General Telephone Electronics requires an easement over city property to serve the residents adjacent to Drew Park. RECOMMENDATION Approve the granting of the easement and authorize the Mayor and City Clerk to execute. ANALYSIS GTE requires an easement through Drew Park in order to service the homes that boarder the park. There is an existing easement on one section. This new easement will allow access to all the homes that back up to the east side of the park property. Public Works and Community Services staff have reviewed the request and concur with granting of the easement. FJINDTNG SOURCE None ALTERNATIVE ACTIONS Do not approve the easement. Such action would necessitate GTE having to run lines through existing streets which will inconvenience the neighborhood and dramatically increase the cost to GTE. THE GRANTEE, its successors and assigns and their respective agents and employees, shall have the right of ingress to and egress from said easement and every part thereof, at all times, for the purpose of exercising the rights herein granted and shall have the right to remove such growth as may endanger or interfere with the use of said easement. Such rights shall be reasonably exercised and the Grantee,shall protect, defend, indemnify and hold and save harmless Grantor against any and all liability, claims, judgments, costs and demands, however caused, arising directly or indirectly out of the Grant of Easement herein contained.
