City of Huntington Beach Page 1 of 1 Printed on 12/16/2020 power Legistar"^ W CITY OF HUNTINGTON BEACH CITY COUNCIL MEETING—COUNCIL MEMBER ITEMS REPORT TO: THE HONORABLE MAYOR AND CITY COUNCIL FROM: DAN KALMICK, CITY COUNCIL MEMBER D�K DATE: DECEMBER 21, 2020 SUBJECT: BEACH EDINGER CORRIDOR SPECIFIC PLAN—CONDITIONAL USE PERMIT REVIEW PROCESS FOR ALCOHOL PERMITS BACKGROUND The Beach Edinger Corridor Specific Plan (BECSP) currently requires that all eating establishments (restaurants) which want to serve alcohol participate in a public hearing at the level of the Planning Commission. During my eight years on the Planning Commission, I cannot recall a time when consideration of a Conditional Use Permit (CUP) for alcohol services in the BECSP required more than a pro-forma meeting. Given that the review of these types of permits at the Planning Commission level adds time (both in staff time and length of review) and cost that are unnecessarily burdening our businesses in the community, I am requesting that the City Council direct staff to coordinate a process through which Section 2.2.1 (1)(d) of the BECSP would be amended to lower the level of review required for CUPs for alcohol service,from the Planning Commission to the Zoning Administrator. Further, I would like to request that staff concurrently address and clarify the entitlement process for retail markets as it relates to alcohol sale CUPs. It should be noted that all actions of the Zoning Administrator are appealable to the Planning Commission and that the Planning Commission will review this HBZSO/BECSP amendment before it returns to City Council for approval. RECOMMENDED ACTION I recommend that the City Council direct staff to draft the necessary amendments to adjust Section 2.2.1 (1)(d) of the BECSP to lower the level of review from the Planning Commission to the Zoning Administrator for all CUPs for alcohol service, and that staff concurrently clarify the entitlement process for retail markets as it relates to alcohol sales CUPs. 1045
