Parra, Interim City Manager VIA: Jennifer Villasenor, Director of Community Development PREPARED BY: Jimmy Hoang, Code Enforcement Manager Subject: Adopt Resolution No. 2024-36 Confirming Cost Report for Weed Abatement on Private Parcels within the City for the 2024 Season Statement of Issue: The City identified properties with weeds and rubbish as nuisances, notified the owners, and held a public hearing for objections. Four properties did not comply by the deadline of May 20, 2024. The City removed the nuisances and compiled a cost report for these services, which is now submitted for City Council approval. Financial Impact: A one-time special assessment totaling $2,170.48 will be added to the Orange County property tax roll. This amount will reimburse the City's General Fund, which covered the initial expense from Account No. 10060301.64620 for Weed Abatement Contracts. Recommended Action: A) Adopt Resolution No.2024-36 "A Resolution of the City Council of the City of Huntington Beach Confirming the Report of the Public Works Director Regarding the Cost for Weed Abatement on Private Property Within the City for the 2024 Season," and B) Direct that all charges listed thereon be certified to the Orange County 2024/25 Property Tax Roll. Alternative Action(s): Do not approve the resolution, resulting in the City not being reimbursed for the weed abatement costs on the four properties. Analysis: Chapter 8.16 of the Huntington Beach Municipal Code (HBMC) mandates the removal of weeds and rubbish on private property. Weeds and rubbish can pose several risks, including fire hazards, health City of Huntington Beach Page 1 of 2 Printed on 7/31/2024 power LegistarTM File #: 24-517 MEETING DATE: 8/6/2024 risks from pests such as rodents and insects, and negative impacts on neighborhood aesthetics. Each spring, as part of its annual weed abatement program, Code Enforcement identifies properties where the owners have failed to address weed and rubbish nuisances in violation of the HBMC. Property owners are given notices and a deadline to comply. After no objections were received during the public hearing on May 7, 2024, the City proceeded with the abatement on four properties. The total cost of $2,170.48 for this work is documented in the 2024 Weed Abatement Cost Report (Attachment 2). These costs were posted for public review on July 19, 2024. By approving the cost report and securing property tax liens for the listed charges, the City ensures that the costs are recovered and reinforces the importance of property maintenance, promoting a safer and more pleasant environment for residents. Posting was completed by April 25, 2024; the Affidavit of Posting is attached. Additionally, staff mailed a letter via regular U.S. mail service to the owner of record of each parcel to inform them of this public hearing and of the requirement to clear their property. If a private property owner is unable or unwilling to clear their property by their own means, staff will complete the task. If the City clears the property, the private property owner is billed for the City's cost as a one-time special assessment on their property tax bill. Parra, Interim City Manager VIA: Jennifer Villasenor, Acting Director of Community Development PREPARED BY: Jimmy Hoang, Code Enforcement Manager Subiect: Adopt Resolution No. 2024-10 declaring weeds and rubbish a nuisance on specific properties and scheduling a Public Hearing on May 7, 2024, at 6:00 p.m. for protests and objections to the abatement thereof Statement of Issue: Each year, the City identifies privately-owned parcels, that have an accumulation of weeds and/or rubbish constituting a public nuisance, and the City Council adopts a Resolution declaring the City's intention to abate weeds and/or rubbish on identified properties. Financial Impact: There is no financial impact to the City, associated with declaring certain properties to be a public nuisance. Following the Public Hearing and the removal of weed and/or rubbish, property owners will be assessed on their property tax bill for abatement work performed by the City. Recommended Action: Adopt Resolution No. 2024-10 "A Resolution of the City Council of the City of Huntington Beach Finding and Declaring That Certain Weeds Growing in the City and Rubbish and Refuse Deposited on Public Ways and Private Property are a Public Nuisance; and Fixing the Time for Hearing Protests and Objections to the Abatement Thereof." Alternative Action(s): Do not adopt the resolution, and direct staff to take a different course of action. Analysis: The California Government Code includes a provision allowing local governments to declare weeds and rubbish a public nuisance, as a precursor to abatement. Pursuant to this provision, the City of City of Huntington Beach Page 1 of 2 Printed on 3/27/2024 powered8*LegistarT" File#: 24-146 MEETING DATE: 4/2/2024 Huntington Beach has adopted Chapter 8.16 Weed Abatement into the Municipal Code. This chapter requires that, "all persons owning any real property within the City keep said property free from weeds or other flammable materials that endanger public safety by creating a fire hazard." In accordance with HBMC Section 8.16.020 Nuisance Declared, the City Attorney's Office has prepared a resolution declaring that certain weeds, rubbish, and refuse deposited on specific properties are a public nuisance, with provisions for posting a notice and abatement of said nuisance. The resolution establishes May 7, 2024 at 6:00 p.m. as the date and time for the public hearing of objections to the abatement of said nuisance. Exhibit A of the resolution identifies the privately owned properties that are currently or potentially in violation of the Municipal Code. This year, through research and field inspections, staff identified 136 properties for abatement, all of which are currently undeveloped and vacant (see Attachment 1). If Resolution No. 2024-10 is approved, these private properties will be posted with a visible Notice to Destroy Weeds and Remove Rubbish and Refuse; property owners will also receive letters in the mail advising them of the May 7 Public Hearing date and the pending weed abatement efforts. Following the public hearing and eventual removal of weeds and/or rubbish, property owners will be assessed on their property tax bill for abatement work performed by the City. As such, there will be no fiscal impact to the City. Environmental Status: The removal of weeds, refuse, and rubbish from undeveloped private properties is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(h), which exempts the maintenance of existing landscaping and native growth. My hat is off to our elected officials and all staff regarding the volume and efficacy in addressing both day-to-day issues and matters of volatile public concern. It is my intention to sign up to speak during the General Comments session but may not address each of these if further time restriction is needed to address a large volume of speakers. I have no complaints on that practice! However, I wanted to provide these slides--without speaker notes-- just as one resident's POV.
