That decision built on the March 4, 2020, determination of Governor Gavin Newsom to declare a State of Emergency as part of California's response to the pandemic. At the time, the determination was necessary in order to streamline decision making processes, protect the health and safety of the community, and position Huntington Beach to access Federal and State funding as part of our local response to the COVID-19 emergency. After more than a year of pandemic induced restrictions, on June 15, Governor Newsom ended its COVID-19 Blueprint for a Safer Economy, which in effect fully reopened the California economy. Today, all business sectors, save for large-scale special events, have been allowed to return to normal business operations. Given our current situation, I am requesting that the City Council vote to direct the City Manager to prepare the documents necessary to terminate Huntington Beach's current COVID-19 local emergency declaration. According to the California Emergency Services Act (ESA) Section 8558-b: a state of emergency can only be called if the threat overwhelms the current resources of the state. Furthermore, the state of emergency has to be terminated at the earliest possible date. Section 8558 (b) "State of emergency" means the duly proclaimed existence of conditions of disaster or of extreme peril to the safety of persons and property within the state caused by such conditions as air pollution, fire, flood, storm, epidemic, riot, drought, sudden and severe energy shortage, plant or animal infestation or disease, the Governor's warning of an California Emergency Services Act 4 California Governor's Office of Emergency Services earthquake or volcanic prediction, or an earthquake, or other conditions, other than conditions resulting from a labor controversy or conditions causing a "state of war emergency, " which, by reason of their magnitude, are or are likely to be beyond the control of the services, personnel, equipment, and facilities of any single county, city and county, or city and require the combined forces of a mutual aid region or regions to combat. Huntington Beach clearly does not meet this criteria. Therefore the state of emergency is invalid and unlawful. Therefore, the state of emergency should have been terminated many months ago according to California law, which states, "at the earliest possible date that conditions warrant." I'm concerned that this declaration is still in place when the state has officially opened up and there are no upticks in cases and the Delta variant, though contagious, is no worse than the flu. Many are vaccinated and the idea of continuing a state of emergency in our city doesn't make sense. When will this emergency declaration be terminated? Please consider doing this immediately as it is necessary for all residents to return to normal, knowing our city follows common sense guidelines.
