HomeMy WebLinkAboutAdopt Resolution No. 2020-05 Ordering the Summary Vacation o f3PPROV6 -p , ' City of Huntington Beach File #: 20-1335 MEETING DATE: 2/3/2020 REQUEST FOR CITY COUNCIL ACTION SUBMITTED TO: Honorable Mayor and City Council Members SUBMITTED BY: Oliver Chi, City Manager PREPARED BY: Tom Herbel, Acting Director of Public Works Subject: Adopt Resolution No. 2020-05 ordering the Summary Vacation of a Public Water Line Easement at 14900 Bolsa Chica Street Statement of Issue: The Public Works Department requests that City Council adopt a resolution to summarily vacate a public water line easement within private property located at 14900 Bolsa Chica Street, pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Highways Code. Financial Impact: Not Applicable. Recommended Action: A) Adopt Resolution No. 2020-05, "A Resolution of the City Council of the City of Huntington Beach Ordering the Summary Vacation of a Public Water Line Easement on Property Located at 14900 Bolsa Chica Street;" and, B) Instruct the City Clerk to record Resolution No. 2020-05 (and attachments) with the Orange County Recorder. Alternative Action(s): Deny the recommended action. Analysis: Sares Regis Group recently purchased several parcels located at 14900 Bolsa Chica Street within the Boeing Space Systems campus. The previous owners, Boeing Realty and McDonnell Douglas Corporation, had dedicated public water line easements to the City of Huntington Beach with Parcel Maps No. 87-424 and No. 97-198. The City had been using the easements to maintain/repair public water lines, fire hydrants and water meter assemblies located within the premises. The abandoned water system was located within private property and only served customers at 14900 Bolsa Chica. There are no other public facilities located within this existing water easement. The developer will be relocating all fire hydrants and water services and reconnecting them to the existing water mains in Bolsa Chica Street and Bolsa Avenue located within the City's right of way. Consequently, the existing public on-site water system is no longer needed. Upon vacation of the water line easement, the rights to the underlying land would revert back to the fee owner of the property. The vacation of the water line (public service) easement does not require Planning Commission Approval for General Plan Conformance under Government Code Section No. 65402. Additionally, unlike the General Street Vacation process, the Summary Vacation of a public service easement does not have public noticing requirements, nor does it require a separate public hearing prior to City Council taking action. After adoption, the Resolution shall be recorded with the Orange County Recorder to affect the easement vacation. Environmental Status: The General Plan Conformance review was categorically exempt pursuant to City Council Resolution No. 4501, Class V, which supplements the California Environmental Quality Act because the request is a minor utility easement vacation. Pursuant to Division 9, Chapter 4 of the California Streets and Highways Code, commencing with Section 8333, the City Council of the City of Huntington Beach hereby orders the summary vacation of a public service easement for water line purposes located at 14900 Bolsa Chica Street and more particularly described on Exhibits A-1, A-2, B-1 and B-2 attached and incorporated herein by this reference. 2. The City Council does hereby confirm that the easement herein vacated has been superseded by relocation and there are no other public facilities located within the easement. 3. The City Council hereby declares that from and after the date of the recordation of this resolution that the easement herein identified shall no longer constitute a public service easement.
