Adopt Resolution No. 2022-06 permitting the City Manager to execute all documents related to the
Permanent Local Housing Allocation Program (PLHA)
Statement of Issue:
On May 4. 2020. the City adopted Resolution No. 2020-29 to accept PLHA entitlement funds from the State
and to authorize the former City Manager to execute all program documents Due to the former City
Manager's departure, staff recommends adopting a new Resolution that authorizes the City Manager position,
and not a specific individual, to execute program documents moving forward This provides the City with
greater flexibility in the event the City Manager position transfers from one person to another.
Financial Impact: None
Recommended Action:
Adopt Resolution No 2022-06, "A Resolution of the City Council of the City of Huntington Beach Authorizing
the Application and Adopting the PLHA Plan for Permanent Local Housing Allocation Program" authorizing the
City Manager position or his/her designee to execute all documents related to the PLHA program.
Alternative Action(s):
Do not approved the recommended action and direct staff accordingly.
Analysis:
Since 2020, the City has annually received a subset of SB 2 funds known as PLHA entitlement funds. The
State's Department of Housing and Community Development (HCD) distributes these funds to entitlement
cities such as Huntington Beach and may be used toward housing-related projects to address the City's unmet
housing needs. Per HCD guidelines, the City has budgeted these restricted funds over the next 5 years
towards PLHA eligible expenses including the Be Well program (specifically for services to the homeless
population) and the Navigation Center for the homeless.
On May 4, 2020. the City adopted Resolution No 2020-29 to accept these funds and authorize former City
Manager Oliver Chi to execute all program documents. Due to his departure, the proposed Resolution No.
2022-06 will rescind Resolution No 2020-29 and authorize the City Manager role (not a specific person) to
execute PLHA documents in order to continue moving the program forward.

A RESOLUTiON OF THE CITY COUNCIL OF THE CITY OF HUNTINGrON BEACH TO
AUTHORiZE AND ADOPT A FIVE-YEAR PLAN FOR PERMANENT LOCAL HOUSING
ALLOCATION PROGRAM FUNDS AND TO SUBMIT AN APPLICATION FOR FUNDING
IN YEAR 1 (FISCAL, YEAR 2020-2021)
WHEREAS, the Department is authorized to provide up to $195 million under the
SB 2 Permanent Local Housing Allocation Program Formula Component from the Building
Homes and Jobs Trust Fund for assistance to Cities and Counties (as described in Health and
Safety Code section 50470 et seq. (Chapter 364, Statutes of 2017 (SB 2)); and
"rhe state of California (the "State"), Department of Housing and Community Development
("Department') issued a Notice of Funding Availability ("NOFA") dated 02/26/2020 under the
Permanent Local Housing Allocation (PLHA) Program; and
Applicant is an eligible Local government applying for the program to administer one or more
eligible activities, or a Local or Regional Housing Trust Fund to whom an eligible i.,ocal
government delegated its PLHA formula allocation; and
The Department may approve funding allocations for PLHA Program, subject to the terms and
conditions of the Guidelines, NOFA, Program requirements, the Standard Agreement and other
contracts between the Department and PLHA grant recipients.
NOW, THEREFORE, the City Council of the City of Huntington Beach, a municipality
("Applicant') does hereby resolve, consent to adopt as follows:
I. If Applicant receives a grant of PLHA funds from the Department pursuant to the above
referenced PLHA NOFA, it represents and certifies that it will use all such funds in a manner
consistent and in compliance with all applicable state and federal statutes, rules, regulations,
and laws, including without limitation all rules and laws regarding the PLi-iA Program, as well
as any and all contracts Applicant may have with the Department.
2. Applicant is hereby authorized and directed to receive a PLHA grant, in anamount not to
exceed the five-year estimate of the PLHA formula allocations, as stated in Appendix C of the
current NOFA 53,290,970 in accordance with all applicable rules and laws.
3. Applicant hereby agrees to use the PLHA funds for eligible activities as approved by the
Department and in accordance with all Program requirements, Guidelines, other rules and laws,
as well as in a manner consistent and in compliance with the Standard Agreement and other
contracts between the Applicant and the Department.

4. Applicant certifies that it has or will subgrant some or all of its PLHA funds to another entity
or entities. Pursuant to Guidelines Section 302(c)(3), "entity" means a housing developer or
program operator, but does not mean an administering Local government to whom a Local
government may delegate its PLFIA allocation.
5. Applicant certifies that its selection process of these subgrantees was or will be accessible to
the public and avoided or shall avoid any conflicts of interest.
6. Pursuant to Applicant's certification in this resolution, the PLHA funds will be expended only
for eligible Activities and consistent with all program requirements.
7. Applicant shall be subject to the terms and conditions as specified in the Standard Agreement,
the PLHA Program Guidelines and any other applicable S13 2 Guidelines published by the
Department.
8. City Manager, Oliver Chi, is authorized to execute the PLFIA Program Application, the PLFIA
Standard Agreement and any subsequent amendments or modifications thereto, aswell as any
other documents which are related to the Program or the PLHA grant awarded to Applicant, as
the Department may deem appropriate.

The City Council of the City of Huntington Beach hereby consents to, adopts, and ratifies
the following resolution:
WHEREAS, the Department is authorized to provide up to $304 million under the SB 2
Permanent Local Housing Allocation Program Formula Component from the Building Homes and
Jobs Trust Fund for assistance to Cities and Counties (as described in Health and Safety Code
section 50470 et seq. (Chapter 364, Statutes of 2017 (SB 2)); and
WHEREAS, the State of California(the"State"), Department of Housing and Community
Development("Department") issued a Notice of Funding Availability ("NOFA") dated 5/3/2021
under the Permanent Local Housing Allocation (PLHA) Program; and
WHEREAS, the City of Huntington Beach is an eligible local government who has

allocation; and

Plan and certifies compliance with all public notice, public comment, and public
hearing requirements in accordance with the Guidelines.
