Present: Absent: Bolton , Delgleize, Carr, Moser, and Kalmick Peterson, and Posey PLEDGE OF ALLEGIANCE -Led by Mayor Pro Tern Delgleize ANNOUNCEMENT OF SUPPLEMENTAL COMMUNICATIONS (Received After Agenda Distribution) Pursuant to the Brown "Open Meetings" Act , City Clerk Robin Estanislau announced supplemental communications that were received by her office following distribution of the Council Agenda packet: Administrative Items #1 (21-750) Twenty (20) email communications regarding oil spill/leak off the Coast of Southern California Draft Resolution No . 2021-58 declaring the existence of a local emergency in Huntington Beach PUBLIC COMMENTS (3 Minute Time Limit)-8 In -Person Speakers The number [hh:mm :ss] following the speakers ' comments indicates their approximate starting time in the archived video located at http://www.surfcitv-hb.org!governmentlagendas . KC Fockler, Member, Surfrider Foundation , was called to speak and stated his support for a resolution that opposes any new offshore drilling off the coast of California , and specifically Huntington Beach. He asked City Council to support the West Coast Protection Act, SB 58 and House Resolution 653 . He Council/PFA Special Meeting Minutes October 4, 2021 Page 2 of 4 expressed appreciation for Surfrider members being included in the emergency response team at Life Guard Headquarters, and stated thousands of people are ready to assist with clean up. (00 :03 :29) Kathleen McGowan, Member of the Huntington Beach Environmental Board, was called to speak and offered the assistance of all Environmental Board members . Ms . McGowan also stated the Federal Bureau of Safety and Environmental Enforcement has regulatory oversight for the oilfield and their operations, and explained she had emailed further details to each Councilmember. (00:06 :35) Laura Sire, a nearly 60-year resident of Huntington Beach, was called to speak and stated her support for the Council members , and asked that no one sign the Recall Petition . (00:08: 17) Richard Busch , Beach Clean-up Coordinator, Surfrider Foundation, was called to speak and stated his support for KC Fockler's comments and added that people and businesses from across the United States are reaching out and offering to help clean up the beaches. Mr. Busch asked that the Surfrider Foundation be notified when t hey can mobilize the volunteers . (00:09 :35) Ra lph Salazar, Ovation Scientific, was called to speak and described his company's product, Oil Spill Eater II (OSE II), a biologic enzyme that has been used around the world to clean up over 40,000 spills, and asked for an opportunity to demonstrate the power of OSE II. (00 :11 :08) Rudy Aguilar, owner of a facility maintenance business, was called to speak and stated he uses Oil Spill Eater II every day in his business , described it as an incredible product, and encouraged City officials to ask for a product demonstration . (00 : 13:58) Bud Benneman , Vice Chair , Huntington Beach Environmental Board and Golden West College Professor, was called to speak and asked on behalf of one of his students why Huntington Beach has not been proactive and implemented a tax to be used for ocean clean up and restoration . (00 : 16:01) Dave Min , State Senator, was called to speak, described the State's efforts to monitor the oil spill and communications with other State and Federal agencies. Senator Min commended the City Council for being proactive and stated there is an effort to get as many resources into the area as soon as possible. Senator Min added that Cal ifornia has had a moratorium on new drilling in State waters since 1969, and a new plea has been made to Congress to also enact an end to Federal drilling . (00 : 17:55) ADMINISTRATIVE ITEMS 1. 21 -750 Discussed held on oil spill/leak off the Coast of Southern California, impacting coastal Orange County and the health, safety and welfare of the City of Huntington Beach; and, adopted Resolution No. 2021-54 declaring an emergency thereto City Manager Chi presented a PowerPoint communication entitled City of Huntington Beach Oil Spill 2021 Emergency Declaration Consideration, with slides entitled: Current Situational Overview; Emergency Declaration Overview; Coordination With Orange County; Timeline of Events -Saturday, 1012 (5); numerous untitled photos; Wildlife Res cue Support Information; Beach Clean-Up Volunteer Support Information; Private Vessel Damage Claims; Economic Damage Claims; Orange County Health Care Agency Hotline; and City Information Hotline . Mayor Carr confirmed with City Manager Chi that the City's website would consolidate the information regarding all available resources. Council/PFA Special Meeting Minutes October 4, 2021 Page 3 of 4 Mayor Pro Tern Delgleize stated her appreciation for the detailed report and discussed with City Manager Chi information related to when volunteers can begin helping with the clean-up process. City Manager Chi explained that interested volunteers should sign-up with the Surfrider Foundation at https://cleanups.surfrider.org as that organization will spearhead the clean-up process at the appropriate time . Councilmember Moser thanked City Manager Chi for the detailed timeline of events and commended the entire City Management Team , Marine Safety, Police, and Fire Departments for immediately responding to reports, rather than waiting for direction from other agencies, in their efforts to provide public safety and protect natural habitats along the coastline . Councilmember Moser encouraged concerned individuals to donate to the non-profits , which will be going into action when it is appropriate. Councilmember Kalmick thanked not only local Huntington Beach staff and elected officials, but also Assemblywoman Cottie Petrie-Norris , State Senators Dave Min and Tom Umberg , and Orange County Supervisor Katrina Foley for ensuring resources were marshalled from all available levels. He commended Marine Safety, Police, and Fire Departments staff for ensuring public safety . Councilmember Bolton expressed her support of the appreciative comments made by her colleagues, and suggested the proposed resolution statement "whereas on October 2, 2021" be re-stated to "whereas on or about October 2, 2021 ". Further, she suggested that in the fifth paragraph, the reference to the number of gallons of spilled oil be stated as the initial amount reported of 126,000 gallons, as this number may continue to change day to day. Councilmember Moser stated that the California Department of Fish and Wildlife Office of Spill Prevention and Response (OSPR) reporting shows the initial incident was on Friday, October 1, 2021, and suggested that date should be referenced in the proposed resolution, including the "on or about" wording suggested by Councilmember Bolton . City Manager Chi said he and City Attorney Michael Gates would determine appropriate language that is not too specific, and Councilmember Moser additionally suggested that "Pipeline P00547 Incident" be referenced in the proposed resolution. Mayor Carr stated her appreciation to the Fire Department, Marine Safety, Police Department, the City's Executive Team and outpouring of support from the community at large. She thanked City staff and managers for being proactive, making decisions and taking action to implement protective measures before it was clear to the monitoring agencies that the oil would actually impact Huntington Beach wetlands and beaches. Mayor Carr reported she received a call from Coast Guard Rear Admiral Brian Penoyer, the lead agency for this incident, to thank Huntington Beach officials and staff for being proactive in responding. Mayor Carr expressed appreciation to County, State and Federal officials who are reaching out to support the City's effort to ensure that resources and funding are available to make everyone whole . Mayor Carr added that the situation is being monitored extremely closely to ensure beaches and water are made available to the public just as soon as it is safe. A motion was made by Bolton, second Moser to approve Resolution No 2021-58 as amended to change the first sentence to "on or about October 1, 2021," using 126,000 gallons, and referring specifically to Pipeline P00547 Incident. Council/PFA Special Meeting Minutes October 4, 2021 Page 4 of 4 The motion as amended carried by the following vote : AYES : NOES : Bolton, Delgleize , Carr, Moser, and Kalmick None ABSENT: Peterson, and Posey COUNCILMEMBER COMMENTS (Not Agendized) Mayor Pro Tern Delgleize gave a shout out to Fire Chief Haberle for his calm demeanor and proactive directions in this situation. She also suggested that people wanting to support clean-up efforts for the affected wildlife go to the Wetlands & Wildlife Care Center website for details and information on ways to help , whether donating money or supplies . Mayor Carr added that the Bolsa Chica Conservancy is also accepting donations that can be designated for wildlife rescue efforts . Councilmember Moser stated she is looking forward to having all of the resource information on the City's website, and thanked every agency that is collaborating for healing and restoration . She stated her commitment to transparency throughout the process .
