Adopt Resolution No. 2021-18 (Supplemental Fee Resolution 13), establishing Short-Term
Rental (STR) Permit Fees: adding a Code Enforcement Officer I and Code Enforcement Officer
II to the Table of Organization; and amending the City's Fiscal Year 20-21 Budget to the extent
necessary to accommodate such expenditures
Statement of Issue:
The City Council recently approved Ordinance No. 4224 establishing regulations, standards, and a
permitting process for Short-Term Rentals (STRs), which went into effect on February 19, 2021. In
order to implement these new processes, the City needs to establish permit application fees to offset
the costs of the program, including reviewing applications, issuing permits, and staffing to monitor
and enforce short-term rentals. Staff is seeking authorization to add two Code Enforcement Officers
to help perform these functions, and to amend the Fiscal Year 2020-21 Budget to incorporate STR-
related changes.
Financial Impact:
The anticipated revenue impact of adopting Short-Term Rental permit fees is:
• Initial Year: $210,000
• Future Years: $109,000
Revenues will offset the Costs of permit application review and processing. Actual revenues will vary
based on permit applications received. If regulation is required beyond the level assumed for typical
permit review and approval, staff may bill hourly for code enforcement regulatory efforts.
The fully-burdened rate of the two additional Code Enforcement Officers is approximately $232,000
per year. It is anticipated that the City will achieve full cost recovery between the permit fee, cost
recovery, and Transient Occupancy Tax revenues generated by the Short-Term Rental program.
Recommended Action:

expenditures.
Alternative Action(s):
Do not approve the recommended actions and direct staff accordingly.
Analysis:
On December 21 , 2020. the City Council adopted Ordinance No. 4224 establishing regulations,
standards, and a permitting process for Short-Term Rentals (STR) affecting residential districts
citywide. The Ordinance went into effect on February 19, 2021 .
The STR permit fees are intended to recover the full costs of typical staff time to review Short-Term
Rental Permit applications. Additionally, the costs of software and systems used to assist the City
with subscription, monitoring, and compliance of Short-Term Rentals are included in the cost of
service calculations. For Short-Term Rental properties that require code enforcement regulation
beyond the level assumed in the base permit fees, staff may use hourly billings for cost recovery
purposes.
Staff recommends that a fee of $589 for an initial application and $306 for an annual renewal. These
amounts are based on the time involved by the Planning Division and Code Enforcement Division in
implementing the Ordinance.
For purposes of comparison, staff surveyed other cities that impose a Short-Term Rental application
fee. Those fees are outlined in the table below:

The proposed fee of $589 for an initial permit and $306 for an annual renewal would be toward the
middle of STR fees by cities that assess a permit fee for short-term rentals.
Hourly billing rates for Code Enforcement are included for City Council consideration as part of
Agenda Item 21-17, and are intended to be adopted and incorporated into the City's Master Fee

Schedule. Staff may use hourly billings for cost recovery purposes for enforcement. For example, a
property owner may be operating a short-term rental without the requisite permit and code
enforcement will spend time enforcing the City's regulations. The only way to recoup costs
associated with those enforcement efforts will be to bill the offenders on the City's actual costs to
enforce.
When staff presented short-term rental regulations to City Council for consideration, the City Council
directed staff to ensure that adequate code enforcement resources are available to effectively
enforce the regulations. Staff is recommending that two additional code enforcement officers (Code
Officer I and Code Officer 11) will be sufficient to ensure adequate enforcement. The combined, fully-
burdened cost of two new officers is approximately $232.000 per year.
As previously presented at study sessions and when the short-term rental Ordinance was introduced,
by regulating short-term rentals, the City will receive Transient Occupancy Tax revenue. Between the
tax, permit fee, and cost recovery revenue, these two additional positions will cover 100% of the
costs of the two additional officers.
Environmental Status:
Not applicable as the action is not subject to the California Environmental Quality Act (CEQA) in that
pursuant to Section 15378(b)(4) of the CEQA Guidelines, the creation of government funding
mechanisms which do not involve any commitment to any specific project which may result in a
potentially significant physical impact on the environment, is not defined as a "project".

ESTABLISHING SHORT-TERM RENTAL PERMIT FEES BY AMENDNG RESOLUTION
2016-59, AS RESOLUTION 2016-59, AS AMENDED BY RESOLUTION NOS. 2017-
28,2017-44, 2017-46, 2018-01, 2018-29, 2018-48, 2018-55, 2019-07, 2019-19, 2020-37, AND
2021-17 WHICH ESTABLISHED A CONSOLIDATED COMPREHENSIVE CITYWIDE
MASTER FEE AND CHARGES SCHEDULE (SUPPLEMENTAL FEE RESOLUTION 13)
WHEREAS, the City Council adopted Resolution 2016-59 establishing the Consolidated
Comprehensive Citywide Master Fee and Charges Schedule (the "Fee and Charges Schedule");
and.
WHEREAS, the City Council temporarily amended the Fee and Charges Schedule
pursuant to Resolution No. 2017-46, and further amended the Schedule pursuant to Resolution
Nos. 2018-01, 2018-29, 2018-48, 2018-55, 2019-07, and 2019-18; and,
WHEREAS, user and regulatory fees are established by the City Council; and
WHEREAS. the Citv Council desires to add Short Term Rental Permit Fees to the Fee
and Charges Schedule; and
WHEREAS, the City Council finds that providing these services is of special benefit to
applicants both separate and apart from the general benefit to the public; and therefore, in the
interests of fairness to the general public,the City desires to better recover the costs of providing
these services from applicants who have sought or require the City's services by revising its
schedule of fees; and
WHEREAS, the City Council hereby finds that the study provides adequate evidence to
conclude that the revised fees do not exceed the cost to provide the services for which the fees
are charged; and
WHEREAS, the adopted fees shall be incorporated into the City's existing Consolidated
Citywide Master Fee and Charges Schedule. Incorporating these fees into the fee schedule will
allow for the fees to be considered with future comprehensive user and regulatory fee updates;
and
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
SECTION 1. Resolution No. 2016-59, as amended pursuant to Resolution Nos. 2017-
46, 2018-01, 2018-29, 2018-48, 2018-55, 2019-07, and 2019-18 is further amended by adopting
the Recommended Fees as set forth in attached in Exhibit A and incorporated by this reference;
which shall become effective March 2, 2021, and continue thereafter.

Dear City Council,
I encourage you to reconsider making the permit fees for short-term rentals in Sunset Beach and Huntington
Beach the same.
Short-term rental properties in Sunset Beach are under less restrictions and require less enforcement. Despite
that, I feel hosted STRs are better supervised with the owner onsite. A room rental generates less revenue per
night and causes a bigger economic impact and will take many nights to recoup the same permit fee rather than
a whole home rental that could recoup that fee in one night.
The proposed permitting fee is $589 for the first year, with a$306 annual renewal fee for both hosted and
unhosted is out of touch. In comparison, application fees are much lower in major cities like San Francisco
($450 for two years), Los Angeles($89), and Denver($50). High fees can be burdensome and inhibit the ability
to host for some, particularly now when many are struggling from the impacts of the ongoing pandemic.

Hello council members. Thank you for taking your time today to address this important issue. I
have always supported Huntington Beach requiring permitting for short term rentals. The proposal of
$589 for the first year and $306 annual is more than double the cost of any other known City I
researched in the United States. While I still support the permitting despite the high cost. Could the
council please address how it will enforce the permitting?Also please explain why these high costs are
being paid. What reassurances do the short term renters receive by following the rules?

1 encourage you to reconsider making the permit fees for short-term rentals in Sunset Beach and Huntington
Beach the same. We only rent it short term for a limited amount of time during summer so high fees would
make it very hard to pay every year. The money earned is very important as we can keep our property inside
and out in great condition. Otherwise it would be difficult to afford the upgrades from the wear and tear of
being on the beach from the wind and salt.

I'm a 30 year resident of downtown Huntington Beach. As an 80 year old widow I depend on the income from my
hosted short term rental. Because of Covid-19 this income has been nonexistent for nearly a year. I appreciate that the
city is finally going to legalize STRs. However, I think the proposed permit fees are exorbitant and very out-of-line with
those of other cities. You must be aware that fees in Los Angeles are $450 for two years, Los Angeles is $89, and Long
Beach is $250, To impose home hosted STRs fees at the same rate as whole house STRs in Sunset Beach is totally unfair.
Because we rent out a room in our houses at rates far less than whole house rentals, perhaps $80 a night as opposed to
$300 or more a night, consider how much longer we would need to recover these costs. Most of us renting out a
bedroom in our houses would not be doing so if it weren't financially necessary. Please consider also that the city has
probably never received complaints about home hosted STRs therefore costing the city nothing. I urge the Council to
consider a much lower separate fee for home hosted STRs.

I'm writing to comment on Agenda Item #15 Short Term Rental permit fees.
I'm a 30 year resident of downtown Huntington Beach. As an 80 year old widow I depend on the income from my home
hosted STR. Because of COVID-19 this has been nonexistent for nearly a year. While I appreciate that the city is taking
steps to make STRs legal, I think the proposed permit fees are exorbitant. I'm sure the Council is aware that the fees in
San Francisco are $450 for two years, Los Angeles is$89, Long Beach is $250, and Denver is$50, 1 also think that having
the same fee for home hosted STRs as that of whole house STRs is grossly unfair. Most of us who rent out a bedroom in
our houses depend on that income. There's a big difference in rental of about $80 a night for a room in a home hosted
STIR as opposed to $300 or more for a whole house rental. It would take home hosts a great deal longer to recoup the
permit fees. The city probably never gets complaints about home hosted as opposed to whole house STRs and therefore
we cost the city nothing! I urge the Council to do the ethical thing and adopt a considerably lower permit fee for home
hosted short term rentals.

I encourage you to reconsider making the permit fees for short-term rentals in Sunset Beach and Huntington
Beach the same. If you were to charge such a high amount 1 would want accountability of where the money is
going. Such as improvements to the beach area and bathrooms that are hideous. No excuse for not having
lavatories in the bathroom especially by the playground on 9th street or not fixing the noted out hand railings
that are a public safety to children and anyone riding a bike in the pathways. South Bay has very nice bathrooms
and there handrails are maintained why can't HB do a better job of this?? I would want quarterly reports on
wfiere this money is being spent. Sidewalks are also a public safety issue with all of the cracks and dips. Put this
money to good use and not some pet project of someone on the council.

1 have met many families vacationing here at the beach, and I have found them to be wonderful guests. They are

our local business's that are in dire needs.
I ask that you re-examine the strict and costly decisions regarding STR's in HB, and move to reduce ongoing
fees and the creation of program whereby all STR's are viewed in the same way.
