SUBJECT: APPEALING SCAG DETERMINATION
On Monday, March 151h,the City Attorney brought to City Council in Closed Session a question about whether
the City should appeal the February 16, 2021, SCAG determination of 13,368 RHNA to the City of Huntington
Beach for its Sixth Planning Cycle. This matter was agendized for public notice. At that March 1S`h Closed
Session the City Council took a pass on taking action and did not vote to authorize the City Attorney to
continue to fight SCAG's 13,368 RHNA determination by filing a challenge in State Court. The City Council's
"no action" on this opportunity to appeal is inconsistent with prior City Council direction, and inconsistent
with the will of the Huntington Beach community. I am bringing this H Item to authorize and direct the City
Attorney to continue appealing this determination, including initiating a lawsuit in State Court.
This March 2021 RHNA determination for Huntington Beach came after many prior events in the SCAG RHNA
timeline and after many opportunities that this City Council took to weigh in on the SCAG RHNA development.
On November 7, 2019, SCAG voted 64-1 to adopt its new RHNA plan to approve a modified methodology for
distributing a state-mandated 1.34 million housing units in the six-county region over an eight-year period —
tripling the state's housing goal for the 2020's. This news generated a lot of community outcry and the City
Council at that time directed Planning staff to return to Council every month with a SCAG RHNA update so
that the developments could be closely monitored. Around the time of the SCAG news in 2019, most of the
Council Members expressed their dismay at such a high RHNA determination, including making statements
that "we need to fight this." At every open Council Meeting and Closed Session opportunity where
challenging this RHNA determination (i.e., 13,386) was present, the City Council sided with challenging the
determination and voted where necessary to direct staff and the City Attorney to fight SCAG, including
pursuing appeals, which the City Attorney did.
For some reason, when this March 15" opportunity was presented in a Closed Session, the City Council
decided to take no action to appeal. This was not right; it was a missed opportunity, and was inconsistent
with Council's repeated direction and the community's input over the past year. Since there is still time to
appeal, and since I want to weigh in on this decision, I bring this H Item requesting that the City Council direct
the City Attorney to appeal SCAG's February 2021 RHNA determination of 13,386, including initiating a
lawsuit in State Court.
RECOMMENDED ACTION
That the City Council direct the City Attorney to appeal SCAG's February 2021 RHNA determination of 13,386,
including with authorization from City Council to initiate a lawsuit on behalf of the City in State Court.

here the more of those services will be needed in our city As well as take a look at what happened during the last year
with COVID in the many cities that have packed in the people of their cities It took a toll on those places and showed that
packing people in like sardines is a TERRIBLE thing when a pandemic hits Let's see the city fight the outrageous

Ms. Mayor and City Council Members,
Please register my strong support for item #19 on the agenda.
The good people of Huntington Beach have been fighting this egregious ruling for years and we do not want to
stop now. We are fully aware of the housing needs in our community and want to retain local control over
future growth. There is absolutely no logical or rational reason that a community should not have control over
their own planning and building issues.
High Density Development is not right for HB. We do not have the necessary infrastructure to support the
additional units the state is trying to mandate us to build. Additionally, it is a fact that current high density
building has caused rental rates to skyrocket. This is not what we want for our community!
I implore you to move forward in supporting your constituents in their efforts to appeal the SCAG
determination.

Honorable Mayor and Distinguished City Council Members:
The rush to build apartments, condos, and other HDD does not consider
the financial burden placed upon the HB Citizen taxpayers.
Outside interests and Sacramento politicians want to dictate what they
think is a solution that does not reflect what the HB Citizens want. Where
is the transparency and justification for their demands.
HB has a major infrastructure problem that needs to be corrected, but is
now a non action item. How are we going to support 13,000 apartment
units that are "intended" for low income residents. Everyone knows the
initial low income residents will be squeezed out after the first year as
there is no legal enforcement for this "Low Income Housing
Development" that will serve 52,000 new residents and 26,000 cars.
HB already suffers from HDD running wild as all you have to do is go
down Edinger from Beach to Golden West. In fact, if you want to have a
nice fish dinner at the Fish House, there is no place to park. So why
bother to "come on down." COSTCO HB is a mess when it comes to
parking, thus a loss of Sales Tax Revenue as many travel to COSTCO
Fountain Valley where there is plenty of free parking and no congestion.

What is the occupancy of the Mall as now the builder owner wants to
build dedicated apartments and professional services in the Burlington
Coat Factory space. Loss of Sales Tax Revenue.
Rubber stamping approval for "Low Income Development" is not the
answer until we, the HB Citizen Taxpayers, see a mapping where these
apartments/ HDD will be built and what neighborhoods will be exempt as
that is a form of Discrimination.

and signed by our then Mayor, Mayor Pro Tern and City Attorney The letter shines the spotlight on the 1 Ith
hour backroom shenanigans employed by the cities of Riverside and Los Angeles, and joined in by the city of
San Bernardino, in connection with the November 7, 2019 Regional Council meeting,as a result of which our
RHNA went from 3,612 units to a whopping 13,300(while the numbers for those three cities were reduced
substantially)!! For us, that's an increase of some 370°/u!!
Phraseology used in the letter included:
• Illegal and blatantly unfair
• This violates the law both procedurally and substantively
•No proper or adequate notice
• Legally unsupported methodology
•Not clearly part of the advance agenda
• Blatant disregard of controlling parliamentary rules
•Our Mayor Pro Tem's request to speak was categorically denied
• A blatant denial of our City to participate in the SCAG RHNA process
• An illegal vote
• The methodology for RENA determination has been flawed and wrought by political manipulation
• Not based on objective, verifiable real-world empirical data
•There is no rational [RHNA] methodology at all
•The RHNAs are nothing more than arbitrary and capricious assignments

• The RHNA formulas provide unbridled discretion

Hello Huntington Beach City Council —
I strongly oppose Agenda Item #19, and I sincerely hope the "political theater" it was written to inspire
is kept to a minimum. In my mind, this item doesn't deserve further debate. Our city council
addressed the same topic just over a month ago, and I strongly urge the balance of the Council to
see this item for what it is and move on.
If Council Member Peterson wished to constructively engage on how best to meet our 6th Housing
Cycle RHNA allotment challenges, I'm all ears. I welcome discussions and debates about all forms of
housing, city land use, municipal zoning, and development standards. Each of these topics can and
should be discussed with vision and nuance focused on shaping Huntington Beach to ensure our
community's vibrant future.
But that's not what this agenda item was ever about.
Sadly, this is little more than a petty political temper tantrum and a public airing of a grievance. I can
only hope that someday Council Member Peterson will become interested in expressing an
affirmative vision with constructive intent instead of wasting everyone's time crafting cheap political
stunts like this one.

I agree with these points below and add that it is already difficult to enjoy the city I've lived in most of my life.
I was a graduate of Edison High School in 1985 and have loved my city enough to sacrifice much to afford to
raise my family here. Both my sons attended Edison as well.
The congestion makes it challenging to get down PCH or even enjoy our pier. Our infrastructure is not going to
accommodate the multiple families living in the space one used to live within. PCH and Beach Blvd are not
going to get any wider. We have previously spoken on this matter, and demand the city council be accountable
to continue the fight to execute the will of the residents who live in Huntington Beach, and who want to
preserve it's quality of life.
What ever it takes to stop the subversion of the will of the people of HB by the State must be employed by our
elected officials. You are accountable to no one else but us.

I am writing to urge your support of Agenda Item #19 As many of you know, this is an issue I have
been following and battling for nearly a decade in order to preserve and protect a very precious and
rare quality of life. HB is one of the few and last remaining "Suburban Beach Communities" and is a
treasure that must be protected for the 200.000 residents who have invested their lives (some for
multiple generations), in our community
I wish to point out some critical elements to this decision. but first and foremost I must dispel a
narrative that has been conjured up by those that will profit wildly (Building Association) from foisting
massive HDD on our community. The illegal SCAG RHNA number of 13,386 WILL NOT. I repeat
WILL NOT solve the so-called affordable housing issue While a very small number of the 13.386
will be designated Section 8 and low income housing.. which will result in a multi-year "wait list" for
this housing. the residual effect of more HDD will catastrophically add to the problem already started
by the existing HDD THE EXISTING HDD CAUSED A MASSIVE INCREASE IN RENTAL RATES
that has already caused hardship to thousands of renters in HB I know this because I have walked
countless neighborhoods and have spoken to both landlords and renters The landlords across HB
enjoyed a large and rapid spike in their rates as soon as the inventory of HDD came on line at rates
never experienced in HBI! The same story happened in L A . Santa Monica. Irvine. Anaheim and no
doubt every city where HDD invaded the landscape
Most important in this decision is the BASIS ON WHICH THIS NUMBER WAS INVENTED. For those
that are new to council, it is imperative that you read the SCAG documents and listen to the
comments by Mayor Lyn Semeta when it was uncovered that these numbers were issued in a
fraudulent and illegal "backroom deal" struck between SCAG officials from Los Angeles and Riverside
counties.

We sit at traffic lights two and three times. The gas stations have fender henders and near misses constantly.
The density here is exploding, as more and more of these "luxury"
Apartments go up. They are no more luxury than the old gray Soviet mass housing units.
1 heard the state is mandating these units. STOP them!

More high density housing will continue to change, and not in a good way, the feel of the city. Many of the
residents have come to Huntington Beach in part because of the classic California beach
town vibe. The town has already lost much of that feeling.

I am writing to urge your support of Agenda Item #19 As many of you know. I have been outspoken
about quality of life issues in SEHB. and I believe that this recent mandate regarding overbuilding
from the State deserves to be challenged HB is one of the few and last remaining "Suburban Beach
Communities' and is a treasure that must be protected for the 200,000 residents who have invested
their lives (some for multiple generations), in our community.
I wish to point out some critical elements to this decision, but first and foremost I must dispel a
narrative that has been conjured up by those that will profit wildly (Building Association) from foisting
massive HDD on our community The illegal SCAG RHNA number of 13,386 WILL NOT. I repeat
WILL NOT solve the so-called affordable housing issue. While a very small number of the 13,386
will be designated Section 8 and low income housing.. which will result in a multi-year "wait list" for
this housing, the residual effect of more HDD will catastrophically add to the problem already started
by the existing HDD THE EXISTING HDD CAUSED A MASSIVE INCREASE IN RENTAL RATES
that has already caused hardship to thousands of renters in HB The landlords across HB enjoyed a
large and rapid spike in their rates as soon as the inventory of HDD came on line at rates never
experienced in HB!! The same story happened in L A. Santa Monica. Irvine. Anaheim and no doubt
every city where HDD invaded the landscape.
Most important in this decision is the BASIS ON WHICH THIS NUMBER WAS INVENTED For those
that are new to council. it is imperative that you read the SCAG documents and listen to the
comments by Mayor Lyn Semeta when it was uncovered that these numbers were issued in a
fraudulent and illegal "backroom deaf' struck between SCAG officials from Los Angeles and Riverside
counties.

attorney to fight the addition of new units on our behalf. HB is losing appeal to us as residents as well as friends who

The Kennedy Commission (the Commission) is a broad based coalition of residents and community
organizations that advocates for the production of homes affordable for families eaming less than
$27,000 annually in Orange County. Formed in 2001,the Commission has been successful in

housing units, of which 5.848 are required to be lower-income units. In 2012 the City was allocated
1.353 units. We understand the City's position in evaluating RHNA, but we are asking that the City
focus its efforts and resources in addressing the dire affordable housing needs that have been
ignored in Huntington Beach.
According to Huntington Beach's Housing Element, 60%of all lower-income owner households
and 73%of all lower-income renter households in the City were overpaying(>30% income) for
housing. The incidence of severe overpayment(>50%income on housing)overall was 17% for all
owners and 21%percent for all renters. The last Housing Element also pointed out that the Oak
View neighborhood in central Huntington Beach evidenced the highest levels of overcrowding, with
38% .1
The City has not addressed housing development in a balanced and equitable manner. To date, the
City has built 97,or 18%, of the 533 low and very low-income units required.2 In comparison,the
City exceeded its above moderate RHNA requirement by constructing 2,701 units or 472%of the
above moderate RHNA requirement of 572 units. In addition to the current deficit in housing for
lower-income households, the City will have to plan for the allocation of new units affordable to
lower-income housing households(regardless of a potential change in an appeal). We urge the City
of Huntington Beach to prioritize its efforts on meeting the sole remaining housing needs of
low-income households and focus on the development of affordable housing opportunities for
lower-income in the development of its Housing Element.

I support the effort by councilmember Peterson to consider any and all legal appeals to SCAG's 13,000-plus
RHNA determination for the latest cycle.
1 am unclear as to why the City is accepting what appears to be an outrageous number of planned new
residential units, well in excess of what appears to be any reasonable estimate of population growth, and based
on flawed theories that cities and regions with high housing costs can build themselves out of a limited
supply/high cost situation. Reality has proven such theories to be false. Land costs and other economic factors
make housing expensive in coastal California. Building more market rate housing(with some low-income units)
does nothing to make housing for most lower-income folks more affordable. Significant public housing and/or
rent control can control costs, but the RHNA process ignores these options.
1 remain puzzled why the City has not challenged the RHNA numbers. In November 2019. City manager Oliver
Chi and other leaders expressed shock that Huntington Beach's proposed future housing allocation went from an
estimated 3,600 as first recommended by SCAG staff, to more than 13,000 units under what City leaders then
suggested was a last-minute backroom deal between the city of Riverside and Los Angeles.
"The mayor of Riverside [and] the mayor of L.A., met, [and] they cut a deal, and ultimately that deal meant
coastal communities [were] being negatively impacted," said HB city manager Oliver Chi during the Nov. 18,
2019 city council meeting.

Dear Mayor Carr and City Council,
1 attended the March 15 city council meeting via Zoom and heard the report from our City
Attorney's office the results of the closed session meeting prior to that meeting regarding
item #19 on tonight's agenda. The report indicated a unanimous vote of the 6 council
members in attendance to not pursue an appeal with the State of California regarding the
Housing Element - 6th Cycle Regional Housing Needs Assessment (RHNA) . It seemed to
me that the city council believed that we had exhausted the appeals process and to move
on and accept the RHNA allocation assigned to the city. In pursuing a lawsuit with the
State of California I would like to know the risk factors and likely outcomes of such an
action.
Tonight's agenda item #19 is an opportunity for city council members to explain and
further clarify to residents the process that all California cities will go through this year to
produce their 6th Planning Cycle Housing Element. We also need to understand the
variables behind the specific numbers assigned to the city.
We know that we do not have adequate housing to meet the needs of our residents. The
lack of adequate housing leads to health issues, overcrowding in our neighborhoods,
inadequate parking. We need to find creative solutions to meet the demand for housing
and ways in which people can build wealth through home ownership. This process in
planning for the next 8 years of housing needs is an opportunity for residents to weigh in
with their needs and ideas for meeting this demand.

I am writing to urge your support of Agenda Item
# 19. As many of you know, this is an issue I have
been following and battling for nearly a decade in
order to preserve and protect a very precious and rare
quality of life. HB is one of the few and last
remaining "Suburban Beach Communities" and is a
treasure that must be protected for the 200,000
residents who have invested their lives (some for
multiple generations), in our community.
I wish to point out some critical elements to this
decision, but first and foremost I must dispel a
narrative that has been conjured up by those that will
profit wildly (Building Association) from foisting
massive HDD on our community. The illegal SCAG
RHNA number of 13,386 WILL NOT, I repeat WILL
NOT solve the so-called affordable housing
issue. While a very small number of the 13,386 will
be designated Section 8 and low income
housing. . . .which will result in a multi-year "wait list"
for this housing, the residual effect of more HDD will
catastrophically add to the problem already started by
the existing HDD. THE EXISTING HDD CAUSED

A MASSIVE INCREASE IN RENTAL RATES that
has already caused hardship to thousands of renters in
HB . I know this because I have walked countless
neighborhoods and have spoken to both landlords and
renters. The landlords across HB enjoyed a large
and rapid spike in their rates as soon as the inventory
of HDD came on line at rates never experienced in
HB ! ! The same story happened in L.A., Santa
Monica, Irvine, Anaheim and no doubt every city
where HDD invaded the landscape.
Most important in this decision is the BASIS ON
WHICH THIS NUMBER WAS INVENTED. For
those that are new to council, it is imperative that you
read the SCAG documents and listen to the
comments by Mayor Lyn Semeta when it was
uncovered that these numbers were issued in a
fraudulent and illegal "backroom deal " struck
between SCAG officials from Los Angeles and
