CLOSED SESSION REPORT BY CITY ATTORNEY-Relating to Closed Session Item No. 6 (20-
1628), City Attorney Gates announced that City Council voted 4 -3 (Hardy, Semeta, Peterson -No) to
dismiss the City as plaintiff in the lawsuit City of Huntington Beach v. Newsom.
AWARDS AND PRESENTATIONS
8. 20-1625 Mayor Semeta acknowledged National Nurses week (May 6-12), and proclaimed
May 10-16 as National Police Week, and May 17-23 as National Emergency Medical
Services (EMS) Week.
Proclamations will be presented later due to current social distancing requirements.
9. 20 -1624 Mayor Semeta presented the "Making a Difference Award" to Reverend James
Pike of Lutheran Church of the Resurrection and member of the Greater
Huntington Beach Interfaith Council for donating his time, effort and resources to
those in need during this pandemic, and playing an integral part in the success of
"OneHB Connects."
Chris Slama, Director of Community Services, shared details of specific actions taken by the Greater
Huntington Beach Interfaith Council under the leadership of Reverend Pike , with the cooperation of
Waste Not OC and Meals on Wheels OC , to provide an additional 500 to 800 meals per week
throughout the City during the COVID-19 pandemic .
Attending the meeting remotely, Reverend Pike thanked Connections Network, Lutheran Disaster
Response , and those organizing the volunteers and scheduling to make this effort successful.
Councilmember Posey announced Reverend James Pike as his new appointee to the Community
Services Commission .

CITY MANAGER'S REPORT
10. 20-1487 Ascon Landfill Site Update
Assistant City Manager Travis Hopkins provided a PowerPoint communication entitled Ascon Landfill
Site Update, which included the following titled slides: North Berm Repair Complete, North Berm
Location, Current Site Activities, How to Stay Informed, and Questions or Concerns? Manager Hopkins
reported that the emergency berm repair was complete on May 8, and discussed activity at the site
going forward .
Councilmember Delgleize and Manager Hopkins discussed the months-long process for securing
permits and implementing the tents for future work at the site .
11. 20-1626 Update of the City COVID-19 Response Plan and Actions for Review and
Discussion
City Manager Oliver Chi provided a PowerPoint communication COVID-19 Response Update, which
included the following titled slides: Situational Update -U.S. Totals (2), Situational Update -Orange
County (2), Situational Update -Huntington Beach (2), Situational Update -HB EMS Response
Statistics, Local Available Hospital Resources, Orange County Hospitalizations I ICU Utilization Rates,
Huntington Beach -City Services Update, Economic Recovery Update -Planning Efforts Underway (2),
and Situational Update -Opening Up The California Economy.
Marie Knight, Director of Organizational Learning and Engagement, described the presentation slide
Economic Recovery Update -New ONEHB Micro-Grant Program, which includes the OneHB Theme,
Goal -To Provide Micro-Grants of $5,000, Eligibility Criteria, Partner Roles, and Program Roll Out.
City Manager Chi confirmed for Councilmember Delgleize that this program is designed to support
small local businesses, not national chain operators . Director Knight announced the OneHB .org
website will be functioning by May 25 and will have links to apply for a grant, make a donation, or
purchase merchandise. Donation checks can be made out to CIELO, designated for OneHB. Director
Knight stated that this effort is supported by staff from several Departments within the City, including
Community Development.
Mayor Semeta and Director Knight discussed the recent survey completed by the Chamber of
Commerce, and marketing efforts for available resources .

19. 20 -1642 Item submitted by Councilmembers Posey and Brenden Approved as Amended -
Directed staff to research Outdoor Dining Program for COVID-19 restaurant relief
Councilmember Posey introduced this item by stating his request to have staff evaluate how
restaurants in Huntington Beach can utilize their outdoor (parking) spaces for table service in a f luid
manner. He further stated this provision is in addition to the currently allowed pick-up of food and
beverages/cocktails, and adding a provision to allow pick-up patrons to eat at a table adj acent t o the
restaurant. In response to a public speaker questioning reference to Vilnius , Lithuania in his report ,
Councilmember Posey explained that his wife's ancestors are from Lithuani a, and listed vari ous other
U .S. and international examples of outdoor dining . Councilmember Posey read part of a letter of
support for this item from Lindsay Parton, President, DJM Capital Partners, Inc., who wrote on behalf of
the ownership and management of Pacific City and Bella Terra in Hunti ngton Beach.
Councilmember Posey explained this item is not necessarily about closing Main Street, nor would it be
mandatory, and described the effort as sensible , smart and approved by the Centers for D isease
Control (CDC).
Councilmember Brenden added examples of additional U . S . cities and commun ities that have
implemented policies for dining access within public and private (common area) spaces as part of their
recovery process to COVID-19. He e x plained the effort is a reasonable accommodation to temporarily
increase dining capacity through ·a Temporary Use Permit (TUP) w ith a fee waiver. Application s for this
TUP would follow normal processes through zoning review and would include time for public
comments.

Councilmember Posey added that the motion does not exclude retail establishments, and as a
temporary solution time is of essence, therefore he would expect an action item for the next Council
meeting in two weeks .
Mayor Pro Tern Hardy stated her support for this item , specifically because of the fluid nature which
allows for decreased public/private area use as inside capacity is increased, i.e ., the TUP will expire
when businesses are allowed to return to one-hundred percent (100%) occupancy . She also favors
following the recommendations of the Downtown Business Improvement District (DBID) in regards to
that area of Main Street. She asked that staff review current alcohol service requirements, such as
fencing , and asked for input from the Police Department including whether there could be a need to
change hours of service .
Councilmember Carr stated support for this item, and encouraged looking at including many other
businesses such as salons, grooming establishments, and fitness trainers . She also suggested that if a
portion of Main Street is closed to vehicular traffic it wouldn't necessarily have to be for 24 hours, seven
days a week . Councilmember Carr encouraged creativeness and flexibility in providing support for all
local businesses .
Councilmember Peterson reminded everyone that public right-of-way laws cannot be violated , and
asked if, or how, the TUP process could be streamlined . Councilmember Posey responded that the
staff proposal is expected to cover both concerns.
Councilmember Delgleize stated her support for this item, especially since it will support businesses
throughout Huntington Beach .
Councilmember Brenden reiterated that ex pediency is critical , and added that review of California
Department of Alcoholic Beverage Control (ABC) regulations will be considered .
Discussion ensued, and the original recommended action was amended.
An motion was made by Brenden, second Posey, to direct staff to develop a program for Council
consideration that would allow for the temporary conversion of adjacent public and private spaces into
outdoor dining and retail use to provide local businesses with the opportunity for greater customer
capacity up to, but not exceeding , the capacity limits that were in effect prior to COVID-19 restrictions .

20. 20-1643 Item Submitted by Councilmember Peterson Tabled -Reopening Huntington
Beach
Councilmember Peterson introduced this item by stating his purpose is to provide clarity for businesses
and residents because of the conflicting orders and recommendations coming down from the federal ,
state and county levels of government. He described how historically the sick were quarantined , but
the healthy were not, and added that since Huntington Beach has for the most part not been affected
like more dense populations, he believes it is time for the City to step back and let the economy safely
open. He supports deeming all Huntington Beach businesses and places of worship as essential and
allowing the opportunity to open and operate following County Health and Human Services guidelines,
and believes that business owners and clients will make responsible decisions.
Councilmember Delgleize stated her opinion that it is the responsibility of local government to be
prepared and ready to reopen businesses , and reminded everyone that each Council member took an
oath to support the Constitutions of the United States and State of California, and she supports
planning for a safe reopening . Councilmember Delgleize stated that she does not see this item as
responding in a responsible way to the unprecedented circumstances that exist.
Councilmember Posey explained that he used the CDC guidelines as his road map in preparing
Council member Item No. 19 regarding researching an Outdoor Dining Program for COVI D-19
restaurant relief, and proposed that Councilmember Peterson's item be postponed to allow time to
consider the Economic Recovery Task Force recommendations and development of a sensible plan to
follow.
Councilmember Brenden stated his support for "meeting in the middle" rather than responding in an "all
open" or "all closed" manne r. He suggested that the Economic Recovery Task Force and staff consult
with local businesses to develop the safeguards that are necessary for safe reopening , while being
aware of the concerns of both extremes.
Councilmember Brenden and City Attorney Gates discussed the issue of how long Governor Newsom 's
COVID-19 Emergency Declaration applies and how it can be legally extended by legislative action.
City Attorney Gates added that most states have sunset provisions of either 30 or 60 days in their
emergency declarations. In California an emergency declaration is indefinite and only ends when it is
declared a non-emergency.
Councilmember Brenden further stated his support for allowing the Economic Recovery Task Force to
produce business reopening guidelines which can be presented to the County for approval.
Mayor Pro Tern Hardy stated that regardless of what Governor Newsom portrayed for the media , the
City coordinated with the State , County and neighboring cities regarding beach access policies; and
she referenced City Council Resolution 2020-30 , approved at the last Council meeting, supporting the
Orange County Board of Supervisors efforts to address commerci a l re-openings in response to COVID-
19 . Her desire is to continue ma k ing decisions in a way where the rules and e x pectations are clear ,
and she supports moving ahead in measured steps in coordination with surrounding communities .
Councilmember Carr stated support for Councilmember Posey's recommendation to revisit this issue in
a couple of months only because things are moving so quickly at both the State and County level. She
expressed her desire to focus on ways the Council can support changes that follow State and County
guidelines for safely re -opening businesses as soon as possible.

Mayor Semeta expressed her opinion that delaying this item will be devastating to the business
community. She and City Manager Chi discussed Governor Newsom's new guidelines which were
issued today .
Mayor Semeta stated she is not in favor of the Economic Recovery Task Force or City recommending
particular safety guidelines, but rather the safety recommendations need to come from the businesses .
Councilmember Brenden responded that his recommendation is only for the Economic Recovery Task
Force to be a facilitator for business recommendations.
Councilmember Delgleize expressed a desire to revisit this in the not too distant future in light of the
fact that things are changing quickly at the State and County level.
Councilmember Peterson clarified that his intention is not to force business openings , but rather an
effort to declare all businesses and houses of worship as essential. He stated this is an effort to show
respect and support for rights and the ability to act responsibly.
Councilmember Posey stated the Council has already agreed to support the Orange County Board of
Supervisors, and developed the Economic Recovery Task Force, and he encouraged a continued focus
in those areas because in his opinion the City cannot control which businesses are considered
essential.
Councilmember Brenden stated his opinion that if the City declares all businesses as essential and
allows them to open , it could actually put them in peril , and he would rather approach the situation by
helping local businesses understand and comply with the State and County guidelines for reopening .
A motion was made by Brenden to direct staff, in coordination with the Economic Recovery Task Force,
to assist various business segments in the City to create standard operating plans with appropriate
public safety safeguards, and help them to obtain Orange County approval to reopen as quickly a
possible. The motion failed due to lack of a second .
Councilmember Delgleize and Mayor Semeta discussed the issue of not putting the City in a position of
even appearing to be developing public safety safeguards . Councilmember Delgleize stated she
believes that positive changes are in the works at the State and County levels , and recommended this
item be tabled for at least a couple of weeks.
Mayor Semeta stated she expects an update from the Economic Recovery Task Force, which will be
meeting on May 29th , for the June 1 Council meeting .
Councilmember Carr stated that it is important to help Huntington Beach businesses understand that
the City did not close down any businesses, therefore the City cannot open up any businesses, and
expressed her opinion that this discussion has just added to the confusion . She further stated that the
City doesn't need to reinvent the wheel, but should help facilitate the guidelines provided by the State
and County, and ensure there are no obstacles or ordinances that are barriers to businesses opening
up.
Mayor Semeta stated that she expects the Economic Recovery Task Force will uncover any barriers
that may exist, and will be focused on long-term recovery.

Mayor Pro Tern Hardy stated no objection to re-visiting this item at Stage 4 , and stated her e xpe ctation
that , as specific conditions are uncovered , they will be brought to Council's attention.
A motion was made by Peterson to direct staff to return with a reso lution that deems all bus inesses as
essential so businesses may follow County gu idelines to reopen . The mot ion failed due to lack of a
second.
With no action taken, Mayor Semeta made a recommendation to table the item to a date uncertain. No
objections were given.

Councilmember Posey shared a compliment he received for Commun ity Development Director Luna-
