PUBLIC COMMENTS: Individuals wishing to provide a comment on agendized or non-agendized

Council Chambers by completing a Request to Speak form delivered to the City Clerk.
SUPPLEMENTAL COMMUNICATION: Members of the public unable to personally participate in the
meeting but interested in communicating with the City Council on agenda-related items are encouraged
to submit a written (supplemental) communication to the Council via email at
SupplementalComm@Surfcity-hb.org . Supplemental Communications are public record, and if
received by 9:00 AM on the day of the meeting, will be distributed to the City Council prior to
consideration of agenda-related items, posted to the City website, and announced, but not read, at the
meeting. Communications received after the 9:00 AM deadline will be incorporated into the
administrative record. Members of the public are also welcome to communicate with the City Council
(and staff supporting Council) at City.Council@surfcity-hb.org .
MEETING ASSISTANCE NOTICE: In accordance with the Americans with Disabilities Act, services
are available to members of our community who require special assistance to participate in public
meetings. If you require special assistance, 48-hour prior notification will enable the City to make
reasonable arrangements for an assisted listening device (ALD) for the hearing impaired, American
Sign Language interpreters, a reader during the meeting and/or large print agendas. Please contact the

PUBLIC COMMENTS (3-Minute Time Limit)
At this time, the City Council will receive comments from members of the public regarding any
topic, including items on the open session agenda. Individuals wishing to provide a comment
may do so in person by filling out a Request to Speak form delivered to the City Clerk. All
speakers are encouraged, but not required to identify themselves by name. Each speaker may
have up to 3 minutes unless the volume of speakers warrants reducing the time allowance.
Please note that the Brown Act does not allow discussion or action on topics that are not on the
agenda. Members of the public who would like to speak directly with a Councilmember on an
item not on the agenda may consider scheduling an appointment by contacting the City Council's
Administrative Assistant at (714) 536-5553 or emailing the entire City Council at
city.council@surfcity-hb.org.
While the City Council welcomes public involvement and supports and defends free speech, the
City Council rejects comments from anyone that are discriminatory, defamatory or otherwise not
protected free speech. Those comments will not inform nor be considered by the City Council and
may be cause for the Mayor to interrupt the public speaker. Such public comments will not be
consented to or otherwise adopted by the City Council in its discussions and findings for any
matter tonight.
COUNCIL COMMITTEE APPOINTMENT ANNOUNCEMENTS
Councilmembers may make brief announcements on any appointments made to a board,
committee, or commission. Councilmembers may not discuss or take any action on these
announcements. Announcements are limited to 1 minute.

In light of the terrorist attack in Israel this weekend, I urge you to work with the Interfaith Council to provide an
appropriate invocation for your 10/17 meeting.
Our HBPD and HBFD chaplains have done an excellent job over the last 9 months but it is past time that you recognized
the diversity of our faith community and sent a message of unity and solidarity with those suffering right now.

Procedure for the election of Mayor and Mayor Pro Tem
Statement of Issue:
The City Charter provides that at the Council meeting at which any Councilmember is installed
following any general or special municipal election, the City Council shall meet and elect one of its
members as its presiding officer, who shall have the title of Mayor.
The Charter also provides that the City Council shall designate one of its members as Mayor Pro
Tempore, who shall serve in such capacity at the pleasure of the City Council.
To ensure that each Councilmember had the opportunity to serve as Mayor, the City Council adopted
Resolution 6320 establishing a procedure to rotate the position. Essentially, the Mayor Pro Tem is
chosen based upon years of service and number of votes received by the electorate, and then
becomes Mayor the following year. Also, to ensure that repeat Mayors occur as infrequently as
possible, Councilmembers who have served as Mayor during the previous four years are not eligible
for election as Mayor Pro Tem.

Analysis:
The City Council resolutions are adopted policy, not law, and is binding upon the Council only to the
extent that the Council chooses to follow its own previously established policies.

RESOLUTION NO. 6320
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AMENDING CHAPTER 1.04, SECTION 1.04.12
OF RESOLUTION NO. 6085 -"A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF HUNTINGTON BEACH
ADOPTING A REVISED COUNCIL MANUAL"
The City Council of the City of Huntington Beach does
hereby amend Chapter 1.04, Section 1.04.12 of Resolution No.
6085 to read as follows:
CHAPTER 1.04
Parliamentary Procedure
1.04.12 Procedure for Selection of the Mayor
and Mayor Pro Tempore
The procedure for selection of the Mayor and Mayor Pro
Tempore, pursuant to Charter Sections 305 and 306, shall be as
follows:
(a) At the City Council meeting following any general or
special municipal election at which any council member is
installed, or as soon thereafter as the results of the
election are certified, the City Council shall elect a
Mayor and a Mayor Pro Tempore. In non-election years, the
selection of Mayor and Mayor Pro Tempore shall be made at
the City Council meeting date closest to the anniversary
date of the selections in the election years.
(b) The Mayor and Mayor Pro Tempore shall serve terms of one
year.

(c) The member of the City Council serving as Mayor Pro Tempore
shall become the Mayor on the expiration of the Mayor's
term.
(d) The member of the City Council having the longest
consecutive City Council service shall become the Mayor Pro
Tempore.
(1) In the event that two City Council members have the
same length of service 1 then the member who received
the greatest number of votes in the last Council
election in which such member was elected shall
become Mayor Pro Tempore.

If any member declines his/her term as it arises in
rotation, that member shall remain in the same place
in the rotation cycle as if he/she had served.
Any City Council member who has served as Mayor
within the last four years will not be eligible for
election as May Pro Tempore.
