Statement of Issue:
On January 17, 2023, the City Council approved a request by Councilmember McKeon to rescind
Ordinance No. 3907 related to the City Treasurer's powers and duties. Ordinance No. 3907,
approved on February 22, 2011, purported to transfer a substantial portion of the City Treasurer's
Charter-mandated powers and duties to the Finance department. However, as the City Charter is the
fundamental law of the City of Huntington Beach, any Ordinance in conflict with the City Charter is
void. As such, the operational structure proposed herein will reinstitute those powers and duties
under the Office of the City Treasurer.
Financial Impact:
The proposed operational structure will require two additional permanent full-time positions and
additional hours for the City Treasurer position to be budgeted within the City Treasurer's Department
for the remainder of the fiscal year 2022-23 and for the full-year beginning in fiscal year 2023-2024.
Salary for the position of full-time Deputy City Treasurer at the Pay Range 249 of $137,416 -
$184,151 is similar to the other non-safety department deputies and at the same rate as the Assistant
Chief Financial Officer position. The proposed salary for the added position of one full-time
Accounting Technician at the Pay Range 153 would be $52,867 - $70,847 on an annual basis. These
costs will be offset by eliminating a part-time Office Assistant Ill position that will no longer be
required. Currently, the City Treasurer position is compensated at 20 hours per week. At the mid-
point of the current salary range, increasing the City Treasurer's hours to 30 hours per week and
adjusting benefits to align with those of appointed department heads will require an additional annual
salary amount of $50,000. An addition to the Job Classification Plan will be required to replace the

existing Finance Manager position with the Treasury Manager position. No additional FTE or
personnel costs are required for this position.
At a fully burdened rate, for the remainder of fiscal year 2022/2023, an additional $75,000 is
requested to be added to the City Treasurer departmental budget. An additional annual budget
appropriation of approximately $300,000 is requested to fund these positions on an ongoing basis.
Recommended Action:
A) Adopt Ordinance 4287, "An Ordinance of the City Council of the City of Huntington Beach
Repealing Ordinance No. 3907 relating to the duties of the Finance Director;" and,
B) Adopt Ordinance No. 4288, "An Ordinance of the City Council of Huntington Beach amending
Chapter 2.15 relating to the duties of the Finance Department and re-adding Chapter 2.16 as
amended relating to the duties of the Treasurer."
Alternative Action(s):
Do not approve actions A - B above and direct the City Treasurer, with the support of the City
Manager, to return to the City Council with an alternate proposal to align the Charter-mandated
Powers and Duties of the City Treasurer with the City Charter.
Analysis:
On January 17, 2023, Council Member Casey McKeon brought forth and the City Council approved
an H-Item request to rescind Ordinance 3907 (see Council Member Item Report, Attachment 6)
related to the City Treasurer's role. This Ordinance (adopted February 2011) purported to transfer
the majority of the City Treasurer's Charter-mandated powers and duties to the Finance Department,
deleting Municipal Code Chapter 2.16 City Treasurer in its entirety, and adding certain responsibilities
to the Finance Department in the Municipal Code Chapter 2.15.
The specific actions based on this Ordinance were in conflict with the City Charter, which is the
fundamental law of the City of Huntington Beach. The independently elected officers of the City are
accountable to the citizens to act as stewards of the taxpayer moneys and as checks and balances
within the operational structure. It is therefore important to restore the elected City Treasurer's duties
in full to comply with the City Charter.
City Charter, Article III, Section 311 City Treasurer Powers and Duties (see Section 311 in full,
Attachment 4) as set forth with pertinent provisions states:
"The City Treasurer shall have the power and shall be required to:
a) Receive on behalf of the City all taxes, assessments, license fees and other revenues of the
City, or for the collection of which the City is responsible, and receive all taxes or other money
receivable by the City from the County, State or Federal governments, or from any court, or
from any office, department or agency of the City.
b) Have and keep custody of all public funds belonging to or under control of the City or any
office, department or agency of the City government and deposit or cause to be deposited all

funds coming into their hands...
c) Pay out moneys only on proper orders or warrants in the manner provided for in this
Charter..."
In summary, the City Charter requires the City Treasurer to receive and keep custody of all
funds of the city and disburse these funds properly.
The responsibilities repositioned under the City Treasurer's Department shall include, but not be
limited to: Receiving and depositing all revenue (including that from all areas within the City) in a
timely manner into the City's financial depository accounts; Ensuring proper controls over cash
deposits; Establishing and maintaining all banking and investment related products, operations and
relationships; Oversight of all collection and payment contracts, software systems and online
payment portals; Collection of delinquent taxes and fees; Maintaining agreements and funds of
trusts, bonds and other security agreements; Disbursing all approved funds and processing all
checks and electronic payments; Oversight of escheatment process. Such responsibilities will be
returned to the City Treasurer's Department.
In order to carry out these duties, the City Treasurer must have the appropriate resources:
1. It is recommended that the functional area within the city that is currently responsible for
receiving, depositing, and collecting on behalf of the City, all taxes, assessments, fees, and
other revenues, as well as disbursing all approved funds, be integrated into the City
Treasurer's Department, with the position of Finance Manager being replaced with the position
of Treasury Manager.
2. The City Treasurer, as allowed under the City Charter, recommends appointing a full-time
Deputy City Treasurer to assists with planning, organizing and directing the treasury
management activities of the City Treasurer's Department.
3. It is requested that an additional full-time Accounting Technician position be added to replace
the current use of part-time individuals in the cashiering and collections area. Such use of part
-time individuals has proven inefficient, as a great deal of staff time is expended to recruit, train
and retain these positions. This is a highly specialized area of operations requiring detailed
training. With the hiring of an additional full-time Accounting Technician, the time spent on
regularly recruiting and training new part-time staff can be better utilized within the department
and the position itself will assist with other necessary responsibilities.
4. Lastly, the City Treasurer's hours will increase from 20 to 30 hours to provide sufficient
oversight of the fully restored powers and duties to this Office.
These actions will serve to restore the elected City Treasurer's Powers and Duties to comply with the
City Charter (see proposed City Treasurer's Department Organizational Chart, Attachment 5).

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
REPEALING ORDINANCE NO. 3907 RELATING TO THE DUTIES OF
THE FINANCE DIRECTOR
WHEREAS, on January 17, 2023,the City Council of the City of Huntington Beach
directed the City Attorney and the City Manager to collaborate with the City Treasurer to return
to City Council with the necessary actions to repeal Ordinance No. 3907 and restore the elected
City Treasurer's duties, in full to those provided in Section 311 of the City Charter.
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
ordain as follows:
SECTION 1. Ordinance No. 3907 is hereby repealed in its entirety.
SECTION 2. By virtue of the repeal of Ordinance No. 3907, Section 2.16 of the City of
Huntington Beach Municipal Code is in effect as codified prior to the adoption of Ordinance No.
3907.
SECTION 3. This ordinance shall be effective 30 days after its adoption.

CHAPTER 2.15 RELATING TO THE DUTIES OF THE FINANCE DEPARTMENT

The City Council of the City of Huntington Beach does hereby ordain as
follows:
SECTION 1. Section 2.15.030 of the Huntington Beach Municipal Code is
hereby amended to read as follows:
2.15.030 Director-Powers and duties. The Chief Financial Officer shall be
appointed by the City Manager. The Chief Financial Officer shall have the
following powers and duties:
(A) Direct, plan, organize and coordinate programs and activities of the Finance
Department.
(B) Establish and maintain a system of financial procedures, accounts and
controls for the City government and each of its offices, officers, departments and
agencies.
(C) Provide direction for the control of all expenditures to insure that budget
appropriations are not exceeded.
(D) Manage the business license functions including the issuance of permits.
(E) Direct and administer the City's centralized purchasing function with regard
to procurement of all supplies, services and equipment for all City departments and
agencies of the City.
(F) Administration and enforcement of appropriate sections of Title 5 of the
Huntington Beach Municipal Code relating to business licensing.
(G) Administer and enforce all Municipal Code regulations including but not
limited to:
(1) Huntington Beach Municipal Code Licensing Procedures (Chapter 5.08)
(2) Huntington Beach Municipal Code Natural Resource Production
(Chapter 5.32)
(3) Transient Occupancy Tax (Chapter 3.28)
(4) Late Charges (Chapter 3.48)

SECTION 2. Chapter 2.16 of the Huntington Beach Municipal Code is hereby
reinstated in its entirety to read as follows:

2.16.010 Establishment. There is hereby established a Department of City
Treasurer.
2.16.020 Powers. The City Treasurer shall have the power to:
(a) Receive on behalf of the City all taxes, assessments, license fees, and other
revenues of the City, or for the collection of which the City is responsible, and
receive all taxes or other money receivable by the City from the County, State,
or Federal Governments, or from any court, or from any office, department, or
agency of the City.
(b) Have and keep custody of all public funds belonging to or under control of the
City of any office, department, or agency of the City government and deposit or
cause to be deposited all funds coming into their hands in such depository as
may be designated by resolution of the City Council, or, if no such resolution
be adopted, then is such depository designated in writing by the City Manager,
and in compliance with all of the provisions of the State Constitution and laws
of the State governing the handling, depositing, and securing of public funds.
(c) Pay out monies only on proper orders or warrants in the manner provided for in
the City Charter.
(d) Prepare and submit to the Finance Director or Chief Financial Officer monthly
written reports of all receipts, disbursements, and fund balances, and shall file
copies of such reports with the City Manager and City Council.
2.16.030 Treasurer- Duties. The City Treasurer shall be the head of the City
Treasurer's Department and shall be elected by the voters. The City Treasurer shall
have the following duties:
(a) Plans, organizes, directs, and coordinates all programs and activities of the City
Treasurer's Department.
(b) Determines and directs department policies, procedures, and organization.

(c) Obtains quotes for the investment of funds under his or her control, authorizes
purchases, maintains documentation, receives payments, schedules maturities,
authorizes fund transfers, calculates and makes daily repurchase agreements,
and establishes and maintains an Investment Policy pursuant to the California

(d) Establishes and controls all bank accounts, negotiates services and contracts
with bank, makes daily deposits, handles returned checks and reconciliation
thereof
(e) Collects monies owed to the City whether by tax, fee, charge,judgment,
settlement or otherwise; utilizes letters, phone calls, and collection agencies as
required; and may write off uncollectible items up to $10,000 without further
authorization, between $10,000 and $50,000 with the prior approval of the City
Manager and in excess of$50,000 with City Council approval only.
(f) Makes cash flow projections on a weekly and monthly basis.
(g) Receives all City monies including taxes, fees, water, sewer and trash fees
including oil well royalties and transient occupancy taxes. (3751-11/06)
(h) Maintains all trusts, bonds, security agreements, and funds for the City
including the filing, depositing, refunds and releases, letters of release, and
inquiries relating thereto.
(i) Prepares, submits, and administers the annual budget for his or her department.

(k) Administer and enforce all Municipal Code regulations regarding the collection
of monies owed to the City.
2.16.040 Appointment of subordinates. The City Treasurer, may, subject to the
approval of the City Council, appoint such Deputy or Deputies to assist the City
Treasurer, or to act for him or her, in carrying out the duties and responsibilities of
this Chapter, at such salaries or compensation as the Council may by ordinance or

2.16.050 Funds. All funds previously created and/or designated by ordinance shall
continue and be maintained until expressly eliminated or otherwise disposed of by
ordinance.
SECTION 4. This ordinance shall become effective 30 days after its adoption.

2.15.030 Chief Financial Officer—Powers and Duties
The Chief Financial Officer shall be appointed by the City Manager. The Chief Financial Officer shall

2.16.010 Establishment There is hereby established a Department of City Treasurer.
2.160.020 Powers. The City Treasurer shall have the power to:
(a) Receive on behalf of the City all taxes,assessments,license fees,and other revenues of the
City, or for the collection of which the City is responsible,and receive all taxes or other
money receivable by the City from the County, State,or Federal Governments,or from any
court, or from any office,department,or agency of the City.
(b) Have and keep custody of all public funds belonging to or under control of the City of any
office,department,or agency of the City government and deposit or cause to be deposited all
funds coming into his heir hands in such depository as may be designated by resolution of
the City Council,or, if no such resolution be adopted,then is such depository designated in
writing by the City Administrater Manager,and in compliance with all of the provisions of
the State Constitution and laws of the State governing the handling,depositing,and securing
of public funds.
(c) Pay out monies only on proper orders or warrants in the manner provided for in the City
Charter.
(d) Prepare and submit to the Finance Director or Chief Financial Officer monthly written reports
of all receipts,disbursements, and fund balances,and shall file copies of such reports with the
City Admiftistratec Manager and City Council.
2.16.030 Treasurer—Duties. The City Treasurer shall be the head of the City Treasurer's Department
and shall be elected by the voters. The City Treasurer shall have the following duties:
(a) Plans,organizes,directs,and coordinates all programs and activities of the City Treasurer's
Department.
(b) Determines and directs department policies,procedures,and organization.
(c) Obtains quotes for the investment of funds under his or her control,authorizes purchases,
maintains documentation,receives payments, schedules maturities,authorizes fund transfers,
calculates and makes daily repurchase agreements,and establishes and maintains an
Investment Policy pursuant to the California Government Code.
(d) Establishes and controls all bank accounts,negotiates services and contracts with bank,
makes daily deposits,handles returned checks and reconciliation thereof.
(e) Collects monies owed to the City whether by tax,fee,charge,judgment, settlement or
otherwise;utilizes letters,phone calls,and collection agencies as required; and may write off
uncollectible items up to$10,000 without further authorization,between$10,000 and
$50,000 with the prior approval of the City Administrator and in excess of$50,000 with City
Council approval only.
(f) Makes cash flow projections on a weekly and monthly basis.
(g) Receives all City monies including taxes,fees,water, sewer and trash fees including oil well
royalties and transient occupancy taxes.

I agree with restoring the City Treasurer's traditional role and responsibilities under the City charter prior to the 2024
citywide election.
This coming election will be the first in City history where City Treasurer and City Clerk candidates can receive up to
$5,500 from a single donor(the previous limit was$620). Based upon filings, it appears that all Treasurer and Clerk
candidates combined over the last 12 years have raised just over$5K for their campaigns, so this could be a big change
with unintended consequences.
Returning the City Treasurer to more of a full-time position could prevent some, but not all, problems from this change,
so I applaud the Council for taking this step.

Approve modifications to the City Treasurer's Department by adopting Resolution Nos. 2023-
08, 2023-09 and 2023-10; approve for introduction Ordinance No. 4287 Repealing Ordinance
No. 3907 relating to the duties of the Finance Director; and, approve for introduction
Ordinance No. 4288 to reinstitute the City Treasurer's Powers and Duties, as authorized in the
City Charter
Statement of Issue:
On January 17, 2023, the City Council approved a request by Councilmember McKeon to rescind
Ordinance No. 3907 related to the City Treasurer's powers and duties. Ordinance No. 3907,
approved on February 22, 2011, purported to transfer a substantial portion of the City Treasurer's
Charter-mandated powers and duties to the Finance department. However, as the City Charter is the
fundamental law of the City of Huntington Beach, any Ordinance in conflict with the City Charter is
void. As such, the operational structure proposed herein will reinstitute those powers and duties
under the Office of the City Treasurer.
Financial Impact:
The proposed operational structure will require two additional permanent full-time positions and
additional hours for the City Treasurer position to be budgeted within the City Treasurer's Department
for the remainder of the fiscal year 2022-23 and for the full-year beginning in fiscal year 2023-2024.
Salary for the position of full-time Deputy City Treasurer at the Pay Range 249 of$137,416 -
$184,151 is similar to the other non-safety department deputies and at the same rate as the Assistant
Chief Financial Officer position. The proposed salary for the added position of one full-time
Accounting Technician at the Pay Range 153 would be $52,867 - $70,847 on an annual basis. These
costs will be offset by eliminating a part-time Office Assistant Ill position that will no longer be
required. Currently, the City Treasurer position is compensated at 20 hours per week. At the mid-
point of the current salary range, increasing the City Treasurer's hours to 30 hours per week and
adjusting benefits to align with those of appointed department heads will require an additional annual

salary amount of$50,000. An addition to the Job Classification Plan will be required to replace the
existing Finance Manager position with the Treasury Manager position. No additional FTE or
personnel costs are required for this position.
At a fully burdened rate, for the remainder of fiscal year 2022/2023, an additional $75,000 is
requested to be added to the City Treasurer departmental budget. An additional annual budget
appropriation of approximately $300,000 is requested to fund these positions on an ongoing basis.
Recommended Action:
A) Approve the modification to the City Treasurer's Department by: authorizing two additional full-
time equivalent positions (1 Deputy City Treasurer, 1 Accounting Technician) and increase the City
Treasurer position from twenty to thirty hours per week; restore the reporting relationship of the
current cashiering and collections area from the Finance Department to the City Treasurer's
Department; and, delete the current position of the Finance Manager and replace the position with
that of Treasury Manager (no additional FTE or personnel cost). (See proposed City Treasurer's
Department Organizational Chart Attachment 5);
B) Adopt Resolution 2023-08, "A Resolution of the City Council of the City of Huntington Beach
Amending the City's Classification Plan by Adding the Job Classification of Treasury Manager and
Establishing Compensation" including Exhibit B - Modified Management Employees' Organization
Salary Schedule Effective April 1, 2023;
C) Adopt Resolution 2023-09, "A Resolution of the City Council of the City of Huntington Beach
Amending the City's Classification Plan by Adding the Job Classification of Deputy City Treasurer and
Establishing Compensation" including Exhibit 1 - Amended Non-Associated Appointed Executive
Management Salary Schedule Effective April 1, 2023;
D) Adopt Resolution 2023-10 "A Resolution if the City Council of the City of Huntington Beach
Modifying Salary and Certain Benefits of the Elected City Treasurer" including Exhibit 1 B - Non-
Associated Elected Executive Management Salary Schedule Effective April 1, 2023;
E) Authorize the City Manager to take all administrative actions necessary to implement the
reorganization;
F) Approve General Fund appropriations of$75,000 to business unit 10025101 for FY 2022/23;
G) Approve for introduction Ordinance 4287, "An Ordinance of the City Council of the City of
Huntington Beach Repealing Ordinance No. 3907 relating to the duties of the Finance Director;" and,
H) Approve for introduction Ordinance No. 4288, "An Ordinance of the City Council of Huntington
Beach amending Chapter 2.15 relating to the duties of the Finance Department and re-adding
Chapter 2.16 as amended relating to the duties of the Treasurer."

Powers and Duties of the City Treasurer with the City Charter.
Analysis:
On January 17, 2023, Council Member Casey McKeon brought forth and the City Council approved
an H-Item request to rescind Ordinance 3907 (see Council Member Item Report, Attachment 6)
related to the City Treasurer's role. This Ordinance (adopted February 2011) purported to transfer
the majority of the City Treasurer's Charter-mandated powers and duties to the Finance Department,
deleting Municipal Code Chapter 2.16 City Treasurer in its entirety, and adding certain responsibilities
to the Finance Department in the Municipal Code Chapter 2.15.
The specific actions based on this Ordinance were in conflict with the City Charter, which is the
fundamental law of the City of Huntington Beach. The independently elected officers of the City are
accountable to the citizens to act as stewards of the taxpayer moneys and as checks and balances
within the operational structure. It is therefore important to restore the elected City Treasurer's duties
in full to comply with the City Charter.
City Charter, Article III, Section 311 City Treasurer Powers and Duties (see Section 311 in full,
Attachment 4) as set forth with pertinent provisions states:
"The City Treasurer shall have the power and shall be required to:
a) Receive on behalf of the City all taxes, assessments, license fees and other revenues of the
City, or for the collection of which the City is responsible, and receive all taxes or other money
receivable by the City from the County, State or Federal governments, or from any court, or
from any office, department or agency of the City.
b) Have and keep custody of all public funds belonging to or under control of the City or any
office, department or agency of the City government and deposit or cause to be deposited all
funds coming into their hands...
c) Pay out moneys only on proper orders or warrants in the manner provided for in this
Charter..."
In summary, the City Charter requires the City Treasurer to receive and keep custody of all
funds of the city and disburse these funds properly.
The responsibilities repositioned under the City Treasurer's Department shall include, but not be
limited to: Receiving and depositing all revenue (including that from all areas within the City) in a
timely manner into the City's financial depository accounts; Ensuring proper controls over cash
deposits; Establishing and maintaining all banking and investment related products, operations and
relationships; Oversight of all collection and payment contracts, software systems and online
payment portals; Collection of delinquent taxes and fees; Maintaining agreements and funds of
trusts, bonds and other security agreements; Disbursing all approved funds and processing all
checks and electronic payments; Oversight of escheatment process. Such responsibilities will be
returned to the City Treasurer's Department.

In order to carry out these duties, the City Treasurer must have the appropriate resources:
1. It is recommended that the functional area within the city that is currently responsible for
receiving, depositing, and collecting on behalf of the City, all taxes, assessments, fees, and
other revenues, as well as disbursing all approved funds, be integrated into the City
Treasurer's Department, with the position of Finance Manager being replaced with the position
of Treasury Manager.
2. The City Treasurer, as allowed under the City Charter, recommends appointing a full-time
Deputy City Treasurer to assists with planning, organizing and directing the treasury
management activities of the City Treasurer's Department.
3. It is requested that an additional full-time Accounting Technician position be added to replace
the current use of part-time individuals in the cashiering and collections area. Such use of part
-time individuals has proven inefficient, as a great deal of staff time is expended to recruit, train
and retain these positions. This is a highly specialized area of operations requiring detailed
training. With the hiring of an additional full-time Accounting Technician, the time spent on
regularly recruiting and training new part-time staff can be better utilized within the department
and the position itself will assist with other necessary responsibilities.
4. Lastly, the City Treasurer's hours will increase from 20 to 30 hours to provide sufficient
oversight of the fully restored powers and duties to this Office.
These actions will serve to restore the elected City Treasurer's Powers and Duties to comply with the
City Charter (see proposed City Treasurer's Department Organizational Chart, Attachment 5).

Experience: Five (5) years' increasingly responsible professional level administrative
and supervisory experience in governmental financial management, municipal
accounting, or treasury management, including three (3) years' experience
supervising professional-level staff. Investment experience, particularly in fixed
income markets, is desirable. Professional experience with a California municipality
is desirable.
License/Certification: A valid California Class C driver license with an acceptable
driving record required at time of appointment and during course of employment.
SPECIAL CONDITIONS
Employees regularly assigned/required to drive a city or personal vehicle in the course
and scope of work shall be required to participate in the DMV Employer Pull Notice
program.
Public Employee Disaster Service Worker: In accordance with Government Code
Section 3100, all Huntington Beach city employees are required to perform assigned
disaster service worker duties in the event of an emergency or a disaster.

• Prepares monthly and quarterly Treasurer's reports and assists with updating investment
policies annually or when required
• Participates in oversight of City's Deferred Compensation Plan and Supplemental
Employee Retirement Plan
• Responsible for managing all City Treasurer departmental RFPs and monitoring
performance of vendors and providers
• Assists in the development and carries out the implementation of policies and procedures
to ensure collection and depositing of all City funds in a timely and accurate manner
• Assists in coordinating treasury activities with internal departments and outside agencies,
including coordination of relevant technology platforms (in conjunction with the
Information Services Department); identifies opportunities for improvements to
procedures and services to enhance delivery
• Carries out necessary duties involved with collection and reporting on TOT/BID and
Short-term rental income programs
• Manages and reports on City Treasurer's Department operating budget
• Acts on behalf of the Deputy City Treasurer in their absence
• Assists with the input and maintenance of the City's billing and collections database and
records of revenues received; prepares a variety of complex financial calculations and
reports
• Supervises, trains, and evaluates assigned staff
• Prepares reports and correspondence as needed
• Receives and evaluates internal and external customer complaints and disputes,
recommends resolutions, and responds to customers accordingly
• Collaborates with other departmental managers to achieve optimal city-wide financial
performance and outcomes
• Attends leadership, management, supervisory and relevant financial training to stay
abreast of industry best practices
• Reviews and reports on existing and proposed legislation related to treasury matters
• Develops processes to ensure business continuity in the event of a disaster
• Reports to work as scheduled and works various hours, including nights and weekends
as required
• Maintains regular and consistent attendance record

MINIMUM QUALIFICATIONS
Knowledge of:
- Standard practices and procedures of financial accounting and treasury
management, including internal controls, cash flow projection development, cash
collection, banking and payment processing

- Applicable State, Federal, County and City Charter laws, regulations, and practices

Ability to:

Education: Bachelor's Degree from an accredited college or university in Finance,
Accounting, Business, Economics, Public Administration, or other closely related field. A
Master's Degree in one of these areas is desirable. Education or training through the

California Municipal Treasurers Association, Association of Public Treasurers, or California
Debt and Investment Advisory Commission (CDIAC) is desirable.
Experience: Five (5) years professional level governmental financial management,
municipal accounting, or treasury management experience. Investment experience,
particularly in fixed income markets, is desirable. Professional experience with a California
municipality is desirable.
License/Certificates: A valid California Class C driver license with an acceptable driving
record required by time of appointment and throughout employment.
SPECIAL CONDITIONS
Employees regularly assigned/required to drive a city or personal vehicle in the course and
scope of work shall be required to participate in the DMV Employer Pull Notice program.
Public Employee Disaster Service Worker: In accordance with Government Code
Section 3100, all Huntington Beach city employees are required to perform assigned
disaster service worker duties in the event of an emergency or a disaster.
PHYSICAL TASKS AND ENVIRONMENTAL CONDITIONS
The incumbent must be able to meet the physical requirements of the job class and have
mobility, balance, coordination, vision, hearing and dexterity levels appropriate to the duties
to be performed.
Work is performed in a general office environment, requiring sitting for prolonged periods of
time; standing and walking to retrieve work files or to other departments or office locations;
leaning, bending and stooping to perform work behind a desk or to retrieve information;
pushing, turning or twisting to move chair or body from desk; reaching to place or retrieve
files or open file drawers or cabinets; light grasping to hold a writing instrument or
documents; firm grasping as needed to lift and carry work files or operate office equipment;
finger dexterity to type on a computer keyboard; and, hearing and speaking to answer the
telephone or answer questions of co-workers and subordinates. Work may necessitate
some lifting, carrying, pushing and/or pulling of objects and materials of light weight (5-10
pounds).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH
MODIFYING SALARY AND BENEFITS FOR NON-REPRESENTED EMPLOYEES BY
ADDING THE DEPUTY CITY TREASURER CLASSIFICATION AND ESTABLISHING
THE COMPENSATION
WHEREAS, the City Council of the City of Huntington Beach desires to modify the
salary and benefits for non-represented employees upon adoption of this resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach as follows:
SECTION 1. Salaries and Benefits for Non-Represented employees is hereby amended
to include the Deputy City Treasurer as reflected in Exhibit"A" attached hereto and incorporated
by this reference.
SECTION 2. The salary range for the Deputy City Treasurer shall be reflected in the
Non-Associated Executive Management Salary Schedule—Exhibit 1.
SECTION 3. All other benefits and salary ranges established and reflected in the Non-
Associated Employees Pay and Benefits Resolution 2022-76, shall continue unless modified by
City Council action.

oversees the management of the department and staff, while the City Treasurer is
responsible for the overall administration, planning, organizing, and directing of the

Education/Certification: Bachelor's degree from an accredited college or university in
Accounting, Finance, Business, Economics, Public Administration or a closely related
field. A Master's degree in one of these areas and/or Certified Public Accountant
credential is desirable. Education or training through the California Municipal Treasurers
Association, Association of Public Treasurers, or California Debt and Investment Advisory
Commission (CDIAC) is desirable.
Experience: Five (5) years' increasingly responsible professional level administrative
and supervisory experience in governmental financial management, municipal
accounting, or treasury management, including three (3) years' experience
supervising professional-level staff. Investment experience, particularly in fixed
income markets, is desirable. Professional experience with a California municipality
is desirable.
License/Certification: A valid California Class C driver license with an acceptable
driving record required at time of appointment and during course of employment.
SPECIAL CONDITIONS
Employees regularly assigned/required to drive a city or personal vehicle in the course
and scope of work shall be required to participate in the DMV Employer Pull Notice
program.
Public Employee Disaster Service Worker: In accordance with Government Code
Section 3100, all Huntington Beach city employees are required to perform assigned
disaster service worker duties in the event of an emergency or a disaster.

To become and remain eligible for City Treasurer, the person elected or appointed
shall have a minimum of five years of financial and/or treasury experience, and have
either:

SUBJECT: REQUEST TO REPEAL ORDINANCE 3907 RELATED TO THE CITY TREASURER'S ROLE
The elected City Treasurer is currently operating in a part-time position with limited
responsibilities. Those responsibilities were reduced by City Council during the 2010-2011
timeframe and shifted to the appointed Finance Director (now titled Chief Financial
Officer). However, those "shifts" were in violation of some parts of Section 311 of the City
Charter.
The City Treasurer shall have the power and shall be required to:
(a) Receive on behalf of the City all taxes, assessments, license fees and other revenues of
the City, or for the collection of which the City is responsible, and receive all taxes or other
money receivable by the City from the County, State or Federal governments, or from any court,
or from any office, department or agency of the City.
(b) Have and keep custody of all public funds belonging to or under control of the City or
any office, department or agency of the City government and deposit or cause to be deposited
all funds coming into their hands in such depository as may be designated by resolution of the

From 2010-2011, the City Council adopted and updated Ordinance 3907 (amending HBMC
Section 2.15.030) assigning some of these Charter responsibilities to the Finance Director. It is
important that the City Council and other City leadership respect the Charter as written as the
voice of the people and the will of the voters. There is wisdom in a divided government with
independently elected officials who are appointed by the people (i.e., to work for the people

and to account to the people without any fear of losing his or her job). With the importance of
the City being stewards of taxpayer moneys, it is important that this City Council reverse the
former City Council's actions of 2010-2011 and restore the elected City Treasurer's duties, in
full, to those provided in Section 311 of the City Charter.
RECOMMENDED ACTION
Direct the City Attorney and the City Manager, in collaboration with the City Treasurer, to return
to City Council at a regular meeting in February 2023 with the necessary actions to reverse
Ordinance 3907 and restore the elected City Treasurer's duties, in full, to those provided in
Section 311 of the City Charter.

appointed by the City Manager. The Chief Financial Officer shall have the

2.16.010 Establishment. There is hereby established a Department of City
Treasurer.
2.16.020 Powers. The City Treasurer shall have the power to:
(a) Receive on behalf of the City all taxes, assessments, license fees, and other
revenues of the City, or for the collection of which the City is responsible, and
receive all taxes or other money receivable by the City from the County, State,
or Federal Governments, or from any court, or from any office, department, or
agency of the City.
(b) Have and keep custody of all public funds belonging to or under control of the
City of any office, department, or agency of the City government and deposit or
cause to be deposited all funds coming into their hands in such depository as
may be designated by resolution of the City Council, or, if no such resolution
be adopted, then is such depository designated in writing by the City Manager,
and in compliance with all of the provisions of the State Constitution and laws
of the State governing the handling, depositing, and securing of public funds.
(c) Pay out monies only on proper orders or warrants in the manner provided for in
the City Charter.
(d) Prepare and submit to the Finance Director or Chief Financial Officer monthly
written reports of all receipts, disbursements, and fund balances, and shall file
copies of such reports with the City Manager and City Council.
2.16.030 Treasurer-Duties. The City Treasurer shall be the head of the City
Treasurer's Department and shall be elected by the voters. The City Treasurer shall
have the following duties:
(a) Plans, organizes, directs, and coordinates all programs and activities of the City
Treasurer's Department.
(b) Determines and directs department policies, procedures, and organization.

(c) Obtains quotes for the investment of funds under his or her control, authorizes
purchases,maintains documentation,receives payments, schedules maturities,
authorizes fund transfers, calculates and makes daily repurchase agreements,
and establishes and maintains an Investment Policy pursuant to the California
Government Code. (3507-10/01)
(d) Establishes and controls all bank accounts, negotiates services and contracts
with bank,makes daily deposits, handles returned checks and reconciliation
thereof.
(e) Collects monies owed to the City whether by tax, fee, charge,judgment,
settlement or otherwise; utilizes letters, phone calls, and collection agencies as
required; and may write off uncollectible items up to $10,000 without further
authorization, between$10,000 and$50,000 with the prior approval of the City
Administrator and in excess of$50,000 with City Council approval only.
(f) Makes cash flow projections on a weekly and monthly basis.
(g) Receives all City monies including taxes, fees, water, sewer and trash fees
including oil well royalties and transient occupancy taxes. (3751-11/06)
(h) Maintains all trusts, bonds, security agreements, and funds for the City
including the filing, depositing, refunds and releases, letters of release, and
inquiries relating thereto.
(i) Prepares, submits, and administers the annual budget for his or her department.

(j) Performs such other duties and has such other powers as the City Council may
establish hereafter by resolution consistent with the City Charter. (3751-11/06)
(k) Administer and enforce all Municipal Code regulations regarding the collection
of monies owed to the City.
2.16.040 Appointment of subordinates. The City Treasurer, may, subject to the
approval of the City Council, appoint such Deputy or Deputies to assist the City
Treasurer, or to act for him or her, in carrying out the duties and responsibilities of
this Chapter, at such salaries or compensation as the Council may by ordinance or
resolution prescribe. (3507-10/01)
2.16.050 Funds. All funds previously created and/or designated by ordinance shall
continue and be maintained until expressly eliminated or otherwise disposed of by
ordinance,
SECTION 4. This ordinance shall become effective 30 days after its adoption.

2.15.030 Chief Financial Officer—Powers and Duties
The Chief Financial Officer shall be appointed by the City Manager. The Chief Financial Officer shall
have the following powers and duties:
A. Direct,plan,organize and coordinate programs and activities of the Finance Department.
B. Establish and maintain a system of financial procedures, accounts and controls for the City
government and each of its offices,officers, departments and agencies.
C. Provide direction for the control of all expenditures to ensure that budget appropriations are not
exceeded.
D. Manage the business license functions including the issuance of permits.
E. Direct and administer the City's centralized purchasing function with regard to procurement of all
supplies, services and equipment for all City departments and agencies of the City.
F. Administration and enforcement of appropriate sections of Title 5 of the Huntington Beach
Municipal Code relating to business licensing.
G. Administer and enforce all Municipal Code regulations including,but not limited to:
1. Licensing Procedures(Chapter 5.08).
2. Natural Resources Production(Chapter 5.32).
3. Transient Occupancy Tax(Chapter 3.28).
4. Late Charges(Chapter 3.48).
5. Service Connections (Chapter 14.08).
6. Fees,Rates and Deposits(Chapter 14.12).

Subject: Council Meeting Item 26: City Treasurer
I agree with restoring the City Treasurer's traditional role and responsibilities under the City charter prior to the 2024
citywide election.
This coming election will be the first in City history where City Treasurer and City Clerk candidates can receive up to
$5,500 from a single donor(the previous limit was$620). Based upon filings, it appears that all Treasurer and Clerk
candidates combined over the last 12 years have raised just over$5K for their campaigns, so this could be a big change
with unintended consequences.
Returning the City Treasurer to more of a full-time position could prevent some, but not all, problems from this change,
so I applaud the Council for taking this step.
