Subject:
Filling an unscheduled vacancy on the City Council
Statement of Issue:
On June 1 , 2021 . Mayor Pro Tem Jacob 'Tito" Ortiz abandoned and resigned his City Council seat.
Pursuant to Section 312 of the Huntington Beach Charter, unscheduled vacancies on the City
Council are to be filled by an appointment of the City Council within 60 days Further, the Charter
stipulates that if the City Council fails to fill the vacancy within that specified timeframe, a special
election must then be held to fill the vacated role.
Financial Impact:
There is no fiscal impact associated with appointing a candidate to fill the current vacant City Council
seat However, if the City Council fails to reach consensus on an individual to appoint to the
abandoned City Council seat, the subsequent Special Election will cost an estimated $885K - $1 M.
Recommended Action:
Select a candidate for appointment to the vacated City Council seat.
Alternative Action(s):
Provide direction to hold a Special Election to fill the vacant City Council seat
Analysis:
A Special Meeting of the City Council was held on June 10, 2021 to consider the vacancy. at which
time the City Council directed that an appointment process be coordinated to include an application
period, introductory interviews with eligible applicants, and a final deliberation to identify an individual
to fill the vacant City Council seat.
Pursuant to that direction, applications were accepted from June 11, 2021 , through June 18, 2021
Subsequently, a Special City Council Meeting was held on July 9 - 10, 2021 , for the introductory
candidate interviews. During the overall assessment process, applications received were as follows:

• 190 applications were received prior to the close of the application process on June 18, 2021.
• 131 applicants accepted an interview time slot with the City Council on either July 9 - 10,
2021 .
• A total of 105 applicants participated in the introductory interviews that were held July 9 - 10,
2021 .
On July 10, as part of the Special City Council meeting, the appointment process was further defined
to include the following parameters:
• A Special City Council meeting would be held on July 19, 2021, at which time the City Council
would deliberate and attempt to identify an applicant to fill the vacant City Council seat.
• To facilitate the assessment process, each City Council member will be able to initially
nominate up to 3 candidates for consideration of appointment to the vacated role.
• Once the finalist candidates are identified by the City Council, a process consisting of
selection rounds will be engaged in an attempt to identify an individual for appointment to the
vacant seat.
o During each assessment round, Council Members would identify their top candidate for
filling the vacancy.
o After each round, the candidate that receives the least amount of support would be
removed for consideration during the future rounds.
o The assessment process would be continued until one candidate receives support of at
least 4 Council Members.
o Ultimately, if no candidate received support from a majority of the City Council by the
July 30, 2021 deadline, then a special election would then be required.

City Council Options Moving Ahead
• Pursuant to Charter Section 312, the City Council is required to
attempt to fill the current vacancy by appointment
—The City Council has until July 31 to appoint an individual to fill the vacant seat
• If the City Council is unsuccessful in filling the vacancy by appointment
by July 31, a Special Election will have to be called
—Based on current election cycles, the Special Election would be held on November
2, 2021
City Council Appointment Process — Next Steps
• Continued City Council assessment of candidates
—Until the City Council meets next, members can continue their assessment of
current candidates
• Joint City Council deliberation either at a Special Meeting or at our
July 20 meeting
—The City Council should decide if we meet next via a Special Meeting, or if we take
this issue up at our next regularly scheduled meeting on July 20
• Identification of a candidate selection framework
—The City Council should also determine a framework through which the formal
selection process will be coordinated for when we meet next

Possible Candidate Selection Framework — Use of Selection Rounds
• Staff has been assessing various city council vacancy appointment
processes, and there are numerous options that can be considered
—In many instances, the process used to make a final selection involves individual
council members nominating their preferred candidate, and then attempting to
garner support for that selection from council colleagues
—This is the process that we have used previously in HB when filling a vacancy on
the City Council
• However, given the unprecedented number of candidates who have
applied to fill the vacancy that currently exists, an alternate selection
process exists which staff believes warrants considerations
—This alternate process for consideration involves the use of selection rounds to
focus and advance the decision making process

Round 1
• In the first round, each member of the City Council would identify
their top candidate for filling the existing vacancy
—In this way, we would narrow the existing pool of candidates from our current
listing of 131 final applicants down to no more than 6 finalists

Round 2
• In the second round, the City Council would only consider the finalists
identified in Round 1, and each City Council member would then
select their top candidate from that narrowed listing
—After that selection process, the finalist candidate that receives the least amount
of support in Round 2 would be dropped from further consideration

Round 3
• In the third round, only the finalist candidates who are moved forward
in Round 2 would be considered by the City Council
—Out of this grouping, each City Council member would identify their preferred
candidate, and again, the individual who receives the least amount of support
would be dropped from further consideration
• Additional (or fewer) rounds would be coordinated using this same
process, until one candidate receives support from at least 4 members
of the City Council
—Ultimately, if no candidate receives support from a majority of the City Council by
our July 31 deadline, we would then have to coordinate a special election

Special Election Details
• If the City Council is unable to reach consensus on a candidate to fill
our current vacancy by July 31, the City Charter directs that a special
election must be coordinated
• Under such a scenario, the Special Election would be held on
November 2, 2021
—Resolutions calling for the Special Election would have to be adopted no later than
August 6, 2021
—The Orange County Registrar of Voters has informed the City that the Special
Election would cost Huntington Beach $88SK - $1M

Good Evening City Council,
I wanted to extend my praise to Sam Jreisat. I believe and assure that he would be a phenomenal additional to City
Council.
I've known Sam for 10 years, as he made Huntington Beach my home; he brought the opportunity to meet like minded
people together through sports and collaborative city wide events. Over holidays when a friend wasn't able to make it
home (family in an alternative state),Sammy and his wife, Brooke,opened up their house and hosted them.
During the COVID crisis,Sam created mental stability to those whom were single, married, separated, and families by
offering different entertainment options like Bingo,or trivia night through the use over ZOOM calls/conferences, to the
point he event dressed up and had a themel
He is well known in the community and is praised and honored. I can't think of a better individual who eats, sleeps, and
breathes what Huntington culture is all about.

Hello,
My name is Gigi and I'm Samy's younger sister. He recently mentioned to me that he has an interview with HB's city
council ....I can tell you so many great things about my brother-and maybe a few not so great;) but none of it would be
relevant unless you actually knew him. I would rather share a short story with you instead .... Samy and I were both
born in California are close in age so naturally we had a lot in common growing up . Ever since we were kids we always
dreamed of moving back to California .As we reached our early twenties we both knew it was the right time to head
back. I started the journey and Samy followed shortly after. We didn't come with much and at times I thought it was a
mistake but Samy was the complete opposite ... he made more friends in one week than I had in one year and he had
more job offers than he knew what to do with. People were drawn to him. His honestly and genuine personality
naturally attracted people to him. Sports we're always his passion .. especially football...after a visit to the beach in
Huntington, he came home and said he had found his future on the sand. He struggled , he worked nonstop, he never
rested until he accomplished that goal. His determination and passion are what define him. I envy his perseverance and
truly believe there is so much he can contribute if chosen to be part of city council. I hope you can see what an asset he
is and know he will bring great things to the table.

Huntington beach in 2019, and instantly fell in love with this amazing city. The first person and friend
I met, was Sammy J. Being new, I had a tough time blending into the HB ways, and Sam quickly
mentored me to being a better resident and neighbor. He showed me how to be humble and accept

About me:
I was born in Garden Grove,and have lived in Huntington Beach for most of my life. My father and I both attended
Huntington Beach High School. I am a Business person, a mother,and a grandmother. 1 am also a recovered
addict,and have overcome homelessness-all right here in Huntington Beach. As "business", "family", "addiction
& recovery",and"homelessness"all have relevance in our community, I think I have a unique perspective that
represent a positive contribution to the discussion and planning on each of these topics.
Qualifications:
I have an MBA in Organizational Leadership from Mount St. Mary's University in LA. I have strong Leadership&
Communication skills. I have served on the Board of Directors at the Roque Center in Westminster,and I am am a
long time volunteer with Working Wardrobes in Costa Mesa,CA in the capacity of Transformational Change
Coach. I would facilitate a 8 week workshop assisting people with the transition from joblessness to self-
sufficiency.
Motivation to Apply:
As a Huntington Beach resident, I'd like to be more involved in community solution(s). However, the confusion and
negativity on Social Media have made getting involved feel very intimidating. 1 don't have an agenda for any one
particular item, but rather have an interest in gaining knowledge on the issues,and in turn sharing that knowledge in

Honorable Mayor Carr, Mayor Pro Temp Delgleize, City Council Members,
You have a tremendous responsibility in front of you. I observed the majority of the interviews and read the
applications of those applying for the open city council seat. I applaud each and every one of them! I do not
envy you in your position of having to make this decision.
However, I would like to make some suggestions to your selection process. First, I must state that I believe
you should honor the vote and choose Gracey Vander Mark. Since I'm pretty sure you will not do this, I offer
my opinion on the selection process.
Since you will not honor the vote and chose the next highest vote-getter in the Nov. 2020 election,you must j
eliminate all the applicants that competed in the 2020 election. You will create tremendous controversy if you
do not select Gracey and select someone else that was on the 2020 ballot.
Please give someone else a chance. Although I respect Jill Hardy and Devin Dwyer, the citizens of HB are
looking for new voices. Let them get re-elected on the next ballot they are qualified for.
Please eliminate those that noted a special interest in their resume, i.e. desalination, HDD, even POA.
My opinion but I feel it is important that a HBCC council member be a homeowner In our
City. Homeowners/property owners have a vested interest in our City. I'm not sure how you will ascertain
this since it was not on the application.
As was noted by many of the applicants, our City, our country are very divided. The HBCC is a non-partisan
position. I hope you will choose someone that that is truly non-partisan and has the best interests of the
residents on HB in mind.
I have some definite choices in mind that I would like to see on HBCC, but I will put my trust and confidence in
you to be non-partisan and chose the best qualified candidate.

process take place. Please know that the citizens of Huntington Beach are not falling for this 'fair' selection
process show that you are putting on. It is clearly shaping up to be a 100% biased appointment of whoever
YOU WANT to join rather than what is best for the City of Huntington Beach, and what the citizens voted for.
As I previously mentioned, the ONLY fair way to select this council member would have been to honor the vote
of the city and place Gracey in the position. If she is not selected, it will be quite obvious that it was simply
because YOU did not want her. She is not only the 4th highest vote getter(and closest in campaign promises to
the person who received the highest votes), but she is obviously qualified for the position, and offers the balance
a city council SHOULD have, and desperately needs.
Aside from Gracey being appointed (fairly and deservedly), the only other option is Jill Hardy because once
again, this is someone we KNOW the citizens have actually selected and chosen to represent then at some
point, she was never voted out unlike some other candidates that applied. Although Gracey should be appointed
far before Jill due to the reasons mentioned above.
Beyond those two choices, the only other option is the special election, something I believe we MUST do if you
do not honor the vote, as I whole heartedly believe the cost of a poor selection will be far greater to this city
over the next 3.5 years than the cost of running a special election.

Please know that a majority of you (Erik excluded) do not represent the vision and hopes of MANY, if not
most, of your citizens, including many I know that voted for you (even myself years ago for some of you) and
no longer feel you have the citizens best interests at heart. I grew up here, I'm a homeowner here, and even as a
'millennial', I am so disappointed in the direction our beautiful, once quiet beach community has taken. The
overbuilding and high density is atrocious, if I wanted to live in Santa Monica, I would move there. Rather than
catering to your precious tourists, do what is right for your citizens who live and work here year round, and you
know, the ones who actually VOTE here.

ethnicity, religion, sexual orientation,gender or disability.Also mentioned under the Code of Ethics are Responsibility,
Fairness, Respect, and Honesty.
Oscar's group Oak View Comunidad is guilty of stalking residents of HB, threatening residents of HB, using hate speech
against whites and American Hispanics calling them coconuts, self-hating Mexicans vendidos (sell-outs). This group
committed Electioneering Fraud and Election fraud at Oak View Elementary School in the 2016 election. Oscar lied on
the application he filed with the Fourth of July meeting board.
I have years of comments posted on Oak View Comunidad's FB page along with video and pictures to prove the many
hate comments about residents, our city, our country such as Amerikkka that was used many times on FB by Oak View
Comunidad and their FB supporters. The hate that this group has towards our city, country,whites,American-Hispanics
is unacceptable and goes against the Code of Ethics and the Declaration.
Oscar Rodriguez co-founder of Oak View Comunidad has a radical following of supporters from other cities that hate HB
and the HBPD accusing us of being the city of white supremacists and the KKK which is crap yes Kalmick, Carr, Moser,
and Delgleize crap.
I have all the proof of the comments that I have made here, videos, FB comments, and pictures. Oh,Antonio Benetiz
who is a member of Oak View Comunidad should be removed from the Human Relations Task Force because his group is
quality of ail the hate that the HRTF tries to tell us is unacceptable and Oscar should be removed from the Planning
Commission because of his hate group.
It is time for Oscar,Antonio, Victor and their group to be held accountable by exposing their group and all the hate that
they show towards HB and our country.
Oak View Comunidad posted a picture of the Commerce Bank with a large sign they hung with the word RESIST on
it. How do I know it was them who vandalized the bank? They admitted it on FB and I have a copy to prove it.
Oscar as well as Gina-Clayton Tarvin should not be allowed to sit on the HB city council because of their association of
Oscar's hate group.

As a resident of Huntington Beach, I wholeheartedly recommend that you choose (Robin)Jenny
Braithwaite to be selected to fill the open City Council position. I have had the privilege of working with
her at Self-Help Interfaith Program where we both serve as volunteers. Despite the fact that she has a
time-consuming job at California State University,she devotes countless hours to helping our formerly
homeless guests become self-sufficient. She is a team player who works well with others to find
creative solutions as problems arise. It is Jenny who handles all intake calls and much of the written
communication for our Board of Directors. She takes it upon herself to translate and converse with our
Spanish-speakers at the shelter. Her communication skills and flexibility have helped immensely as we
dealt with the spread of COVID through the SHIP house. Conscientious about attending all meetings,
she is passionate about making sure that guests do everything possible to maintain both physical and
mental health.
Jenny enjoys discussing politics, and we both advocate for government transparency. We share the
belief that if a service can be provided well by volunteers and non-profits(including the faith
community)without cost to the city, then that is the choice that should be made. When we disagree,
she listens intently to what is being said and tries to find points of agreement. Rather than relying on
party dictates,she follows her conscience as well as the law. In addition to understanding well the
causes and solutions for homelessness,she would use her interpersonal skills to increase community
engagement. Her background in both business and government would help in the analysis of data, the
city budget, and decisions facing City Council. Using her experience leasing real estate, Jenny has
provided the appropriate lease templates for our non-profit to use. Her strong education and financial
background would help our city to make wise decisions regarding economic development and housing.
Never overwhelmed with details, she responds to challenges with zeal and compassion, always wanting
to "beat the odds' and prove that when there's a will, there's a way. Please feel free to contact me if

This problem has at least three major subsets, Those who are facing hard economic times, those who are having
substance abuse problem and those who are mentally and emotionally challenged. Each group needs a tailored
solution and just building shelters will not cut it in the long run:
l- the first group will need affordable housing and supplemental income while getting back on their feet,
2- the second group will need mental and emotional support facilities, where they can be treated so they
can function and be placed in jobs that matches their abilities, and that can be done through charitable
organizations, I was on the board of such organization
3- The third group will need rehab facilities and support groups thereafter so once they are back
functioning in society they stay there and off drugs.
Within each of above three groups there are subgroups; teens,older people, women and men with or without
children. Each will have to be dealt with differently, and there are charitable organizations that can deal with
some of these sub-groups, for example the homeless teens has an organization called the Covenant House, and
the city can partner with them and others like them
Economic development and housing. From experience economic development has a three legged stool that
greatly contribute to its success, they are:
I- quality of life to attract employees, like Safe environment, good schools, parks and recreation etc..
2- Trained labour force; good skilled labour, and/or community colleges and universities nearby that
businesses can tap into it or partner with
3- Low cost power (Gas and electricity). And here I have few ideas that I can share with the council if they
so desire.
One more that is hobby horse of mine : Conservation and the environment. There are many things that the city
controls and can use to make a difference, like traffic light synchronization based on volume of traffic during
different time of the day. This can be done suing college students to study the traffic pattern, and design a
system which will be good for the students development as well as the city's budget. Again 1 was party to an
initiative similar to that when I was a graduate student.
