February 24 1 personally delivered Councilmember Kim Carr's petition documents to the Registrar's office On behalf of the City of Huntington Beach. I made a formal request that the ROV conduct a 100% signature verification exercise to produce findings on whether or not the petition document(s) contained the minimum number of 13.352 valid voter registration signatures required to qualify the matter for a special recall election I also delivered twelve (12) written requests for removal of recall signatures for Councilmember Carr that were received by my office prior to petition filing. The Elections Code provides a window of time of 30 working days for the ROV to complete petition signature verification and on February 24, 2022. the ROV provided me with a written acknowledgment that it would deliver findings to the City no later than Wednesday, April 6, 2022 Today, April 6. 2022 I received written certification from the ROV(attached) that signature verification for the recall of Councilmember Kim Carr was found to be insufficient based on the number of signatures necessary to qualify the matter for holding of a special municipal election Questions concerning this decision should be directed to the Orange County Registrar of Voters California Elections Code Section 11301 states If a petition is found insufficient by the electrons official or. in the case of the recall of a state officer, the Secretary of State. the petition signatures may be examined in accordance with Section 6253.5 of the Government Code. (b) If the proponents of a petition are permitted to examine the petition and memoranda pursuant to subdivision (a), the examination shall commence not later than 21 days after certification of insufficiency, and the county elections officials shall retain the documents as prescribed in Section 17200 of the Elections Code. (c) As used in this section, "petition"shall mean any petition to which a registered voter has affixed his or her signature. (d) As used in this section, "proponents of the petition"means the following: (1) For statewide initiative and referendum measures, the person or persons who submit a draft of a petition proposing the measure to the Attorney General with a request that he or she prepare a title and summary of the chief purpose and points of the proposed measure. (2) For other initiative and referenda on measures, the person or persons who publish a notice of intention to circulate petitions, or, where publication is not required, who file petitions with the elections official. Per CA Elections Code Section 11221, recall proponents were advised in writing that the required number of signatures necessary to qualify the petition for a recall election was 13,352 (10% of Huntington Beach registered voters published in the California Secretary of State's report dated August 21, 2021). The recall proponents were also advised to collect an additional 50% above the 10%figure (based on ROV advice) to compensate for signers disqualified for not being registered, being registered but not living in the district, or for other reasons. Per CA Elections Code Section 11220, 1 informed recall proponents that the 160-day deadline to file petition documents was Wednesday, February 23, 2022 at 5:00 p.m. Proponents delivered the enclosed recall petition yesterday, February 23, 2022 at approximately 2:30 p.m. After conducting a prima facie review, my staff determined that the minimum number of signatures had been collected to seek voter registration certification from the ROV. Elections Code Section 11221 prescribes that the number of signatures you are required to collect is ten percent (10%) of the number of registered voters in Huntington Beach. Based on the most recent voter registration report published by the California Secretary of State (SOS) dated August 31, 2021 (attached), Huntington Beach has 133,521 registered voters. In addition, the Orange County Registrar of Voters office recommends collecting an additional 50% above the 10% figure to compensate for signers disqualified for not being registered, being registered but not living in the district, or for other reasons. My staff and I had discussed the provisions of Elections Code Section 11041(b) with states, "All petition sections shall be printed in uniform size and darkness with uniform spacing." We knew not to accept bolded text (which you did not present),and since we found no guidance on underlined sentences in the Secretary of State recall guidebook, I felt it would be wise to leave a message with the Registrar's office requesting advice on this matter. With the Recall Election held yesterday, I thought it was doubtful that I would receive a prompt response (which I did not). So, I decided to proceed without requesting the underline be included. This afternoon I went back to the County's recall guide, and found the highlighted sentence shown in the first attachment. I now believe in addition to the revisions requested in today's letters of findings, you should also incorporate underline to accurately capture the answers submitted by Councilmembers Carr and Kalmick. Mayor Kim Carr has failed in her duty to protect the interests of the citizens of Huntington Beach by refusing to oppose a state requirement that we add over 13.000 High Density Apartments to our city, the equivalent of 47 Beach-Ellis style high-rises, thus threatening the suburban beach community character of our beloved city She has violated and damaged the City Charter by surrendering our local control of zoning to the state. She has made numerous attempts to undermine our elected City Attorney.
