit parking.
As required by code, staff investigated the conditions along the Heil Avenue frontage road to examine
the parking conditions and related concerns. Field observations and discussions with the residents
demonstrated that the street experiences recurring parking impacts from commuter vehicles, with the
most significant impacts on the weekend. Although the noise and trash bin moving issues were not
observed by staff, these concerns were mentioned by several of the residents as frequent commuter
vehicle parking issues.
Due to these conditions, staff believes findings can be made demonstrating that commuter vehicle
parking unreasonably and regularly interferes with the use of available street parking for residents
and their guests, and causes other related disturbances. These findings are consistent with
requirements of the Municipal Code as a basis for establishing permit parking. The number of
addresses that would comprise the permit parking district is 19 with permit parking established along
both sides of the frontage road as shown in Attachment 2. Notices were sent to the affected
properties and properties within 500 feet of the proposed district boundaries indicating the date and
time of the City Council meeting

The project is categorically exempt from CEQA.

Permit Parking District Request - Heil Avenue Frontage Road
between Goldenwest Street and Gothard Street
Residents on Heil Avenue frontage road have petitioned the City to establish permit parking due to
parking impacts and associated issues from commuter vehicle parking. The request is located on the
north side of Heil Avenue along the Heil Avenue frontage road between Goldenwest Street and

Figure 1 shows the petitioned permit parking area along the Heil Avenue frontage road. The requested
parking restrictions are 6 p.m. to O a.m. every day including holidays. Including the commuter vehicle
parking impacts, residents expressed their concerns with associated issues of late night noise, littering,
parking too close to driveways, and finding areas for placing trash bins on the street on the collection
day as the reasons for initiating the process to establish permit parking on their street.
As required by Municipal Code Chapter 10.42, staff reviewed the request, determined the petition and
concerns of the residents were valid, and considered the proposed area to be reasonable.
Staff prepared and mailed letters to the affected properties explaining the permit parking district
requirements, boundaries, and included ballots for voting on the permit parking district.

Per Municipal Code 10.42 a minimum of 75% of the property units (1 vote per unit) shall be in favor of
establishing permit parking to move the request for further consideration. Of the 19 affected
properties, 18 ballots were returned with 15 votes in favor of permit parking (83%) and three votes not
supporting permit parking. The 75% minimum support requirement was satisfied to continue the
evaluation. Table 1 summarizes the voting results of the Heil Avenue frontage road permit parking
district request.

As required by code staff investigated the parking conditions and related issues on the proposed
permit parking street. The code requires that facts exist that reasonably establish that unrestricted
parking creates a situation in which the subject streets cannot be used for regular parking by residents
or their guests, or creates a situation that commuter vehicles or their occupants produce significant
sources of health, safety, or welfare concerns to continue the process for further consideration. Below
summarizes the field surveys of the parking conditions in the requested permit parking area.

Analysis:
During the weekdays, parking impacts were observed between the evening to early morning hours.
The most impacted field observation occurred on the weekend where a majority of the available on-
street parking was occupied by commuter vehicles. These parking impacts could affect the availability
of on-street parking for the residents and their guests. In addition to the parking impacts, the
residents expressed concerns with trash left on the street and front yards, and late night noise
attributed to the commuter vehicle parking. Although staff observations of the area did not witness
occurrences of trash on the street or noise, these concerns were expressed by many of the residents as
recurring commuter vehicle parking issues.
Municipal Code 10.42 requires that specific conditions shall exist for a parking district request to move
forward for consideration to the City Manager's office. These include: unrestricted parking creates a
situation where on-street parking cannot be regularly used by residents and guests; or, unrestricted
parking by commuter vehicles produces significant sources of health, safety, or welfare concerns.
Based on the field evaluations and discussions with the residents, staff finds that the unrestricted
parking creates a situation where the commuter vehicle parking regularly interferes with residents and
their guests parking, and produces significant sources of welfare concerns. Staff recommends
establishing permit parking along Heil Avenue frontage road between Goldenwest Street and Gothard
Street as shown in Figure 1 affecting 19 addresses.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ESTABLISHING PERMIT PARK
DISTRICT"Z" WITHIN THE CITY OF HUNTINGTON BEACH
WHEREAS, the City Council has adopted Ordinance No. 4051 allowi the establishment of
parking districts in residential areas under certain conditions; and
The citizens of the residential street frontage road along the north s' e of Heil Avenue between
Goldenwest Street and Gothard Street have petitioned for establishment a permit parking district:
The Director of Public Works reviewed the petition, sent a llot for further consideration to
residents of the petitioned roadway, and cause an investigation w$ic reasonably established that:
1. A minimum of 75% of the Property Units along the ontage road on the north side of Heil
Avenue between Goldenwest Street and Gothard S eet are in favor of establishing a Permit
Parking District; and
2. Unrestricted parking creates a situation in whic the subject street cannot be used for parking
by Residents or their guests because Commu r Vehicle parking unreasonably and regularly
interferes with the use of the available stree parking; and
3. Unrestricted parking creates a situation ere Commuter Vehicles or their occupants produce
significant sources of health, safety or elfare concerns.
Therefore, the Director of Public Wor s has found the requirements of Ordinance 4051 to be
reasonably fulfilled, and determined that the ermit Parking District will not affect other uses of on-
street parking.
NOW, THEREFORE, the City uncil of the City of Huntington Beach does hereby resolve as
follows:
Permit Parking District "Z" is hereby established to include the above mentioned roadway,
everyday including holidays betw n 6:00 p.m. to 6:00 a.m.

The Public Works Department requests that Item 19 (19-970) be removed from the
October 7, 2019 agenda. The review of comments received as a result of notification of
the agenda item has revealed that a property owner in the proposed district has asked to
have their vote changed from being in support to being opposed to the permit parking
district. The change in voting has resulted in the proposed district not meeting the 75%
property owner support level required by the Municipal Code. Staff will reevaluate the
proposed district with residents and identify the appropriate next steps.

My name is Mark Fowler. My wife, son, and I live at 16382 Serenade Lane. I received your letter concerning
the proposed establishment of a residential permit parking district on the Heil Avenue frontage road between
Goldenwest Street and Gothard Street.
I assume the residents of that area requested the district because of parking scarcity issues involving vehicles
belonging to the residents of the apartments on the south side of Heil.
I'm concerned that if the district does not include our entire tract,then those extra cars that used to park on the
frontage road will, instead, be parking further inside our tract. That will decrease availability of parking spaces
for our own vehicles and it will increase the number of non-tract-residents walking and driving into and out of
the tract. It will increase the amount of automobile noise,too. Furthermore it will encourage car burglary in the
tract due to the increase in the number of cars in the tract. Car burglary incidents have increased in this part of
Huntington Beach in recent years. An increase in car burglary could lead to an increase in other types of
property crimes and even worse.

I'm writing to you on behalf of the residents across the street of the Heil fiotage. I am unable to attend the
meeting and key points are being misrepresented.
I respectfully park here regularly and see this street daily.
First, I question the residents credibility. The residents are lying about trash and noise. There is no trash brought
into the street by me or the very few others who park there and absolutely no noise(I've seen this street
peacefully used for years now with no problems).
Your report even notes "staff observation did not witness these occurrences."
Honestly, these lies concern me as the residents will do anything to take over this area. For what? to put even
more pressure on the already impacted less affluent townhomes?
(I have helped out their own children who have been drunk and passed out in the middle of the street.)
Second,there is always parking available there. Even in your own report the lot was NEVER full. These homes
are two car garage homes with two car driveways.
Please consider us, the neighbors of this frontage. Measure our "Percent Occupancy" it would be 100%,how is
removing legal and available parking the recommended decision?

away from us adds unnecessary abundance to these homes. It's just a pure greed move from an already

I realized what bothered me most about this permit request. It's sad... it's sad that our own neighbors don't want
us to exist in their world. Out of sight, out of mind.
15 homes voted 'yes'to make 63 parking spots require permits...
Let me repeat that, FIFTEEN two car garage,two car driveway homes voted yes to remove 63 parking spots
from the neighborhood.
It's.funny how people want freedom and less intervention until they want something for themselves. The city
proved it's clean, quiet and safe.., so what, they want it to be totally empty?
How far do these homes property lines even go?
I won't live in that area for long, but seeing how open that street is and reading the request is pathetic.
It might read like I'm angry,but I just see the misrepresentation of facts. At least now you know another side of
this story.

Dear Mr. Stachelski.
I am one of those home owners that live on the Subject Sreet.
I am on the Frontage Road, heading East from Sabot.
Below are my comments in support of Permit Parking:
When stopping at the Stop sign (heading West)on the frontage road meeting Sabot and waiting to turn left(or right)onto
Sabot, I have to watch if any cars are heading West down Heil and going to turn right on Sabot. With the 3 ft. high cinder
block wall, you can't see their signal light if they are turning right. What I do is look for the top of any car coming South and
wait. Now, with all the parked cars along the frontage road (all the way up to the STOP sign), I cannot even see the tops
of cars. So what do I do now? I have to drive out very slowly to see if a car is coming and going to turn right towards
me. Keep in mind that I also have to watch for cars coming from two other directions. So it is a dangerous situation for
everyone on the North end of the frontage road. Not to mention the"take out"trash left on the curb, radios playing loud on
Fri. & Sat. night when coming home from the bars at 1:00am plus losing street parking for relatives and friends visiting. (I
park both my cars in the garage.)The people parking here on the frontage road,jaywalk across Heil which is illegal. There

I live on Sunlight Drive in the subdivision behind the noted permit location and I am in favor of enacting
parking permits as described in the proposal. I do however have a concern that the proposal does not seem to
address and that is what happens to the commuter cars that are going to be displaced by the permits?
When I leave for work in the morning, I have seen an increase in cars parked on Sabot Lane and have noticed
this increase over the last year. This is likely related to the increase of commuter cars parked on the Heil
frontage road resulting in the request to enact permits. So when commuter cars are displaced by the permits
and Sabot Lane and Sunlight Drive are not included in the permit zone, won't those cars simply move to Sabot
and Sunlight resulting in the same issue residents on Heil face?
By placing permits only on Heil and not registering the entire neighborhood as a permit zone I feel like the City
is simply pushing the problem to the other residents of the neighborhood. One of the reasons my wife and I
moved here in 2002 was because Sunlight Drive did NOT have a lot of residents parking on the street and it
looked clean and neat because of that(a good number of houses have 3-car garages which really helps.) If
commuter cars are simply going to move from Heil to Sabot and Sunlight,that will definitely impact our quality
of life on Sunlight Drive.
Please consider adding the entire neighborhood to the permit zone so that the problem is not simply pushed
inside to the other residents or at least also include Sabot and Sunlight in the proposal.

I am writing in protest of the proposed residential permit parking on the frontage road between Goldenwest
Street and Gothard Street. I am a homeowner on Heil Street and have lived there for over 12
years. Unfortunately, I work full time and due to traffic commute, am unable to attend the 6:00 PM City
Council meeting.
I find the proposed residential permit to be restrictive and punitive to homeowners/occupants who have visiting
family/friends and need/arrange home services (i.e.,repairs, lawn service, medical care/deliveries). The hours
of 6:00 PM to 6:00 AM including the holidays is very limited and does not accommodate working people's
schedule especially during the summer hours where the day light hours are longer. By implementing this
restrictive residential permit, it negatively affects the ability of working homeowners to implement home
repairs/services, have a social life, and in some cases,medical care (i.e.,home health or in-home support
services, a sitter). Out of town family/friends cannot drop in and stay late both during regular
weekdays/weekends but also during the holidays,a time in which people need their family/friends
nearby. Depression and suicide is higher during the holiday season(feelings of isolation,feeling sad)which is
more of a reason for family and friends to be able to visit and stay after 6:00 PM or overnight. The residential
permit does not allow for last minute babysitters or in-home support services for medical and elderly care. The
residential permit requirement does not accommodate last minute requests and emergency situations/care (i.e.,
plumbing repair, cable). Obtaining a permit during emergencies is not always a priority and on people's mind
and to penalize them with a ticket during a stressful time is unfair and can be avoided. Even the act of obtaining
the car registrations/permits as a homeowner on Heil would be an additional inconvenience as it would require
me to take time from work and pay an additional expense.
I understand the concerns of my neighbors having people from the apartment complex park in the residential
area but implementing the restrictive permit is not the answer. It is so much more punitive and a hindrance than
a solution. Let us be kind and understanding of working home owners who have family and friends who can
visit only after 6:00 PM, who make unscheduled/unannounced visits after their work day or drive from far away
and come late at night/stay overnight,who can only visit during the holidays and want to stay overnight because
it's the holidays and want to spend time with loved ones. This residential permit is not a gift but rather a
punishment.

Why is it that I have to have a permit just to park in front of my own house?This neighborhood is not run by
HOA. It is uncalled for that you want to limit my rights as a citizen.
Taxes in California are high already. I pay everything I need to pay so having to pay any extra to park in front of
my own house is unreasonable.
I have big family. They come to visit me all the time. I feel that it is very unreasonable that the parking permit
be required just to visit us for dinner?
We don't have any problem with parking in front of our house.
I also find it very odd the person requesting the parking permit does not even live in the area.
Today is Oct 4 2019. 1 just received your letter sent out on Oct 12019, and you ask us to be there on Monday?
Mail is normally 5 to 10 business day.
I'm so tired with this unnecessary parking permit. Later on, our house value will also drop due to this permit.
Will city of Huntington Beach compensate for that value?

I am writing in response to your letter, dated 10/1/19, addresses to the residents that would be impacted by
the proposed residential parking permit district.
My husband and I have lived in the impacted neighborhood since 1997. We have seen
the problems of overflow parking from the apartments located on the south side of Heil Ave between
Goldenwest and Gothard on our neighbors and neighborhood.
The residents on Heil feel the brunt of the overflow parkers on a regular basis. However, once the Heil Street
parking is full the parkers come into the track to park; first along Sabot,then to the north side of Sunlight
between Magellan and Wishingwell as well as down Serenade.
In establishing this parking district I ask that you and the City Council consider expanding the parking district
to include all impacted streets within our tract and not just Heil Ave.
