CITY OF HUNTINGTON BEACH CITY COUNCIL MEETING — COUNCIL MEMBER ITEMS REPORT TO: CITY COUNCIL FROM: PAT BURNS, COUNCIL MEMBER DATE: JUNE 6, 2023 SUBJECT: REQUEST TO FORM A CHARTER REVIEW AD HOC COUNCIL COMMITTEE TO RECOMMEND PROPOSED CHARTER AMENDMENTS ISSUE STATEMENT The proposals for Charter Amendments that were placed on the November 2022 ballot by the previous City Council failed. There are areas in the Charter that could use meaningful updates. The California primary is set for March 5, 2024. We should have a City Council ad hoc Committee assembled to return to the entire City Council with recommendations for Charter updates. I support the creation of a charter review committee.The previous discussion by council ignored several desired charter amendments.In particular,I believe the committee should discuss the possibility of having a referendum to revise section 803 of the city charter,to allow the city council to discuss the possibility of a rent stabilization ordinance for mobile home residents.The city council needs to address this issue eventually,and I support allowing the city council to consider all possible solutions by revising the charter.Consideration might also be made to reviewing the procedure for filing a council vacancy.I take no position on the selection of committeemen, recognizing that this is the Mayor's prerogative. I would like to urge an amendment to Item XXVIB to strike the words"March 5..."and add the words"November 5..."General elections often have a higher voter turnout,and I believe it is important the most electors possible be included in revising our city charter,a fundamental document. I am concerned that with the amount of time needed by the charter review committee to review the charter,and for the council to discuss any recommended referenda,there will not be enough time for organized campaigns by those who support and those who oppose the proposed referenda.Campaigning has already begun for many of the races on March 5. If changes are really necessary, an ad hoc committee of insiders is not the way to go. We need an open, transparent committee of citizens from across the political spectrum to make changes that are in the interest of the city, not of the current party in power. The agenda item should be clear in its intentions. "There are areas in the Charter that could use meaningful updates." is too vague. However, since charter amendments are being considered, Section 8.03 should be removed entirely. It is out of place in the city charter and there is evidence in public record that the public was misled when signing petitions and voting on it. I've attached a letter from 11/21/2000 that showed petitioners were misleading the public in order to collect signatures. I have no problem with this petition end the right for Property Owners to cirtxrtale this petition but do have`a problem with rnsleading the public and a lot of people probably went ahead and signed this • petition,thinking It was something different ban whet It actually is because she was net feting the truth. If someone is tenng at of the petitioners to present the petition this way there I feel the City Legal Department shoukt look bib this matter.Also I scratched my name off of the petition.
