Huntington Beach CA 92649 Re: Acceptance of"Petition for Recall"forms—Councilmember Natalie Moser Mr. Neal, Staff has reviewed the revised"Petition for Recall'forms submitted to our office on Friday, August 27, 2021, for Huntington Beach Councilmember Natalie Moser, and finds them to be acceptable for circulation. Elections Code Section 11221 prescribes that the number of signatures you are required to collect is ten percent (10%) of the number of registered voters in Huntington Beach. Based on the most recent voter registration report published by the California Secretary of State(SOS) dated July 17, 2021 (attached), Huntington Beach has 132,822 registered voters. In addition, the Orange County Registrar of Voters office recommends collecting an additional 50% above the 10%figure to compensate for signers disqualified for not being registered, being registered but not living in the district, or for other reasons. The breakdown is as follows: 10% (EC 11221): 13.282 50% above 10%figure: 6.641 Total: 19,923 Elections Code Section 11220 prescribes a 160-day window to circulate the petition if the electorate jurisdiction has 50,000 registered voters or more. Based on a start date of tomorrow, August 31, the 160- day timeline expires on Sunday, February 6, 2022. Therefore, we will accept petition documents filed with this office during normal business hours no later than Monday, February 7, 2022. The title PETITION FOR RECALL found on side one of each double-sided petition form should also be present in the same location on the top of each second side. 2. Insert County of Orange, where indicated in two separate sections on the noted petition form copies (both sides). 3. The opening paragraph of your Notice of Intention to Circulate Recall Petition (NOI) beginning with the sentence, "TO THE HONORABLE City Councilmember Barbara Delgleize: Pursuant to Section 11020, California Elections Code ..."is missing from both letter and legal-sized versions of the petition forms. Insert where indicated on the noted petition form copies (both sides). 4. The savesurfcity.org website address on the "Official Top Funders" page should read SaveSurfCity.org (each word in caps) to match the link published in your NOI. She has made numerous attempts to undermine our elected City Attorney,Michael Gates,and not follow legal advice to protect the citizens of Huntington Beach,thereby abusing her authority.She has further flouted the express will of the voters by: 1)shamefully harassing Mr.Tito Ortiz out of office and 2)replacing him with a person of the Councils,rather than the voters'choice,all in furtherance of the destructive High Density Development scheme.
