*Per Elections Code section 15: Notwithstanding any other provision of law, if the last
day for the performance of any act provided for or required by this code shall be a
holiday, the act may be performed upon the next business day. Gov't Code Section
6700 states: Saturdays are holidays only after 12:00 p.m. The express language of
Elections Code Section 15 refers to the "last day," meaning the whole day must be a
holiday in order for the extension to apply. Since the deadline is a Saturday (a half-day),
it is not considered a holiday. Therefore, there is no extension of time to the following
Monday.

Notice is hereby given by the persons whose names appear hereon of their intention to
circulate the petition within the City of Huntington Beach for the purpose of qualifying for the
ballot a Charter amendment to preserve the Huntington Beach Public Library. A statement of the
reasons of the proposed action as contemplated in the petition is as follows:
The Huntington Beach Public Library has been providing library and cultural services to
the City of Huntington Beach since 1909.Now, some politicians seek to privatize/outsource the
management of the library including our librarians. Some of our beloved librarians have already
quit due to this threat of lower pay and loss of benefits. Outsourcing threatens the institution of
the Huntington Beach Public Library system to its core. Privatization and/or outsourcing is likely
to lead to a reduction in services, cutting of staff and programs, and would cause private
organizations that support the library (like the Friends of the Huntington Beach Public Library)
to reduce or eliminate their programs that support the library. Libraries are public services for the
public good and should not be turned over to private corporations seeking to turn a profit.

Text of the Proposed Charter Amendment ; Y
Section 806 of Article VIII Miscellaneous is adopted to read as follows:
SECTION 806. Huntington Beach Public Library
No public library owned or operated by the City as of March 19,2024,or hereafter
owned or operated by the City, shall be sold, leased,exchanged or otherwise transferred or
disposed of, nor shall any service provided by the Huntington Beach Public Library as of March
19,2024,be operated or managed by a private contractor that employs library staff to achieve
cost savings and/or any proposal that would change the wholesale management of any
Huntington Beach library unless: (1) such service was outsourced to a private organization or
operated pursuant to a managed services agreement with a private entity during any period from
January 1, 2018 through March 19, 2024; (2)the City declares a fiscal emergency pursuant to
Article XIIIC, Section 2(b)of the California Constitution; or(3) it is authorized by the
affirmative votes of at least a majority of the total membership of the City Council and by the
affirmative vote of at least a majority of the electors voting on such proposition at a general or
special election at which such proposition is submitted.
Any contract to change the wholesale management or outsource library management and
operations services to a private contractor entered into between March 19, 2024 and the adoption
of this Section 806, shall be considered void or shall be immediately canceled to the extent
permitted by law.
