Emergency Ordinance 4210 Establishing Temporary Ban on Certain Tenant Evictions for Non-
Payment of Rent as a Result of COVID-19 Related Financial Impacts
Statement of Issue:
On March 19, 2020, Governor Gavin Newsom issued Executive Order N-33-20 requiring all
Californians to stay at home and avoid public gatherings to slow the spread of novel coronavirus
(COVID-19). This Order has necessitated the closure of all non-essential businesses, which has
resulted in substantial losses of income for many residents. These economic impacts have hindered
some people's abilities to pay rents, potentially exposing them to evictions during the Stay At Home
Order. In response, the City is considering a temporary ban on certain evictions of residential and
commercial tenants during the pandemic.
Financial Impact:
Not applicable.
Recommended Action:
Adopt Ordinance No. 4210, "An Emergency Ordinance of the City of Huntington Beach, Adding
Chapter 3.58 to the Huntington Beach Municipal Code Establishing a Temporary Ban on Certain
Tenant Evictions for Non-Payment of Rent as a Result of COVID-19 Related Financial Strain."
Alternative Action(s):
Do not adopt Ordinance No. 4210.
Analysis:
On March 16, 2020, Governor Newsom issued Executive Order N 28-20, finding in part, that despite
sustained efforts, COVID-19 remains a threat to the State's public health and economy. In particular,
the Executive Order authorized local governments to halt evictions for renters and homeowners to
ensure housing security as the State, counties and cities have enforced Stay At Home policies and
instituted extreme social distancing measures designed to prevent any gathering of any number of

individuals, including in non-essential California businesses.
These extreme social distancing requirements have resulted in private-sector business closures. This
is reflected by the fact that a total of around 3.3 million Americans applied for unemployment benefits
last week, which was the highest one-week increase ever recorded. Locally, numerous Californians
are now out of work, on unpaid leave, have experienced a substantial reduction in work hours, have
been laid off, or are otherwise suddenly without requisite financial means to maintain their
households and pay rents and mortgages because of COVID-19 and related governmental actions.
Executive Order N 28-20 states that local jurisdictions are no longer preempted by State Law from
imposing certain temporary regulatory laws that restrict the ability of Landlords to effectuate certain
tenant evictions. The City's proposed Ordinance No. 4210 also proposes similar measures.
However, there are differences between the Governor's Executive Order and the City's proposed
Ordinance:
■ Timeline: The Governor's Executive Order is currently in effect through the May 31, while the
City's Emergency Ordinance proposes to be in effect for 120 days.
■ Application: The Governor's Executive Order applies to residential tenants, while the City's
Emergency Ordinance applies to both commercial and residential tenants.
■ Penalties: The Governor's Executive Order is silent on penalties, while the City's Emergency
Ordinance provides that those violating the regulation are subject to the City's administrative
citation penalties.
Given the overall situation, the proposed Emergency Ordinance has been developed for City Council
consideration, pursuant to Huntington Beach Charter Section 501, as an emergency measure for the
immediate preservation of the public peace, health, and safety, by eliminating any uncertainty
regarding evictions during the COVID-19 virus pandemic. If approved, the Emergency Ordinance will
remain in effect for no longer than 120 days from the date of adoption.

CHAPTER 3.58 TO THE HUNTINGTON BEACH MUNICIPAL CODE ESTABLISHINGA
TEMPORARY BAN ON CERTAIN TENANT EVICTIONS FOR NON-PAYMENT OFRENT
AS A RESULT OF COVID-19 RELATED FINANCIAL STRAIN
The City Council of the City of Huntington Beach does hereby ordain as follows:
SECTION 1. Findings.
Whereas, on March 4, 2020, Governor Newsom declared a State-'of Emergency due to the
widespread, vast, and substantial health and safety threat posed by the`Coronavirus pandemic
(COVID-19)to the broad population of Californians; A`

Whereas, on March 16, 2020, Governor Newsom issued Executive Order N 28-20,
finding in part, that despite sustained efforts, COVID-19 remains a threat and further efforts to
control the spread of the virus to reduce and minimize the risk of infection and otherwise
mitigate the effects of COVID719 are needed;

Whereas the State and Counties and Cities/have instituted extreme social distancing
measures designed to prevent any gathering of any number of individuals in both public and
private places, including in California businesses, mandating the sudden closure of colleges, high
schools, grade schools, public institutions,/And non-essential private-sector businesses throughout
the State of California related to COVID7 1 9;
Whereas these extreme social/distancing requirements and private-sector business
closures have left thousands of Californians out of work, on unpaid leave, substantial reduction
in work or hours worked, laid off;or otherwise suddenly without requisite financial means to
maintain their households and,.pay rents and mortgages related to COVID-19 and related State
and County actions;
Whereas, to date/the substantial adverse economic impacts of COVID-19 on the
population and busine ses of California have been significant, and could threaten to undermine

Whereas to Governor Newsom's Executive Order N 28-20, local jurisdictions
are no longer preempted by State Law from imposing certain temporary regulatory laws that
restrict the ability of Landlords to effectuate certain tenant evictions;
I ereas, this Ordinance is adopted pursuant to Huntington Beach Charter Section 103,
which 'uthorizes the City Council "to make and enforce all laws and regulations in respect to
Mun' ipal Affairs, subject only to such restrictions and limitations as may be provided in this
Ch er or in the Constitution of the State of California" as well as Executive Order N 28-20;

Whereas, the City Council adopts this Emergency Ordinance pursuant to Charter Section
501 as an emergency measure for the immediate preservation of the public peace, health, and
safety, by eliminating any uncertainty regarding evictions during the COVID-19 virus pandemic.'
This Emergency Ordinance shall remain in effect for no longer than 120 days from the date of
adoption;
Whereas, this Emergency Ordinance adds Chapter 3.58 to the Huntington Beach
Municipal Code ("HBMC") establishing a"Temporary ban on certain tenant evictions for non-
payment of rent resulting from COVID-19 related financial concerns."
THEREFORE, the City Council of the City of Huntington Beach does hereby ordain and
approve as follows:
SECTION 2. Chapter 3.58 is hereby added to the Huntington Beach Municipal Code to
read as follows:
"3.58.010 Purpose"
The purpose of this Chapter is to prevent the eviction for a period of 120 days or until the
City Council repeals this Emergency Ordinance, of.<certain residential and commercial tenants,
who sufficiently demonstrate they cannot pay red as a direct result of COVID-19-related
substantial losses of income as a result of business closures, dramatic downturn of the economy,
the substantial loss of working hours or wages, or layoffs specifically related to COVID-19 and
related State and County actions.

Nothing in this Chapter shall ban, prevent, or prohibit a Landlord, real property owner, or
person(s) with control over real property, from taking action against a tenant, including possible
eviction, for other non-COVID-19=related reasons, such as damage being done to property, threat
to safety and security of property, etc.
"3.58.020 Definitions"

Unless otherwise/defined in this Chapter, all terms contained herein shall have the same
meaning as defined ink.-the Huntington Beach Municipal Code, or State law.
"Stay of EVIiction" means the temporary moratorium on residential or commercial
tenant(s)this Chapter has to offer, related to COVID-19 and related State and County actions.
"3.58.030 COVID-19 Tenant Protections"

In`accordance with the Governor's Executive Order N 28-20, no Landlord, real property
owner,ror person(s) with control over real property, shall evict a residential or commercial tenant
when}the City Manager, in consultation with the City Attorney, establishes through documented
evidence provided by the tenant and Landlord to the City that:

(i) The basis for the proposed eviction is for nonpayment of rent arising directly from a
substantial decrease in household or business income (including, but not limited to, a
substantial decrease in household income caused by layoffs or a substantial reduction in
the number of compensable hours of work, or a substantial decrease in business income
caused by a reduction in opening hours or consumer demand), or substantial out-of-
pocket medical expenses, demonstrably directly related to COVID-19 and related State
and County actions; and
(ii) The decrease in household or business income or the out-of-pocket`'medical expenses
described in subparagraph (i) above was directly caused by the COVID-19 pandemic, or
by any local, State, or Federal government response to COVID-19.
The City Manager shall make a determination as to the efficacy of a Stay of Eviction
within 5 days after receipt of documented evidence provided by the tenant and Landlord.
In the event a tenant disputes the determination, he or she shall provide, in writing, a
request that the matter be appealed to a hearing officer. Said appeal hearing will be
conducted by a City-appointed hearing officers, and will take place within 20 days, if
practicable.
In accordance with the Governor's Executive Order N 28-20, the statutory cause of action
for judicial foreclosure (Code of Civil Procedure. section 725(a), et seq.); unlawful
detainer (Code of Civil Procedure section 1161, et seq.,) and any other statutory cause of
action that could be used to evict or otherwise eject a residential or commercial tenant or
occupant of residential real property after foreclosure is suspended to the extent of the
limitation imposed by the City as.to residential tenants.
While certain evictions are stopped by operation of this Emergency Ordinance, nothing in
this Chapter shall relieve any tenant of the obligation to pay rent, rent owed, or rent held
in arrears, nor shall it restrict a Landlord's ability to recover owed rent, or rent in arrears,
at a later date after the.,date this Emergency Ordinance is no longer in effect. The
protections in this Chapter shall be in effect for 120 days, unless this Emergency
Ordinance is extended.

The City may,engage with financial institutions to identify tools to be used to afford
citizens of Huntington Beach relief from the threat of residential foreclosure and
displacement, and to otherwise promote housing security and stability during this
declaration of a State of Emergency, in furtherance of the objectives of this Chapter.
Nothing in this Chapter shall ban,prevent, or prohibit a Landlord, real property owner, or
pers.on(s) with control over real property, from taking action against a tenant, including
possible eviction, for other non-COVID-1 9-related reasons, such as damage being done

seek the relief this Chapter has to offer, where the tenant actually has the ability to pay

related Governor's Executive Orders, including fraudulently claiming either that the
tenant(s) cannot pay rents when they actually can, or that a Landlord is evicting in
violation of this Chapter when the Landlord is not.
"3.58.040 Penalties"
A. Violations of this Chapter shall be subject to Administrative Citation pursuant to
Chapter 1.18, except that notwithstanding Section 1.18.070; and-
B. Any violation of this Chapter shall be assessed administrative fines in the
following amounts: a
1. An administrative fine not exceeding one thousand dollars ($1,000) for a
first violation.
2. An administrative fine not exceeding two thousand dollars ($2,000) for a
second violation within one (1) year of the first violation.
3. An administrative fine not exceeding five thousand dollars ($5,000) for
each additional violation within one (1) year of the first violation.
None of the aforementioned administrative penalties, if/when assessed and imposed by
the City, shall preclude any interested party;from also seeking civil or criminal relief pursuant to
other applicable laws and/or Statutes.
SECTION 3. The recitals provided in this Ordinance are true and correct and are
incorporated into the substantive portion of this Ordinance.
SECTION 4. Nothing in this Ordinance is intended to conflict with or otherwise
supersede any provision of the Huntington Beach Charter, in particular Charter Section 803.
SECTION 5. The City Council finds the introduction and adoption of this ordinance is
not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections
15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical
change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
SECTION 6. If any section, subsection, sentence, clause, phrase, part, or portion of this
Ordinance is for any reason held to be invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions of this
ordinance. The City Council declares that it would have adopted this ordinance and each section,
subsection, sentence, clause, phrase, part, or portion thereof, irrespective of the fact that any one
or more section, subsections, sentences, clauses, phrases, parts, or portions be declared invalid or
unconstitutional.

SECTION 7. The City Council adopts this Ordinance pursuant to Charter Section'501 as
an emergency measure and shall become effective immediately upon its adoption for the
immediate preservation of the public peace,health, and safety. This Ordinance shall remain in
effect for no longer than 120 days.

Dear Huntington Beach City Council Members,
I wanted to thank you for adding item number four(4)to the agenda"Emergency Ordinance
4210 Establishing Temporary Ban on Certain Tenant Evictions for Non-Payment of Rent as a
Result of COVID-19 Related Financial Impacts". I had time to read through the proposed
ordinance yesterday and to date this is a very comprehensive ordinance in Orange County that
goes above and beyond to ensure residents and small business owners have time to get back
on their feet during this major health crisis that affects many residents and nation wide. Jobs
positions are being affected and many like myself have temporary lost my job and can
eventually loose as I'm a instructional assistant at one of the local school district. Current data
shows that this will take time to surpass meanwhile residents like myself are suffering
economically to meet ends for rent payment coming up. So I encourage the council to consider
including language to the ordinance that if additional measures are needed, the council will
consider extending. With weeks of having a local stagnant economy, this will provide much relief
to thousands in our city including those families who are more vulnerable and of low-income . I
hope that you to please vote yes on this agenda item as it's a necessary step to relieve this
economic hardship.

Please adopt Agenda Item#4 at the next City Council meeting.
The potential impact of allowing evictions to proceed during this global pandemic is
immeasurable. Not only would it be incredibly inhumane to throw people out on the streets due
to a statewide shutdown (circumstances that were unforeseen only a few months ago), but the
likelihood that COVID-19 would spread further is certain.
All experts agree that the best weapon we have against COVID-19 at this time, is to stay at
home. If we allow people to be evicted from their homes, we put even more people at risk of
contracting this dangerous and expensive disease.
Please do the right thing for all of us and vote YES on Agenda Item#4.

Hello to all, and thank you in advance for hearing my comment. My name is Tanya, I believe it is
imperative that Huntington Beach City Council adopt agenda item #4 - "Emergency Ordinance
4210 Establishing Temporary Ban on Certain Tenant Evictions for Non-Payment of Rent as a
Result of COVID-19 Related Financial Impacts". Many working people have been negatively
impacted by no fault of their own by the current pandemic, and need your support and
leadership. This should be passed as an Ordinance that is enforceable, and should protect all

I believe it is important to be leaders in our county by understanding that our residents and small

Dear Mayor Symeta and City Council,
Thank you for meeting to represent us during this stressful time. Also thank you to you the staff, first responders,
volunteers of our city as we all try to do our part to contain the spread of the COVID-19 virus in our community.
I support your action to adopt Agenda Item #4, Emergency Ordinance 4210 Establishing Temporary Ban on Certain
Tenant Evictions for Non-Payment of Rent as a Result of COVID-19 Related Financial Impacts. This is forward
thinking. Landlords will eventually be made whole once we've gone through this storm because it does not forgive
either commercial or residential tenant obligations.
I ask that you include emergency actions to shelter our homeless population by providing safe parking and shelter in
sites available to the city like recreation centers and vacant hotels/motels. These are critical steps to take to contain this
horrible virus. People entering a shelter are tested and then quarantined as indicated by their symptoms. Sadly, we
know that many homeless resist shelters. This is a reason to maintain full staffing of the task force so that they may stay
in contact with their cases and be ready refer them when shelters become available.
This is not the time to plan, delay or wait. It is the time to act.The better that we have everyone sheltered in place the
more effective containment of this virus will occur.

I wanted to thank you for adding item number four(4) to the agenda "Emergency Ordinance
4210 Establishing Temporary Ban on Certain Tenant Evictions for Non-Payment of Rent as a
Result of COVID-19 Related Financial Impacts". I had time to read through the proposed
ordinance last night and to date this is the most comprehensive ordinance in Orange County that
goes above and beyond to ensure residents and small business owners have time to get back
on their feet. Current data states that the end of April will be the peak of this invisible enemy and
I encourage the council to consider including language to the ordinance that if additional
measures are needed, the council will consider extending. With weeks of having a local stagnant
economy, this will provide much relief to thousands in our city. I implore you to please vote yes

Dear Council Members,
I am a resident of Huntington Beach,I have concerned regarding eviction and rent payment
after May 31,2020.All the governor's order does is to extend the time to answer a UD from 5
days to 60 days,Landlords can still serve 3-Day Pay or Quit Notices at any time.If the courts
are available,they can file and serve a UD anytime.If that service occurs before May 31st,and
if the person qualifies as one who has lost income due to the state of emergency,they will have
60 days to answer instead of 5 days.If the order is not extended,and they are served June 1st
or later it will revert to only 5 days to answer.
As you see,this is not very protective,but it merely delays when an eviction will happen.
Currently the only meaningful protection is that based on action taken by local government.So
far in OC that is just Santa Ana,Anaheim and Costa Mesa.In general terms,those ordinances
prohibit the landlord from beginning eviction for nonpayment for those that meet the
qualifying criteria and they give people time(4-6 months)to come current on rent after the
emergency ends.
I would like to request that the city council members or city manager come up with a plan to
protect affected tenants because we do not have any right now for the residents in Huntington
Beach.

Dear Members of the Council,
The Kennedy Commission is a broad based coalition of residents and community organizations
that advocates for the production of homes affordable for families earning less than $20,000
annually in Orange County. Formed in 2001, the Commission has been successful in partnering
and working with jurisdictions in Orange County to create effective policies that has led to the
new construction of homes affordable to lower income working families.
Given our state's high costs of housing and the extensive rent burden for many California
families, we worry that any loss of wages related to the outbreak of COVID 19 will only further
imperil with homelessness our most at-risk families. We know that the need to protect residents
that live paycheck to paycheck from the economic fallout of this virus includes protecting them
against facing eviction and homelessness which would only further spread this disease and
make its containment harder if people don't have a home to care for the health, safety and
welfare of their families.
Cities across the state have adopted ordinances to protect their residents. On March 16th
Governor Newsom said, "Over the next few weeks, everyone will have to make sacrifices -- but
a place to live shouldn't be one of them. I strongly encourage cities and counties to take up this
authority to protect Californians."
We commend your work on this urgency ordinance to protect Huntington Beach tenants. While a
great start, the ordinance can be strengthened. We recommend the following amendments:
"Section 3.58.010 Purpose" Amend this section so that the ordinance is in place to prevent
evictions for 120 days or the duration of Governor Newsom's Executive Order N 28-20,
whichever is longer.
Amend this section to also prevent the following types of evictions. • 30/60/90 day notices to quit
• 3-day notice to perform covenant or quit • 3-day notice to quit

"Section 3.58.030 COVID-19 Tenant Protections" Amend this section so that the acceptable
causes for decreased income include the following: The tenant was/is sick with Covid-19 or
caring for a household or caring for a household or family member who was/is sick with COVID-
19 • The tenant's compliance with a recommendation from a government agency to stay home,
self-quarantine, or avoid congregating with others during the state of emergency • The tenant's
need to miss work to care for a home-bound school age child
"Section 3.58.040 Penalties" Remove this section in its entirety. These penalties are likely not
lawful and should not be adopted.
Rent Repayment • Add a section that will allow tenants up to 180 days from the date the
temporary eviction moratorium ends to repay rent or longer if an agreement is reached between
the tenant and landlord.
We urge that you pass an emergency ordinance with the recommendations provided. A
temporary eviction moratorium with broad protections would provide the greatest protection.
Immediate assistance is necessary to keep low-income working families in their homes and to
not exacerbate homelessness.

Dear Honorable Mayor Semeta and City Council Members:
As a longtime Huntington Beach resident and local elected official, I urge the City Council to
adopt agenda item 4 "Emergency Ordinance 4210 Establishing Temporary Ban on Certain
Tenant Evictions for Non-Payment of Rent as a Result of COVID-19 Related Financial Impacts".
I can definitively say as a member of the Ocean View School District Board of Trustees, I am
fielding many questions and concerns in relation to issues of financial hardship. Many families
that reside in OVSD boundaries and beyond are hurting economically at this time, and need
immediate relief. Just to give you an example of the hardships people are facing right now, I
must report that OVSD served over 15,000 free meals to children ages 1-18 just in this past
week alone. Some of our residents are struggling with providing basic necessities, lacking the
resources to feed their children.
With the passage of this proposed ordinance, you can provide needed relief and alleviate
tremendous stress and anxiety for many. Should you not take action and pass this ordinance,
there will be greater societal implications, which could mean that residents might be evicted and
become homeless in a time of a viral outbreak of COVID-19. During this unprecedented global
pandemic, our Governor has issued a mandatory Stay at Home Order and our President has
stated that distancing guidelines be adhered to until at least April 30, 2020, therefore we must
work at the local level to enforce these measures. In a humanitarian spirit, you must act and
pass this today, and include no evictions for nonpayment of rent for 120 days, and that this
ordinance be inclusive of all residential and commercial (small businesses) renters.
I would like to give special thanks to HB resident Oscar Rodriguez for bringing this matter to the
forefront, his work on this issue is commendable Also, I would like to deeply thank City Attorney
Michael Gates for taking the initiative to make this proposed ordinance a reality. We residents
appreciate his efforts as well.

Buenas Tardes, alcalde y miembros del consejo, mi nombre es Araceli Flores residente del
vecindario de Huntington Beach, Oak View. Estoy aqui en apoyo del articulo 4 de la Ordenanza
de emergencia 4210 que establece la prohibicion temporal de ciertos desalojos de Tennant por
falta de pago como resultado del impacto financiero relacionado con COVID-19. Tambien estoy
aqui para abogar por nuestros miembros de nuestra comunidad que no son de nomina, que
incluyen, entre otro& jornaleros, vendedores ambulantes, amas de casa y muchas otras
personas que son la columna vertebral de nuestra sociedad. Todos ellos han sido gravemente
afectados por esta pandemia mundial y merecen ser protegidos por esta "Ordenanza de
emergencia", ya que todos estamos afectados por esta pandemia.

council per Congressman Rouda(he has assisted me before with matters such as Veteran
Benefits&Compensation issues)and instructed to seek information for assistance programs or
plans the council have/will make in precaution to prevent tenant/renter evictions.This which
would/could increase on homeless population with most hotels,motels,and other lodging
closed down due to economic recession/layoffs from this crisis.

Good afternoon,
I urge you to adopt agenda item #4 -"Emergency Ordinance 4210 Establishing Temporary Ban
on Certain Tenant Evictions for Non-Payment of Rent as a Result of COVID-19 Related
Financial Impacts".
It is my understanding that this action will allow Huntington Beach to follow and enforce
Governor Newsom's executive action to establish a statewide moratorium on evictions and to
protect renters and homeowners during this pandemic.
