HomeMy WebLinkAboutCity Council - 2020-53 RESOLUTION NO. 2020-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADOPTING AN AMENDED UNIFORM BAIL SCHEDULE FOR PARKING VIOLATIONS WHEREAS, pursuant to California Vehicle Code Section 22511, the City added Section 10.52.025 to the Municipal Code authorizing the designation of parking stalls and spaces for electric charging, and prohibiting the use of such spaces except when connected to a charging station; WHEREAS, Vehicle Code Section 40203.5 requires local governing bodies to establish a schedule of parking penalties for parking violations; and WHEREAS,the City seeks to set parking penalties for the following offenses: 1. Failure to park in a designated space in any City beach parking lot pursuant to Huntington Beach Municipal Code ("HBMC") Section 13.08.300(A); 2. Parking outside of a designated parking area on a beach or service road pursuant to HBMC Section 13.08.280(E); 3. Parking a trailer or similar vehicle in the City beach parking lot without a Community Services Director permit pursuant to HBMC Section 13.08.300(F); 4. Parking a vehicle on the Pier or Pier Plaza without a Community Services Director permit pursuant to Section 13.08.290(D); 5. Parking or stopping a vehicle where the vehicle constitutes a traffic hazard or endangers life or property pursuant to HBMC Section 10.40.050(F); 6. Parking a vehicle where the Director of Public Works has caused the curb marking to be painted white pursuant to HBMC Section 10.48.050(D); 7. Parking a vehicle where the Director of Public works has posted signs prohibiting parking during cleaning (including street sweeping), repair or construction pursuant to HBMC Section 10.40.050(G); 8. Parking a vehicle where the City Council has established a no parking zone designated by a red curb face pursuant to HBMC Section 10.40.050(D); 9. Parking a vehicle in a City off-street parking lot where the Director of Community Services has designated no parking areas through signs or curb markings, pursuant to HBMC Section 10.52.020(C); 10. Parking a vehicle where it occupies more than one marked parking space (unless the vehicle size exceeds the marking)pursuant to HBMC Section 10.40.230(B); Resolution No. 2020-53 11. Parking a vehicle in a metered parking space where the meter is not in an active and unexpired condition pursuant to Section 10.40.230(B); 12. Parking a vehicle where the Public Works Director has posted temporary no parking signs due to a public or private assembly pursuant to HBMC Section 10.40.170(B); 13. Parking a vehicle where the Public Works Director has posted no parking signs or red curbs pursuant to HBMC Section 10.40.40(B); 14. Parking a vehicle where the Public Works Director has posted signs adjacent to a school restricting parking to the loading or unloading of passengers pursuant to HBMC Section 10.48.105(B); 15. Parking a vehicle alongside curb space authorized for loading and unloading passengers of a bus in violation of California Vehicle Code Section 22500(i); 16. Parking or stopping a vehicle upon a one-way roadway in violation of California Vehicle Code Section 22502(e); 17. Obstruct,block, or otherwise bar access to parking stalls or spaces in violation of California Vehicle Code Section 22507.8(b)); 18. Parking or leave standing a vehicle in a stall or space unless the vehicle is connected for electric charging purposes in violation of California Vehicle Code Section 22511.1(a); 19. Obstruct, block, or otherwise bar access to parking stalls or spaces in violation of California Vehicle Code Section 22511(b); 20. Failing to attach both license plates issued to the vehicle in violation of California Vehicle Code Section 5200(a); and 21. Failing to attach one license plate issued to the vehicle in violation of California Vehicle Code Section 5200(b); 20-8703/231939/SFF 2 Resolution No. 2020-53 NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: Section 1. Pursuant to the aforesaid authority, the City Council of the City of Huntington Beach does hereby rescind Resolution 2019-75 and adopts the Uniform Bail Schedule for parking violations, attached hereto as Exhibit A.
