City Clerk April 6, 2022 Russell Neal 16342 Wildfire Circle Huntington Beach CA 92649 Re Recall Petition Signature Verification for Councilmember Mike Posey found Insufficient by the Orange County Registrar of Voters (ROV) Mr Neal, On Wednesday, February 23, 2022, acting on behalf of proponents for the potential recall of Huntington Beach City Councilmember Mike Posey. you delivered petition documents to the Huntington Beach Civic Center at approximately 230PM On that date. you and several interested parties witnessed my staff and I conduct a prima facie review in Meeting Room B-7 This exercise was necessary to determine that the minimum number of 13,352 signatures had been collected in order to seek voter registration certification from the ROV, our signature count validated your efforts On the morning of Thursday, February 24, 1 personally delivered Councilmember Mike Posey petition documents to the Registrars office On behalf of the City of Huntington Beach I made a formal request that the ROV conduct a 100% signature verification exercise to produce findings on whether or not the petition document(s) contained the minimum number of 13.352 valid voter registration signatures required to qualify the matter for a special recall election I also delivered twelve (12) written requests for removal of recall signatures for Councilmember Posey that were received by my office prior to petition filing The Elections Code provides a window of time of 30 working days for the ROV to complete petition signature verification and on February 24 2022, the ROV provided me with a written acknowledgment that it would deliver findings to the City no later than Wednesday, April 6, 2022 Today. (a) Notwithstanding Sections 6252 and 6253, statewide, county, city, and district initiative, referendum, and recall petitions, petitions circulated pursuant to Section 5091 of the Education Code, petitions for the reorganization of school districts submitted pursuant to Article 1 (commencing with Section 35700) of Chapter 4 of Part 21 of the Education Code, petitions for the reorganization of community college districts submitted pursuant to Part 46 (commencing with Section 74000) of the Education Code and all memoranda prepared by the county elections officials in the examination of the petitions indicating which registered voters have signed particular petitions shall not be deemed to be public records and shall not be open to inspection except by the public officer or public employees who have the duty of receiving, examining or preserving the petitions or who are responsible for the preparation of that memoranda and, if the petition is found to be insufficient, by the proponents of the petition and the representatives of the proponents as may be designated by the proponents in writing in order to determine which signatures were disqualified and the reasons therefor. However, the Attorney General, the Secretary of State, the Fair Political Practices Commission, a district attorney, a school district or a community college district attorney, and a city attorney shall be permitted to examine the material upon approval of the appropriate superior court. (b) If the proponents of a petition are permitted to examine the petition and memoranda pursuant to subdivision (a), the examination shall commence not later than 21 days after certification of insufficiency, and the county elections officials shall retain the documents as prescribed in Section 17200 of the Elections Code. (c) As used in this section, "petition"shall mean any petition to which a registered voter has affixed his or her signature. (d) As used in this section, "proponents of the petition" means the following: (1) For statewide initiative and referendum measures, the person or persons who submit a draft of a petition proposing the measure to the Attorney General with a request that he or she prepare a title and summary of the chief purpose and points of the proposed measure. (2) For other initiative and referenda on measures, the person or persons who publish a notice of intention to circulate petitions, or, where publication is not required, who rile petitions with the elections official. (3) For recall measures, the person or persons defined in Section 343 of the Elections Code. (4) For petitions circulated pursuant to Section 5091 of the Education Code, the person or persons having charge of the petition who submit the petition to the county superintendent of schools. (5) For petitions circulated pursuant to Article 1 (commencing with Section 35700) of Chapter 4 of Part 21 of the Education Code, the person or persons designated as chief petitioners under Section 35701 of the Education Code. (6) For petitions circulated pursuant to Part 46 (commencing with Section 74000) of the Education Code, the person or persons designated as chief petitioners under Sections 74102, 74133, and 74152 of the Education Code. Grand Avenue Santa Ana, CA 92705 Re: Request for Signature Verification— Petition for Recall of City Councilmember Mike Posey ' To Whom It May Concern, On September 16, 2021, proponents for the potential recall of Huntington Beach City Councilmember Mike Posey received written notification that the petition documents delivered to my office on September 16, 2021 were acceptable for circulation. Per CA Elections Code Section 11221, recall proponents were advised in writing that the required number of signatures necessary to qualify the petition for a recall election was 13,352(10% of Huntington Beach registered voters published in the California Secretary of State's report dated August 21, 2021). The recall proponents were also advised to collect an additional 50% above the 10% figure (based on ROV advice)to compensate for signers disqualified for not being registered, being registered but not living in the district,or for other reasons. Per CA Elections Code Section 11220, 1 informed recall proponents that the 160-day deadline to file petition documents was Wednesday, February 23, 2022 at 5:00 p.m. Proponents delivered the enclosed recall petition yesterday. February 23, 2022 at approximately 2:30 p.m. After conducting a prima facie review, my staff determined that the minimum number of signatures had been collected to seek voter registration certification from the ROV. On behalf of the City of Huntington Beach, I would like to formally request ROV assistance to receive the enclosed recall petition for Councilmember Mike Posey and conduct a signature verification exercise that will produce findings on whether or not the petition document(s)contain the minimum number of 13,352 valid voter registration signatures required, and to stop the 100%count at 13,352 plus 10 additional signatures (13,362) to qualify the matter for a special recall election. I would also bring to your attention that twelve (12)written requests for removal of recall signatures for Mike Posey were received by my office prior to petition filing (see attached). Elections Code Section 11221 prescribes that the number of signatures you are required to collect is ten percent (10%) of the number of registered voters in Huntington Beach. Based on the most recent voter registration report published by the California Secretary of State (SOS) dated August 31, 2021 (attached), Huntington Beach has 133,521 registered voters. In addition, the Orange County Registrar of Voters office recommends collecting an additional 50% above the 10% figure to compensate for signers disqualified for not being registered, being registered but not living in the district, or for other reasons. The breakdown is as follows: 10% (EC 11221): 13,352 50% above 10% figure: 6J676 Total: 20,028 Elections Code Section 11220 prescribes a 160-day window to circulate the petition if the electorate jurisdiction has 50,000 registered voters or more. Based on a start date of tomorrow, September 17, the 160-day timeline expires on Wednesday, February 23, 2022. Therefore, we will accept petition documents filed with this office during normal business hours no later than 5:00 PM on Wednesday, February 23, 2022. Instead, it's usually a reaction to election results.The timing of this petition underscores the point.The proponent's Council candidate of choice was not selected. The argument for the recall is dissatisfaction with State Law requiring City Council to plan for housing.As I've stated many times,the battle against high density development is in Sacramento and not at City Council. The dissatisfaction about "high density development" should be leveled against those serving on the Council in 2013. That's when development agreements were approved. I was elected to the Council in 2014 never voting for BECSP high density.
