Plans - Review of prohibition on "Late Night Happy Hours"
I recommend that the City Council direct staff to do the following:
A) Conduct a full review of the prohibition on "late-night happy hours" in the BECSP and Bella
Terra Specific Plan areas.
B) If that review finds no concerns, staff should move forward with facilitating the removal of the
prohibition on "late-night happy hours" for interested and impacted restaurants within the
BECSP and Bella Terra Specific Plan areas.

SUBJECT: BEACH EDINGER CORRIDOR & BELLA TERRA SPECIFIC PLANS — REVIEW OF
PROHIBITION ON "LATE-NIGHT HAPPY HOURS"
BACKGROUND
As the Beach Edinger Corridor Specific Plan (BECSP) was coming online, and as Bella Terra was in
its nascent state,the City did not have enough data to know if the Edinger area was going to turn
into a new 'downtown,' and with it, experience the issues that Downtown HB has had with
alcohol service. To address that possible concern, one of the conditions placed on new alcohol
permits(CUPs)that were issued to restaurants was a prohibition on "late-night happy hours" (i.e.
drink specials after 7 p.m.).
It has now been over 10 years since the implementation of the BECSP, and alcohol related issues
in the Edinger area have not occurred. Having discussed this with several restaurants in the
Edinger Corridor (and given that this most likely holds true on Beach Boulevard as well), these
businesses would like these restrictions relaxed. There does not seem to be an issue with over
consumption of alcohol at locations within the BECSP and the Bella Terra Specific Plan.
With that set of factors to consider, I am requesting that the City Council direct staff to conduct
a full review of the prohibition on "late-night happy hours" in the BECSP and Bella Terra Specific
Plan areas. If that review finds no concerns, I would ask that the City Council also direct that staff
create a mechanism through which impacted restaurants who would like to have the prohibition
on "late-night happy hours" removed, be allowed to do so through some type of simplified and
streamlined entitlement amendment process.
RECOMMENDED ACTION
I recommend that the City Council direct staff to do the following:

Bella Terra Specific Plan areas.
2. If that review finds no concerns, staff should move forward with facilitating the removal
of the prohibition on "late-night happy hours" for interested and impacted restaurants
within the BECSP and Bella Terra Specific Plan areas.
