Mr. Neal,
In a letter dated August 30, 2021 (attached), I provided you with written confirmation that the'Petition
for Recair documents submitted to this office by you on Friday, August 27, 2021 for Huntington Beach
Councilmember Barbara Delgleize were acceptable for circulation. In addition, I also provided
instructions on the petition process, including number of required signatures, and a filing deadline of
Monday, February 7, 2022 during normal business hours.
As of today. February 7, 2022 at 5.01 PM, I am providing written acknowledgment that the recall
petition documents referenced above for Huntington Beach City Councilmember Barbara Delgleize
have not been filed in this office. Pursuant to the provisions of CA Elections Code Section 11222, no
further action on this matter shall be taken.

Re: Acceptance of"Petition for Recall" forms—Councllmember Barbara Delgleize
Mr. Neal,
Staff has reviewed the revised `Petition for Recall"forms submitted to our office on Friday, August 27,
2021, for Huntington Beach Councilmember Barbara Delgleize, and finds them to be acceptable for
circulation.
Elections Code Section 11221 prescribes that the number of signatures you are required to collect is ten
percent(10%) of the number of registered voters in Huntington Beach. Based on the most recent voter
registration report published by the California Secretary of State (SOS) dated July 17, 2021 (attached),
Huntington Beach has 132,822 registered voters. In addition, the Orange County Registrar of Voters office
recommends collecting an additional 50% above the 10%figure to compensate for signers disqualified for
not being registered, being registered but not living in the district, or for other reasons. The breakdown is
as follows:
10% (EC 11221): 13,282
50% above 10% figure: 6 641
Total: 19,923
Elections Code Section 11220 prescribes a 160-day window to circulate the petition if the electorate
jurisdiction has 50,000 registered voters or more. Based on a start date of tomorrow, August 31, the 160-
day timeline expires on Sunday, February 6, 2022. Therefore, we will accept petition documents filed with
this office during normal business hours no later than Monday, February 7, 2022.
The requirements detailed above are included in the SOS Procedures for Recalling State and Local
Officials guidebook previously provided to you under separate cover.

Mr. Neal,
A review of the "Petition for Recall"forms submitted to this office on Friday, August 20, 2021, for
Huntington Beach Councilmember Natalie Moser has been conducted by City Clerk staff, and it has been
determined that the following alterations are necessary (applicable to both letter and legal-sized forms):
1. The title PETITION FOR RECALL found on side one of each double-sided petition form should also
be present in the same location on the top of each second side.
2. Insert County of Orange, where indicated in two separate sections on the noted petition form copies
(both sides).
3. The opening paragraph of your Notice of Intention to Circulate Recall Petition (NOI) beginning with the
sentence, "TO THE HONORABLE City Councilmember Natalie Moser. Pursuant to Section 11020,
California Elections Code ..."is missing from both letter and legal-sized versions of the petition forms.
Insert where indicated on the noted petition form copies (both sides).
4. The savesurfcity.org website address on the "Official Top Funders" page should read SaveSurfCity.org
(each word in caps) to match the link published in your NOI.
A noted copy of the double-sided petition form (applicable to both letter and legal-sized forms), and the
NOI dated August 3, 2021 are enclosed for your reference.
Please be advised that you have ten (10) days to make the requested alterations and file another two

Beach,Cafif,,r�nxia,respectfully state that we seek the recall and removal of Natalie Moser holding the office of City Council Member in Huntington(W6ach,

We demand an election of a successor to that office.
The following Noticeof Intention to Circulate Recall Petition was served on August 3,2021 to Natalie Moser:
Council Member Natalie Moser has failed in her duty to protect the interests of the citizens of Huntington Beach by refusing to oppose a state requirement that
we add over 13,000 High Density Apartments to our city,the equivalent of 47 Beach-Ellis style high-rises,thus threatening the suburban beach community
character of our beloved city.Site has violated and damaged the City Charter by surrendering our local control of zoning to the state. She has made numerous
attempts to undermine our elected City Attorney,Michael Gates,and not follow legal advice to protect the citizens of Huntington Beach,thereby abusing her
authority.She has further flouted the express will of the voters by: 1)shamefully harassing Mr.Tito Ortiz out of office and 2)replacing him with a person of the
Councils,rather than the voters'choice,all in furtherance of the destructive High Density Development scheme.Her immediate replacement,rather than
waiting for the next election is urgent and necessary to stop further damage and Save Surf City.(See SaveSurfGty.org for details)Proponents include Cari Swan,

We're investing more than ever in law enforcement,making HB one of the safest cities in Orange County.We've advanced the fight to end homelessness and are
regional leaders developing new solutions.We've increased infrastructure funding in a way that supports enhanced accessibility.We've made groundbreaking

threatening the suburban beach community character of our beloved city She has violated and

made numerous attempts to undermine our elected City Attorney, Michael Gates, and not follow

TO THE HONORABLE City Council Member Natalie Moser Pursuant to
Section 11020. California Elections Code. the undersigned registered qualified voters of
the City of Huntington Beach in the State of California, hereby give notice that we are
the proponents of a recall petition and that we intend to seek your recall and removal
from the office of City Council Member in the City of Huntington Beach California, and
to demand election of a successor in that office.
The grounds for the recall are as follows
Council Member Natalie Moser has failed in her duty to protect the interests of the citizens of
Huntington Beach by refusing to oppose a state requirement that we add over 13,000 High
Density Apartments to our city, the equivalent of 47 Beach-Ellis style high-rises, thus
threatening the suburban beach community character of our beloved city She has violated and
damaged the City Charter by surrendering our local control of zoning to the state She has
made numerous attempts to undermine our elected City Attorney, Michael Gates. and not follow
legal advice to protect the citizens of Huntington Beach. thereby abusing her authority She has
• further flouted the express will of the voters by 1) shamefully harassing Mr Tito Ortiz out of
office and 2) replacing him with a person of the Councils, rather than the voters choice, all in
furtherance of the destructive High Density Development scheme Her immediate replacement.
