ISSUE STATEMENT
This affirmation of the City of Huntington Beach City Council is to show our commitment and respect for
the Constitution of the United States of America.The Constitution and its Amendments are the
foundation of our Republic securing each person the rights to live and work freely without government
overreach or unreasonable restriction from any entity.
These freedoms have rarely been challenged in our county as they have been recently and called into
question. From a presidential candidate defending himself from unreasonable charges in court to a city
council candidate being attacked by an incumbent through "lawfare"for speaking out.Then there is the
constant attack on our 2nd Amendment by our state that ignores our federal laws and claims to be a
"sanctuary state".This weakens local control.
Laws are being made to weaken the laws that protect those of law-abiding citizens and businesses(2nd
Amendment laws or Covid 19 restrictions)while other laws are either being ignored by prosecutors or
weakened on behalf of enabling criminals to be even more brazen or violent.With open borders enabled
by our federal government or illegal immigration encouraged by our Governor at the taxpayers' expense,
the laws are not being enforced by our government equally or rationally-all the while those that speak
out often get attacked for or suppressed from speaking out freely.This is barely scratching the surface of
the infringements being committed against the citizens of our state and country.This is a warning of a
gross deterioration of our Republic and of our beloved freedoms.
The Constitution and Amendments are the foundation of our Republic securing each person the rights to

should cherish our freedom to speak our views, especially to our government,and we should be
empowered to defend ourselves from attacks on our granted freedoms.

Do you not see the hypocrisy?How can you declare we are a 1st Amendment friendly city,
when you voted to create a politically appointed committee to pick and choose(without
appeal)what books are available in our library.???? Your item is a farce.You can't deny 1st
Amendment rights in one meeting and then say you care about protecting the freedom of
speech in another.
Sadly, based on recent council actions, I cannot say with confidence that our city is fully
committed to the First Amendment.

I am writing regarding the upcoming agenda item to recognize Huntington Beach as a 2nd
amendment friendly city. I am strongly opposed to this designation. As a mom of two
elementary age children and an educator I fear for the message this sends to the community
and the threat of gun violence it encourages.Huntington Beach has many wonderful features
such as the Bolsa Chica Wetlands, beautiful coastline,and treasured public library. There is so
much to celebrate in Huntington Beach but guns are not it. Please do not designate Huntington
Beach as a 2nd amendment friendly city,gun violence is very serious and should not be
treated in such a cavalier manner.

Dear Mayor and City Council,
I feel that the proposed "Affirmation" of Agenda Item#21 is both gratuitous and
self-serving, and is simply grandstanding by a Council member who is speaking only
to his conservative base and is ignoring the rest of the community. Who determines •
the interpretation of the First and Second Amendments? Certainly the Council
majority would have its own interpretations, especially on the Second Amendment,
and is asking the citizenry to subscribe to whatever he deems the "friendly"
designation to mean. This item, like so many before it which speaks only for its
supporters and not for the general public, should be considered a political stunt that
is unnecessary and frivolous. I would advise pulling this item. Is the Mayor Pro Tern
that desperate for gratuitous glory as to foist this largely uncalled for"affirmation" on
our citizenry? BTW, is the NRA coming to town any time soon?!

Hello. I would like to object to the designation of Huntington Beach as a "Second Amendment
Friendly City." What a dangerous thing to do! Nobody's 2nd amendment rights are being
threatened. To make such a move is reckless and sends yet another bad message about this
city. Huntington Beach has a very wide and very ugly reputation for racism and intolerance.
Such a move would only make this worse. That is hardly something the government should do
for its own city which is a destination for visitors from all over the world.
The current city council majority is constantly advertising their small-mindedness and -
ignorance. Please re-consider this as it is yet another backward step.

Why is the HB City Council spending time on this?
It is clearly a partisan political attempt when you
blatantly mention you consider "These freedoms

disagree.
Most people in this country are in favor of
supporting common-sense gun laws to keep all of
us safe. This resolution is ridiculous, having no
impact on our state or local laws. Your proposal
represents a vocal minority and not the will of the
people.
Over and over again, I see 4 members of the HB
Council promoting changes which are in stark
contrast to what our citizens want and not taking
issues to our community.

I oppose agenda item 24-427,Submitted by Mayor Pro Tern Pat Burns-(Affirmation of

City Council meetings should not be partisan events, but Huntington Beach's majority
members continue to push a national MAGA agenda, creating division within our
community. In his statement to the citizens of Huntington Beach, Mayor Pro Tern Burns
even shamefully champions Donald Trump as "a presidential candidate defending
himself from unreasonable charges in court."
This is such an inappropriate statement from a city council member. Avast number of
HB citizens, as well as most U.S. citizens, believe Trump received a fair trial and due
process. Mayor Pro Tern Burns' statement undermines trust in our justice system and
the rule of law. Partisan statements like this have nothing to do with effective
management of our city's affairs!
Furthermore, it's hypocritical touting the First Amendment when you support a library
book review board of political appointees who have final and non-appealable authority
over what books can be acquired and kept in our public library. The First Amendment
protects citizens, including minors,to receive and read information. (The fact that 4,000
signatures have been gathered in just 2 weeks to repeal this book review board is proof
that this form of censorship will not be tolerated in our community.)
And Mayor Pro Tern Burns' politicized affirmation of the Second Amendment is truly
scary. I understand that he will be joining Mayor Van Der Mark and Council Member
McKeon at the God, Guns, and Government event in June, so that's most likely the real
reason for this agenda item. It's strictly a performative gesture to appeal to outside
MAGA groups. (FYI: God, Guns, and Government supports the January 6 convicted
rioters)
A proclamation of this nature makes us more unsafe because it's a misinterpretation of
the Second Amendment. Most Americans support common-sense gun laws, but this
statement promotes more gun use and violence. This is shameful.

Dear City Council,
I am writing with respect to these items for the Council Agenda on June 4, 2024. I continue
to be disappointed that this council spends more time on things that are not related to the
governance of and support for the Clty of Huntington Beach. These 2 items reflect that no
return to polite political discourse will happen anytime soon.
As to Mr. Kalmick's item, it reflects deep frustration and well understood why this is.
However,I do think it does not move the city forward in any regard and do not support the
item.
Mr. Burns' item is simply not appropriate for a HB City Council member to put his
PERSONAL national view of the world into a City Council meeting. The time he spent
drafting this item would have been better spent educating himself on any number of items that
ALL.residents agree are important: Clean water,well paved streets,homelessness support,
affordable housing etc....so much real work to be done and yet.... In watching most City
Council meetings, I have been underwhelmed with the lack of critical thinking by this council
member. Please stop the grandstanding and blowing the dog whistle. The residents are very
clear on your views on all manner of things,just not clear that your priority is to serve the
city.

June is National Gun Violence Awareness Month, created to draw
awareness to the reality that more than 300 people in the U.S. are directly
impacted by gun violence every day....
So Mayor Pro Tern Pat Burns puts on the agenda a really dumb resolution
to affirm the City Council's commitment to the U.S. Constitution and
specially recognize that we are a 1st and 2nd Amendment-friendly city.
After his previous grandstanding resolution on an irrelevant national issue
to show solidarity with Texas, I thought it couldn't get any more ridiculous,
yet here we are. The partisan political rant in the Issue Statement is truly
bizarre. What does this resolution even mean? That we welcome gun-
carrying residents and visitors? How are local businesses that rely on
tourism going to feel about that? We already support the Constitution,
which includes all of its amendments. We already have free speech
(though often limited by Gracey to just 90 seconds, and by censoring
books in the library). We already have the right to bear arms, even in
California. I vehemently oppose the resolution.
Who are you trying to impress with this nonsense? Maybe Trump himself,
since Strickland is a spokesperson for the Trump campaign in Orange
County? Attendees at the upcoming God, Guns, Government "Election
Action Summit" where Van Der Mark, Burns, and McKeon will be featured
speakers? Trump-supporting U.S. Representative Michelle Steel and others
you met while schmoozing at the Capitol Hill Club, a private social club for
Republicans in Washington DC?
Per AB 1234, it was reported at the May 7th City Council meeting that
several of you flew to Washington DC on an "advocacy trip" coordinated by
Stapleton &Associates, the City's advocacy firm. Gracey mentioned
meeting with Stapleton staff as well as "staff for Senators Padilla and
Butler to advocate for federal funding for several coastal erosion projects
and the Navigation Center, just to name a couple." Strickland said you
"had some really good meetings . . . on federal funding for coastal erosion
projects and the Navigation Center." Burns said, "I was with Gracey."
According to information obtained through a CPRA request, that junket
(April 29-May 2) included Van Der Mark, Burns, Strickland, Parra, and
Council policy analyst Shannon Levin, for a total cost to taxpayers of
$9,355.66. City Attorney Michael Gates was also on the original list, but
canceled two weeks prior to the trip.
Question #1: Why would the trip require six people? According to the daily
schedule, Monday and Thursday were travel days, Tuesday was meetings
with members of Congress or their staff on just three topics: Bluff Top
Stabilization and Slope and Trail Repair (5 meetings, 3.5 hours),
Downtown Streetlighting (2 meetings, 1.5-2 hours), and Navigation Center
and Mobile Crisis Response (1 meeting, 1 hour). Wednesday was a day of
sightseeing (tour of Capitol complex and Capitol dome) briefly interrupted
by a lunchtime discussion of the grant process with Thomas Stapleton.
Question #2: Why would the City Attorney have even needed to go? What
involvement would he have in these topics? Shouldn't he be here taking
care of his many ongoing lawsuits and supervising his bloated staff? If the
proposed 2024/25 budget is approved at the June 4 City Council meeting,
his department budget will have increased by $1,616,887 since 2020/21, a
whopping 61.4%. And what do we have to show for it? A costly secret Air
Show settlement and a series of recent losses in court.
Question #3: Why was it necessary to fly all the way across the country to
meet with those people? Michelle Steel has an office in nearby Cypress,
just 13 miles away, and is in Orange County regularly. David Valadao has
an office in Bakersfield, Pete Aguilar in San Bernardino, Mike Garcia in
Santa Clarita. Perhaps a maximum of eight hours of meetings in one day
on just three topics was an excuse to visit our nation's capital on
somebody else's dime and cozy up to others of like MAGA mind? Better
photos to post on Facebook?
For people claiming to be fiscally conservative and such great stewards of
city funds, you could have been a lot more judicious with them. Even if the
city is ultimately awarded a couple million dollars in federal aid, it could
have been achieved in a much less expensive, much less suspect manner.
In other news...
An OC Register article dated May 31, 2024, states: "Van Der Mark said she
respects the right of residents to circulate the petitions, but emphasized
that the city hasn't issued the request for proposals on outsourcing the
library's management." The RFP had already been released the previous
day. Was she not in the loop, was she being disingenuous, or was she
blatantly lying?
We just lost another valued city employee — the deputy city manager
resigned. So now we have no city manager or deputy city manager. Who
would want to work under this city council? Maybe Parra can fill that
position on an interim basis as well?
There was a pro-Trump rally at the pier last Saturday, many of his
supporters waving giant Trump banners and inverted American flags. You
may have approved an increase in the tourism tax to generate more
income and attract more tourism, but who in their right mind would want
to visit here and see that? Say goodbye to conventions, conferences, and
tourists who don't want to deal with this crap.
It's a lot to ask, considering this Council's penchant for voting 4-3 on
everything the majority themselves propose, and 3-4 on anything sensible
and good for the city that's proposed by the minority (such as putting the
library issues on the November ballot, or doing something about the
campaign signs blight), but it would be really nice if common sense and
common decency prevailed on the dais once in a while. Unfortunately,
we're learning the consequences of electing candidates, both locally and
nationally, with big egos, extremist ideology, and no moral compass.

resume of jack-assery being foisted on the citizens of Huntington Beach by the
"conservative" members of the council. I guess you all think you need more
red meat to feed the animals at your upcoming "Election Action Summit".
How about you all do something practical like fixing the non-functioning
fountains at the Central Library?

June is Gun Violence Awareness month, designated by Congress to bring public
awareness to the tragedy of the 300 gun-related tragedies that occur each day in the US,
affecting almost every family in America. Cities around the country are recognizing the
• importance of addressing this national shame, by supporting reasonable weapons
control legislation, universal background checks, assault weapons controls, permitting
laws,gun sale regulations,weapons education programs, Domestic Violence programs
and other programs that will make our country safer. But Huntington Beach is silent.
Shame on you.
June is Pride Month --recognizing the humanity of a large segment of our population that
has been historically subject to discrimination. Cities around the country are showing
their compassion by flying the Pride Flag. But in Huntington Beach the city council
majority chose to specifically demonstrate its disdain for the LGBT community by
banning the display of the Pride flag on city property. Shame on you.
Instead of supporting these national commemorations, Councilman Burns proposes
nonsense resolution, 24-427, bemoaning the obstruction of what he considers
freedoms,the injustice of holding his favorite former president accountable for his
crimes and torts under the law, and recognizing Huntington Beach as a 1st and 2nd
Amendment friendly city.As you may have forgotten,you took an oath to support and
defend the entire constitutions of the United States of America and the State of
California, not just the first and second amendments of the US Constitution,which it
appears you haven't read. Freedom is not defined as existing only within the context of
the religious mores of the council majority. How ironic that you decry the loss of
freedoms while stomping on the freedoms of the citizens of Huntington Beach.
Councilman Kalmick's Resolution 24-433, despite its intended satire, pales in absurdity
to 24-427. Shame on you.

Hi,
I am writing as an HB resident and mother in opposition to the agenda item proposing that
Huntington Beach be recognized as a 2nd Amendment Friendly City. Our leaders should focus
on solutions that can keep our families, schools, and communities safe. This pointless
resolution will have no impact on state or local law and only serves to cater to extreme
constituents who feel threatened by common sense gun laws.
Our elected officials have an obligation to enforce the law, especially those laws which help
keep us and our children safe from senseless gun violence. The so-called leaders proposing
this resolution are not doing their jobs to promote safety in our HB community, and are not in
line with the vast majority of residents and law enforcement who support common-sense gun
laws, such as safe storage and background checks on all gun sales.
As a volunteer with Moms Demand Action,I will continue to advocate for common-sense,

This is a plea that our City Council restrict its actions to those needed by our city. These
include but are not limited to infrastructure that badly needs repair,homelessness, and e-bike
regulation. Why can't the fountain in the library be fixed for the 50th anniversary
celebration?
Instead, our City Council is doing what the OC Register called "political theater." I have been
a homeowner and resident of this city for 39 years. Until last year, I never concerned myself
with city politics. This CC has made me an activist.
Firstly, I understand Mr.Kalmick's intent with this resolution. I understand his frustration.
And am reminded of the quote "You are entitled to your own opinion, but not your own
facts." But this resolution wastes valuable time.
Secondly,I very much object to 24-427. It is extremely partisan and will further divide the
city. I respect Mayor.Pro Tem Burns,but I think this is both unnecessary and divisive.
Please - get back to your real job of running this city and leave the grandstanding to national

Just say no to privatizing the public libraries. There is no need for this and no one asked for it to

I would like to address Mr. Kalmick's Item 20 and Mr. Burns' Item 21 on tonight's agenda.
Mr. Kalmick mocks Mr. Burns'concern that our federal constitution and especially the first and second amendments are
under attack and therefore in need of defense. He wants us to think that everyone supports and defends the federal
constitution and our rights. This is manifestly untrue. The attacks are open, blatant, and continuous and primarily from
the eft and the Democratic Party.
Democrats are actively seeking to abolish the electoral college. Rather than bothering to amend the Constitution,they
are even now entering into a conspiracy against it with their National Popular Vote Interstate Compact.
Democrat Representative John Dingell has argued for doing away with the Senate.Such a pure one person one vote
democracy, a dictatorship of the majority,is a system guaranteed to produce a dictator. Erwin Chemerinsky has even
argued that the Supreme Court should impose all this by judicial fiat without bothering to amend the written
constitution.
In 2014 under SJR 19,the Democratic Party attempted to amend the first amendment to suppress political speech.
As revealed in the "Twitter files," Democratic administrations have pressured social media platforms to act as de facto
government censors and propaganda organs.
In 2016, Democrats staged a sit-in in Congress to deny anyone on the no fly list the right to buy a guy,thus attacking
both the second amendment and the fifth amendment's guarantee of due process.
In 2023 under SJR 7, California Democrats proposed modifying the second amendment to severely limit this important
constitutional right.
Left-leaning Supreme Court members have invented constitutional rights to child killing and the desecration of God's
holy institution of marriage, and treated these invented rights as superseding the written rights to freedom of speech
and religion. Citizens are routinely jailed,fined and punished for even passively opposing child killing and the
desecration of marriage.
The current administration has engineered a Venezuela-style conviction and possible jailing of its principal opponent in
the upcoming presidential election. They have done so in violation of the defendant's sixth amendment right to know
the charges against him.
And we could go on. The attacks against our constitution are blatant, numerous, continuous,and practically define the
modern Democratic Party.
Unable to deny or defend these specific attacks against both the constitution's system of checks and balances and its
enumerated rights, Mr. Kalmick and his allies at the OC Register resort to mockery and ridicule,with the Register today
calling defense of the constitution a "circus"that distract from the pot hole filling business of the City.
Put me on record as supporting Councilmember Burns efforts to defend our constitution and the Bill of Rights.

I am writing in response to an "issue statement" put forth by Mayor Pro Tern Pat Burns,that has just come to my
attention.
This is nothing but a political stunt, not representing the vast majority of city residents with no benefit to our city and is
totally superfluous. We are all as citizens of the United States of America, protected under our constitution, and all
amendments to the constitution.
Furthermore,the justification given as a support to a presidential candidate,falsely claiming he is being charged
unreasonably,when the proof is so glaringly opposite. The fact that you want to refute the judgement of a jury of his
peers,who were accepted onto the jury by his defense team, indicates that you do not respect our great judicial system,
form of governance,and the rule of law.
Using the city to support your personal political biases is unconscionable.
Recent moves, like threatening to privatize the library, ban books, and make this city unwelcome to all those who don't
hold with your religious beliefs, is so counter to the principles our country was founded on and,judging from responses
in the last two city council,against the vast majority of citizens of Huntington Beach.
Please stop these counterproductive shenanigans and do your job as our City Council should, responding to the needs s of
our residents.
