Adopt Resolution No. 2020-35 authorizing the adoption of Chapter 10 of the California
Department of Transportation's (Caltrans) Local Assistance Procedures Manual
Statement of Issue:
In order to receive Federal-Aid Highway Program funding for engineering and design-related
consultant services, the City is required to adopt the California Department of Transportation's
(Caltrans') written policies and procedures governing the consultant selection process, as outlined in
Chapter 10 of the Local Assistant Procedures Manual, to ensure compliance with applicable State
and Federal laws and regulations.
Financial Impact:
No funding is required for this action.
Recommended Action:
Adopt Resolution No. 2020-35, "A Resolution of the City Council of the City of Huntington Beach
Adopting Chapter 10 of the Local Assistance Procedures Manual of the California Department of
Transportation."
Alternative Action(s):
Do not adopt Resolution No. 2020-35, and direct staff accordingly. This action would result in the
forfeiture of federal grant funding. currently obligated for the Davenport Drive Bridge. Additionally, the
City would forfeit the ability to seek federal grant reimbursement from Caltrans for any future
Architectural and Engineering consulting service costs expended on federal-aid funded projects.
Analysis:
On March 17, 2020, the City received the authorization from the Federal Highway Administration
(FHWA) and Caltrans to proceed with the Preliminary Engineering phase of the Davenport Drive
Bridge Preventive Maintenance Project.
Staff issued a Request for Proposals seeking the professional engineering and environmental
consulting services needed to complete the project. This solicitation also included the Gilbert Drive
Bridge, which staff anticipates receiving FHWA and Caltrans authorization for federal funding later

this year.
As the administrator of these Federal Highway Bridge Program funds, Caltrans requires local
agencies to formally adopt the consultant selection and procurement process specified in Chapter 10
of the Caltrans Local Assistance Procedures Manual in order to receive federal grant reimbursement
for Architectural and Engineering consulting services used on federal-aid projects.
City staff from the Public Works Department and the City Attorney's Office have reviewed the
requirements contained in Chapter 10, and have not identified any barriers to complying with the
specified procurement process. Therefore, staff recommends adoption of the attached resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ADOPTING CHAPTER 10 OF THE LOCAL
ASSISTANCE PROCEDURES MANUAL OF THE CALIFORNIA
DEPARTMENT OF TRANSPORTATION
WHEREAS, the City Council of the City of Huntington Beach, through its Department
of Public Works ("City"), is responsible for the execution of State and Federal funded projects;
and
Section 172.5(b) of Title 23 of the Code for Federal Regulations of the United States
("CFR") provides that Caltrans, and subrecipients of Federal-Aid Highway Program funds such
as the City, shall develop and sustain organizational capacity and provide the resources necessary
for the procurement, management, and administration of engineering and design related
consultant services, as specified at Section 106(g)(4)(A) of Title 23 of the United States Code
("USC"); and
Section 172.5(b)(1) of Title 23 of CFR requires that the City adopt Caltrans' written
policies and procedures for the procurement, management, and administration of engineering and
design related consultant services in accordance with applicable Federal and State laws and
regulations; and
Caltrans has developed the policies and procedures for procurement and management of
engineering and design related consultant services contracts on Federal and State funded
transportation projects to ensure compliance with applicable Federal and State laws and
regulations; and
Chapter 10 (Consultant Selection) of the Caltrans Local Assistance Program Manual
("LAPM") describes the consultant selection and procurement process local agencies such as the
City must follow to maintain eligibility for Federal and State reimbursement;
NOW, THEREFORE, the City Council of Huntington Beach does hereby resolve that
the City adopts Caltrans LAPM Chapter.10, and any updates thereto, in the procurement of
Engineering and Design services for State and Federal funded projects.
