This expansion included shutting down and completely cutting off the second block of Main St. to vehicular traffic, in favor of businesses. Additionally, some tenants expanded onto private property beyond approvals or permits. This expansion served two purposes: to assist small business in continuing revenue generation during the pandemic, but also to allow safe outdoor healthy dining and retail shopping to reduce the spread of COVID-19. However, we are in 2023; the COVID-19 pandemic is over; the downtown small businesses are still occupying the same expanded outdoor dining and retail areas on public property; and the street on the second block of Main St. remains closed. There are efforts to pursue plans to revitalize Main St. in downtown. But the current outdoor dining and retail expansion, including the second block closure, is not warranted any longer, brought with it a lot of avoidable blight, caused an increase in transient occupation, and created an increase in health and safety concerns. RECOMMENDED ACTION Direct the City Manager to work with staff to give the downtown businesses on Main St., who are occupying public areas with outdoor dining and retail, 30-days' notice to remove all expanded outdoor dining and to return Main St. to its pre-COVID-19 state. This reversal of the outdoor dining and retail expansions by small business will remain until the City Council makes a decision about a long-term revitalization plan. Additionally, direct the City Manager to require tenants who have expanded on public rights-of-way nearby Main Street as well as on private property to scale back to approved patio areas until they are permanently permitted for expansion. Approved 4-3 (Kalmick, Moser, Bolton-No) as amended for compliance by March 1st 24. 23-051 Item submitted by Mayor Pro Tern Van Der Mark approved - Request to implement a managed hiring process for vacant City staff positions (with limited exceptions) Recommended Action: Direct the City Manager to take necessary measures to develop and implement a "managed hiring" process for City staff position vacancies that results in only necessary hiring for public safety (including Police and Fire Departments), building inspection and code enforcement, legal services (City Attorney's Office), infrastructure maintenance and operation, essential support services, meeting Charter and Municipal Code requirements, filling interim/permanent Department Head vacancies, etc. This "managed hiring" process is meant to be temporary and is designed to allow the City Manager to prepare and present a report for City Council at its regular meeting on February 21, 2023, about the state of the City's budget and financial health, as well as staffing levels, vacancies, the costs of filling vacancies, and any other aspect of citywide reorganization or planned increase in fiscal responsibility and economic efficiency. While improvements do need to be made, and we are willing to make them with direction and confidence that they will not be temporary measures, a closure would devastate our business, increase crime and put many jobs at risk. Survival in the restaurant business in the current economic environment is extremely difficult even with the additional seating we have been able to install since Covid. Labor is greater than 50%of gross sales and food costs have rocketed. Personally, I think that if this is done, my family will no longer wish to continue operations. Please talk to the owners downtown and come up with a better solution to creating an even more friendly family environment in our downtown. I am a property owner here in Huntington Beach and I work downtown on Main Street. I enjoy bringing the family down on the weekends to enjoy the food and atmosphere. I have heard that removing the extra seating may cause some of the businesses to go under as they are barely making ends meet as it is. I would hate to see long- standing staples of this community disappear because they were unable to generate enough revenue to make things work. Our downtown bars and restaurants were put through hell by Governor Newsom's strict COVID lockdown and are only now recovering. We should not be messing with the on-going economic recovery of our downtown businesses by removing outdoor seating. We have one of the greatest climates on the planet and outdoor seating should be encouraged. The Main Street street closure has been such a success, it should be made permanent. I am a two time cancer survivor and severely immune compromised. Being able to have the fresh air and outdoor dining is incredibly important to me. We also have a two year old and feel so much safer being able to walk down main street without the threat of crazy drivers. Taking away this option would ruin so much of the downtown areas accessibility for immune compromised, handicapped, and people with young children.As well as hurt business owners who are able to have more space and outdoor options. Closing it honestly is a ridiculous option and I do not know one person who is in favor of doing so! In all respect, I truly believe that re-opening the street would be a huge step backward for Huntington Beach. I moved to Huntington 6 years ago as a 23-year-old and quickly realized that Main Street was the "it" spot to hang out with people my age in the evening. I then, quickly realized how unsafe and chaotic the road was during bar hours. From Uber's, to emergency vehicles,to (intoxicated) people running back and forth from Hurricanes to Sharkees in the dark,the flaws in that road operating as a main artery at 1 am was absolutely insane to me. Covid did a lot of bad. But I'd argue that the result of the pandemic closing that road down did a lot of good. It allowed more aesthetic seating during the day that was inviting to both locals and to tourists, provided more opportunities for restaurant owners on the street, and added to a safer nightlife atmosphere. I've watched the business owners invest in nice outside areas that double as both a total vibe AND a huge expansion of space for their businesses. I viewed the 4th of July fireworks at a table with my dog while eating and drinking and stayed 3x as long as I planned (and way more than 3x the amount of money). I'm now 29 with a husband and children and both from my 23-year-old eyes and right now, I would absolutely suggest you reconsider reopening that road. As for me and my family, we're in support of keeping the street closed. On behalf of my entire neighborhood in the grid starting from 1306 Walnut Ave to 20th street,we wanted to write in to explain why opening up the street on Main Street and closing down outside access to restaurants and stores is a huge mistake. First of all, HB is a beach town. How we call it'surf city' and then have no where to dine outside. I worked at a backpackers hostel for 7 years and the only thing I ever heard from tourists and international travelers is that,that is exactly why they go to HB, because it's one of the only places in SoCal that has dining and things outdoors. Not to mention the locals. I have had several friends come and visit with me who then moved here and decided to stay,for that very reason. Including myself! I was planning on moving 3 times in the last 3 years but decided to stay and even changed jobs to do so, solely because there is so much to gain by being able to actually enjoy the weather here. Not to mention the only people that actually used to use that street to drive on were just obnoxiously revving their engines and almost running everyone over when you're trying to get to the post office. Me and every neighbor in the grid agree that the amount we go out to eat, run errands and go to the events on Main has significantly risen since the street is closed and open for outside dining. If that stops and there's nowhere to enjoy outside... we don't know what the point of living in a beach town would be. There are cheaper places to live that have better surf and do have outdoor activities. Please do not reopen the street for driving on and take away the one thing that sets HB apart from other beach towns! Please allow us to keep the outdoor experience going.We were shut in enough during the pandemic, please don't make us feel that distance from one another again. Having the street dining has made us all more of a community again.The amount of people I've met as a local because of this is astounding and brought even the grid together. Makes us feel safe to meet people and walk around on Main Street, made us want to support our local businesses and meet the owners. We will not want to go downtown to eat 'out' if we have to be 'in'.We can eat in at home for barely any cost.The whole draw is for the outside atmosphere and feeling connected to our neighbors and neighborhoods. Please don't take that sense of community away.And please don't take away our ability to enjoy the town and the wonderful nature surrounding it at the same time. It's what makes HB, HB. It has practically doubled bar/restaurant seating for some of our favorite spots down town and has also created a MUCH safer place to walk around. Despite a slower posted speed limit, I remember cars and motorcycles wizzing down that section which was not only loud but posed a safety problem. If parking is in question, I would say that the spots in that section of main st are minuscule. Pacific City's parking structure has produced many more spots for patrons to park(and also spend money in our town) before heading downtown. All in all, I believe keeping that section of main st closed is beneficial to the retail shops, restaurants/bars, locals and tourists alike. We even noticed that car clubs were able to continue cruising downtown by simply changing their route to avoid one segment of Main Street.Time and time again, we remarked that the City should have made part of Main Street a pedestrian-only space, with more outdoor dining options, long before the pandemic. There are several factors that contribute to having a successful pedestrian-only shopping street: 1. Located adjacent to or mixed in with residential development; 2. Convenient parking and access to public transportation; and 3. Primary uses are restaurants and retail stores. The segment of Main Street between Olive and Walnut has all three attributes. This is the appropriate location for a pedestrian-only shopping street in downtown Huntington Beach. A long-term plan for the future of the pedestrian-only area should be developed while our restaurants continue to utilize expanded patios. There is no need to hurt local businesses by making them tear down patios and therefore reduce their operations and earnings, while a plan is developed. Since the second block has been closed, I have only heard rave reviews from tourists and locals alike. It brings out a much more family friendly environment. Kids can walk around more freely.Today for example, I saw three middle school aged boys walking around shopping while their parents were sitting at a restaurant's extended patio. Families are not afraid of cars flying down the street and not stopping at the crosswalk. I have seen many people be hit in the crosswalk and many more near misses. Before the closing of Main Street, I witnessed multiple accidents happen because cars were flying down the street, or were too impatient to wait for people to park/back out their cars from the parking spaces. Pedestrians have more room to walk and do not have to walk down a cramped sidewalk. Tourists come to California and specifically Huntington Beach for two things,the beach/surf and the California sunshine.With rising inflation in food costs, labor costs,and still the threat of COVID in indoor spaces,these extended patios have been a life saver.The extended patios for the restaurants on the second block have improved business in these difficult times.And if people come to eat,they stay to shop at our local stores. The cons that I have heard from people wanting to open the 2nd block backup include: decreased foot traffic, increased homeless activity,and lack of cleanliness. Above I have explained why I think the decrease in foot traffic is a misconception. Having these extended patios has brought the business back to life downtown after COVID shut it down.And they have continued to keep the restaurant and retail doors open in face of record inflation. As for increased homeless activity, I have worked downtown for a decade now and have been a resident of HB my whole life.This has been a problem for forever and should have nothing to do with whether or not the second block is kept open. The homeless issue stems from other cities bussing homeless people into our downtown. Every month or so,there is a new group of homeless people walking around.They sleep, pee,defecate, buy and sell drugs, and have caused harm to people down here way before the closure happened. I have seen firsthand, many times, even just 4 days ago, drug deals go down. If we want to handle this, our police force needs to enforce the laws we already have in place,Code 12.32.020 Loitering, Obstructing Free Passage,and Sitting or Lying Upon the Public Way. Many cities use this code to be able to do something about their homeless population. We should also make it more clear where the public restrooms are located and add more to the downtown area that are clean and safe to use. As for lack of cleanliness.The City changed cleaning companies and that company did not live up to the standards of the previous company. Now that we have reverted back to the original company the cleanliness issue has been somewhat alleviated. However,with the continued issue with people leaving trash, doing drugs on the street and using the restroom in the parking structure the cleaning has to be constant. In summary, I am requesting that the city continue to allow extended patios on Main Street.The city can continue to create regulations the city should keep the extended patios open for the second block to keep promoting business downtown,while the city continues to clean up and create regulations for the businesses to have the area more aesthetically pleasing patios. It feels lopsided and disproportionately only benefits a handful of restaurants. 3) how is this fair to businesses who paid the premium for their location/patio, to now give every business who didn't pay that premium the same benifit of having a patio. For a small restaurant they had the ability to now double or triple their sales/profits while paying the same rent. How is that fair to the businesses owner who paid? 4) while I enjoy the idea of a promenade and think there may be a path to accomplishing that. That would need to be done in a consistent and continuous fashion. It's currently a free for all and each business has decorated and designed their sidewalk patio extension in anyway they wanted and it makes the street as a whole look unorganized. I manage properties from the 200 block to the 500 block of Main Street which includes restaurant,retail,and other service industry businesses.With the onset of COVID and the indoor restrictions that followed,the expanded outdoor dining on Main Street was instrumental in allowing business to stay open,provide needed services to the residents of Huntington Beach and visitors as well. Once the COVID restrictions were lifted,it has become apparent what a positive affect these changes have had on the downtown area. I do not know of any food service business who has not seen an increase in patronage of local families that had long since given up on downtown Huntington Beach. I manage many buildings in the downtown area and often speak to many business owners at 200 Main Street.Those who opposed the closure in the beginning have now changed their position after feeling the benefits it has brought. Retail shops and service businesses such as salons also support the continued closure of Main Street as it welcomes addition foot traffic (see included emalls in support). In addition,the closure of the 2nd block allows the downtown HB Police foot patrol to address issues more easily, especially those associated with late night businesses which has been a challenge for many years. We 100 percent support the continued closure of Main Street as well as the expanded outdoor dining.We look forward to the day when the city can move forward with one of the many comprehensive plans we have seen presented over the past few years.A permanent new face to Main Street is long overdue and would help uplift and connect the downtown area to Pacific City,the wonderful upscale hotels, and attractions that Huntington Beach offers. If a change must be made, then I promote expanding the closure of vehicle traffic both north and south of the current block, not its elimination. We supported the initial closure due to hardships caused by the pandemic. The pandemic is now over, so the Main Street closures serve no other purpose than to give businesses on the 2'd block of Main Street an unfair competitive advantage over similarly situated businesses just a block away, while costing the City and taxpayers money, and creating an unsightly and unwelcoming environment for locals, families, and tourists. a. Equal Treatment. All restaurants in Huntington Beach pay their taxes and fees, as assessed. The Main Street closure grants businesses on the 2nd block a cost-free premises expansion. Meanwhile similar businesses just a block or two away are stuck with their same restricted footprint. The City is arbitrarily subsidizing favorable treatment of certain taxpayers over others based on no other factor than the block they happen to be on. The BID acknowledged in its previous letter to the Council that "the closure has been very positive for some and quite negative for others". Reopening Main Street will reinstate the level playing field that previously existed for those businesses that have been harmed by the closures for the last two years. b. Access to Other Main Street Businesses. Main Street is downtown Huntington Beach's primary attraction and thoroughfare for those visiting the area by car. Reopening Main Street will give visitors the ability to see all of Main Street while eliminating the congestion on the residential side streets. c. Reopening Main Street Will Generate Revenue for the City. The City is losing parking meter revenue every day that Main Street is closed. The sooner Main Street reopens,the sooner that revenue stream is renewed. d. Reopening Main Street Will Make Downtown More Attractive and Inviting to Locals, Families, and Tourists. While closed, the 2nd block of Main Street has turned into (unpermitted) extensions of every bar on the block, creating a party atmosphere that is not welcoming to families or tourists. With Main Street back open, people will be able to cruise their classic VW buses, woodies, and other classic cars down the main drag. We would like to comment and share our perspective of why.keeping the downtown street plan the way it is now is beneficial for all. Not just for neurodiverse individuals but for all individuals-it provides the opportunity to decide between what environment best fits the individuals' needs-whether we're light sensitive and need an enclosed environment,or the opposite where we might be crowd,noise,and space sensitive and need an outdoor space.The sensory benefits alone have provided so many options and opportunities for our entire community as a whole-thus contributing to an inclusive environment for HB,thus bringing in more revenue for the city in the form of locals and tourists. The ability to choose indoor/outdoor also provides families piece of mind that they have the flexibility to work with options once they get to the location.Often times,we try to pre-plan for the"what-ifs"for certain environments but when the unexpected happens,it can often be overwhelming to the individual so having the ability to offer choices (such as sitting outside in a more open space)to help support de-escalation is golden for families.And with the added benefit of more outdoor live music being played,it also provides a physical sensory outlet for those who needs it in the form of listening to music,singing,and dancing.And most importantly-it does not stigmatize the individual.Additionally,the added piece of mind that due to some of the street being blocked off to cars to allow for the outdoor dining space,it provides opportunities for our special-needs community to access recreational time with their caregivers/families as the vehicle traffic is more controlled and provides safer environment for family/group walks and not carrying the worry of cars not obeying traffic laws. This is a tip of the iceberg in terms of the information we use to determine what resources we want to be able or provide in the community and surrounding communities but the outdoor dining has definitely helped support needs to so many families that can easily access them in our own community-which is what we want.Right? Why would we want them to go to other cities?And the added benefit for the Mobi Mat being nearby,the pirate ship playground on 9th,and the beach right there?It is priceless to have all of those built in amenities with having a protected space as Main St has provided.
