Statement of Issue:
Residents along the Heil Avenue frontage road between Goldenwest Street and Sabot Lane, along
with Sabot Lane between Heil Avenue and Sunlight Drive, have petitioned the City to establish a
residential permit parking district, Permit Parking District "Z", in Huntington Beach.
Financial Impact:
The regulations of Huntington Beach Municipal Code Chapter 10.42 (Permit Parking Districts) require
that the residents choosing to participate in a residential permit parking district pay a proportionate
share of the cost to establish or amend the district, making the district cost neutral to the City. Typical
costs include, but are not limited to, fabrication and installation of signs, curb markings, which are
initially funded in the General Fund Signs and Marking business unit 10085302, and staff time to
issue permits, which are funded in the General Fund Transportation Management business unit
10085301 . The total cost for this parking district is estimated at $825, or $55 per address.
Recommended Action:
Adopt Resolution No. 2020-18, "A Resolution of the City Council of the City of Huntington Beach
Establishing Permit Parking District `Z' Within the City of Huntington Beach."
Alternative Action(s):
Do not adopt Resolution No. 2020-18, and direct staff accordingly.
Analysis:
Residents along the Heil Avenue frontage road between Goldenwest Street and Sabot Lane, as well
as Sabot Lane between Heil Avenue and Sunlight Drive. have petitioned the City requesting a permit
parking district be created, due to commuter vehicle parking impacts and related issues. The
neighborhood is located on the north side of Heil Avenue between Goldenwest Street and Gothard

Street, as shown in Attachment#2.
Including the commuter vehicle parking impacts, residents expressed their concerns with associated
issues of late-night noise, littering, parking too close to driveways, and finding curbside areas to place
trash bins on the street on collection day. The requested permit parking restrictions are 6 p.m. to 6
a.m. every day, including holidays.
Following procedures in Municipal Code Chapter 10.42 Permit Parking Districts, staff validated the
petition, determined the concerns of the residents merit further consideration, and considered the
proposed area to be reasonable.
Staff prepared and mailed letters to the affected properties explaining the permit parking district
requirements, boundaries, and included ballots for voting on the permit parking district proposal. As
stated in Chapter 10.42, a minimum of 75% of the property units must vote in favor of the parking
district to move the request forward for further consideration. The voting results met the minimum
criteria initiating the evaluation of the conditions on the requested permit parking area.
Following the procedures outlined in Chapter 10.42, staff investigated the conditions to examine the
parking conditions and related concerns. Field observations and discussions with the residents
demonstrated that the street experiences recurring parking impacts from commuter vehicles, with the
most significant impacts occurring on the weekend. Although noise and trash bin moving issues
were not observed by staff, these concerns were mentioned by several of the residents as frequent
commuter vehicle parking related issues. Due to these conditions, staff determined that the
unrestricted parking creates situations where the commuter vehicle parking regularly interferes with
residents and their guest parking, and creates other concerns for the residents.
Prior to the original date when the City Council was set to consider the permit parking district request,
notifications were sent to the surrounding area. As a result of these notifications, several residents
on nearby streets expressed interest in being included in the permit parking district, and one resident
communicated changing their original vote. In response to these comments, staff re-balloted the
area, which included the Heil Avenue frontage road, Sabot Lane, and Sunlight Drive. The results
showed the Heil Avenue frontage road between Goldenwest Street and Sabot Lane, and Sabot Lane
between Heil Avenue and Sunlight Drive, both met the voting requirement to request establishing
permit parking on those streets.
Based on the voting results, field surveys, and discussions with residents, staff believes findings can
be made demonstrating that commuter vehicle parking unreasonably and regularly interferes with the
use of available on-street parking for residents and guests, and causes other related disturbances.
These findings are consistent with requirements of the Municipal Code as a basis for establishing
permit parking.
The number of affected addresses that would comprise the permit parking district is 15 addresses, as
shown in Attachment#3. Notices were sent to the affected properties, as well as properties within
500 feet of the proposed district boundaries, indicating the date and time of the City Council meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH ESTABLISHING PERMIT PARKING
DISTRICT "Z" WITHIN THE CITY OF HUNTINGTON BEACH
WHEREAS, the City Council has adopted Ordinance No. 4051 allowing e establishment of
parking districts in residential areas under certain conditions; and
The citizens of the residential street frontage road along the north side of Heil Avenue between
Goldenwest Street and Sabot Lane, and Sabot Lane between Heil Avenueand Sunlight Drive have
petitioned for establishment of a permit parking district:

a ballot for further consideration to
residents of the petitioned roadway, and caused an investigatio reasonably established that:
1. A minimum of 75% of the Property Units alon the frontage road on the north side of Heil
Avenue between Goldenwest Street and Sabpf Lane, and Sabot Lane between Heil Avenue
and Sunlight Drive are in favor of establishing a Permit Parking District; and
2. Unrestricted parking creates a situation in which the subject street cannot be used for parking
by Residents or their guests because ommuter Vehicle parking unreasonably and regularly
interferes with the use of the avail ble street parking; and
3. Unrestricted parking creates a ' ation where Commuter Vehicles or their occupants produce
significant sources of health afety or welfare concerns.
Therefore, the Director of P blic Works has found the requirements of Ordinance 4051 to be
reasonably fulfilled, and determi d that the Permit Parking District will not affect other uses of on-
street parking.
NOW, THEREFO , the City Council of the City of Huntington Beach does hereby resolve as
follows:
Permit Parkin District "Z" is hereby'established to include the above mentioned roadway,
everyday including olidays between 6:00 p.m.`to 6:00 a.m.

Original Permit Parking District Request:
Figure 1 shows the original petitioned permit parking area along the Heil Avenue frontage road. The
requested parking restrictions are 6 p.m. to 6 a.m. every day, including holidays. Including the
commuter vehicle parking impacts, residents expressed their concerns with associated issues of late
night noise, littering, parking too close to driveways, and finding areas for placing trash bins on the
street on the collection day as the reasons for initiating the process to establish permit parking on their
street.
As required by Municipal Code Chapter 10.42, staff reviewed the request, determined the petition and
concerns of the residents were valid, and considered the proposed area to be reasonable.
Staff prepared and mailed letters to the affected properties explaining the permit parking district
requirements, boundaries, and included ballots for voting on the permit parking district request.

Per Municipal Code 10.42 a minimum of 75% of the property units (1 vote per unit) shall be in favor of
establishing permit parking to move the request for further consideration. Of the 19 affected
properties, 18 ballots were returned with 15 votes in favor of permit parking (83%) and three votes not
supporting permit parking. The 75% minimum support requirement was satisfied to continue the
evaluation. Table 1 summarizes the voting results of the original Heil Avenue frontage road permit
parking district request.

As required by code staff investigated the parking conditions and related issues on the proposed
permit parking street. The code requires that facts exist that reasonably establish that unrestricted
parking creates a situation in which the subject streets cannot be used for regular parking by residents
or their guests, or creates a situation that commuter vehicles or their occupants produce significant
sources of health, safety, or welfare concerns to continue the process for further consideration. Below
summarizes the field surveys of the parking conditions in the originally requested permit parking area.

Analysis:
During the weekdays, parking impacts were observed between the evening to early morning hours.
The most impacted field observation occurred on the weekend where a majority of the available on-
street parking was occupied by commuter vehicles. These parking impacts could affect the availability
of on-street parking for the residents and their guests. In addition to the parking impacts, the
residents expressed concerns with trash left on the street and front yards, and late night noise
attributed to the commuter vehicle parking. Although staff observations of the area did not witness
occurrences of trash on the street or noise, these concerns were expressed by many of the residents as
recurring commuter vehicle parking issues.
Municipal Code 10.42 requires that specific conditions shall exist for a parking district request to move
forward for consideration to the City Manager's office. These include: unrestricted parking creates a
situation where on-street parking cannot be regularly used by residents and guests; or, unrestricted
parking by commuter vehicles produces significant sources of health, safety, or welfare concerns.
Based on the field evaluations and discussions with the residents, staff determined that the
unrestricted parking creates a situation where the commuter vehicle parking regularly interferes with
residents and their guests parking, and produces significant sources of welfare concerns, and
recommended establishing the permit parking district.
Revised Voting Results:
Prior to the original request being considered by City Council, staff mailed notifications to properties
within a minimum of 500 foot radius of the proposed permit parking district area. Staff received
several responses from residents in the neighborhood supporting and opposing the permit parking
district request. In addition to receiving responses from residents outside the parking district area,
staff was contacted by a resident within the proposed parking district who communicated the desire to
change their vote from "YES" to "NO". Due to this change, the original permit parking district area no
longer met the minimum 75% support requirement, however, the west section of the Heil Avenue
frontage road still qualified with a minimum of 75% voting in favor of the request. The revised voting
results for the west and east section of the Heil Avenue frontage road based on the one vote change is
shown on Table 2 and Figure 2.

Updated Permit Parking District Request:
Due to the revised voting results and responses received by staff from residents on nearby streets after
the notifications were mailed, staff's decided to re-ballot the area to give an opportunity for residents
on the adjacent streets to participate in permit parking and confirm the affected addresses support for
the proposal. Staff received comments from the residents on Sabot Lane and Sunlight Drive expressing
interest in joining the Heil Avenue frontage road for permit parking, prompting staff to re-ballot the
area to determine if these streets would qualify to be included in a new permit parking district. The
voting results showed the west section of Heil Avenue frontage road and Sabot Lane between Heil
Avenue and Sunlight Drive qualified to be considered for permit parking. Voting results are shown on
Table 3 and Figure 3.

Staff Recommendations:
Based on the updated voting results, field surveys and discussions with residents staff has determined
that the provisions in Municipal Code 10.42 have been met as a basis for establishing a permit parking
district. Staff recommends establishing Residential Permit Parking District 'T' consisting of Heil
Avenue frontage road between Goldenwest Street and Sabot Lane, and Sabot Lane between Heil
Avenue and Sunlight Drive and is shown in Figure 4. The parking districtis recommended to include
Sabot Lane due to the probable shift in commuter vehicle parking to that street with permit parking
implemented on the west portion of Heil Avenue frontage road.

I live on the Frontage Road East of Sabot Lane
which is not covered by this Resolution.
Therefore my section of Heil will have all
the overflow parking in front of my house
plus the 6 other homes East of Sabot Lane.
The Resolution should have covered the
complete length of the Heil Frontage road.
Do not pass this resolution as written.

This letter is for the purpose of the city Council on Monday to be aware that the residence on the
east side of Heil Ave are now in a position where we have to all join in on the yes vote to have
permit parking. I have sent a copy of all Correspondence we've had from Bob Stachelski. We
thought the prior vote was for the entire St between Goldenwest St and Gothard St. We were un
aware that he separated the streets when we recast our votes the second time. We have been put in a
position to participate in the permit parking as if we vote no the east side of Heil Avenue will be
burdened with the overflow of cars from the west side of Heil Avenue. Originally our goal was to
have Heil Avenue re-done as it is now turned into Beach Boulevard. We have problems with
emissions pollution safety and now with the addition of the dedicated left turn lane that's going up
on Goldenwest Street and Heil Avenue will only exacerbate the problem. I would also like to ask
that when this matter is reviewed and voted for that we set aside a special fund for a beautification
project on Heil Avenue. In other words the money that the homeowners who are taxpayers pay&
the money from the tickets on the street be dedicated to a beautification fund for our street.Seeing as
Heil Ave is now turned into Beach Blvd.

Dear Huntington beach Resident:
The City of Huntington Beach Public Works Department has received a request to create a new residential permit parking
district in your neighborhood. This proposed residential permit parking district would include properties on a frontage road
section cif Heil Avenue east of Goidenwest Street(See attached Figure 1).
The proposed parking restriction time is 6:00 pm to 6:00 am daily,including holidays.
ilie City's residential parking permit ordinance requires that at least 75 percent of the residents(one vote per property unit)
on the affected streets support the proposal to continue the request for further consideration. A ballot is being sent to each
affected property owner and property unit to determine if a minimum of 75 percent of the property units support establishing
permit parking. The property owner of the affected address has the initial opportunity to cast a vote for the property. In the
absence of the property owner vote,the vote of the tenant of the property will be counted. Please indicate whether you do
or do not support the establishment of the parking district by completing and returning the ballot in the provided envelope
by February 15,2019.
Residents are charged a fee,which is currently$24.00 for the first permit and $10.00 for each additional permit up to a total
of four,but is subject to change. In addition to the regular resident permits,each household will be issued two guest permits
at no charge. Permits are valid for up to five(5)years. Additionally,a one-time setup fee is charged for each household
for the costs associated with implementing the residential parking district. For the requested proposed residential permit
parking district, the anticipated fee amount is $58.74 per household. This includes, but is not limited to, permit parking
signs and installation costs. Occupants are not required to purchase a parking permit if they do not plan to park on the street

Dear Huntington Beach Resident:
Earlier this year, the City of Huntington Beach Public Works Department received a request to
create a new residential permit parking district along the Heil Avenue frontage road between
Goldenwest Street and Gothard Street. The request was to be considered at the October 7, 2019
City Council Meeting but was withdrawn by staff in response to input from residents of the affected
addresses and neighborhood prior to the scheduled meeting. The review was prompted by one
resident who notified the City that they wished to change their vote from being in favor of the
district to being opposed, significantly altering the narrow results for the east end of the cul-de-
sac.
After reexamining the request in light of the revised voting, which included reviewing permit
parking voting results from earlier in the year, the proposed permit parking area was modified to
reflect those areas that met the required support. Please refer to Figure 1 on the second sheet back
side illustrating the new proposed permit parking area:
• West section of Heil Avenue frontage road (west of Sabot Lane) between Goldenwest
Street and Gothard Street
Please note that street sections can be included only if a street votes a minimum of 75% in
support of permit parking.
Due to this change, staff enclosed a second ballot to residents in the area to vote on this proposal.
The second ballot is to affirm whether you support or do not support the permit parking request
for those who have voted earlier this year, and to provide the opportunity for nearby addresses
shown on Figure 1 to participate should sufficient support exist,with the knowledge that the west
section of the frontage road appears likely to meet the required 75% support.
It is our intent to recount all votes as part of this process to ensure an accurate review. This
means that you must resubmit a ballot indicating your preference. Prior votes will not be
considered.
The proposed parking restriction time is 6:00 pm to 6:00 am daily, including holidays.
Please indicate whether you do or do not support the establishment of the parking district by
completing and returning the ballot in the provided envelope by January 24,2020.

Residential Permit Parking fees are currently $24.00 for the first permit and $10.00 for each
additional permit up to a total of four. Each household purchasing permits.will be issued two guest
permits at no charge. Permits are valid for up to five(5)years. Additionally, a one-time setup
fee estimated to be between$50 to$60 is charged for each household for the costs associated with
implementing the permit parking district.
Occupants are not required to purchase a parking permit if they do not plan to park on the street
during the restricted times. The Huntington Beach Police Department or Parking Control can cite
any vehicle parking in a residential permit parking district that is not displaying a parking permit
for that district during the restricted time.

Upon receipt of Robert Stachelski,Transportation Manager's letter received on June 6, 2020, 1 was
perplexed as to the sense of urgency to schedule this matter for the June 15th City Council meeting.
Due to the current seriousness of a corona virus pandemic, it would be in very poor judgment to conduct
business on this non-urgent matter. When I received Mr. Stachelski letter I immediately called him and
inquired as to the urgency. He stated to me the Heil Ave. homeowners have been waiting for over a year
on this issue. Please, both sides of this public parking matter needs to be fully considered.
The residents impacted by a proposed change in public parking would like to attend a public meeting and
voice their concerns to the City Council members in less restrained health conditions. However, some
folks will attend the City Council meeting on June 15th.
I do understand approximately 12 residential homeowners on Heil Ave. would like the public parking for
their own use. My observation is the homes all have a two (2) car garages as well as their parking
driveways. And, one of the homes does has a three (3)car garage and driveway.
This proposed public parking change would give the homeowners additional parking and parking for their
guests. I don't have control who parks in front of my home and few people do as it is public.
The Covington four-plexes across the street from the residential houses on Heil Ave. were built in
1968/1969, and they have been a residential rental community for all of these years.
Some years ago the City took away the street parking on Goldenwest St., causing all the residents of the
Covington four-plexes on Goldenwest St. to move their motor vehicles inward to the alleys and to the
next street, Bartlett Lane creating a parking nightmare.
The residents occupying the Covington four-plexes, some long-term and hard working families would love
to be the proud owners of a Huntington Beach house but circumstances don't permit them from having
the luxury of home ownership.
The above-mentioned public parking on Heil Ave. has been valuable for some tenants because they work
late at night and when they arrive to their apt. there is no parking is available. Their jobs in the restaurant,
food service business, home service industry often requires them to close up the business at night.
Also, in normal times, no pandemic we have night school students that can only go to school at night due
to their day jobs and parking is a real issue. We are once again reminded of the"essential service"
provided by hard-working Americans, many are tenants in our community.
There should not be any discrimination between homeowners and tenants. They are all people
attempting to make a decent living and raise their children. In keeping the current public parking on Heil
Ave.for all is the best most fair and the decent thing to do.

I've lived in the area almost my whole life, living in both the apartments and the Prestige home track
for many years.
I am sending you this email to request that you rei=the adoption of Resolution number 2020-18.
"A resolution of the City Council of the City of Huntington Beach establishing Permit Parking District
"Z" within the city of Huntington Beach",that you will be voting on Monday,June 15tn
This rejection request or postponement of this Resolution is necessary because information
presented in the previous meeting on October 7th, 2019 is not correct.
The apartment area that was discussed is directly across from the homeowners,they share Heil for
their addresses. The biggest misinformation claim is that there is sufficient parking for the
apartments, and that the residents are not utilizing the available parking and are abusing the
situation. To clarify the situation; each individual 4 unit apartment building located on Heil and the
surrounding area, have two private parking spaces and two 2 car garages. There is also a shared
space located between buildings. Each individual 4 plex has a three bedroom apartment in the front
and three two bedrooms units= nine bedrooms for that building, which means that without any
street parking,each apartment has 1 and a half parking spaces that they can use. It was also
stated that you could park in front of the garages,this is incorrect and unsafe. When done the
garages are blocked and become inaccessible, the alleyway becomes a hazard.
It was also stated that the garages are being used for storage,this is an unpermitted change on
some buildings and the city should correct those owners through enforcement. Each apartment has
access to one car sized spot in a shared 2 car garage and rotating use of a exterior%space parking
spot. In comparison to the four available spots for each home(2 on driveway-2 in garage).
If I have not said this clear enough—there is insufficient parking for the area. The Street parking
is constantly packed,
In addition,there is a large apartment complex that has limited parking for the number of units that
it has. Exact numbers are not available at this time.
It's understandable that there has been some confusion as it appears that there are large parking
areas at the Park and closed school, but none of those spaces are available for parking by the
residents of the neighborhood.
Since the expansion of the Murdy Park Community Center(2017), the increase in noise,trash, and
criminal activity has increased for the residents of the apartments. That is where the claims of
criminal activity are coming from.
Apartment Owners must be very careful when limiting vehicles as it can be construed by Fair
Housing as a violation. For example:You have a 2-bedroom apartment. You limit the resident to
one car. Which means that you will give preference to a family with children that are not of driving
age, or families over roommates. Even if the owner or manager does not state this.
This is a clear violation of Fair Housing. This was a recommendation I received when I called Public
Works about the situation.
The homeowners have unfortunately ignored the park as the center of the problems. Which is
located next to the apartment complexes. Currently the city has closed certain areas of parking
which has pushed even harder on the residents as people return to the park.True "commuters" park
on the resident streets even though the residents are not allowed to park on the school or the park,
they have been told this by the city and threatened with towing.
Concerning the frontage road and blocking the use of the frontage road from the Apartment
residents from across Heil, this will not widen the frontage road if the homeowners continue to use
the road themselves. If there is not sufficient space, the frontage road should be declared a Fire
Lane and restrict all cars from parking there.
A Fire Lane would address all space issues for Trash pickup day, emergency vehicles,tight turns to
get out of drive ways and increases visibility.
Putting in a Restrictive Parking District in this area,moves the issue to another.nearby area.
If the apartments do not get access to the basic amenity of parking,then the area will decline as
residents move and owners struggle to fill a unit that can only have one car in it.
To truly give these homeowners the quiet and space that they are requesting, it is imperative that
the true parking shortage be addressed in the neighborhood. Please be a stand-up city council and
help the owners of these apartment properties, many of whom have as much pride in their
properties as these homeowners do.

My name is Lynda Engel and I am the homeowner of 7211 Heil Avenue, Huntington Beach. I
am strongly requesting that this proposal NOT be passed for the following reasons:
--When this issue was first discussed with residents last year, there was no mention
whatsoever of"splitting"the frontage road into and east and a west side to be considered
separately for permit parking. All discussion was about permit parking for the entire frontage
road from Goldenwest to Gothard.
--I was very surprised when a second vote of residents was requested, splitting the road into
two separate entities, apparently voting separately. It had never been discussed to vote as
separate entities. Also, the east side of the road includes 7 residences, and the west side
includes 12 residences.
--The way the proposal stands, if passed, all non-residents of the Heil frontage road will be
allowed to park in front of the seven residences on the east side of the road only, creating
impacted parking for the residents.
--If passed, those of us living on the east side will be very limited in our own guest parking and
will have no access to guest parking even along Sabot. So our guests will have to park on
Sunlight Drive.
--Although I do not live at the 7151 address,just looking at the map, the homeowners there
have the worst scenario if passed. They will not be able to park along Sabot Lane, which is
directly adjacent to their property. Very unfair.
--This proposal is unfair to seven residences and should not be passed. The permit parking
should extend for the entire length of the frontage road or not at all.
--For the record, at the time of the first vote, I voted against the permit parking because I was
not bothered that much by non-residents parking along the road. And I felt it was quite costly
for homeowners. However, when I saw how the whole issue had been changed, I voted in
favor of the proposal the second time, because I could see how a split proposal would be
unfair to seven residences.
I urge you to take these points into consideration when you vote.

Dear Council Member,
We currently own five rental properties within the City of Huntington Beach. Two of the properties are
located at 7092 and 7102 Heil Avenue across from the proposed residential permit parking district. We
respectfully ask that you vote against the proposal.
As providers of multifamily housing our tenants are hard working individuals who often work odd hours or
evening shifts. In addition, to help with expenses our tenants often double up. As an example, one of our
larger three-bedroom units has three roommates and three cars. They are provided two parking spaces
on the property. These individuals are health care workers and therefore considered essential workers
during the pandemic. They work long hours and often come home later in the evening when parking is a
premium. In our effort to provide affordable, safe housing, parking for our tenants is a must. Over the
past few years household formation has increased and it is not unusual that apartment dwellers have
multiple drivers with two and three cars. This taxes older properties with 60's and 70's parking
requirements and allocation.
We would like to add that the red curb along Golden West has placed added stress on parking in the area
as tenants who would have parked along Golden West now must park along an interior street.
Again, we ask for a no vote on the proposal.

I am against 15 entitled property owners that wish to establish an exclusive parking area limiting their
neighbors from across the street to park on a seldom used dead end public Street. Unfortunately, there is not
enough off-street parking for the hard-working citizens of this community. Occasionally the residents do park
on the dead-end street, when there is an insufficient amount of parking available to them. Parking across the
street is done only when there is no other alternative and they cannot get off street parking or on street parking
on the South side of Heil Ave. Which means that the residents on the South side of Heil Ave. will fill up the
parking on the South of Heil first because of convenient then once filled with no other parking available on the
South side they will park in the dead-end street of Heil Avenue Frontage. The parking fills up from 10pm till
lam weekdays and not every week day. The worst I have seen across the street was about ten cars for that time
period. The parking plan was designed and approved prior to construction by the City of Huntington Beach
back in the 60s. Each of 15 entitled property owners has double the off-street parking per house-hold. We
should not make Heil Avenue Frontage Road exclusive on-street parking for the 15 entitled property owners.
Now by limiting the on-street parking to the 15 entitled property owner household's vs the 18 lots with 4
households each lot to a total sum of 72 households the City of Huntington Beach will burden more of the less
fortunate working-class Huntington Beach citizens. We should not have to change the parking that has been
working for over a half a century and incur the cost of signage and enforcement for a small amount of home
owners verses 4 times the amount of house-holds that reside in Huntington Beach.

times stated. I have a lot of family gatherings and the times for the permit was not a good time frame. I misunderstood
and thought that both sides of Heil Avenue were included as a whole, and not split up as I just found out.
I became aware with the recent city letter that was sent out.
If the street is being split up this will cause more of a problem with the parking issue. At this point I prefer to work on
the permit parking for both sides.
