At that meeting, Council Members discussed the differences between the second and third blocks of Main Street, including the lower number of third block businesses using the outdoor space, and the lower level of support among affected third block businesses for extending the street closure. Ultimately, after substantive deliberation, the City Council directed staff to reopen the third block to vehicular traffic, extended the closure of the second block to February 28, 2021, and requested that the issue related to opening / closing the second block of Main Street be reagendized for consideration on February 16, 2021 (Attachment 1). The temporary closure of Main Street has resulted in robust discussions that warrants further study for informed discussions about future place making opportunities and better connection to the southern portion of the Downtown as defined in the Downtown Specific Plan. Financial Impact: There are no direct costs to the City if the City Council is to extend the temporary closure. If the closure does result in increased sales to the businesses then there would be a nominal positive, corresponding fiscal impact to the City's General Fund via sales tax revenue. Recommended Action: A) Authorize the City Manager to continue the temporary closure of the second block of Main Street to vehicular traffic to accommodate outdoor dining and retail in the public right-of-way through September 6, 2021; and, B) Authorize staff to engage an Urban Design Firm; and, C) Establish an Ad Hoc Downtown Urban Design Study Committee; and, D) Appoint the Mayor, Mayor Pro Tem, and a City Council Member to the Ad Hoc Committee. Alternative Action(s): Provide alternative direction. Analysis: Staff has confirmed that the BID maintains its request that the City Council extend the closure of the second block of Main Street through Labor Day. If approved, this extension would give merchants certainty that this additional outdoor space will remain available through the pandemic in this otherwise highly uncertain time. According to the BID, there is broad support among second block businesses and property owners for this extension. The City has been able to pilot the closure of the second block of Main Street during the pandemic. Anecdotal information has indicated positive sales for the second block businesses, particularly restauranteurs, due to the ability to add or increase outdoor dining opportunities. This inferred success has led to interest in further studying Main Street, particularly the second block, for future place making and outdoor dining opportunities. The addition of street side dining has added liveliness and interest to downtown and the ability to imagine an enhanced physical environment that could be even more inviting. Further, there has long been interest in enhancing the connectivity between the resorts, Pacific City, downtown and the pier. A concept was prepared for the City by RSM Design and was included with the City Council packet at the December 21 st meeting. This study particularly focused on the connection via Walnut. Further refinement of this concept, with additional study of potential PCH improvements, is necessary prior to being able to design and estimate costs for implementation. Staff has solicited proposals from three urban design firms. Staff is seeking direction from the City Council to move forward with a Downtown Urban Design Study. The scope of work includes: • An assessment of existing conditions and review of previous reports and studies • Potential streetscape configurations of Main Street • Downtown connectivity strategies • A feedback loop to provide input on Main Street configurations and connectivity strategies • A final refinement of two concept configurations and two strategies (based on feedback City of Huntington Beach Page 2 of 3 Printed on 2/10/2021 power,LegistarTM File #: 21-100 MEETING DATE: 2/16/2021 received) to be presented to the City Council. Staff requests that the City Council establish the Ad Hoc Downtown Urban Design Study Committee and appoint the Mayor, Mayor Pro Tem, and a member of the City Council to serve on the Ad Hoc Committee. This Ad Hoc Committee will also work to engage community representatives to assist with the overall assessment. It is envisioned that the Ad Hoc Committee will then participate with staff and the consultant in the feedback loop component of the above-described scope of work. Staff from Community Development, Public Works, and Community Services will provide technical support to the Ad Hoc Committee, with Community Development staff being the main liaison in coordinating meetings and managing the agreement with the Urban Design firm. At the conclusion of this effort, and within 4 months of execution of an agreement with an Urban Design firm, two Main Street streetscape configurations and two downtown connectivity strategies will be presented to the City Council for consideration. Staff will also provide an order of magnitude cost estimate to implement each concept. Should the City Council desire to move forward with possible implementation, staff will engage in a robust community engagement process that will include small group stakeholder meetings and a virtual open house to further refine and assist selection in final configurations and plans. Should the City Council desire to proceed with implementation, staff would then request approval to engage services for design documents and allocation of funds. At the time of such consideration, any necessary environmental analysis will be conducted. Environmental Status: The project is exempt pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15304(e) because the proposed project consists of a minor temporary use having negligible or no permanent effects on the environment. The proposed project would not have a negative effect on biologically sensitive resources, and there is no evidence of any unusual environmental circumstances that might give rise to a reasonable possibility that the project will have a significant effect on the environment. This issue of uncertainty, where businesses do not have a definitive end date of when temporary outdoor activity is to cease being allowed, was raised by the Economic Recovery Task Force. Task Force members argued that it is difficult to make significant investments when you don't have a certain, guaranteed amount of time to get a return on investment (ROI). Discussion occurred that the City Council could select an outside date, regardless of whether the pandemic is still occurring, to provide enough time and certainty to allow a ROI. This input was considered in staffs recommendation. During this last year as businesses have been so significantly impacted by pandemic restrictions, staff has begun exploring strategies to support downtown merchants in the long term after COVID- 19. For example, staff revisited the idea of improving wayfinding and the pedestrian experience between Main Street, Pacific City, and the hotels located on Pacific Coast Highway to increase pedestrian traffic among these businesses. A concept plan was prepared in August 2019, which is attached to this staff report to demonstrate some potential ideas (Attachment 2). Also, the temporary closure of the second and third blocks of Main Street has been well received by the community for the more family-friendly downtown dining experience it has created and a more favorable business City of Huntington Beach Page 2 of 3 Printed on 12/16/2020 2*were944 Legistar"^ File #: 20-2090 MEETING DATE: 12/21/2020 climate for restaurateurs, particularly those on the second block, which have indicated increased sales when comparing summer 2020 to summer 2019. The temperate climate of Huntington Beach and downtown's proximity to the Pacific Ocean make it an interesting area to study for year-round, permanent outdoor dining. Staff proposes engaging the services of an urban design firm to study alternatives for better pedestrian connectivity between downtown and the hotels/Pacific City, and a more permanent pedestrian and outdoor dining format for Main Street. Staff is also exploring the feasibility of forming a community benefit district for downtown property owners, which districts have proven to be highly successful in other communities, particularly for financing and maintaining physical improvements in business and tourism areas as well as promoting the districts offerings. Staff will report to the Council on the progress of each of these initiatives over the coming months. During the past few weeks, staff has met with the Downtown Business Improvement District (BID) to discuss the current situation as it relates to the second and third block closure of Main Street. Given the ongoing COVID-19 emergency and the continuing need for safe physical distancing, the BID has asked that the street closures currently in effect be maintained through Labor Day in 2021 (Attachment 1). The BID conducted a survey of downtown merchants and found overwhelming support for continuing the closure of the second block of Main Street. Survey results were mixed regarding the third block closure. Attachment 2 contains the BIDs survey findings. With the pending change in the make-up of the City Council come this December, staff is recommending at this time that the second and third blocks of Main Street remain closed to vehicular traffic through February 28, 2021. If approved, such a decision would allow merchants with the certainty that they can continue operating as is for the next few months, while also allowing time for the new City Council to transition into their roles and be part of the longer-term decision making process regarding the Main Street closure. It has been an extra-ordinary time for Downtown Huntington Beach, particularly the last 5 months and the closures of the 2"d and 3`d blocks of Main Street.Those closures are set to expire on Dec.31, 2020. Unfortunately, COVID restrictions have not changed since August, in fact they have worsened.in many neighboring counties, and Downtown has entered the slow season.The purpose of this ask is to present recently collected data and recommendations for possible courses of action. Situation Analysis 2"d Block Main Street:The businesses on the 2"d block are very consistent in their support for a continued closure which is reflected in their survey responses. BID Recommendation:The BID Board of Directors voted 8-0 in favor of recommending that the 2nd block of Main Street remain closed through Labor Day pending any major changes to COVID policies and restrictions. 3`d Block Main Street:The businesses continue to be divided in their view of the closure which is reflected in their survey responses. BID Recommendation:After an extended and in-depth discussion,the BID Board of Directors voted 8-0 in favor of recommending that the 3`d block of Main Street remain closed through Labor Day pending any major changes to COVID policies and restrictions. Public Survey:The BID distributed a survey to its consumer database in late October. The BID collected 429 responses and 190 comments. Public sentiment about the closures is overwhelmingly positive. However,the BID represents the business community, not the public at large. 1'Block Main Street Conversations: In conversation, property and business owners on the Vt block are inclined to let the businesses determine the best course of action for themselves.They understand that the closure has been very positive for some and quite negative for others.The 1'block did express concern about traffic planning and parking solutions should closures continue for an extended time. General Feedback: One of the issues brought up frequently in meetings this fall is the overall aesthetic of the closure.There is the opinion that this could (and should) be improved if closures continue with smart planning and investment. Nothing but positive things from our standpoint. It brings a better family feeling to downtown. If the city wants a shopping, dinning,walking village. This is a good time to change the image of Main Street. We should set design standards and approve these patios so they are on Main Street for good.Our food sales are above last year. Overall sales are down with limited hours. Without the patios we couldn't afford to open. With the approved opening for inside dinning from county supervisors office. Why Huntington Beach is enforcing a 10pm limit on the inside dinning since we are only allowed to have 25%seating and social distancing inside. This is not what is happening in other Orange County cities. it is hard for us to be competitive. Neighboring cities like Costa Mesa, Laguna, Fountain Valley are allowing inside dining for their businesses normal closing hours. Whatever your approved cup and liquor license says. At least four of them have not been open one time the entire summer. These can definitely be relocated to allow for more outside dining on that side of the street as well as using the fire zone. That way they have room for everyone including drive-through traffic. The kiosks are not a valid reason to close the 3rd block of Main Street to vehicular traffic. The photos are attached from my last email. Thank you Dear Council, Regarding agenda Item # 20. It is unreasonable to continue the vehicular street closure on the 3rd block at this time. Us merchants not in favor of this closure have complied for the past few months. We have tried EVERYTHING to give this a go and make it work for us. It does not. We desperately need our block open to vehicular traffic. As you know, the 3rd block is not a majority of restaurants like the 2nd block. We are retail and service with very few eateries. In fact, one of the eateries on the 3rd block who pushed for this closure is not even open at this time (Ale House). Nor have 80% of the Kiosks been open. I am requesting you open our block to traffic while allowing restaurant outdoor dining in the parking spaces and loading zone. That is fair to all of us on the 3rd block. This is being done on the 1 st block, 5th Street &Walnut Avenue as well as in most other downtown areas and is a success. Keeping in mind there is no actual outdoor dining allowed at this time and our street is still closed. Takeout would be doing much better if cars could get in to pick up food orders. This street closure has created a funnel of traffic into the 2nd block. We on the 3rd block are losing at all levels with this closure. When customers park in the 200 block parking garage the exit at the fountain, they look left to the ocean and look right to a barricade that looks like my block is off limits. It is a complete deterrent to walk up to the 3rd block. Also, please note the BID has not had a meeting with the 3rd block to follow up on how this closure is NOT working for many of us. At least four of them have not been open one time the entire summer. These can definitely be relocated to allow for more outside dining on that side of the street as well as using the fire zone. That way they have room for everyone including drive-through traffic. The kiosks are not a valid reason to close the 3rd block of Main Street to vehicular traffic. Please note the businesses on my side of the street have not been approached by the BID board of directors to discuss this situation. We oppose the current proposal to extend the Main Street Closures through Labor Day 2021 because it is premature and gives businesses on 2"d and 3`d Street an unfair competitive advantage over similar businesses nearby businesses. It will also cost the City money. 1. EXTENDING THE MAIN STREET CLOSURES IS PREMATURE AND GIVES BUSINESSES ON THE 2ND AND 3RD BLOCK AN UNFAIR COMPETITIVE ADVANTAGE AND DEPRIVES SIMILAR BUSINESSES NEARBY EQUAL PROTECTION AND TREATMENT BY THE CITY. a. The City is Arbitrarily Favoring Some Businesses over Others. All restaurants in Huntington Beach are under the same Covid restrictions as those on the 2"d and 3rd blocks. They all pay their assessed taxes and fees like they did before Covid. The City has arbitrarily decided to grant businesses on the 2"d and 3`d block a cost-free premises expansion,allowing them greater capacity. Meanwhile similar businesses just a block or two away are stuck with their same restricted footprint. The City is arbitrarily subsidizing favorable treatment of certain taxpayers over others based on no other factor than the block they happen to be on. Customers will undoubtedly opt for the less restricted restaurants on the 2"d and 3`d blocks over the more restricted restaurants nearby. This merely shifts the financial burden of the pandemic entirely onto the restricted restaurants for no other reason than their address. The BID acknowledges in its letter to the Council that"'the closure has been very positive for some and quite negative for others". It seems entirely inappropriate for the City to tip the scales in favor of some businesses at the expense of others and arbitrarily pick winners and losers. b. Blocking the 2"d and 3`d Blocks Unfairly Restricts Access to Other Main Street Businesses. Main Street is downtown Huntington Beach's primary thoroughfare for those visiting the area by car. Blocking the 2"d and 3`d blocks makes it unjustifiably inconvenient to get to the V block and PCH. As people encounter the blockade,they will be much less likely to find a way to meander around the side streets looking for a way to get to the 1"block or PCH,even though that might have been their intended destination. Page 1 of 2 318 Moreover,the time frame includes the already congested summer season along with several holidays and special events(St. Patrick's Day, Cinco de Mayo, Memorial Day, Fourth of July, US Open of Surfing, Labor Day, etc.). Huntington Beach is already congested during the summer and almost impassible on special event days. Blocking off the streets will only exacerbate the problem and will inconvenience both visitors and locals by forcing them into the side streets and neighborhoods even more than they already are. 2. AN EXTENSION THROUGH LABOR DAY IS PREMATURE AND UNFAIR. Although the Main Street Closures put our business at a competitive disadvantage and costs us money,we support the Council's recent decision to extend through February 28, 2021 and reassess then. However, it is premature to extend the closures through Labor Day. Covid restrictions and the pandemic are in constant flux with guidelines and restrictions loosening and tightening regularly. There are currently two vaccines approved by the FDA and others in the works. We don't know, but there is a possibility that everything will be back to normal long before Labor Day. There's no reason to make such a long-term commitment right now,especially when they are so favorable to some taxpayers and so detrimental to others. As previously indicated the Main Street Closure has been "quite negative for others [businesses]". To force those businesses that are suffering from the closures to continue to suffer after things have returned to normal is beyond unfair,it is cruel. 3. THE CITY WILL INCUR DIRECT FINANCIAL LOSS. Even if the businesses chip in,the City will incur significant costs in policing and maintaining the closed area. Moreover,the City owns the property next to the pier,which houses two restaurant tenants. In addition to their base rent obligations,those restaurants are required to pay percentage rent based on their sales. If customers choose to forgo these restaurants in favor of the less restricted businesses,the restaurant doesn't get those sales and the City doesn't get as much rent. While we are not opposed to the Main Street Closures through February 28, 2021,we believe that constantly changing restrictions,fundamental unfairness to other businesses,and the financial burden on the City all justify a more thoughtful and deliberate approach. While I do not object to discussion of this idea, I feel there has been a lack of outreach to residents of Huntington Beach on this matter. While Mr.Chi has hosted town halls to address businessmen's concerns,Mr. Chi has not hosted ones regarding residents' concerns. I recognize that the coronavirus pandemic limited the ability to have town halls,but would encourage a town hall to be held before considering this item. I feel that closing Main Street should not be done without figuring out an alternative solution for Surf City Nights. An alternative location should be found. I would suggest James Farquhar Park and Lake Park but am open to other potential sites. I am particularly concerned about this because the Huntington Beach Historic Resources Board,on which I serve, has had a booth at surf city nights for many years. The Independence Day Parade is another concern.Alternative routing will need to be considered for the parade. restaurateurs are not going to give up their outdoor dining income on Independence Day, especially since Independence Day does not have the same culinary connotations as thanksgiving or Christmas. Move parking structure toll booths back, allowing two 2 post-toll exit lanes, one leading to the new turnabouts (see "E." and "F." above) J. Equip toll both operators with PAS (Passive Alcohol Sensors, usually flashlights) and instruct them to release those with positive hits for alcohol or other substances only to the lane leading to the "staffed" turnabout. PREVENT UNHEALTHFUL TRANSIENT/YOUTH INTERACTIONS Example: K. Post a "white flag" behind the Main St. Fountain and offer periodic free transport of transients from the parking-structure side of the corridor to the new shelter every few hours until the shelter reaches capacity, at which point a "red flag" should be posted (instead of the "white flag"). I own Model Citizen and Dash of Sass, clothing boutiques on the 3rd block of Main st. First, I would like to thank you from the bottom of my heart for opening up the 3rd block to vehicular traffic. It has revived my business. I know that you hear a lot of different opinions about the street closures, please allow me a few moments to share my story with you. Model Citizen opened in May 2006. Unfortunately, Dash of Sass right before the pandemic hit in February of 2020. Of course, Covid hit everyone hard and you have to pivot and make adjustments to survive. Just as things were starting to come back, it was decided to close the 2nd and 3rd block so that restaurants could move out into the street. Pivot and make changes, it makes sense. My business immediately took a steep decline. Back in September, I wrote a letter to council stating that although it was not in the best interest of my business, I felt the street should be closed until indoor dining could resume. I built a patio and REALLY tried to make it work. I hosted fundraisers, pop-up shops, trunk shows, partnered with my neighbors. I participated in The Surf City Market Place in hopes of driving business to my stores. I can say I honestly tried to make the street closure work for my stores. My business improved immediately following the street opening. The street closure does not work the same for retail and restaurants. I can put clothing on a patio and pop up a portable fitting room, the bottom line is women want to shop the entire store. They do not want to try clothes on in the middle of Main st. It just doesn't work. I am a team player and want what is best for our community. I shouldn't have to continuously do that to the detriment of my own business. Please keep the street open.
