CLOSED SESSION REPORT BY CITY ATTORNEY — City Attorney Michael Gates reported no
discussions were held on Closed Session Items Nos . 2 - 6 ; and , in the matter of Closed Session Item
No. 21 -754 — Potential Litigation — recent Oil Discharge from pipeline off the coast of Huntington
Beach , by a vote of 5-0-2 (Bolton and Posey absent) , Council authorized the City Attorney to pursue
litigation to protect the City's interests .
Mayor Carr requested the City Manager's Office to announce items removed from the agenda because
of time needed to focus on oil spill issues , and Assistant City Manager Travis Hopkins announced the
following Agenda items were withdrawn from consideration : Nos. 8 - 13, 22 , 23 and 24 ,

Shirley Dettloff, a 57-year resident of Huntington Beach, was called to speak and stated support for the
current City Council and opposition to the Council Recall. (00: 12 : 17)
Linda MacDonell , a 25-year resident of Huntington Beach and member of HB Reads , was called to
speak and announced October is Bully Prevention Month. Ms. MacDonnell stated that as a resident she
appreciates Council's efforts for the Navigation Center, and the time that each Councilmember gives to
take care of City business. (00: 14: 07)
Karen Ccarroll , a long-time resident, was called to speak and stated her opposition to the Council Recall.

Linda Rose, a 41 -year resident and homeowner, was called to speak and stated her appreciation for the
many positive changes made by the current Council . (00 : 15:49)
Cathey Ryder, homeowner since 1985, was called to speak and stated her support for Consent Calendar
Item #18 regarding traffic signal synchronization along Bolsa Avenue , and Councilmember Items #25
regarding a plan to upgrade the City Fleet to Alternative Fuel Vehicles. Ms . Ryder also thanked
Councilmembers, City staff and First Responders who are working to mitigate the current environmental
disaster. (00: 16:20)
Luanne Nichols , a fourth generation Huntington Beach property owner, was called to speak and
described her personal opinions related to high density housing mandates SB 9 and SB 10 from
Sacramento. She shared her opinion that Mayor Carr, Mayor Pro Tern Delgleize, Councilmembers
Kalmick, Moser and Posey appear to support Sacramento's high density housing standards for
Huntington Beach , rather than following the City Charter and representing the residents as they promised
during their election campaigns. (00: 17 : 14)
Victoria VanTwist, a resident of Huntington Beach and member of the Tobacco and Vape Free OC
Coalition , was called to speak and presented a framed certificate to acknowledge the City's efforts to
protect the health and safety of residents by updating the definition of smoking to include marijuana and
vaping . Ms. VanTwist thanked Councilmembers for supporting smoke-free air. (00: 19: 37)
Marlene Flaherty, a resident for 25 years and Senior Citizen caregiver, was called to speak and shared
her personal experience of receiving what she perceives as an unjust parking ticket at the Main Street
Post Office at 2 PM today, and asked that the ticked be absolved . (00: 20: 23)
Pat Goodman was called to speak and stated that a couple of recent articles in the Orange County
Register and Los Angeles Times are worth reading to better understand high-density housing and SB 9
and SB 10. She also stated that her review of the Council vote on May 3 , 2021 , shows opposition to SB
9 and SS 10, not support as some residents are claiming . Ms. Goodman stated her opposition to the

Tim Geddes , a resident of southeast Huntington Beach since 1983, was called to speak and shared his
support for the way Mayor Carr, and County and State officials have stepped forward to address the
current environmental disaster to ensure that our beaches, coastal waters and marine wildlife are
preserved. He further stated his opposition to the Council Recall . (00 :26 :26)
Kimo Gandall was called to speak and shared his opinions on the current oil spill , stated his support for
the Council Recall , and cited Consent Calendar Item #20 regarding Section 230 . 26 (Affordable Housing)
to support his opinion parks and open green spaces are unfortunately being replaced with housing . He
asked Councilmembers to vote against high-density development to preserve the City's culture and
quality of life. (00:29:26)
Pano Frousiakis, a Candidate for City Council in 2022, was called to speak and shared his opinions on
the current environmental crisis, and opposition to the lobbyists influencing Planning Commissioners
regarding development of the former Gisler Middle School property. He also stated his support for the
Council Recall. (00 : 32: 13)
Don Kennedy, a resident since 1962, was called to speak and stated his dissatisfaction with Council's
efforts to circumvent the will of the voters by arbitrarily approving hundreds of millions of dollars in debt,
foregoing property taxes, and appointing Ms . Bolton rather than allowing the voters to select a Council
member. (00: 35: 23)
An unnamed guest, who stated his name was not important and was wearing a mask, was called to
speak and shared his derogatory opinions of the Councilmembers. (00: 38:36)
An unnamed guest was called to speak and shared recent Councilmember statements printed in the
Orange County Register to document his opinion that six Councilmembers are using the oil spill to
politicize the tragedy and deflect from the Council Recall . He asked that Councilmembers resign, and
stated his support for the Council Recall to restore Huntington Beach . (00:40:42)
Kathryn Levassiur, a resident of Huntington Beach, was called to speak and shared her opinions
regarding a most restrictive short-term rental (STR) ordinance and imposing it upon Sunset Beach
residents. She asked what Council expected to achieve through the current STIR ordinance, and
expressed her opinion that allowing more time will not increase compliance. She also asked why OC
Alert was not used to notify people that the Sunday Air Show had been cancelled. (00:43: 10)
Donna Brandt, President, Therapeutic Riding Center at Huntington Central Park Equestrian Center, was
called to speak and invited Councilmembers and the public to their Boots and Bowties fundraiser on
Saturday, October 16, Therapeutic Riding Center is a 501 (c)3 volunteer supported non-profit to benefit
anyone with mild to severe disabilities . Additional details about the organization and upcoming event can

Galen Pickett, a 10-year resident of Huntington Beach , was called to speak and stated his opinion that
everyone has a choice through their responses to provide healing , or increase divisiveness . (00:49:40)
Dave Davis was called to speak and suggested there should not be a van and boat show on the same
weekend as the Air Show, and stated his dismay that at least 40 Handicap Parking spaces were
unavailable for use. He also shared his opinion on the unnecessary cancellation of the Sunday Air
Show, and asked that the Council use common sense in their decision making . (00: 50: 38)
Caller #5760 , Ben Pickens, a long-time Huntington Beach resident, was invited to speak and shared his
comments regarding the oil spill and COVID- 19 pandemic mandates. (00:53:51 )

Caller Allison Plum , a ten-year resident of Huntington Beach and Mobile Home Advisory Board Member,
was called to speak and invited the public to attend the next meeting of the Mobile Home Advisory Board
on Monday, October 25 , at 5 PM . Ms . Plum described the purpose of the Advisory Board, and stated her
personal opposition to the Council Recall. (00: 55:44)
Caller Dan McDonald , Huntington Beach resident and homeowner, was invited to speak and shared his
opinions on SB 9 based on reading the actual law, and his belief that having Sacramento write local
land-use laws is not a good idea . Mr. McDonald asked why Councilmembers do not appear to be even
researching Californians for Community Planning , a group that supports a ballot initiative to amend the
California Constitution to cement local control over local land use issues . (00: 58 : 19)
COUNCIL COMMITTEE — APPOINTMENTS — LIAISON REPORTS, AB 1234 REPORTING, AND
OPENNESS IN NEGOTIATIONS DISCLOSURES
Councilmember Kalmick reported attending a Harbor Commission meeting and announced there are
going to be two (2) vacancies on that Commission; and, there are four (4) vacant positions on the
Environmental Board .
Councilmember Moser reported attending the League of California Cities Annual Conference and Expo
in Sacramento, and a Project Zero meeting . Councilmember Moser announced her appointment of
Damon Mircheff to the Charter Review Commission.
Mayor Pro Tern Delgleize reported attending a Be Well OC meeting on homelessness, and meeting to
review Central Park's efforts to update the children's play equipment and the Shipley to Shore Trail
progress. Mayor Pro Tern Delgleize announced her appointment of Dianne Thompson to the Charter
Review Commission .
Councilmember Bolton reported attending the League of California Cities Annual Conference and Expo
in Sacramento, and announced her appointment of Cynthia Benton to the Charter Review Commission .
Mayor Carr reported attending the League of California Cities Annual Conference and Expo in
Sacramento , and announced she was recently elected to represent large cities from the Orange County
Division of the League of California Cities and was sworn in . She also attended a Be Well OC Project
Hope meeting , and met with the Huntington Beach Fire Authority,
Mayor Carr thanked the Fire Department, Marine Safety, and the City's Executive Team for taking
preventive and proactive steps to mitigate potential impacts to the wetlands , rather than waiting to
receive any other agency green light or directive. Mayor Carr reported she received a call from Coast
Guard Rear Admiral Brian Penoyer, the lead agency for this incident, to thank Huntington Beach officials
and staff for being proactive in their response .
Mayor Carr provided an update from a virtual meeting earlier in the day with County, State and Federal
officials regarding the oil spill . Topics discussed included clean-up plans, training required for all
volunteers, continued monitoring of the situation , no fishing allowed from Sunset Beach south to San
Clemente, opportunities to make whole businesses that have been impacted , and added the incident is
under a federal investigation .
Mayor Carr announced that the City's website now has a central page with all of the resources available
related to the oil spill .

first term as a member of the Human Relations Task Force through December 31 , 2023 , the end of term
for the current vacancy; and/or approve the appointment of Elaine Keeley for her initial term as a
member of the Human Relations Task Force through December 31 , 2021 , the end of term for the current
vacancy and approve an extension of her term through December 31 , 2025 ; and/or approve the
reappointment of Antonio Benitez as a member of the Human Relations Task Force through December
31 , 2025; and/or approve the reappointment of Hemesh Patel as a member of the Human Relations Task

Department of Parks and Recreation for the Outdoor Equity Grants Program Grant
Funds

City Council of the City of Huntington Beach Approving the Application for Outdoor Equity Grants
Program Grant Funds . "

execute "Cooperative Agreement No. C- 1 -3598 Between Orange County Transportation Authority and
Cities of Huntington Beach , Santa Ana , Tustin , Westminster and the County of Orange for First
Street/Bolsa Avenue Regional Traffic Signal Synchronization Program Project. "

(AIMS ) to serve as the Third -Party Administrator of the City's Workers'
Compensation Program

execute , " Professional Services Contract Between the City of Huntington Beach and Lien on Me , Inc. , for
Medical Bill Review Services , " in an amount not to exceed $525 , 000 . 00 for the three-year period ; and ,
approve and authorize the Mayor and City Clerk to execute , "Professional Services Contract Between
the City of Huntington Beach and Arissa Cost Strategies , LLC , for Utilization Review Services of City's
Workers' Compensation Claims , " in an amount not to exceed $300, 000. 00 for the three-year period ; and ,
approve and authorize the Mayor and City Clerk to execute , "Amendment No . 1 to Professional Services
Contract Between the City of Huntington Beach and Acclamation Insurance Management Services
(AIMS) for Workers' Compensation Third Party Administration , " in an amount not to exceed $920, 182 . 00
for the two-year period .

PUBLIC HEARING
21 . 21 =715 Adopted Resolution No. 2021 =56 approving an Annual Assessment within the
Huntington Beach Downtown Business Improvement District for Fiscal Year 2021 -
2022, and authorized appropriation of fund
Development Director Steve Holtz introduced Economic Development Manager Kriss Casanova who
presented a PowerPoint communication titled FY 2021-2022 Downtown Huntington Beach Business
Improvement District (BID) Renewal, with slides entitled Downtown BID, Annual Assessment, 2020-2021
Accomplishments, 2021 -2022 Goals, Proposed Budget, Proposed Expenses, and Public Hearing.
Mayor Carr opened the Public Hearing .
City Clerk Robin Estanislau announced that at this time the City Council would hear and consider all
protests against the renewal of the Downtown Business Improvement District, the extent of the area , or
the furnishing of specified types of improvements or activities within the area . All written protests must
have already been received by the start of this public hearing . A written protest may be withdrawn in
writing at any time before the conclusion of this public hearing . A new protest may be made orally at this
public hearing . If a business owner is making a new oral protest , and has not already filed a written
protest, please state clearly your name, business name , business address and assessment amount
protested .
If written protests are received from the owners of businesses in the proposed area which will pay 50
percent or more of the assessments proposed to be levied and protests are not withdrawn so as to
reduce the protests to less than 50 percent, no further proceedings to renew the Downtown Business
Improvement District or to levy the proposed assessment , shall be taken for a period of one year from
this date . If the majority protest is only against the furnishing of a specified type or types of improvement
or activity within the area, those types of improvements or activities shall be eliminated .
At the conclusion of the public hearing to renew the Downtown Business Improvement District, the City
Council may adopt, revise , change, reduce or modify the proposed boundary, assessment of the type or
types of improvements and activities to be funded with the revenues from the assessment.

Pursuant to the Brown "Open Meetings" Act, City Clerk Robin Estanislau announced supplemental
communications that were received for this item by her office following distribution of the Council Agenda
packet:
#21 . (21415) A PowerPoint communication titled FY 2021 -2022 Downtown Huntington Beach Business
Improvement District (BID) Renewal submitted by Ursula Luna-Reynosa , Director of
Community Development.
City Clerk Estanislau announced there were no public speakers.
Mayor Carr confirmed with City Clerk Estanislau that no protests had been received .
City Clerk Estanislau reported that the percentage of assessments protested for the Downtown BID is
zero (0%) , or none ($0) of the $ 111 , 521 projected assessment amount, and that protests were received
from none (0) of the two hundred and sixty-one (261 ) businesses in the Business Improvement District
boundaries .
Mayor Carr closed the Public Hearing .

Councilmember Kalmick introduced this item by stating that the City has a fleet of 900 vehicles ,
California will stop selling combustion engine vehicles in 2035, and this item is intended to begin
planning for the move from fossil fuel vehicles .
Councilmember Moser added that it is important for Huntington Beach to lead and model the transition
from fossil fuels. She further stated that the number of vehicles involved in this plan will make a big
impact.
Councilmembers Peterson and Kalmick discussed the cost benefit aspect, and Councilmember Kalmick
explained the intent is to be ahead of the curve and setting a policy to eliminate combustion vehicles by
purchasing alternative fuel vehicles.
Councilmember Peterson stated he would like to see a more detailed cost benefit analysis before
approving such a policy, and suggested it may not be appropriate to replace all types of vehicles.
Councilmember Kalmick stated his expectation that staff will include the cost benefit analysis as part of
the process.
Councilmember Moser stated she expects the staff report will provide options to consider, including
possibly excluding certain types of vehicles from the program .
Mayor Carr asked that the staff report include available grants to fund the transition .
A motion was made by Kalmick, second Moser to recommend that the City Council direct the City
Manager to prepare a plan to transition the entire City fleet to alternative fuel vehicles .

Mayor Pro Tern Delgleize announced the website for consolidated oil spill resources is
https://huntingtonbeachca . gov/residents/oil-spill-response/. Mayor Pro Tem reported participating in the
opening of the 44°i Old World Oktoberfest Opening Ceremony , and noted that Bernie is in good health
after severely burned in the fire that broke out during last year's festivities .
Councilmember Peterson thanked Code Four, Huntington Beach Police and Fire Departments , Life
Guards, and Public Works for a successful two-day Pacific Air Show and excellent crowd management .
Councilmember Moser stated her appreciation to everyone who was involved in the Pacific Air Show and
keeping everyone safe . She also commended the Huntington Beach Public Information Office (PIO) for
an outstanding job of communication regarding the oil spill . Councilmember Moser reported attending a
community meeting hosted by the Huntington Beach Police Department with Be Well OC Mobile Crisis
Response Unit at Lifeguard Headquarters regarding a recent unfortunate event. Councilmember Moser
also announced that October is Bully Prevention Month , which provides an opportunity to focus on
treating others with respect and care.
Mayor Carr reported attending the U . S . Open of Surfing and congratulated the two champions . Mayor
Carr thanked Kevin Elliott of Code Four and everyone else who was involved in the amazing , but

abbreviated , Pacific Air Show that was attended by approximately 1 .5 million people on Saturday, and
stated she is doing what she can to ensure Code Four is made whole in spite of events , which closed the
beaches on Sunday. Mayor Carr reminded everyone that tar is not safe, should not be handled, and
asked that people not touch any wildlife impacted by the oil spill , but rather notify authorities so the
situation can be properly addressed .
Mayor Carr thanked Jennifer Carey, Public Information Officer, for ensuring the accuracy of information
reported about the oil spill.
Councilmember Bolton reported attending the Air Show and expressed her pride in how well the City has
responded to the oil spill .
