Reject Bids for the Peck and Springdale Facility Improvements Project CC-1590
Statement of Issue:
On April 20. 2021 , bids were opened for the Peck and Springdale Facilities Improvements Project CC
1590. Staff recommends that all bids be rejected, since there was an error in the project
specifications. which was not identified until after bids were opened
Financial Impact:
Funds totaling $400,000 were budgeted in the current fiscal year in the Water Master Plan Account
No 50791005 82100 The recommended action will preserve funds in the Account.
Recommended Action:
Reject all bids for the Peck and Springdale Facility Improvements Project CC-1590.
Alternative Action(s):
Do not reject bids at this time and direct staff accordingly.
Analysis:
The Peck and Springdale Facility contains two potable water reservoirs. Peck Reservoir and
Springdale Reservoir. which provide 47% of the City s water storage capacity Additionally, the
Facility contains three potable water wells, Well No 4. Well No. 7, and Well No. 13, which provide
31% of the City's well field capacity.
The Peck and Springdale Facilities Improvements Project CC 1590 is the first phase of a two phase
improvement to the Facility's site security. The projects goals include augmenting security fence
systems and installing conduit throughout the site The conduit will be used for the installation of
electronic site security in the second phase of the project.
The Engineer's Estimate for this project was $320,000. Bids for the Peck and Springdale Facility
project CC1590 were opened on April 20. 2021 , and are listed in ascending order

The low bidder, A2Z Construct, Inc., withdrew their bid, due to a clerical error. One bidder submitted
their bid late and was prohibited from bidding. In a post-bid analysis of the project, bidders identified
the specification of aluminum conduit as an additional and unnecessary expense within the bid.
Aluminum conduit is more expensive than galvanized steel conduit. The project Engineer has since
revised the project specifications to accept galvanized steel conduit. The use of the less expensive,
galvanized steel conduit, will not compromise the integrity of the project, and will likely produce a
more favorable bid outcome.
Public Works Staff recommends rejecting all bids, with the intention of re-bidding the project. This
strategy provides an opportunity for more companies to submit bids on this project, and to receive
bids that incorporate the use of galvanized steel conduit.
Environmental Status:
This project is categorically exempt pursuant to the California Environmental Quality Act, Section
15303.c.

Good afternoon Donna,
Just wanted to keep you in the loop. Our low bidder from yesterday morning's bid opening for the Peck and Springdale
Facility Improvements project, A2Z Construct Inc, withdrew their bid (see attached). Since our other bid that made it in
time was nearly double our estimate, we've rejected all bids. We've had a chat with the bidders and are discussing some
changes to the plans and specifications internally and are planning on re-advertising soon. I will forward a new section A
for advertisement when that occurs. Thank you for all your help!

The following clarifications, revisions, replacements, additions, and/or deletions shall be made a
part of the above-referenced contract documents.
1. Several concerns voiced over the size of the poles called out to be installed for micromesh.
Various potential bidders indicated heavier poles / larger gauge should be used as micromesh
is heavier. City of Huntington Beach to discuss with the designer and will issue an addendum if
needed.
a. PACE Response: Please see the attached revised plans and specs. To increase the
ability of the site security fence to meet the applicable loads, the bid plans have been
revised to include larger and thicker end/corner, intermediate, and line fence posts.
2. Clarification was requested on site regarding removals — See Construction Notes 22, 23, 24,
and 25 on Sheet C 1.0/DWG 3 of 13.
a. PACE Response: The intent is the existing wrought iron fence along the western and
southern edge of the site shall be protected in place as the fence is located beyond the
current property line. In these locations a new 10'tall chain link fence will be installed
within the property in the same fence line as the existing electrical security fence to be
removed.
Existing pilaster columns associated with the western and southern wrought iron fence
shall be protected in place. The intent behind constriction note 24 is to clarify that the
pilaster column where the eastern and southern wrought iron fence meet needs to be
protected in place.
3. A question was asked regarding whether there were approved micromesh fencing
manufacturers specified. City and Designer to review specifications to confirm. If there are not
already specified manufacturers, it is likely the intent of the design to freely allow whichever
products meet the specifications.
a. PACE Response: The intent behind Specification Section 02821 is the required site
fencing material is common and not specific to set manufacturers. Therefore, the
Contractor can submit any fence fabricator as long as their provided system can meet
the requirements of the bid documents in the opinion of the City and Engineer(PACE).
4. City will confirm whether existing fence footings will be removed, this is likely already in the
specification.
a. PACE Response: As noted on sheet C2.0, the existing electrical security fence posts
to be removed shall be saw cut (angle grinded) down to be Rush with the finished
grade. The interior of the fence posts shall be filled with grout and abandoned in place.
In other words, the existing concrete footings for the existing electrical security fence
posts shall be abandoned in place.
5. Bid Schedule Sheet C-2.1 has been revised and re-issued with the following changes:
a. Bid Schedule Sheet C-2.1, "Additives Alternative Unit Bid Price Item (City Controlled
Bid Item Separate form Total Bid Amount)" has been deleted.
b. Bid Schedule Sheet C-2.1 "Unit Bid Price Item IN WORDS:" has been deleted.
6. Sheet C-2.0 Note 1 has been revised:

Project Description:

2. Installation of a new site perimeter fence in accordance with the Contract Documents

The contract shall allow the Contractor 40 working days to complete the contract. Two Notices to

The engineer's estimate of probable construction cost for the work included in the basis of award
is SJ20.000.

TO THE HONORABLE MAYOR AND MEMBERS OF THE COUNCIL OF
HUNTINGTON BEACH:
In compliance with the Notice Inviting Sealed Bids, the undersigned hereby proposes and agrees
to perform all the work therein described, and to furnish all labor, material,equipment and incident
insurance necessary therefor, in accordance with the plans and specifications on file in the office
of the City Engineer of the City of Huntington Beach. The undersigned agrees to perform the
work therein to the satisfaction of and under the supervision of the City Engineer of the City of
Huntington Beach, and to enter into a contract at the following prices. The undersigned agrees to
complete the work within 40 working days, starting from the date of the Notice to Proceed with
Work after materials are procured.
BIDDER declares that this proposal is based upon careful examination of the work site, plans,
specifications, Instructions to Bidders and all other contract documents. If this proposal is
accepted for award, BIDDER agrees to enter into a contract with AGENCY at the unit and/or lump

a contract in the manner and time prescribed will result in forfeiture to AGENCY of the guaranty

BIDDER understands that a bid is required for the entire work, that the estimated quantities set
forth in the Bid Schedule are solely for the purpose of comparing bids and that final compensation
under the contract will be based upon the actual quantities of work satisfactorily completed. THE
AGENCY RESERVES THE RIGHT TO DELETE ANY ITEM FROM THE CONTRACT. It is
agreed that the unit and/or lump sum prices bid include all appurtenant expenses, taxes, royalties,
fees, etc., and will be guaranteed for a period of sixty days from the bid opening date. If at such
time the contract is not awarded, the AGENCY will reject all bids and will readvertise the project.
In the case of discrepancies in the amounts bid, unit prices shall govern over extended amounts,
and words shall govern over figures.

The undersigned hereby promises and agrees that in the performance of the work specified in the
contract,known as the Peck and Springdale Facility Improvements,(I)(we)(it)will employ and
utilize only qualified persons, as hereinafter defined, to work in proximity to any electrical
secondary or transmission facilities. The term "Qualified Person" is defined in Title 8, California
Administrative Code, Section 2700, as follows:
"Qualified Person: A person who, by reason of experience or instruction, is familiar with the
operation to be performed and the hazards involved."

with all applicable electrical utility company's requirements, Public Utility Commission orders,
