AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING TITLE 13 PUBLIC PROPERTY OF THE HUNTINGTON BEACH MUNICIPAL
CODE ADDING CHAPTER 13.07 RELATING TO GOVERNMENT FLAGS ON CITY
PROPERTY
NOW THEREFORE, the City Council of the City of Huntington Beach does hereby
ordain as follows:
SECTION 1. That Title 13 of the Huntington Beach Municipal Code, is hereby
amended to add Chapter 13.07 to read as follows:
Chapter 13.07 Displaying Flags.
The City shall only fly or display at/on any of the City's properties the following flags: the
American flag, the POW/MIA flag,the State of California flag, the Huntington Beach City flag,
and, may fly or display at times the County of Orange flag and any of the flags of the
six branches of service: the Army,Navy, Air Force, Coast Guard, Marine Corps, and Space
Force.
This restriction by the City of its own speech(by the display of flags)by this Section does not
modify, abridge, restrict, interfere with, or otherwise limit in any way with the exercise of free
speech of businesses or individuals protected by the First Amendment by flying any flag they so
choose on private property, or public property, so long as the flying of such flags are consistent
with other laws.
SECTION 2. This Ordinance shall become effective 30 days after its adoption.
PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a
regular meeting thereof held on the 7th day of March , 2023.

Council at a Regular meeting thereof held on March 7,2023, and was passed and
adopted by the affirmative vote of at least a majority of all the members of said City
Council.
