/J AMENDMENT NO. 1 TO AGREEMENT BETWEEN THE CITY OF HUNTINGTON BEACH AND NANCY K. BOHL, INC. dba THE COUNSELING TEAM INTERNATIONAL FOR PSYCHOLOGICAL COUNSELING AND PEER SUPPORT TRAINING SERVICES THIS AMENDMENT is made and entered into by and between the CITY OF HUNTINGTON BEACH, a California municipal corporation,hereinafter referred to as "City,"NANCY K. BOHL, INC. dba COUNSELING TEAM INTERNATIONAL, hereinafter referred to as "Consultant." WHEREAS, City and Consultant are parties to that certain agreement, dated June 1, 2021, entitled"Professional Services Contract Between the City of Huntington Beach and Nancy K. Bohl, Inc., dba The Counseling Team International for Psychological Counseling and Peer Support Training Services" which agreement shall hereinafter be referred to as the "Original Agreement"; and City and Consultant wish to amend the Original Agreement to increase the amount of compensation to be paid to Consultant and to extend the term, NOW, THEREFORE, it is agreed by City and Consultant as follows: 1. ADDITIONAL COMPENSATION In consideration of the services to be performed under the Original Agreement, City agrees to pay Consultant at the rates specified in Exhibit B which is attached hereto and incorporated by reference into this Agreement. City further agrees to pay Consultant an additional sum not to exceed Thirty Thousand Dollars ($30,000.00). The additional sum shall be added to the original sum of Sixty Six Thousand Dollars ($66,000.00), for a new contract amount not to exceed Ninety Six Thousand Dollars ($96,000.00). 24-14639/340816 1 2. TERM The term of the Agreement is extended for one additional year until May 31, 2025. 3. REAFFIRMATION Except as specifically modified herein, all other terms and conditions for the Original Agreement shall remain in full force and effect. BOHL. INC. dba THE COUNSELING TEAM INTERNATIONAL FOR PSYCHOLOGICAL COUNSELING AND PEER SUPPORT TRAINING SERVICES TF-IIS AGREEMENT ("Agreement") is made and entered into by and between the City of fiuntington Beach. a municipal corporation of the State of California, hereinafter referred to as "CITY." and, a Nancy K. Bohl, Inc. dba Counseling "ream International hereinafter referred to as "CONSULTANT." WHEREAS. CITY desires to engage the services of a consultant to provide psychological counseling and peer support training services; and Pursuant to documentation on file in the office of the City Clerk, the provisions of the Huntington Beach Municipal Code, Chapter 3.03, relating to procurement of professional service contracts have been complied with; and CONSULTANT has been selected to perform these services, NOW. THEREFORE, it is agreed by CITY and CONSULTANT as follows: I. SCOPE OF SERVICES CONSULTANT shall provide all services as described in Exhibit "A," which is attached hereto and incorporated into this Agreement by this reference. These services shall sometimes hereinafter be referred to as the "PROJECT." CONSULTANT hereby designates Julie Koot who shalt represent it and be its sole contact and agent in all consultations with CITY during the performance of this Agreement. 21-9639G5.1312 1 of I3 2. CITY STAFF ASSISTANCE CITY shall assign a staff coordinator to work directly with CONSULTANT in the performance of this Agreement. 3. TERM• TIME OF PERFORMANCE Time is of three essence of this Agreement. The services of CONSULTANT are to commence on)iftV`, 2041 (the "Commencement Date"). This Agreement shall automatically terminate three (3) years from the Commencement Date, unless extended or sooner terminated as provided herein. All tasks specified in Exhibit "A" shall be completed no later than one year from the Commencement Date. The time for performance of the tasks identified in Exhibit "A" are generally to be shown in Exhibit "A." This schedule may be amended to benefit the PROJECT if mutually agreed to in writing by CITY and CONSULTANT. In the event the Commencement Date precedes the Effective Date, CONSULTANT shall be bound by all terms and conditions as provided herein. 4. COMPENSATION In consideration of the performance of the services described herein, CITY agrees to pay CONSULTANT on a time and materials basis at the rates specified in Exhibit "B," which is attached hereto and incorporated by reference into this Agreement, a fee, including all costs and expenses, not to exceed Sixty-Six Dollars ($66,000). 5. EXTRA WORK In the event CITY requires additional services not included in Exhibit "A" or changes in the scope of services described in Exhibit "A," CONSULTANT will undertake such work only after receiving written authorization from CITY. Additional 21.9639254312 2 of 13 compensation for such extra work shall be allowed only if the prior written approval of CITY is obtained. 6. METHOD OIT PAYMENT CONSULTANT shall be paid pursuant to the terms of Exhibit "13." 7. DISPOSITION OF PLANS. ESTIMATES AND OTHER DOCUMENTS CONSULTANT agrees that title to all materials prepared hereunder, including, without limitation; all original drawings, designs, reports, both field and office notices. calculations, computer code, language, data or programs, maps, memoranda, letters and other documents, shall belong to CITY, and CONSULTANT shall turn these materials over to CITY upon expiration or termination of this Agreement or upon PROJECT completion, whichever shall occur first. These materials may be used by CITY as it sees fit. 8. 1-I01-D HARMLESS A. CONSULTANT hereby agrees to protect. defend, indemnify and hold harmless CITY, its officers, elected or appointed officials, employees, agents and volunteers from and against any and all claims, damages, losses, expenses, judgments, demands and defense costs (including, without limitation, costs and fees of litigation of every nature or liability of any kind or nature) arising out of or in connection with CONSULTANT's (or CONSULTANT's subcontractors, if any) negligent (or alleged negligent) performance of this Agreement or its failure to comply with any of its obligations contained in this Agreement by CONSULTANT, its officers, agents or employees except such loss or damage which was caused by the sole negligence or willful misconduct of CITY. CONSULTANT will conduct all defense at its sole cost and expense and CITY shall approve selection of CONSULTANT's counsel. This indemnity shall :1-9619/2 54312 3 of 13 apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as limitation upon the amount of indemnification to be provided by CONSULTANT. B. To the extent that CONSULTANT performs "Design Professional Services" within the meaning of Civil Code Section 2782.8. then the following Hold Harmless provision applies in place of subsection A above: -CONSULTANT hereby agrees to protect. defend, indemnify and hold harmless CITY and its of7icers. elected or appointed officials, employees. agents and volunteers, from and against any and all claims, damages, losses, expenses. demands and defense costs (including, without limitation, costs and fees of litigation of every nature or liability of any kind or nature) to the extent that the claims against CONSULTANT arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of- CONSULTANT. In no event shall the cost to defend charged to CONSULTANT exceed CONSULTANT's proportionate percentage of fault. However. notwithstanding the previous sentence, in the event one or more other defendants to the claims and/or litigation is unable to pay its share of defense costs due to bankruptcy or dissolution of the business, CONSULTANT shall meet and confer with CiTY and other defendants regarding unpaid defense costs. The duty to indemnify. including the duty and the cost to defend, is limited as provided in California Civil Code Section 2782.8. C. Regardless of whether subparagraph A or 13 applies, CITY shall be reimbursed by CONSULTANT for all costs and attorney's fees incurred by CiTY in enforcing this obligation. This indemnity shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by CONSULTANT. 21-9639f'54312 4 of 13 9. PROFESSIONAL LIABILITY INSURANCE CONSULTANT shall obtain and furnish to CITY a professional liability insurance policy covering the work performed by it hereunder. This policy shall provide coverage for CONSULTANT's professional liability in an amount not less than One Million Dollars ($1.000,000.00) per occurrence and in the aggregate. The above- mentioned insurance shall not contain a self-insured retention without the express written consent of CITY: however an insurance policy "deductible" of Ten Thousand Dollars (S10.000.00) or less is permitted. A claims-made policy shall be acceptable it' thepolicy further provides that: A. The policy retroactive date coincides with or precedes the initiation of the scope of work (including subsequent policies purchased as renewals or replacements). B. CONSULTANT shall notify CITY of circumstances or incidents that might give rise to future claims. CONSULTANT will make every effort to maintain similar insurance during the required extended period of coverage following PROJECT completion. If insurance is terminated for any reason. CONSULTANT agrees to purchase an extended reporting provision of at least two (2) years to report claims arising from work performed in connection with this Agreement. If CONSULTANT fails or refuses to produce or maintain the insurance required by this section or fails or refuses to furnish the CITY with required proof that insurance has been procured and is in force and paid for, the CITY shall have the right, at the CII-Y's election, to forthwith terminate this Agreement. Such termination shall not 21-9639253312 5 of I J effect Consultant's right to be paid for its time and materials expended prior to notification of termination. CONSULTANT waives the right to receive compensation and agrees to indemnify the CITY for any work performed prior to approval of insurance by the CITY. 10. CERTIFICATE OF INSURANCE Prior to commencing performance of the work hereunder, CONSULTANT shall furnish to CITY a certificate of insurance subject to approval of the City Attorney evidencing the foregoing insurance coverage as required by this Agreement; the certificate shall: A. provide the name and policy number of each carrier and policy; B. state that the policy is currently in force; and C. shall promise that such policy shall not be suspended, voided or canceled by either party, reduced in coverage or in limits except after thirty (30) days' prior written notice: however, ten (10) days' prior written notice in the event of cancellation for nonpayment of premium. CONSULTANT shall maintain the foregoing insurance coverage in force until the work under this Agreement is fully completed and accepted by CITY. The requirement for carrying the foregoing insurance coverage shall not derogate from CONSULTANTS defense, hold harmless and indemnification obligations as set forth in this Agreement. CITY or its representative shall at all times have the right to demand the original or a copy of the policy of insurance. CONSULTANT shall pay, in a prompt and timely manner. the premiums on the insurance hercinabove required. 2 1-9 6 3 912>J312 6 of 13 I I. INDEPENDENT CONTRACTOR CONSULTANT is, and shall be, acting at all times in the performance of' this Agreement as an independent contractor herein and not as an employee of CITY. CONSULTANT shall secure at its own cost and expense. and be responsible for any and all payment of all taxes. social security, state disability insurance compensation, unemployment compensation and other payroll deductions for CONSULTANT and its officers, agents and employees and all business licenses, if any, in connection with the PROJECT and/or the services to be performed hereunder. 12. TERMINATION OF AGREEMENT All work required hereunder shall be performed in a good and workmanlike manner. CITY may terminate CONSUL fANT's services hereunder at any time with or without cause. and whether or not the PROJECT is fully complete. Any termination of this Agreement by CITY shall be made in writing, notice of which shall be delivered to CONSULTANT as provided herein. In the event of termination. all finished and unfinished documents. exhibits, report. and evidence shall, at the option of CITY, become its property and shall be promptly delivered to it by CONSULTANT. 13. ASSIGNMENT AND DELEGATION 'I-his Agreement is a personal service contract and the work hereunder shall not be assigned, delegated or subcontracted by CONSULTANT to any other person or entity without the prior express written consent of CITY. If an assignment. delegation or subcontract is approved. all approved assignees, delegates and subconsultants must satisfv the insurance requirements as set forth in Sections 9 and 10 hereinabove. 21-9639n5.1312 7 of 13 14. COPYRIGHTS/PATENTS CITY shall own all rights to any patent or copyright on any work, item or material produced as a result of this Agreement. 15. CITY EMPLOYEES AND OFFICIALS CONSULTANT shall employ no CITY official nor any regular CITY employee in the work performed pursuant to this Agreement. No officer or employee of CITY shall have any financial interest in this Agreement in violation of the applicable provisions of the California Government Code. 16, NOTICES Any notices. certificates, or other communications hereunder shall be given either by personal delivery to CONSULTANf's agent (as designated in Section I hereinabove) or to CITY as the situation shall warrant. or by enclosing the same in a sealed envelope, postage prepaid, and depositing the same in the United States Postal Service, to the addresses specified below. CITY and CONSULTANT may designate different addresses to which subsequent notices, certificates or other communications will be sent by notifying the other party via personal delivery. a reputable overnight carrier or U. CONSENT When CITY's consent/approval is required under this Agreement, its consent/approval for one transaction or event shall not be deemed to be a consent/approval to any subsequent occurrence of the same or any other transaction or event. 18. MODIFICATION No waiver or modification of any language in this Agreement shall be valid unless in writing and duly executed by both parties. 19. SECTION FIEADINGS Elie titles, captions, section, paragraph and subject headings, and descriptive phrases at the beginning of the various sections in this Agreement are merely descriptive and are included solely for convenience of' referenceonly and are not representative of matters included or excluded from such provisions, and do not interpret, define, limit or describe, or construe the intent of'theparties or affect the construction or interpretation of any provision of this Agreement. 20. INTERPRETATION OF THIS AGREEMENT The language of all parts of this Agreement shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any of the parties. If any provision of this Agreement is held by an arbitrator or court of competent jurisdiction to be unenforceable, void, illegal or invalid, such holding shall not invalidate or affect the remaining covenants and provisions of- this Agreement. No covenant or provision shall be deemed dependent upon any other unless so expressly provided here. As used in this Agreement, the masculine or neuter gender and singular or plural number shall be deemed to include the other whenever the context so indicates or requires. Nothing contained herein shall be construed so as to require the commission of any act 21-9639n54312 9 of 13 contrary to law. and wherever there is any conflict between any provision contained herein and any present or Future statute, law, ordinance or regulation contrary to which the parties have no right to contract, then the latter shall prevail, and the provision of this Agreement which is hcrcbv affected shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law. 21. DUPLICATE, ORIGINAL The original of' this Agreement and one or more copies hereto have been prepared and signed in counterparts as duplicate originals, each of which so executed shall. irrespective of the date of its execution and deliver\,, be deemed an original. Each duplicate original shall be deemed an original instrument as against any party who has signed it. 22. INIMIGRATION CONSULTANT shall be responsible for full compliance with the immigration and naturalization laws of the United States and shall, in particular, comply with the provisions of the United States Code regarding employment verification. 23. LEGAL SERVICES SUBCONTRACTING PROHIBITED CONSULTANT and CITY agree that CITY is not liable for payment of any subcontractor work involving legal services, and that such legal services are expressly outside the scope of services contemplated hereunder. CONSULTANT understands that pursuant to Hunnngtrm Beach Call, Charter Section 309. the City Attorney is the exclusive legal counsel for CITY; and CITY shall not be liable for payment of any legal services expenses incurred by CONSULTANT. 21-9639P54312 10 of 13 24. ATTORNEWS FEES In the event suit is brought by either party to construe, interpret and/or enforce the terms and/or provisions of this Agreement or to secure the performance hereof. each party shall bear its own attorneys fees. such that the prevailing party shall not be entitled to recover its attorneys fees from the nonpreyailing part\. 25. SURVIVAL Terms and conditions of this Agreement, which by their sense and contest survive the expiration or termination of this Agreement, shall so survive. 26. GOVERNING LAW This Agreement shall be governed and construed in accordance with the laws of the State of California. 27. STATEMENT OF WORK: (Narrative ol'work to be performed) Consultant shall provide psychological counseling and peer support training services for sworn and non-sworn personnel. B. CONSULTANT'S DUTIES AND RESPONSIBILITIES: 1. The CONSULTANT shall provide short-tern counseling services to employees and their family members living at home. Short-term counseling will be determined by the mental health professional on a case- by-case basis. If it is determined that the issues require long-term treatment, i.e., acute or chronic emotional disorders, etc., then the mental health professional can refer accordingly. 2. The CONSULTANT shall provide training for the management and supervisory teams related to the program. These team members will receive short training sessions on how the program works, and how they can relate to the program and support it. 3. The CONSULTANT shall provide initial orientation training to all employees related to the program. This will give the employee an opportunity to find out about the program. 4. the CONSULTANT shall maintain the confidentiality of all employees and their eligible family members living at home referred for counseling. The cornerstone of every successful employee support services program is the pledge of confidentiality. Employees will not reveal their personal problems if there are no clear guidelines about confidentiality. Confidentiality means all personal information provided to the CONSULTANT will be respected and safeguarded. Such information may be used only in a responsible manner for the purpose of helping in rehabilitating that person. The CONSULTANT shall keep employee personal records secured in accordance with the Professional Code of Ethics, Federal Regulations and State Laws. 5. The CONSULTANT shall make themselves available for psychological counseling services %with Fire Department staff in a convenient and timely manner. 6. The CONSULTANT shall provide psychological counseling services related to critical incidents and high stress events. 7. The CONSULTANT shall provide training programs to Fire Department employees and develop curricula in stress management, resilience building, and other psychological topics. 8. The CONSULTANT shall provide basic and advanced peer support training for staff selected as peer supporters by the Fire Department. 9. The CONSULTANT shall provide basic critical incident stress management training. 1 10. The CONSULTANT shall provide psychological testing and screening of public safety applicants. 11 . The CONSULTANT shall maintain all appropriate professional licenses and certifications. METHODOLOGY 1. Short-term Counseling TCll's professional short-term counseling services are designed to help the City of Huntington Beach Fire Department employees with professional assistance in a confidential environment. TCI-I is committed to the health and well-being of the City of Huntington Beach Fire Department employees. TCfI recognizes that personal problems are a normal part of living and that many public safety employees may be aff'ected by personal difficulties during the course of their career. TCITs Mental Health Professionals (MI-113s) are experienced in providing "Behavioral Health and Wellness Services" to public safety employees. 'rCTI vii-irs will deliver confidential in- person or telehealth short-term, solution focused assessment and counseling sessions for the Huntington Beach Fire Department employees and their family members who are experiencing life problems of any kind. TCI-I has Telehealth services available. MI-11's can provide counseling services to their clients from a distance using videoconferencing. It is CONFIDENTIAL in the same way that face-to- face sessions are, while using our online telehealth portal. The Behavioral Health and Wellness Services will provide counseling for problems related, but not limited to: stress, family, work, grief, alcohol R drug abuse, marriage R divorce, depression, parent- child relationships. child/spouse abuse, aging. eldercare, eating disorders. financial and credit problems, gambling, conflict resolution. serious iltness/death of a family member, and mental health issues. TUITs professional staff will be available to provide counseling services in a convenient and timely manner. Appointments can be made by calling 800-222-9691 between the hours of 8:00 am - Noon and 1:00 pm - 4:30 pm Monday through Friday. TCII offers new appointments that are non-urgent within five (5) business days. 2. Confidentiality TCfI records are kept secure in accordance with our professional code of ethics, Federal Regulations and state laws. All records are locked in filing cabinets. We also have top of the line security alarm systems installed, which protects our records. TCfI will not reveal the names or identities of employees or family members who come to the program voluntarily unless a written release form is signed by the client. This release will need to state specific information a client is willing to have released and what specific person or entity can receive that information. Psvchological Services Related to Critical Incidents (Fligh stress events) TCTI believes critical incidents can be effectively handled and under control when the lollowing steps are put in place for the Huntington Beach Fire Department (HBFD). • Effectively manage and cope with stress relating to any situation that may be considered a critical incident • Provide through on-scene support. demobilizations, crisis management briefings (CMB), defusing, psychological first aid and debriefings. • Provide peer support, chaplains and TC11 clinicians to assist with effective critical incident stress management. (The Helping Triad) Descriptions of Critical Incident Stress Management (CISf\9) Services: One-on-One: One-on-one assessments allows the I IBFD employee to feel comfortable discussing what they have just experienced or witnessed while in a confidential setting. In the event one-on-one assessments are not necessary, other methods to assist HBFD personnel may be required. Critical Incident Stress Defusings: Defusing is a small group discussion tollowing the critical incident. which typically takes place within 8 to 12 hours of the event. It includes a three-phase structure and the duration is usually less than one hour. The group is typically a hornogeneous group that consists of'persons directly impacted by the event. The goal of a defusing is to normalize reactions and lower the group's tension. set expectations, provide information, discuss coping methods and identify those individuals who may need additional support. Defusing helps to accelerate the recovery process and identify the need for debriefings and other services. There are three phases, which include the following steps: The Introduction Phase is designed to introduce the team, lay out guidelines and lower anxiety about the process. The Exploration Phase allows a brief discussion of the experience and a brief story of the event. The Inlornation Phase is designed to provide information. normalize, teach, provide guidance, and summarize key points. Critical Incident Stress Debriefing: Critical Incident Stress Debriefings are structured in small groups and must follow the crisis intervention process developed by Jeffery Mitchell, Ph.D. of the International Critical Incident Stress Foundation (ICISF). The function of this process is to build the group's resistance to traumatic stressors through an active and supportive process. Critical Incident Stress Debriefings focus on the group's ability to bounce back from a traumatic incident by emphasizing group cohesion, group performance and the ability of the group to recover and resume its normal functions. Critical Incident Stress Debriefings are not a l'orm of psychotherapy, nor is it a substitute for psychotherapy, professional counseling, treatment of Posttraumatic Stress Disorder (PTSD), or any other mental or physical disease or disorder. Is it also used to identify those who might be in need of additional support and in some case referral for professional psychotherapy. Critical Incident Stress Debriefings are best applied 5 between 24 and 72 hours after a traumatic event. In some cases. such as a disaster in which the individuals exposed have continuous exposure to the event over time. the Critical Incident Stress Debriefing may not be provided until several weeks have passed. TCTI's MI-IPs will consider the psychological readiness of the group for the debriefing process in order to avoid any negative or adverse reactions. A Critical Incident Stress Debriefing may last between I to 3 hours. depending on the number of people in the group and the nature of the event. More intense events may generate stronger emotional reactions, which may make it more difficult for individuals to express their feelings. Psychological First Aid: Psychological First Aid really means nothing more complicated than assisting people with emotional distress whether it results from physical injury, disease or excessive stress. It is walkina around and checking on those impacted by using crisis intervention skills- TCfI provides Stand-by-Status, by being available 24 hours a day. 7 days a week, 365 days of the year for calls that require immediate attention. "rurrs stafTcan be reached by calling I- 300-222- 9691. During business hours. calls will be answered by a member of our clerical stafT who has been trained in crisis intervention. The clerical staff will assure that a qualified MI-IP will respond to the department; as requested. All after-hour calls will be automatically transferred to TCTI's answering service, which will connect you to the on-call MI-IP. If the answering service is unable to connect you to the MI-IP the caller will be assured that a MI-IP will return the call within 15 minutes and will render the services that are requested by the department. Those services may be one of the following i.e., one-on-one, defusings, debriefings , demobilizations, Crisis Management Briefings, Psychological First .Aid and phone consultation. 6. Training Programs. TCTI's training will help decrease the day-to-day stress of I-IBFD. It can also counter-check the emotional strain of critical incidents, as well as prevent the accumulation of frustration. anger, and helplessness, which could lead to. substance abuse, depression, domestic violence, and suicide. TCTI will provide the curricula in stress management. resilience building and other psychological topics. Stress Management for Firefighters ']'his class is designed to help firefighters Understand the effects stress can have on their psychological and physiological well-being. They will learn about the stages of stress and some of the external factors that can trigger stress responses. Overall, firefighters will learn about the symptoms associated with stress and ways to effectively cope with stressful situations. Resiliency "I-his class will help participants understand the importance of resiliency in their lives, both personal and professional. This class will help participants understand the different types and methods of resilient behavior and will inform them of the components of having a resilient 6 personality in order to face life's challenges with a strong and positive sense of well-being. Rest Information Transition Services (RITS) after large-scale traumatic incidents. small group defusings and the group intervention known as Critical Incident Stress Debriefing (CISD). The Basic CISM course specifically prepares participants to provide several of these interventions, specifically RITS, defusings and the CiSD. The need for appropriate follow-up services and referrals when necessary is also described. Considerable evidence Gathered to date strongly supports the multi-component crisis intervention strategy. which is discussed in this course. Psychological Testing • nd Screenin TCTI's psychological testing and screening are conducted by one of TCTs Clinical Psychologists who are involved in the objective test assessment of the screening procedure. They are well versed through training and experience, in the construct and interpretation of Psychological testing instruments and have already completed the required continuing professional education requirement of six (6) hours and complete twelve (12) hours of POST approved CPL every two years based on their biennial license renewal cycle. The followinc tests are included in our screening process. The Minnesota Multiphasic Personality Inventory-2 (M\1111-2)7 the most widely used and accepted psychological test in the United States today. The California Psychological Inventory (CPI) or The Sixteen Personality Factor "rest (16PF), a short form I.Q., which is the Wonderlic Personnel Test and a Sentence Completion Test, is used to give insight into the applicant's personality. To schedule an appointment, the FIBI-D will call the Psychological Testing Coordinator at (800) 222-9691. The Psychological Testing Coordinator will set up the written testing date. The written portion is conducted at TCrI Monday thru Friday at 8:30 am. If 1-IBFD requests a group larger than 20 applicants, TCTI will come to FIBI-D to administer the written portion of the examination. The applicant will need to allow four to six hours for the written test. During the 10 written test. the Psychological Testing Coordinator will schedule the oral interview with the applicant not to exceed 5-working days following the written testing. The oral interview will last. at the minimum. 45 minutes with one of our Clinical Psychologists. The applicant will need to come dressed in business attire for this interview. In some cases. HBFD may request that a same day oral interview appointment be made, which TCTI will be able to accommodate. During the COVID-19 pandemic TCTI has virtual appointments available one day a week for the written and oral interview. After the testing is electronically scored, the applicant is interviewed using background material provided by the FIBI D and his/her test results. History being the best predictor of future behavior, evaluee's relationships: social, familial and vocational are explored. After integrating the test data and clinical interview data, the doctor prepares a written summary of findings and interpretations. The summary will state clearly the evidence, if any. of Psychopathology suggested by the test battery and corroborated by the clinical interview and will mention the job-related impact of such findings. The test results are summarized in a brief report that supports a final score, Psychologically Suitable - Score 3.0 or Psychologically Unsuitable - Score 2.0. The Clinical Psychologists will be available to the department to answer any questions related to the report or applicants testing TCfI's professional staff will be available to provide counseling services in a convenient and timely manner. Appointments can be made by calling 800-222-9691 between the hours of 8:00 am to 12:00 pm and 1 :00 pm to 4:30 pm Monday through Friday. TCTI also has a 24-hour answering service and will provide telephonic counseling if necessary. 10. Professional Licenses and Certifications TC-rl is in accordance with all state laws and federal regulations. -TCTI adheres to the requirements set forth by the California Board of Behavioral Sciences (BBS), the California Board of Psychology (BOP) and the California Department of Consumer Affairs. 11 EXHIBIT "B" Payment Schedule (Hourly Payment) A. Hourly Rate CONSULTANT'S fees for such services shall be based upon the following hourly rate and cost schedule: See Attached B. Travel. Charges for time during travel are not reimbursable C. Billing 1. All billing shall be done monthly in fifteen (15) minute increments and matched to an appropriate breakdown of the time that was taken to perform that work and who performed it. 2. Each month's bill should include a total to date. That total should provide, at a glance, the total fees and costs incurred to date for the project. J. A copy of memoranda, letters, reports, calculations and other documentation prepared by CONSULTANT may be required to be submitted to CITY to demonstrate progress toward completion of tasks. In the event CITY rejects or has comments on any such product, CITY shall identify specific requirements for satisfactory completion. 4. CONSULTANT shall submit to CITY an invoice for each monthly payment due. Such invoice shall: A) Reference this Agreement; B) Describe the services performed; C) Show the total amount of the payment due; D) Include a certification by a principal member of CONSULTANT's firm that the work has been performed in accordance with the provisions of this Agreement; and E) For all payments include an estimate of the percentage of work completed. Upon submission of any such invoice, if CITY is satisfied that CONSULTANT is making satisfactory progress toward completion of tasks in accordance with this Agreement, CITY shall approve the invoice, in which event payment shall be made within thirty (30) days of receipt of the invoice by CITY. Such approval shall not be unreasonably withheld. If CITY does not approve an invoice, CITY shall notify CONSULTANT in writing of the reasons for non-approval and the schedule of performance set forth in Exhibit "A" may at the option of CITY be suspended until the parties agree that past performance by CONSULTANT is in, or has been Surfnet Exhibit B hourly 1 brought into compliance, or until this Agreement has expired or is terminated as provided herein. 5. Any billings for extra work or additional services authorized in advance and in writing by CITY shall be invoiced separately to CITY. Such invoice shalt contain all of the information required above, and in addition shall list the hours expended and hourly rate charged for such time. Such invoices shall be approved by CITY if the work performed is in accordance with the extra work or additional services requested, and if CITY is satisfied that the statement of hours worked and costs incurred is accurate. Such approval shall not be unreasonably withheld. Any dispute between the parties concerning payment of such an invoice shall be treated as separate and apart from the ongoing performance of the remainder of this Agreement.
