HomeMy WebLinkAboutAdopt Resolution No. 2020-90 Appointing Design Review Board F y _, 1c City of Huntington Beach File #: 20-2106 MEETING DATE: 12/21/2020 REQUEST FOR CITY COUNCIL ACTION SUBMITTED TO: Honorable Mayor and City Council Members SUBMITTED BY: Oliver Chi, City Manager PREPARED BY: Ursula Luna-Reynosa, Director of Community Development Subject: Adopt Resolution No. 2020-90 appointing the Design Review Board to also serve as the Huntington Beach Building Appeals Board to hear and decide appeals of orders, decisions, and determinations made by the Building Official relative to the application and interpretation of Title 17 of the Huntington Beach Municipal Code Statement of Issue: Section [A] 113.1 of the California Building Code (CBC) and Section 17.04.120, of the Huntington Beach Municipal Code (HBMC) created a Huntington Beach Building Appeals Board to hear and decide appeals of orders, decisions, and determinations made by the City's Building Official. The City Council is requested to consider adopting Resolution No. 2020-90 to appoint the Design Review Board to also serve as the Huntington Beach Building Appeals Board, to hear and decide appeals of orders, decisions, and determinations made by the City's Building Official relative to the application and interpretation of Title 17 of the Huntington Beach Municipal Code. Financial Impact: Not applicable. Recommended Action: Adopt Resolution No. 2020-90, "A Resolution of the City Council of the City of Huntington Beach Appointing the Design Review Board to Also Serve as the Huntington Beach Building Appeals Board to Hear and Decide Appeals of Orders, Decisions, and Determinations Made by the Building Official Relative to the Application and Interpretation of Title 17 of the Huntington Beach Municipal Code." Alternative Action(s): Do not adopt the Resolution and direct staff accordingly to comply with the Huntington Beach Municipal Code requirement. Analysis: When the City Council adopted the CBC as well as Section 17.04.120, of the HBMC, it created the Huntington Beach Building Appeals Board. Instead of establishing a separate board, staff recommends that the City Council appoint the Design Review Board to also serve as the Huntington Beach Building Appeals Board. The Design Review Board would sit, as needed, as the Huntington Beach Building Appeals Board. The Design Review Board typically consists of members that have a background in design, such as architects, engineers, and contractors, which provides the necessary qualifications to hear and decide appeals of orders, decisions, and determinations made by the Building Official relative to the application and interpretation of Title 17 of the Huntington Beach Municipal Code. Environmental Status: The proposed resolution is exempt from the California Environmental Quality Act (CEQA) because it is not a project. Pursuant to Section 15378 (b)(5) organizational and administrative activities of governments that will not result in any direct or indirect physical environmental effects, such as the proposed resolution to designate the Design Review Board as the Building Appeals Board, is not a project. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: The Design Review Board will sit as needed, as the Huntington Beach Building Appeals Board to hear and decide appeals of orders, decisions, and determinations made by the City's Building Official relative to the application and interpretation of Title 17 of the Huntington Beach Municipal Code.
