A PROCLAMATION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH DECLARING THE EXISTENCE
OF A LOCAL EMERGENCY IN THE CITY
WHEREAS, on or about October 2, 2021, the United States Coast Guard notified the
City of Huntington Beach about the existence of a significant oil spill (identified as the Pipeline
P00547Incident) off the our coast, of which the conditions are or are likely to be beyond the
control of the services, personnel, equipment, and facilities of the City of Huntington Beach; and
WHEREAS, the City's Marine Safety Department identified oil intruding onshore to City
and State beaches and inland channels; and
WHEREAS, the oil spill has progressed and impacted almost all beaches, coastal waters,
and environmentally sensitive areas in Orange County and the City of Huntington Beach; and
WHEREAS, initial reports state that the oil spill originated from the rupture of an
underwater pipeline off the coast of Orange County and is currently estimated to exceed 144,000
gallons; and
WHEREAS, in certain areas, residents are being directed to avoid contact with ocean
water and/or oil on the beach and to cease recreational and fishing activities due to the toxic
nature of the oil spill; and
WHEREAS, by Sunday, October 3, 2021, natural and wildlife impacts include reports of
bird oiling, localized fish kills, and oil penetration into the Talbert Wetlands near Huntington
Beach; and
WHEREAS, efforts are being made to protect beaches, ecological preserves and other
sensitive habitats; and

WHEREAS, the oil spill has the potential for economic impacts for community members,
businesses, government agencies, and others due to the loss of outdoor access, tourism, and
impacts to commercial and recreational fishing and watersports; and
WHEREAS, the conditions caused by the oil spill create conditions of disaster or extreme
peril to the safety of the persons and property within the coastal areas of Orange County; and
WHEREAS, pursuant to Huntington Beach Municipal Code 8.60.070, the City Manager,
i.e. the Director of Emergency Management, is empowered to request the City Council to
proclaim the existence or threatened existence of a local emergency if the City Council is in
session; and
WHEREAS, the City Council met on October 4, 2021 to discuss the existence of a local
emergency pursuant to the significant oil leak/spill; and
WHEREAS, due to the aforementioned facts, there exists extreme peril to the safety of
persons and property in the City of Huntington Beach,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
1. A Local Emergency as defined in the California Government Code §8558(c), and
Huntington Beach Municipal Code 8.60 exists in the City of Huntington Beach, The City
Council shall review, within 30 days, until such Local Emergency is terminated, the need for
continuing the Local Emergency at the earliest possible date that conditions warrant.
2. The City Manager and the Fire Chief, by virtue of their designations as Director
and Deputy Director, respectively, of Office of Emergency Management and Homeland Security
pursuant to Huntington Beach Municipal Code Chapter 8.60, are hereby designated as the
authorized representatives of the City of Huntington Beach for purposes of receipt, processing,

federal assistance as may be available.
3. The Proclamation of Local Emergency is hereby issued by the City Council on

Current Situational Overview
• This past Saturday, October 2, a major oil spill occurred off the coast of Huntington Beach
— It appears that the spill occurred from a ruptured distribution line connected to the oil platform Elly
— Elly is run by Beta Operating Company, a California subsidiary of Houston-based Amplify Energy Corporation
— The clean-up response is being coordinated by the Unified Command, under the jurisdiction of the Coast Guard
and through an Incident Management Team (IMT) structure
• Current estimates indicate that -144,000 gallons of oil have been spilled, and current clean-
up and recovery effort details are as follows
— Main oil spill impacts are now moving south along the Orange County coast, away from Huntington Beach
— Oil dispersants are not currently being used as part of the clean-up efforts
— 14 boats are skimming the Orange County coastline to remove oil from the ocean before it reaches the shore
— Response operations are currently staged at Huntington State Beach by Brookhurst
— 320 personnel have been deployed on the ground throughout the County to perform oil clean-up activities
— 8,700 feet of containment booms have been deployed County-wide to protect sensitive areas from oil
— AQMD is monitoring air quality for any health concerns
— Orange County Health Care Agency has set-up a health-related hotline for those with questions
Emergency Declaration Overview
• For the past few days, Huntington Beach has been the City most impacted by the oil spill in
Orange County
— Access to the surf line and ocean water in Huntington Beach are currently closed from Seapoint to the Santa Ana
River Jetty
— The City is assessing the situation and if the recovery situation improves in the coming days, we will be assessing
the viability of reopening ocean access north of the Pier
— Mitigation booms have been installed at 7 ecologically sensitive locations in Huntington Beach and additional
wetland response plans have been developed if the situation warrants
• To facilitate procurement and reimbursement related activities, it is recommended that the
City Council proclaim the existence of a local emergency in Huntington Beach
Coordination With Orange County
• Orange County will be declaring a County-wide local emergency tonight, given the impacts
that the oil spill is having along our entire coast
— Given the nature of the incident, coupled with an uneven initial response from the Unified Command responding
to the oil spill, the County has also activated their EOC
• During the past few days, as the Unified Command structure has been developed, clean-up
activities and oil spill information has been inconsistent
Timeline Of Events — Saturday, 10/2
• 9:00 a.m.
— City personnel were informed via announcement made on VHF Channel 16 by US Coast Guard of a possible oil
spill in the area of Huntington Beach, however, no specific details or intelligence was made available
• 10:30 a.m.
— The Coast Guard advised that the spill could be larger than originally thought, and that air assets were being
deployed to survey the scope and severity of the oil spill
— Very little information was provided though regarding the location and scope of the situation
• 11:00 a.m.
— The Coast Guard advised that the spill was being classified as a major spill, and that an Incident Management
Team (IMT) was being activated
Timeline Of Events — Saturday, 10/2
• 12:00 p.m.
— The City received information that the oil impact could reach Huntington Beach
— City personnel began collaborating, and a determination was made that if the situation warranted, we would
begin local response operations beginning at 4:00 p.m.
— Response operations were driven by our marine oil spill protocols, which calls for the City to implement boom
mitigations at the:
— Talbert Inlet Channel
— Bolsa Chica Wetlands entrance near Warner Fire Station
— Talbert Marsh entrance near Brookhurst / PCH
• 2:00 P.M.
— The Coast Guard advised the City that the new spread model indicated that the oil spill would not reach our
shores until October 4
— This information was provided with very little context, and few details were provided regarding the location and
scope of the oil spill situation
Timeline Of Events — Saturday, 10/2
• 2:30 p.m.
— The City command post at Jr. Lifeguard Headquarters received our first report that oil was impacting boats on the
outer edge of the Air Show flight box, and rescue vessels assigned to the Air Show conducted patrol checks to
assess the size and scope of oil spill near our shore
— City Fire Department crews, our haz mat teams, and our oil spill response trailer were dispatched to the Talbert
Inlet Channel (TIC) to begin mitigation efforts
• 2:45 p.m.
— The City was informed by Newport Beach Rescue Vessel that private contractors were conducting oil spill clean-
up operations on south end of Air Show flight box, and that a large amount of oil was impacting the Air Show
flight box
— Subsequently, the Coast Guard made an announcement on VHF Channel 16 that boaters could expect the closure
of Huntington Harbor
— The Huntington Harbor announcement was only made one time, and was then canceled by the Coast Guard
— The Coast Guard then advised the City again that their new oil spread model showed that the spill would not
reach our shores until October 4
Timeline Of Events — Saturday, 10/2
• 4:00 p.m.
— The City began efforts to install boom protective measures at ecologically sensitive areas
— Talbert Inlet Channel — soft booms were installed to protect the Bolsa Chica Wetlands
— Warner Bridge off PCH — hard booms were installed to protect the Bolsa Chica Wetlands
— Warner Fire Station — hard booms were installed to protect the Bolsa Chica Wetlands
— Talbert Marsh — soft booms were installed to protect the Talbert Marsh
• 4:45 p.m.
— The City made the decision to close the water in the area from the Huntington Beach Pier south to Beach
Boulevard
— CA State Parks also conducted a water closure of Huntington State Beach from Beach Boulevard to Brookhurst
Street
Timeline Of Events — Saturday, 10/2
• 5:30 p.m.
— State Parks reported that oil was being seen 300 yards outside of surfline near Magnolia and Brookhurst
— The City placed a request into Anaheim and OCFA for additional soft booms
• 6:10 p.m.
— The City conducted aerial surveillance in our Police helicopter and it was determined that oil spill stretched south
to the Balboa Pier, with the northern boundary in Huntington Beach at Newland Street
— At the time, the oil spill appeared to be around 2.8 nautical miles off the coast, and stretched S.8 nautical miles in
length
• 7:00 p.m.
— The City observed that oil had reached the shoreline in Huntington State Beach at Newland, and small oil splotch
segments were being observed as far north as the HB Pier

UNBELIEVABLE.
You have oil rigs just off your beaches, in plain sight.
You knew about the Gulf in 2010.
You knew about Santa Barbara.
And yet you had no plan to deal with a leak.
No equipment anywhere nearby.
No established task force with the equally useless Cal Fish and Wildlife. (They had no plan either)
No well established connection with the rig owners for mitigation plans and early warning.
You are partially responsible for the impacts upon wildlife and the wetlands. (Although 1 am betting you only
care about the loss of tourist dollars!)
Shame on you all for having zero foresight.

Dear City Councilmembers,
I'm writing to you today to urge you to decommission the oil rigs off the coast of Orange County in order to
avoid future oil spills.
I'm a lifelong resident of Orange County. Huntington Beach was always the beach that my family and 1 went to
even though we lived right next to Seal Beach. 1 remember thinking the oil rigs were not only a tremendous
eyesore but also a symbol of our disgusting dependence on oil.
As a child. I was very concerned about climate change and hoped that there would be alternatives to fossil fuels.
Thankfully, there are. And }'et, we are still completely dependent on them. There's a very clear solution: Electric
Vehicles (EVs).
How many more oil spills do there need to be before we do something about it?
Quite frankly, it's only a matter of time before the next oil spill. And yet, we've seen so many of these happen in
recent years and still we do nothing about it. Each time it's upsetting. Each time it's called an environmental or
ecological disaster. We clean up, move on, and do nothing.
Do something about it now. Orange County's beaches are some of the most beautiful in the world. Let's keep it
that way. Close these oil rigs and transition towards EVs instead. We must end our dependence on oil. It's
literally killing us, marine life, and our beautiful coastlines.

The council has the grave responsibility of managing a citywide response to the recent oil spill affecting our single most
important natural resource The ecological impacts are acute and pressing, and managing the economic impact is likely
to claim the lion share of the council attention and working efforts over the next few months While the impact to the
city and our reputation as a healthy venue for outdoor activities organized at the water's edge is unknown. those water
edge activities underly the value of every piece of real estate in the city both commercial and residential Even during a
global pandemic. those activities remained in place and were the reason that we and our neighbors would come to our
parking lots, enjoy meals in our restaurants. book stays in our hotels The disruption to the city economy caused by the
pandemic was very well managed by the Council and the legions of hard-working city staff led by City Manager Chi
Even in the absence of a detailed picture of the damage done thus far. I have been a close observer of this council in
action You have addressed issues both chronic (homelessness. the availability of crisis stabilization mental health
services. the housing affordability crisis for the "missing middle') and acute (primarily the city response to the pandemic
itself) I have every confidence in this council to address our current challenge
While the future is uncertain. the whole and entire point of representative government is that you -the citizens elevated to
the dais-are in the right place, and at the right time, with clear minds. full hearts and strong hands as you address this
issue

friends and family that live in Huntington Beach, and they are concerned with the current damage and long-
lasting damages that will happen to their beaches and wildlife.
I reached out to contact that I have that his organization has experience in oil clean up with larger oil spills
throughout the world and his product is fast acting and environmentally safe.
My contact (Ralph Salazar) is the President/CEO of Ovation-Scientific.com have enough drums available to
address the entire 126,000-gallon spill near Huntington Beach, OSE II can be applied easily with firefighting
equipment from any commercial vessel, 2 to 4 vessels could apply enough OSE II to render the spill nontoxic
and prevent further natural resource damage.
No product or process in the world has ever come remotely close to being as effective as Oil Spill Eater II ( OSE

I worked three years on the Exxon-Valdez and the Anacordes oil cleanup and I can tell you that the "ONLY"way to get rid of
the oil is to dig it up. Amazingly rocksisands, esp rip rap. are big oil sponges. And no matter what you do to them when the
sun hits them they bleed. Had I of not recommended that they dig everything up that oil touched at Anacordes they would still
be dealing with it. We still are in Prince William Sound. You will do less damage than any other method. Don't be convinced
otherwise. I have been there, done that. So get your front end loaders, backhoes and line your dumps so you can haul it off.
For sure you can find some remote road that could use the sand and oil. Exxon did,

Thanks for a great Air Show. Really super this year. Understandable you decided to cancel, I
support the decision.
While 1 am aware of all the city volunteer opportunities listed on the website - PLEASE update us
as to the specific way residents can assist with the oil clean up, wildlife, land clean-up etc. Many of
us have time and want to help with this human caused disaster.
Maybe a heading on the city website with regular updates as the situation progresses over the next
several weeks.

Good morning Kim
I have been reading the devastating news of the oil spill or leak off your coast, which has cause traumatic
impact to the wildlife, beaches and waterway.
1 am reaching out from Nanaimo, Vancouver Island Canada. I have a product with would be able to assist
immediately with the oil clean up.
We have just launched we have a large model which extract the oil out of the water, also clearing the sheen.
The Clean Bilge is a product which has been designed for large bilges of Tug boats and large fishing boats, but
one of our products is used in marinas, to make sure no oil goes out to sea from sitting boats.
The oil which is extracted from the water is trapped into a container which is then completely recyclable.
We have a air-force base very close, plus a US Navy port 15 mins away. We would be able to figure out some
way to get them to you.

I just want to ask you about something completely different from our normal cruise business.
Do you know if anyone in PCL is having some good connections or contact details to the CA environmental department
etc.? -1 have just seen in the news, that there is a big oil spill outside California, and we have a swallow water catamaran
designed for such a purpose (SWORC).
I did the development with naval architect company Knud E. Hansen in 2008, and sold off the rights to Damen shipyard
group. Two years ago, I purchased back the demo boat and the rights to produce the boats, so I actually have a boat
there can be shipped to California tomorrow either in a 20f container or in a plane on the trailer.

I'm writing to add my support to what I'm sure is in alignment with many HB residents. Everything has been
thrown at you and now it's "the kitchen sink!" The calm and peace I find in these turbulent and now literally
disastrous times is knowing that you folks are up there on the dais.
Thank you for your fearless and stalwart leadership. 1 have absolute confidence that you will get us through this
latest major unfortunate event. It will obviously take hard work, patience, and dedication to the well-being of
HB now, and for the foreseeable future. But you have that covered. Mayor Carr, you are a natural in those press
conferences. Great job yesterday!
In my view, the only silver lining to this ecological disaster is that it makes the recall petitions irrelevant and all
the more counterproductive to the unified efforts now clearly needed by HB residents. This emergency demands
our undivided attention and funds. Hopefully, this small disruptive group will drop their ill-conceived,
misinformed, and misguided effort for the good of Surf City.

you with a product called PeatSorb. It's a 100% Natural product made from Peat moss and it
absorbs oil on contact and not the water The PeatSorb can be launched from a boat or on shore at
the beach. It is the perfect product to get into the hard to reach shore line rocks and nesting
areas. The Peat Sorb is made from Peat moss and will absorb the oil and not the water. It will float
on top and can be skimmed up, vacumed, or shoveled up. It can be squeezed and the water will call
out but not the oil. On the beach it can be mixed in with the sand and absorb the oil and then
separated from the sand. These are processes that we have done around the world including small
scale in the United States. It keeps nasty chemicals away from sea life and will stop the emulsion of
the oil in the ocean and keep it On top. The captured material can then be stockpiled, covered and treated The
contaminated sand can be treated via our Matrix Enhanced Treatment System "METS offering full remediation and return
of clean sand to the beach The encapsulated oil and Peat Sorb can also be disposed of in a landfill. The
encapsulated oil will not leach and will biodegrade over time If desired, the biodegradation process
can be accelerated with the application of a nitrogen-derived fertilizer or microbes.
It will save marine life, birds and easy to use vacuums. shovels, or skimmers to remove. This spill's
hazards are eliminated with the least ecosystem damage using Peat Sorb No introducing nasty

Usage Instructions:
Depending upon the spill size. Peat Sorb is either applied manually or mechanically and spread over the
contaminated area. Start by using '/, of a cubic meter of Peat Sorb for every square meter of contaminated
area. Till or mix the Peat Sorb and oil in the contaminated soil or spread over water. If the Peat Sorb and oil
mixture is black. add more Peat Sorb to the surface and re-mix until the color turns light brown On average.
one PSC8 bale (3.8 ft3 - compressed) of Peat Sorb will remediate and absorb approximately one barrel of
crude oil. This is about 11b of Peat Sorb to 1 US gallon of oil.
Once the oil has been absorbed by Peat Sorb. the encapsulated Peat Sorb and oil can be disposed of in a
landfill. The encapsulated oil will not leach and will biodegrade over time If desired the biodegradation
process can be accelerated with the application of a nitrogen-derived fertilizer or microbes. Alternatively,
once it has absorbed oil. Peat Sorb can be burned and used a fuel source. The product is certifiable
incinerable and carries a BTU value of approximately 15,500 BTU per pound with encapsulation.

1 am a weekly visitor to Huntington Beach and concerned about the oil damage to the precious beaches on our
OC Coast!
Please work to adopt renewables and get off of fossil fuel dependence as soon as possible.
Huntington Beach can lead the way by adopting strong renewable content with OCPA which will allow all
residents and businesses to choose renewables at a lower cost than current utilities with no tax dollars used.
Item # 25 comment, I support the full adoption of a plan to transition the entire City of Huntington Beach fleet
to alternative fuel vehicles.

I am not sure I understand. I get phone alerts for an old person missing in the city. No
description or location. However I never got a phone alert about the oil leak. Is it more
responsible to send a phone alert saying the oil leak has come ashore and even more
reprehensible that it was not defined and contained days before. I would think a missing old
person not defined in location but the oil leak effected everyone including those planning to
attend the air show on Sunday should have been more important than an old person not
defined by location. Get your act together as all City Council should be held to account for
their actions and some should be put in jail.

Thursday and had the opportunity to protect the wetlands. I saw the police helicopter
hovering by the pier, I assume to watch the oil flow. People were in un safe water. I guess the
protection of the wetlands and the protection of the public was not as important as the
airshow (the show must go on) until the oil reached the beach in disproportionate amounts
late Saturday. The oil company is responsible but you as our mayor and city council are equally
responsible for your lack of action.
A phone alert should have been sent instead of the email and the wetlands should have been
protected sooner. Your fault and you need to own it.
