Commissions, and Committees Approved for introduction November 16. 2021 - Vote 7-0 (#4239, #4241, #4242, #4243, #4244) and 6-1 (Peterson-No) on #4240 Statement of Issue: As part of the 2021 Strategic Planning session, City Council identified the streamlining of its Boards, Commissions, and Committees (BCCs) as a key priority and formed an Ad-hoc Council Committee. The ad-hoc Committee subsequently met with City Staff on April 27, May 24, June 8, July 29, August 10. and September 27, 2021 and developed ten recommendations for City Council's consideration. On October 19, the City Council approved ten recommendations to reform, consolidate and/or dissolve a select number of BCCs. Subsequently, on November 16, the City Council approved for Introduction Ordinance Nos. 4239, 4240, 4241, 4242, 4243, and 4244 prepared by Staff to implement approved adjustments on a select number of the City's BCCs. The second reading of these Ordinances are presented tonight for the Council's final adoption. Recommended Action: A) Adopt Ordinance No. 4242, "An Ordinance of the City Council of the City of Huntington Beach amending the Huntington Beach Municipal Code by repealing Chapter 2.103 and 2.111 and creating a new chapter 2.111 titled "Citizen Infrastructure Advisory Board/Public Works Commission:" and. B) Adopt Ordinance No. 4241 , "An Ordinance of the City Council of the City of Huntington Beach repealing the Huntington Beach Municipal Code Chapters 2.64 and 2.84 and adding a new chapter 2.64 titled Community and Library Services Commission:" and. C) Adopt Ordinance No. 4243, An Ordinance of the City Council of the City of Huntington Beach repealing the Huntington Beach Municipal Code Chapter Chapters 2.86 and 2.30 and add a new chapter 2.30 titled Community and Library Services Department:' and. I am interested to hear their justification of this proposal and why they (Delgleize, Posey, Kalmick)think the City Charter allows this. One of adjustments was to modify Personnel Commission's scope to refocus primarily on the critical matters related to investigations, appeals, and impasse matters, and leave job classification reviews to the City's administrative function. Staff is currently in the process of reviewing and updating current Personnel Rules adopted in 1974, including duties of the Personnel Commission and will bring a resolution back to the City Council for its consideration and adoption upon the completion of updating Personnel Rules. Separately, the City Council directed Staff to form the Disability Advisory Committee as a separate stand-alone committee with potentially seven at-large citizen appointees, rather than having it as a subcommittee of the Citizens Infrastructure Advisory Board/Public Works Commission to address needs of people with disabilities in Huntington Beach. As such, Staff plans to present a proposal with roles and structure of such committee to the City Council at a later time. The Huntington Beach Municipal Code 2.100 Operating Policies for Boards and Commissions also requires adjustments to modernize and make rules clear, consistent, and enforceable across all BCCs. The City will be enforce and ensure that all BCCs adhere to this code once the amendment is approved. Approve the official dissolution of the Strategic Planning Ad-hoc Committee and BCC Review Ad-hoc Committee as their goals have been met. 2. Approve combining of the Downtown Economic Development Committee and the Economic Development Committee (EDC), comprising of the Mayor, Mayor Pro Tem, and Immediate Past Mayor. The EDC will meet every other month and as-needed. 3. Approve the conversion of Smart Cities Ad-hoc Committee into Smart Cities & Technology Committee. Per the Council's approval, this Committee becomes a standing Council Committee comprised of three appointed City Council members, whose goal is to provide strategic policy direction towards the City's Smart Cities roadmap / broadband master plan efforts as well as other innovative technology initiatives. 4. Adopt Resolution No. 2021-65 to repeal Resolution No. 2000-78 to formally dissolve the Children's Needs Task Force. This allows an official dissolution of the Children's Needs Task Force and its current members will retire effectively at the time of its dissolution. 5. Adopt Resolution No. 2021-66 to officially rename the Human Relations Task Force to the Human Relations Committee, approve its updated bylaws, and adopt the Declaration of Policy About Human Dignity (See Attachment 2). On October 19, 2021, the City Council approved the renaming the Human Relations Task Force (HRTF) to Huntington Beach Human Relations Committee (HBHRC) and directed Staff. The updated bylaws were approved by the HRTF and submitted tonight for the City Council's approval. Key changes include: 0 Revise the HRTF's title as the Huntington Beach Human Relations Committee 0 Update the Committee's bylaws to be consistent with HBMC 2.100 o Add the following Vision Statement to the Committee's bylaws: Huntington Beach is a community where all people feel respected, valued, and are free from discrimination and violence. o Revise the Mission Statement from "to promote and celebrate diversity in our community through education and understanding" to "to inspire and promote mutual understanding, respect, safety, and the wellbeing of all in our community through education and engagement." The attached bylaws were reviewed by the City Attorney and are approved as to form. In response to the exponential increase in hate crimes and incidents in the region over the past two years (based on the data included in the 2020 Orange County Human Relations Hate Crimes Report released on September 17, 2021), Mayor Carr also directed the Task Force to review and enhance the 25-year old document. As such, the HRTF discussed and made recommended changes on the Declaration of Policy About Human Dignity. The updated document is being presented for City Council's consideration and official adoption. This declaration was reviewed by the City Attorney and is approved as to form. 6. Adopt Ordinance No. 4242 to amend the Huntington Beach Municipal Code by repealing Chapter 2.103 and 2.111 and creating a new chapter 2.111 titled "Citizen Infrastructure Advisory Board/Public Works Commission"; Approve the official dissolution of the Beautiful, Landscape, and Tree (BLT) Committee. This allows the City to consolidate the Citizens Infrastructure Advisory Board (CIAB), Public Works Commission, and Beautification, Landscape, and Trees (BLT) Committee into the new CIAB/Public Works Commission. This will rename the Public Works Commission as the CIAB/Public Works Commission, incorporate the scopes of work for three advisory bodies and include the following provisions: o All current members of both bodies who remain in good standing will continue to serve in the new Commission until their terms sunsets. The Commission will thereafter be comprised of seven members serving the term that coincides with his / her Council appointer's term. o Incorporate the BLT's scope of work (excluding the administrative functions) into the duties of the CIAB/PW Commission. Current BLT Committee members will be released from membership. o Require future new members of the CIAB/PW Commission to be residents with special interest, training, and/or experience in the field of Public Works. o Revise the minimum project dollar threshold ($50,000) to be consistent with the City's policies related to CIP projects. 7. Adopt Ordinance No. 4241 to repeal the HBMC Chapters 2.64 and 2.84 and add a new chapter 2.64 Community Services Commission 8. Adopt Ordinance No. 4243 to repeal the HBMC Chapters 2.30 and 2.86 and add a new chapter 2.30 Community and Library Services Department This enables the City to consolidate the Community Services Commission and Library Board of Trustees and to amend the HBMC chapters reflecting the reorganization of the Community and Library Services Department as one department. Key changes in provisions include: o All existing members in good standing with the Library Board and Community Services Commission will continue to serve in their current terms until they sunset. Adopt Ordinance No. 4240 to amend HBMC Chapter 2.102 Environmental and Sustainability Board This allows the City to re-establish the Environmental Board as the Environmental and Sustainability Board and refine its role to develop and monitor progress on the City's comprehensive Sustainability Master Plan. The membership will be changed from 9 to 7 citizen members and chaired by two Council Liaison members. The Board will meet every other month and as needed. 10. Adopt Ordinance No. 4239 to amend HBMC Chapter 2.109 Finance Commission This allows the City to modify the Finance Commission structure to better align with the Finance Department's fiscal year milestones, which include mid-year and annual budget reviews and audits. The composition of the Commission continues to be seven (7) individual Council appointees, but preferably with a professional finance or budgeting background. The Finance Commission will meet six times per year and as needed at the request of the City Council or by Finance Commission request with the approval of the City Council. 11. Adopt Ordinance No. 4244 to amend HBMC Chapter 2.100 Operating Policies for Boards and Commissions During this review, it was identified that the Huntington Beach Municipal Code 2.100 Operating Policies for Boards and Commissions also requires adjustment to modernize and make rules consistent and enforceable across all BCCs. The City will ensure that all BCCs adhere to this code once the amendment is approved. The amendment include rules regarding removal of members, record retentions, and attendance requirements. Change in provisions include: o Removal of Members (New): Members may be appointed and positions maintained by individual or majority of City Council. o Attendance (Revised): Members with unexcused absences greater than one third of the scheduled meetings during a calendar year or miss more than two consecutive unexcused absences shall automatically vacate the office. o Records (New): Records of the boards and commissions, and committees shall be retained per the City's Records Retention Guideline. This diversity brings to our city a rich and varied cultural heritage. Our citizens honor and respect the diversity that exists in Huntington Beach. When acts of hate are committed against any citizen, it is considered an act against the entire community. The Huntington Beach City Council declares that everyone should be treated with courtesy and respect, regardless of their actual or perceived racial background, their nation of origin, the religion they practice, their sexual orientation, gender, gender identity or gender expression, or disability status. It is the right of all residents to pursue their daily lives with the knowledge that they will not be physically harmed or verbally abused. The Huntington Beach City Council states in the strongest terms that it condemns all hate incidents and hate crimes and will vigorously fight criminal activity related to hate with all of the resources at its disposal. A hate incident is the behavior that is motivated by hate or bias towards a person's actual or perceived disability, gender, gender identity, or gender expression, nationality, race or ethnicity, religion or sexual orientation but is not criminal in nature. Typically, these behaviors are protected by the First Amendment right to freedom of expression. If this type of behavior escalates to threats or is carried out against a person or property, or becomes an incitement to commit violence, it would be classified as a hate crime. According to California penal code 422.55, a hate crime is a criminal act committed, in whole or in part, because of one or more of the following actual or perceived characteristics of the victim: disability, gender, gender identity, or gender expression, nationality, race or ethnicity, religion, sexual orientation, or association with a person or group with one or more of these actual or perceived characteristics. It may involve a verbal, written, or physical action that is intended to create emotional suffering, physical harm or property damage. The City Council warns those who advocate or perpetrate hate not to test the community's resolve to oppose them. It is the city's stated policy to vigorously pursue a course of investigation, apprehension, prosecution, conviction, and incarceration of all those who participate in hate crimes. For hate incidents, and in cases where incarceration or prosecution is not sought or granted, the City Council strongly supports alternatives to carceral punishment, which gives an opportunity to repair harm within the community where and if possible. In support of this declaration, the City Council sends these messages: To the Community To the community we say, "Believe in the value of interdependence of all people. Every member of our community has the right to be treated with dignity and it is our collective responsibility to ensure this is normalized behavior. Participate at your places of worship community meetings, and wherever you are; lend your voice in opposing hate." To the Schools To the schools we say, "Continue fostering safe environments of learning and care. Encourage curiosity and keep developing programs and curricula which promote respect, inclusion and acceptance towards all. Call on resources of the city, the county, the state, and the nation as you engage in the educational process to combat hate." To the Parents To the parents we say, "Act as positive role models for your children by demonstrating inclusion and acceptance of those whose race, nationality, religion, sexual orientation, gender, gender identity, or gender expression, or disability status may be different from yours. You are the most powerful influence on your children's behavior." To the Youth To the youth we say, "Educate yourself to the ways of the world and the lessons of history. Develop sensitivity towards the feelings of others. Thus, as you grow into adulthood and become society's leaders, you will be more effective in the fight to preserve our humanity. " Do not ignore history. What we do should be a monument to all who have lost their lives because of hatred. We must all become activists in this battle as a living memorial. Remember that silence and apathy are the greatest allies of those committing hate crimes and initiating hate incidents. If you are a victim or a witness of a hate crime or hate incident, call 9-1-1, and say "I want to report a hate crime." With those seven words, you will instantly have as an ally the full resources of the city of Huntington Beach and the nearly 200,000 residents of our city. You are not alone! Together, the city of Huntington Beach and its residents will promote a city that welcomes all and vigilantly protects against hate crimes and hate incidents. The Huntington Beach City Council declares that it will not tolerate any hate crimes or hate incidents in our community. The previous Declaration of Policy on Human Dignity was unanimously adopted by the Huntington Beach City Council on May 6, 1996 in response to brutal hate crimes in Huntington Beach resulting in the murder of Vernon Flournoy and attempted murder of George Mondragon by members of white supremacist groups. The matter of hate incidents and hate crimes, which are numerous and pernicious, do much to degrade the quality of life for all in our community. Now known as Declaration of Policy on Human Dignity, this document was adopted by the Huntington Beach City Council on November 16, 2021. Resolution No. 2021-66 Exhibit "B" HUNTINGTON BEACH HUMAN RELATIONS COMMITTEE BYLAWS 1. Article I: NAME The name of this committee shall be the Huntington Beach Human Relations Committee (HBHRC). 2. Article It: VISION & MISSION STATEMENT 2.1 VISION STATEMENT Huntington Beach is a community where all people feel respected, valued, and are free from discrimination and violence. 2.2 MISSION STATEMENT The HBHRC mission is to inspire and promote mutual understanding, respect, safety and the wellbeing of all in our community through education and engagement. 3. Article III: MEMBERSHIP COMPOSITION 3.1. MEMBERSHIP Membership shall consist of 9 voting members. All members shall be residents and electors of the City of Huntington Beach. 3.2. FULL VOTING MEMBERSHIP The full voting membership of the HBHRC shall consist of 9 members. 4. Article IV: MEMBERSHIP TERMS OF SERVICE Each member shall be appointed by the City Council as recommended by the Council liaisons for a four-year term, with no member serving more than two consecutive terms. Members seeking reappointment for a second term shall submit a letter requesting reappointment to the City Council Liaisons for review and consideration 90 days prior to the expiration of their current term. Approximately one-half of the membership shall be appointed every two years. If a member fills a vacant seat with more than 2 years left for that term, this will count as 1 term. 5. Article V: MEMBERSHIP ATTENDANCE 5. 1. RULES FOR MEMBERSHIP Any member shall automatically vacate his/her membership upon a fifth (5th) unexcused absence during the calendar year or upon more than three (3) consecutive absences. With the exception of emergencies, absences must be reported to the Chairperson preceding the meeting so the absence may be recorded as excused in the minutes. 5.2. VACANCIES Upon removal or resignation of a member prior to the end of a term, a successor shall be appointed in accordance with Article IV to complete the vacated term. Resolution No. 2021-66 Exhibit "B" 6. Article VI: VOTING 6.1. RULES Each member of the HBHRC shall have one vote. 6.2. QUORUM A quorum of the full membership is required in order to transact business at every regular meeting. For the purposes of the HBHRC, a quorum is represented by a simple majority of the members then in office. 7. Article VII: MEETING REQUIREMENTS 7.1. TIME AND PLACE Regular meetings of the HBHRC shall be held in a designated location specified in the public posting. Additionally, if unforeseen or extenuating circumstances arise alternate accommodations can be made via digital platform. 7.2. OPEN MEETINGS All meetings of the HBHRC shall be open and public, and all persons shall be permitted to attend any meeting. All meetings shall be governed by Robert's Rules of Orders and the Brown Act. 7.3. POSTING OF PUBLIC MEETING NOTICE All agendas and notices of meetings for the HBHRC and its standing committees shall be posted for public review in accordance with the Brown Act. 7.4. ADJOURNED REGULAR MEETINGS Any regular meeting of the HBHRC may be adjourned to a subsequent date prior to the next regular meeting to consider further items. An adjournment notice shall be posted on the official posting board within 24 hours after the time of the adjournment. If a regular meeting of the HBHRC is adjourned to a subsequent date, a new agenda and notice of meeting must be posted as required by the Brown Act. 7.5. SPECIAL MEETINGS Special meetings may be called by the chairperson or a majority of the HBHRC. Notice of a special meeting must be given as required by the Brown Act. 8. Article VIII: OFFICERS 8.1. COMPOSITION Officers shall consist of one chairperson, one vice chairperson, and one secretary. 8.2. NOMINATION OF OFFICERS At the regular meeting immediately preceding the meeting at which officers shall be elected, the chairperson shall appoint a Nominations Committee consisting of three members. The Nominations Committee shall solicit and/or receive nominations and meet as frequently as necessary to screen nominees for the officers who will be elected. All officers shall be drawn from the membership. EXHIBIT B Resolution No. 2021-66 Exhibit "B" 8.3. ELECTION The annual election of officers shall be held at the regular meeting each December, or at such other meeting set by the membership. The Nominations Committee shall announce the names of those members who are seeking election to each of the officer positions to be elected. The chairperson shall ask the membership for additional nominations for each of the officers to be elected. Members may nominate other members or themselves. The chair shall allow the members to question any of the nominees. The election of each of the officers shall be conducted by secret ballot. 8.4 POSTPONING ELECTION OF OFFICERS By a majority vote of the members present, the HBHRC may postpone for a period not to exceed 90 days, the annual election of officers. In the event of a postponement, those members serving in the positions whose election was postponed shall be asked to continue until the new election. In the event that such officers do not wish to continue to serve in their positions, interim officers shall be elected by the membership to serve until the postponed election takes place. 8.5 TERMS All officers shall be elected by the full membership for a one-year term, with no officer serving more than three consecutive terms in the same position. 8.6 ATTENDANCE Officers are required to attend all regular meetings. Any officer having more than three unexcused absences during his or her term of office shall automatically vacate his or her position. 8.7 VACANCIES An unanticipated vacancy of an officer, which may occur during the course of an Officer's term, shall be filled by a vote of the membership within 30 days of the notice of resignation or vacancy. 9. Article IX: DUTIES OF OFFICERS 9. 1. CHAIRPERSON The Chairperson shall preside at all regular meetings of the HBHRC, prepare the agenda for all regular meetings, and shall have powers and duties as may be prescribed from time to time by the membership. The Chairperson shall be the spokesperson for the HBHRC and shall also have a vote on all matters. 9.2. VICE CHAIRPERSON The Vice Chairperson shall preside at all regular meetings in the absence of the Chairperson and perform duties as assigned by the Chairperson. The Vice Chairperson shall also have a vote on all matters. 9.3. SECRETARY The Secretary shall prepare minutes for all regular meetings. Other duties include the drafting of required business correspondence and the preparation of an annual summary of activities. The Secretary shall also have a vote on all matters. Article X: AUTHORIZATION TO TAKE ACTION The HBHRC shall take such actions that it deems necessary and proper to further the goals identified in its Mission Statement set forth in Article ll; provided, however, that such actions shall not be inconsistent with all applicable federal, state and local laws, regulations and ordinances as well as any recommendation or guidance received from a majority of the City Council. 11. I am concerned that regardless of the desired results of this ordinance that it may lead to consequences that are undesirable for the operation of the Board, for City Council as the beneficiaries of the Board's work, and for the people of Huntington Beach. I voiced some of these concerns in comments to the City Council on 10/19/2021 but wish to speak now to the proposed ordinance as written and presented to City Council for the 11/16/2021 Meeting. I would argue that one of the original duties of the Environmental Board as stated in the Original Municipal Code language of Original Municipal Code Section 2.102.050 is still a need for our city: "Study the environment of the City of Huntington Beach and investigate all actual and potential threats to a clean environment for the City and its inhabitants;" ...and that a need and benefit from this activiq xkill remain, whether or not there is a body so directed. By turning the focus of the Environmental and Sustainability Board to that which is defined in a specific Sustainability Master Plan risks limiting the ability of the board to respond quickly to new situations and opportunities where timeliness is important. These situations could range from -opportunities for community outreach such as the Student Environmental Art Contest which the Environmental Board initially proposed and has successfully conducted in recent years with support by the City Council, to - review of Environmental Impact Reports(EIRs) for the City Council - education of the public on environmental matters, some which may change rapidly. All of these activities are always understood to be at the service, diirection and approval of the City Council, regardless of the structure and procedures of the Environmental Board. The concern is how to enable the Board to take those actions, including it's communication with the City Council Liaisons, as effectively as possible. Toward that end, 1 would like to point out the following concerns about how the proposed changes to the Board may adversely affect it's operation: NUMBER OF MEMBERS The Board has previously operated with nine citizen members. That number ma seem arbitrary but the Board has found it advantageous for carrying out it's mission: -Nine members has allowed the Board to diNide into up to three separate ad hoc committees for review of EIRs. which make the work of effectively addressing these large documents much more feasible, especially when the number or scope of projects is large. -The Board benefits from a diversity of professional and citizenship experiences. t NUMRER OF MEETINGS - To keep the work of the Board moving forward. monthly meetings are beneficial. It is difficult for the bode to conduct planned projects. let alone rapid response. in a timely fashion with less frequent meetings, as has been found when meetings have been unavoidably cancelled. Less frequent nominal meeting schedule would also make the impact of future cancellations even more severe. PARTICIPATION OF CITY COUNCIL AS BOARD MEMBERS While communication with Council Liasons is critical to the Board's operation, placing these Councilmcmbcrs into the Board itself will be a strain on their already heavily-demanded time. It will make their attendance, and the subsequent impact on maintaining Board quorums. more problematic. 1 ask the the Council considers the impacts to the fulfillment of the mission of the Ivironmental and Sustainability Board. and consider a structure closer to that which currently exists, with resolve to maintain active communication with the City Council Liaisons as part of the Boards ongoing work Thank You for your consideration Mark Sheldon 2
