We recommend that the City Council vote to direct the City Manager to agendize at our next City
Council meeting an analysis of the Settlement Agreement reached in the case Moore/Field v. City of
Huntington Beach & Michael Gates, to include a full accounting of all costs incurred in the case.

SUBJECT: CONSIDER AGENDIZING A REVIEW OF THE SETTLEMENT AGREEMENT REACHED
IN THE MOORE/FIELD v. HUNTINGTON BEACH& MICHAEL GATES
Given that direct City costs and insurance related settlement payments in the case Moore/Field
v. City of Huntington Beach & Michael Gates have totaled approximately $4 million, we believe
that the City Council and public deserve a full and transparent accounting of the facts involved in
this matter. Fiscal responsibility and transparency are paramount to maintaining the public trust,
especially when such significant amounts of public dollars are expended.
As the settlement agreement is a public record, we are requesting that the City Council vote to
have a public open session discussion about this matter at our next City Council meeting. Further,
as part of that discussion, we would like to specifically direct that staff provide the City Council
and the public with an overview of all costs incurred and associated with the case, Moore/Field
v. City of Huntington Beach & Michael Gates.
RECOMMENDED ACTION
We recommend that the City Council vote to direct the City Manager to agendize at our next City
Council meeting an analysis of the settlement agreement reached in the case Moore /Field v.
City of Huntington Beach & Michael Gates, to include a full accounting of all costs incurred in the
case.

Council,
I wanted to write in and ask that agenda item 21 be removed. For those of us that have been watching city
council over the years this is concerning. Ever since this new council started there have been agenda items that
have been more to big development and take the voice of the residents away. This agenda item is wrong. Dan
Kalmick is the worst and let me tell you all why. Dan K. along with Kim.Kramer his fellow board member of
the Huntington Beach Public Art Alliance hired a video crew during a DRB meeting in which I was
there. Meanwhile the people that showed up to speak thought why is this being recorded by the city. Come to
find out it was them that hired the video crew. They used that video to contact several residents who spoke up.
Several residents have reported that Dan and Kramer contacted them telling them lies about my wife and our
property and now 4 in a half years later we are still fighting the harassment. Mr. Posey was mayor at the time.
My wife and a couple of others went to get help from Mr. Posey and they got a clip board thrown at them. My
wife also went to new council member Kim Carr at the time. So now we have her talking about str, and how
they are bad and how people are converting their garages. Most of you are aware if this and most of you have
done nothing to help. My wife stopped a 2.4 million dollar pay day because she told the truth. Dan K. Tried to
launder money from the public using HBPAA for brick sales by H.S. seniors(not council approved) That
money would he donated to HBPAA then given to the Chamber pac at the time and rerouted to council
members Kalmick. Posey knew, Carr knew, and others knew. True story.They all wanted to dip their hands in
the campaign fund cookie jar. As you can see, I don't believe anything this council does to be for the people
items like this should be removed from the agenda. This is another example of the mistrust I have with this
city. We need a elected city attorney and not a appointed one.

HB City Council Members,
Please be aware that many residents of Huntington Beach are not happy with the shenanigans that are clearly
going on within our City Council. I am not well versed in city politics, but even I can see there is definitely
something shady going on when the council approves an expenditure to process a lawsuit, claims they were
"left in the dark" after discussing the case at least 10 times in closed session, submits an agenda item to
review the case just long enough for the favored OC Register reporter, Susan Goulding, to write a hit piece
about it and then pulls the item from the agenda.
We are sick and tired of the dirty, backroom colluding that is going on with this city council. Residents have
been very clear in voicing our desire for transparency.
Please stop working AGAINST the people that put you into office. Stop working on your own personal agendas
and start working on the issues that the voters want you to work on. Namely, public safety and infrastructure.
If you can't think of anything to work on, may I draw your attention to the homeless woman that last week
exposed her genitals and tried to smear her feces on a resident that was out walking with his two small
children? I don't know about you, but THAT is a problem I'd like to see addressed.
Additionally, your campaign to oust City Attorney Michael Gates has been seen and heard loud and clear. Mr.
Gates has done and continues to do an outstanding job for HB. The voters stand behind him completely. So,
please focus your energies elsewhere. Mr. Gates is doing just fine.

Michael Gates has done a great job for the City of Huntington Beach. I understand that the city council's stance is to take
the elected position away and make it an appointed position. This is a grave mistake and opens up the gateway for the
council to pick and choose who will be the city's attorney, instead of the will of the people being governed. It should be
the peoples choice, not a political decision. I also feel that some of you do not like Michael Gates and have made this
personal.
