Director of Public Works Subject: Adopt Ordinance No. 4237 amending Huntington Beach Municipal Code Chapter 10.12 relating to speed limits on Atlanta Avenue between Huntington Street and Beach Boulevard - Approved for introduction 10/19/2021, Vote: 6-0-1 (Peterson-Absent) Statement of Issue: Ordinance No. 4237 approved for introduction on October 19, 2021, requires adoption. Financial Impact: None. Funding for the implementation of the recommended speed limits is included in the Public Works Department operating budget. Recommended Action: Adopt Ordinance No. 4237, "An Ordinance of the City of Huntington Beach Amending Chapter 10.12.080 of the Huntington Beach Municipal Code Relating to Speed Limits." Alternative Actionlsl: Adopt posted speed limits different from those recommended and forgo enforcement using speed- measuring devices for the updated speed limits on Atlanta Avenue from Huntington Street to Beach Boulevard. Analysis: When roadway conditions undergo significant changes, an updated evaluation following State procedures is required to post enforceable speed limits on those roadways. Improvements were recently completed on Atlanta Avenue between Huntington Street and Delaware Street, adding an additional eastbound vehicle lane and eastbound bike lane along with new sidewalk on the south side. Due to these changes in roadway conditions, reevaluation of the speed limit is required to continue enforcement. City staff has performed the three required elements used to establish posted speed limits in accordance with procedures set forth by the State of California. All speed limits shall be established in conformance with the State adopted procedures in order to gain legal support for enforcement of City of Huntington Beach Page 1 of 3 Pnnted ron 1027/2021 File #: 21-805 MEETING DATE: 11/2/2021 the posted speed limit. The three elements used to establish speed limits are: 1) Sample the existing travel speeds at representative locations within the roadway segment. 2) Review accident history. 3) Review the street segment to identify roadway characteristics and conditions that may not be readily apparent to motorists. The review of travel speeds is used to establish a baseline speed limit for a roadway segment. Per California Standards, the posted speed limit is established at the nearest five mile per hour (5 mph) increment of the 85th percentile speed of free-flowing traffic, except as shown in the two options below: 1. The posted speed may be reduced by 5 mph from the nearest 5 mph increment of the 851h percentile speed of free-flowing traffic. Documentation is required of the conditions and justification for the lower speed limit. 2. For cases in which the nearest 5 mph increment of the 85" percentile would require rounding up, then the speed limit may be rounded down to the nearest 5 mph increment below the 851h percentile speed, if no further reduction is used. Case law has shown the courts will not support any speed limit posting that appears to be arbitrary. In other words, without demonstrated technical information to support the postings. To ensure consistency in establishing speed limits, the State has established very specific procedures, requirements and standards under which all speed limits are to be established. Any speed limit found by the courts to be inconsistent with approved requirements is deemed a "speed trap" and therefore not enforceable. The current speed limits on Atlanta Avenue between 1st Street and Beach Boulevard Street are 35 miles per hour between 1" Street and Delaware Street, and 40 miles per hour between Delaware Street to Beach Boulevard. Based on the study conducted in accordance with State requirements, the recommended update is a 40 mile per hour speed limit on Atlanta Avenue between Huntington Street to Beach Boulevard. The 35 mile per hour speed limit on Atlanta between 151 Street and Huntington Street will remain. Attachment 1 shows a diagram of the current and recommended updated speed limits. Attachment 2 documents that staff identified roadway characteristics within Atlanta Avenue between Huntington Street and Beach Boulevard that may not be readily apparent to motorists. Due to these conditions, posting near the 85th percentile speed (45 mph) may not be reasonable and prudent to facilitate the orderly flow of traffic. Documentation of the roadway conditions was provided to use the aforementioned option to reduce the speed limit 5 mph from the nearest 5 mph increment of the 851h percentile speed for a posted speed limit of 40 miles per hour. This speed limit posting matches the current speed limit on Atlanta Avenue east of Delaware Street. Attachment 3 presents the Legislative Draft of the recommended ordinance adopting the speed limit on Atlanta Avenue between Huntington Street and Beach Boulevard. Attachment 4 shows Ordinance No. 4237 amending the enumerated speed limits in Municipal Code Section 10.12.080. Agenda Item #27 requests amending of Huntington Beach Municipal Code Chapter 10.12 relating to speed limits on Atlanta Avenue between Huntington Street and Beach Boulevard. Essentially this is a request to increase the posted speed limit along Atlanta Ave from 35mph to 40mph. I often discuss our public rights-of-way and how we could greatly improve the quality of life in HB by proactively re-shaping these public spaces to be more accommodating for people. And while we often focus on better bike lanes, more crosswalks, and other highly visible infrastructure improvements for pedestrians and cyclists, vehicle speeds are frequently overlooked. As a frequent walker and cyclist, I simply can't emphasize this point enough: Vehicle Speeds, more than any other single factor, are both what make pedestrians and cyclists feet unsafe and are statistically are an ever- present contributor to vehicle crashes and pedestrian/cyclist injuries and deaths. The thought that we would ever willingly increase a posted speed limit seems extremely counterproductive. I have corresponded with HB Public Works about this issue, and while I understand they feel bound by various state-wide standards to make this request, I don't believe, those in Public Works or anyone else actually feels that increasing posted speed limits is ever in the best interest of residents whether behind the wheel. on a bike or traversing our streets on foot. I respectfully request that this agenda item be tabled and that an alternative motion be made focused on engaging in further discussion and study of posted speed limits both at this location but also throughout Huntington Beach. To ensure consistency in establishing speed limits, the State has established very specific procedures, requirements and standards under which all speed limits are to be established. Any speed limit found by the courts to be inconsistent with approved requirements is deemed a "speed trap" and therefore not enforceable. The current speed limits on Atlanta Avenue between 1" Street and Beach Boulevard Street are 35 miles per hour between 1s' Street and Delaware Street, and 40 miles per hour between Delaware Street to Beach Boulevard. Based on the study conducted in accordance with State requirements, the recommended update is a 40 mile per hour speed limit on Atlanta Avenue between Huntington Street to Beach Boulevard. The 35 mile per hour speed limit on Atlanta between 151 Street and Huntington Street will remain. Attachment 1 shows a diagram of the current and recommended updated speed limits. Attachment 2 documents that staff identified roadway characteristics within Atlanta Avenue between Huntington Street and Beach Boulevard that may not be readily apparent to motorists. Due to these conditions, posting near the 851h percentile speed (45 mph) may not be reasonable and prudent to facilitate the orderly flow of traffic. Documentation of the roadway conditions was provided to use the aforementioned option to reduce the speed limit 5 mph from the nearest 5 mph increment of the 85th percentile speed for a posted speed limit of 40 miles per hour. This speed limit posting matches the current speed limit on Atlanta Avenue east of Delaware Street. As many of you know, I have been an avid proponent of prioritizing pedestrian and bicycle infrastructure in Huntington Beach for some time. I see many community-wide benefits in making our streets, roadways, and thoroughfares safer and more accessible to those who choose to walk and/or bicycle in our community. I have met with various city council members, city staff, and fellow residents on this topic for the past several years. Not surprisingly, there is almost universal support for addressing these needs. However, when I see proposals like that contained in Agenda Item #22 seeking to increase the posted speed limit along a recently improved section of Atlanta Ave., I realize there is still so much work to do. I have already reached out to the Public Works Dept. to discuss my concerns. As always,they have been responsive in explaining their rationale for this request, but regardless of their reasons, I see this requested change as presenting an added danger to our streets. I respectfully request we seek further study to find a better/safer alternative. I am writing to urge you to vote against Agenda Item #22 and instead make a motion for Public Work to study this matter further rather than simply increasing the posted speed limit. <<Note: Above is the short version of my letter. Below are my more specific concerns.>> My reasons for opposing the increase in the posted speed limit as requested by Agenda Item #22 are as follows: First, the section of Atlanta Ave between Beach Blvd and 1"Street has always been tricky and presents challenges for pedestrians, bicyclists, and drivers. The road itself has multiple locations where the paved surface narrows and provides for on-street parking. These factors combined with a section of fairly steep incline can create a confused and somewhat chaotic environment for all users. It should also be noted that this stretch of roadway should be seeking to slow vehicles down as they enter our dense downtown residential neighborhoods. In my opinion, any increase in the posted speed limit adds an unnecessary element of danger for all users. Second, Atlanta Avenue represents the only relatively safe route for cyclists attempting to navigate back and forth from southeast Huntington Beach into the heart of our City: Downtown HB. PCH is only an option for elite road cyclists, and the issues of using the multi-use path along our beachfront are well documented and unresolved.The City of Huntington Beach Public Works Dept. has made tremendous progress in improving most of Atlanta Avenue into a viable east/west bike route for residents. Still, the section addressed by Agenda Item #22 has always been "tricky" in terms of bicycle safety. Improvements were recently completed on Atlanta Avenue between Huntington Street and Delaware Street, adding an additional eastbound vehicle lane and eastbound bike lane along with new sidewalk on the south side. Due to these changes in roadway conditions, reevaluation of the speed limit is required to continue enforcement. All speed limits shall be established in conformance with the State adopted procedures in order to gain legal support for enforcement of the posted speed limit. The three elements used to establish speed limits are: 1) Sample the existing travel speeds at representative locations within the roadway segment. 2) Review accident history. 3) Review the street segment to identify roadway characteristics and conditions that may not be readily apparent to motorists. The review of travel speeds is used to establish a baseline speed limit for a roadway segment. Per California Standards, the posted speed limit is established at the nearest five mile per hour (5 mph) increment of the 85th percentile speed of free-flowing traffic, except as shown in the two options below: 1 . The posted speed may be reduced by 5 mph from the nearest 5 mph increment of the 8511 percentile speed of free-flowing traffic. Documentation is required of the conditions and justification for the lower speed limit. 2. For cases in which the nearest 5 mph increment of the 851h percentile would require rounding up, then the speed limit may be rounded down to the nearest 5 mph increment below the 851h percentile speed, if no further reduction is used. Case law has shown the courts will not support any speed limit posting that appears to be arbitrary. In other words, without demonstrated technical information to support the postings. To ensure consistency in establishing speed limits, the State has established very specific procedures, requirements and standards under which all speed limits are to be established. Any speed limit found by the courts to be inconsistent with approved requirements is deemed a "speed trap" and therefore not enforceable. The current speed limits on Atlanta Avenue between 1s1 Street and Beach Boulevard Street are 35 miles per hour between 1st Street and Delaware Street, and 40 miles per hour between Delaware Street to Beach Boulevard. Based on the study conducted in accordance with State requirements, the recommended update is a 40 mile per hour speed limit on Atlanta Avenue between Huntington Street to Beach Boulevard. The 35 mile per hour speed limit on Atlanta between 1 If Street and Huntington Street will remain. Attachment 1 shows a diagram of the current and recommended updated speed limits. Attachment 2 documents that staff identified roadway characteristics within Atlanta Avenue between Huntington Street and Beach Boulevard that may not be readily apparent to motorists. Due to these conditions, posting near the 851h percentile speed (45 mph) may not be reasonable and prudent to facilitate the orderly flow of traffic. However, I am strongly opposed to Agenda Item #22 and needed to reach out to let you know. As many of you know, I have been an avid proponent of prioritizing pedestrian and bicycle infrastructure in Huntington Beach for some time. I see many community-wide benefits in making our streets, roadways, and thoroughfares safer and more accessible to those who choose to walk and/or bicycle in our community. I have met with various city council members, city staff, and fellow residents on this topic for the past several years. Not surprisingly, there is almost universal support for addressing these needs. However, when I see proposals like that contained in Agenda Item #22 seeking to increase the posted speed limit along a recently improved section of Atlanta Ave., I realize there is still so much work to do. I have already reached out to the Public Works Dept. to discuss my concerns. As always,they have been responsive in explaining their rationale for this request, but regardless of their reasons, I see this requested change as presenting an added danger to our streets. I respectfully request we seek further study to find a better/safer alternative. I am writing to urge you to vote against Agenda Item #22 and instead make a motion for Public Work to study this matter further rather than simply increasing the posted speed limit. «Note: Above is the short version of my letter. Below are my more specific concerns.» My reasons for opposing the increase in the posted speed limit as requested by Agenda Item #22 are as follows: First, the section of Atlanta Ave between Beach Blvd and 1" Street has always been tricky and presents challenges for pedestrians, bicyclists, and drivers. The road itself has multiple locations where the paved surface narrows and provides for on-street parking. These factors combined with a section of fairly steep incline can create a confused and somewhat chaotic environment for all users. It should also be noted that this stretch of roadway should be seeking to slow vehicles down as they enter our dense downtown residential neighborhoods. In my opinion, any increase in the posted speed limit adds an unnecessary element of danger for all users. Second, Atlanta Avenue represents the only relatively safe route for cyclists attempting to navigate back and forth from southeast Huntington Beach into the heart of our City: Downtown HB. PCH is only an option for elite road cyclists, and the issues of using the multi-use path along our beachfront are well documented and unresolved. The City of Huntington Beach Public Works Dept. has made tremendous progress in improving most of Atlanta Avenue into a viable east/west bike route for residents. Still, the section addressed by Agenda Item #22 has always been "tricky" in terms of bicycle safety. Unfortunately, the area proposed for an increased posted speed limit would lead right up to the most dangerous portion of this tricky section where Sharrows, existing on-street parking, and new center median planters create an extremely dangerous confluence of conditions for cyclists.
