Re: Notice of Intention to Circulate a Petition to repeal Ordinance No. 4318 relating to the
formation of a Community-Parent Guardian Review Board for Review of Procurement of
Children's Library Material
Ms. Ryder,
I am writing to acknowledge that on Thursday, May 9, 2024, I received an Affidavit of Publication
from the Huntington Beach Wave to confirm publication of your notice of intention to circulate a
petition as required by Elec. Code 9205. Your 180-day petition circulation deadline of Monday,
October 28,2024 was provided to you on Wednesday, May 1, 2024,the date I provided you with a
ballot title and summary authored by the City Attorney.
In addition,I am accepting as sufficient the petition document for this initiative submitted to my
office by you on Wednesday, May 15, 2024, as required by Elec. Code Sections 101, 104, 107 and
9203(b). You are required to collect signatures from at least 10 percent of registered voters in
Huntington Beach based on figures reported by County Elections Official to the Secretary of State
pursuant to Elec. Code Section 2187 (report of registration dated February 20, 2024, attached), and
effective at the time of publication of notice of intention to circulate the initiative petition. In
addition, the Orange County Registrar of Voters office recommends collecting an additional 50%
above the 10% figure to compensate for signers disqualified for not being registered,being
registered but not living in the City, or for other reasons. The breakdown is as follows:
10%: 13,247
50%above 10% figure: 6.623

The City Attorney has prepared the following title and summary of the chief purpose and points of the proposed measure:
AN ORDINANCE TO AMEND THE HUNTINGTON BEACH MUNICIPAL CODE BY DELETING CHAPTER
2.66 THEREOF ENTITLED"COMMUNITY PARENT GUARDIAN REVIEW BOARD FOR PROCUREMENT
OF CHILDREN'S LIBRARY MATERIALS"AND ADDING SECTION 2.30.090 THERETO ENTITLED
"SELECTION AND USE OF LIBRARY MATERIALS"
The proposal would delete Chapter 2.66 of the Huntington Beach Municipal Code("HBMC"),which established
the Community Parent Guardian Review Board for Procurement of Children's Library Materials(the"Parent
Review Board")and provided the Board's purpose to review children's books for appropriateness in the Children's
Library,and the Board's composition,operating policies,and duties.
The proposal would also add HBMC Section 2.30.090 entitled"Selection and Use of Library Materials,"which
would require the Director of Community and Library Services and"Library Services"(an undefined term)
to establish policies for the selection and use of library materials,provided that such policies adopt certain
requirements as set forth in the ordinance.
Text of the Proposed Ballot Initiative
Chapter 2.66 of Title 2 of the Huntington Beach Municipal Code is stricken.A new Section 2.30.090 of Title 2 of the Huntington
Beach Municipal Code is added to read as follows:
2.30.900.Selection and Use of Library Materials
Director and Library Services shall establish policies for the selection and use of library materials,provided that such policies adopt
the following requirements:
(a) The Library serves as a center for voluntary inquiry and the dissemination of information and ideas.
(b) Library materials shall not be excluded from the library collection because of the origin,background,or views of
those contributing to the creation of the materials,or because of the topic addressed by the materials or the views expressed in the
materials.
(c) Library materials should be provided for the interest,information,and enlightenment of all people and should
present diverse points of view in the collection as a whole.
(d) The public has the right to receive access to a range of social,political,aesthetic,moral and other ideas,and
experiences.

NOTICE OF INTENTION TO CIRCULATE PETITION
Notice is hereby given by the person whose name appears hereon of their intention to circulate the petition within the City
of Huntington Beach for the purpose of qualifying for the ballot an initiative to repeal Ordinance 4318.A statement of the
reasons of the proposed action as contemplated in the petition is as follows:
Parents should decide what their own children should read,not what my children should read.We seek the repeal of this
ordinance that creates a committee of twenty-one parents or guardians reviewing all of the children's books(Ages 0-17)
in our library and all new materials being acquired.The committee then makes a determination as to whether or not these
materials are allowed to be purchased and included in our libraries.This appears to us to be a book banning committee
and committees that ban books are un-American.
The parents/guardians appointed to this highly political committee are not required to have any training or expertise
in reviewing some 6200 books and other materials our libraries acquire annually.The ordinance has been sloppily
drafted and could result in destroying the Huntington Beach Public Library. It is a disservice to the library's mission that
"welcomes,empowers and enriches our community by providing innovative and traditional services that inspire and
encourage transformation and growth."One member of this committee could stall the purchase of all materials entering
the children's and young adult sections of our library for up to a year.
The decisions of this board would be final and unappealable even to the City Council. We believe that this is by design.
This ordinance is designed to destroy our beloved public library and we believe it should be repealed.

Per your request, please find attached the Ballot Title and Summary as prepared by the City Attorney
for a proposed measure that would delete Chapter 2.66 of the Huntington Beach Municipal Code
(HBMC)that established the Community Parent Guardian Review Board for Procurement of
Children's Library Materials, and add to the HBMC Section 2.30.090 entitled "Selection and Use of
Library Materials."
Per California Elections Code 49208, "Signatures upon petitions and sections of petitions shall be
secured, and the petition, together with all sections of the petition,shall be filed within 180 days
from the date of receipt of the title and summary, or after termination of any action for a writ of
mandate pursuant to Section 9204, and, if applicable, after receipt of an amended title or summary
or both, whichever occurs later. Petitions and sections thereof shall be filed in the office of the
elections official during normal office hours as posted. If the petitions are not filed within the time
permitted by this section, the petitions shall be void for all purposes. With today's delivery of a Ballot
Title and Summary,your 180-window will sunset on Monday, October 28,2024.
Your next steps involve publication of your Notice of Intention and Ballot Title and Summary of the
proposed measure at least once in a newspaper of general circulation (§9205(b)) at your expense,
and filing of publication affidavit with my office (§9206). The Initiative Handbook I shared with you
documents these activities in the initiative timeline.

NOTICE OF INTENTION TO CIRCULATE PETITION
Notice is hereby given by the persons whose names appear hereon of their intention to circulate
the petition within the City of Huntington Beach for the purpose of qualifying for the ballot an
initiative to repeal Ordinance 4318.
A statement of the reasons of the proposed action as contemplated in the petition is as
follows:
Parents should decide what their own children should read, not what my children should read.
We seek the repeal of this ordinance that creates a committee of twenty-one parents or
guardians reviewing all of the children's books (Ages 0-17) in our library and all new materials
being acquired. The committee then makes a determination as to whether or not these materials
are allowed to be purchased and included in our libraries. This appears to us to be a book
banning committee and committees that ban books are un-American.The parents/guardians
appointed to this highly political committee are not required to have any training or expertise in
reviewing some 6200 books anJ otper materials our libraries acquire annually. The ordinance
n has been sloppily drafted and 6eild- result in destroying the Huntington Beach Public Library. It
is a disservice to the library's mission that "welcomes, empowers and enriches our community
by providing innovative and traditional services that inspire and encourage transformation and
growth." One member of this committee could stall the purchase of all materials entering the
children's and young adult sections of our library for up to a year. The decisions of this board
would be final and unappealable even to the City Council. We believe that this is by design.This
ordinance is designed to destroy our beloved public library and we believe it should be
repealed.

There is hereby established a new Community Parent Guardian Review Board for Procurement

first regular meeting of the calendar year and such officers shall serve for one year and until

2.30.900. Selection and Use of Library Materials
Director and Library Services shall establish policies for the selection and use of library
materials, provided that such policies adopt the following requirements :
A. The Library serves as a center for voluntary inquiry and the dissemination of
information and ideas.
B. Library materials shall not be excluded from the library collection because of the
origin, background, or views of those contributing to the creation of the materials,
or because of the topic addressed by the materials or the views expressed in the
materials.
C. Library materials should be provided for the interest, information, and
enlightenment of all people, and should present diverse points of view in the
collection as a whole.
D. The public has the right to receive access to a range of social, political. aesthetic,
moral, and other ideas and experiences.
