Funding Source: Not applicable. Recommended Action: Adopt the attached Ordinance amending the Huntington Beach Municipal Code by amending Section 10.64.080 thereof to remove the parking meter rates and time limits, which are now established by Council Resolution. Alternative Action(s): Amend HBMC Section 10.64.080 by inserting the current parking meter rates and time limits instead of establishing them by Council Resolution. Analysis: Chapter 10.64 of the Huntington Beach Municipal Code has not been updated since 1978. The chapter is concerned with installation of parking meters on city owned or leased land and calls out the amount of money to be deposited in order to obtain a certain amount of time on a parking meter. For example, this section notes that to park for a period of twelve minutes requires the depositing of one cent. It has become city policy to establish parking meter rates and time limits by Council Resolution. This is currently done by the city fee resolution which is amended yearly or more frequently as needed. By removing the parking meter rates and time limits from Section 10.64.080, there will be no ambiguity for enforcement purposes. That Section 10.64.080 of Chapter 10.64 of the Huntington Beach Municipal Code is hereby amended to read as follows: 10.64.080 Adiustinq meters. Parking meters when installed and properly operated shall be so adjusted to accept coins to show legal parking time. Rates will be determined by Council resolution. SECTION 2. This ordinance shall take effect 30 days after its adoption. The Director, when directed by the Council, shall cause to be installed upon such streets or portions thereof or city-owned or leased land within the parking meter zones, adjacent to each designated parking space, such parking meters as shall have been approved by the Council. It is the duty of the Department of Public Works to maintain signs in the various areas within the parking meter zones, indicating the type of meter there installed and the days and hours during which the parking meters are in operation. Signs as mentioned in section 10.64.020, may either be on separate posts, painted on the curbs, or fastened to the parking meters, in the discretion of the Department of Public Works. The Department of Public Works shall have lines or markings painted upon the curbs, streets or area adjacent to each parking meter, designating the parking space for which the meter is to be used. Any person violating any provision of this chapter shall, upon conviction thereof, be guilty of an infraction, and punishable by a fine not to exceed one hundred dollars ($100).
