I later contacted Officer L A M A S #1224 and asked her to co me out with her Search & Rescue tea m when the tide receded. At approxi mately 1500 hours, as they searched, a citizen turned in what was possibly the spent shell casing. See Officer L A M A S` report for further details. Detective P RI C E R located a possible witness to the arrest. See his report for further details. Detectives E S K E S and M C C O L L O M later went to the police station to collect and process Officer B A C H M A N` S service weapon. I was told that one round had been fired. See the related report for further details. was transported to the H B P D Jail and later intervie wed by Detectives C H E N and B U R T O N. He ad mitted to s moking metha mpheta mine with and later getting pursued by H B P D patrol officers. During the pursuit, he thought about fleeing on foot. When the pursuit ter minated, he said he surrendered. See their reports for further details. IN T E R VI E W At approxi mately 0910 hours, Detective T U N S T A LL and I contacted at the H B P D Jail. We walked hi m up to our 3rd floor intervie w roo m. I read his rights per Miranda fro m my depart ment-issued card. I asked hi m if he understood and he said, " Yes." I asked why we were all here and he said, "Joyride I guess." Based on my training and experience, I kno w "joyride" is a ter m often used for driving a stolen vehicle. said he was near California Girls strip club in Anahei m connected to a "grille." " Grille" was his ter m for being connected to Wi- Fi. Based on m y kno wledge of the area, it was later deter mined to be at Brookhurst Street in the city of Anahei m. I asked what na me he kne w as and he said he did not kno w his na me. He said he has kno wn hi m for a fe w months, but didn`t care to kno w his na me. said just before midnight, he was at the club and a "drunk guy" may have mistaken hi m as a valet driver. He was in the parking lot. The driver gave hi m the key s and was "du mbfounded." said had to have kno wn the vehicle did not belong to hi m. He said sa w when he was given the keys. said it felt good to drive around in the vehicle. He believed he was by Fairvie w Park ( Costa Mesa). said he did not stop for the police car when the red and blue lights were activated. He said he did not pull over and "left" and they went in "pursuit." I asked hi m ho w fast he believed he was going and he said, "like 100, 110." He looked at the odo meter. I asked hi m if he was a good driver and he said, " Not if I crashed." I asked if he ran any red lights and he said, "I probably did." I asked hi m why he ran and he said he thought he was going to get a way. I asked what he thought he was going to get arrested for and he said, " Grand theft auto?" During the pursuit, I asked what he and talked about and he mentioned warrants. He kne w he had a "bench warrant" for co m mercial burglary . He also kne w he was "in the wrong" and stole the vehicle. I asked about the bolt cutters in the vehicle and he said they did not belong to hi m. said a pair of thick gloves belonged to hi m. The blue gloves belonged to There were several pairs of sunglasses in the vehicle. He said they belonged to hi m. He did "steal" one fro m a friend, found one and bought the others. said the " meth" and pipe belonged to but he kne w they were in the vehicle. I asked about speakers and he said the " Bose" belonged to hi m. I asked about the credit card in the vehicle that belonged to victi m He said he kne w the card was in the vehicle and it ca me fro m The other credit card belonged to He said she is his mother and he had per mission to possess it. Again, Detective M C C O L L O M later confir med the credit card that belonged to was stolen. He was never able to contact denied stealing the vehicle fro m the rental dealership. He said he would not be on video surveillance there. He said so meone could have stolen the vehicle fro m the rental dealership and then gave it to hi m. He described the male that gave hi m the keys as " Arabian," 27-32 years old, 5`11", 200 lbs., with a goatee, polo shirt, fedora hat and black sunglasses, even though it was nightti me. said the male parked the vehicle in the back parking lot of California Girls. After he was given the keys, went and stole the vehicle. He ad mitted to stealing the vehicle fro m the unidentified male that gave hi m the keys, but not the rental dealership. The gloves were for electrical work. He had the m with hi m "just in case." We went back and talked about the pursuit. When the pursuit ended, said he opened the door and ran do wn the stairs and onto the sand. He heard officers yell at hi m to " Get do wn and stop!" He did not co mply because he "couldn`t think." I asked if he thought it was reasonable for officers to tell hi m to get on the ground and he said, "of course." He kne w they were police officers. started to get out of breath. He said he had a knife in his hand and quickly changed his story and said it was in his pocket. He said he al ways carries a knife. As he ran, he was "zigzagging." said he stopped and motioned that he put his hands up. He then motioned to us as he put his left hand in his waistband. He intended to take one last "hit" fro m his Juul alternative s moking device. As he raised his left hand fro m his waistband, he heard a gunshot. He thre w hi mself do wn to the ground. clarified and said when he fled fro m the vehicle, the knife was already in his front left, jacket pocket. said the knife was in the sa me pocket as the Juul. stated again when he stopped, he reached with his left hand to ward his waistband to grab his Juul. He pulled the Juul out and the " Ar my" knife fell out. He described it as green and bro wn ca mouflage color. stood up and sho wed us his positioning. As he stood facing me, he describe my position as the male officer, I believed to be Officer B A C H M A N. He said the fe male officer, I believed to be Officer H A N E Y, was behind hi m. He was slightly turned to his left and reached into his left front, jacket pocket. This was near his waistband. I asked hi m if the hand and pocket could have been out of the officer`s vie w and he said, " Yeah." As soon as he pulled it out and lifted his hand, he heard the gunshot. He dropped to the ground. During the foot pursuit, he heard the police officers y ell at hi m. He said they were muffled. I asked if he felt it was reasonable for police officers to believe he was possibly going for a weapon and he said, " Yeah, but not to shoot like that." For safety said, "I would have reach for it too," referring to the police officer pointing his gun, based on S actions. I asked again if it was reasonable for an officer to believe he was going for a gun or weapon and he said, " Yes." I asked if he pulled the knife on the officer and he said he did not. He pulled his Juul out and the knife fell. He said if he did, he kne w he would have been shot. I asked if it was a s mart idea to go to his waistband after the pursuit and chase and he said, " That`s the thing, I` m not thinking." He said in the heat of the mo ment, "I just don`t think." said he was then handcuffed. described his Juul as the size of a pen and shiny silver in color. Detective T U N S T A LL later obtained his sa mple and booked the s wabs into Property. signed the consent for m; see the attached for m for further details. We concluded our intervie w and later walked back do wn to the H B P D Jail. The intervie w was video and audio recorded. I later uploaded the digital file to evidence.co m. Detective W A G O N E R fro m Placentia P D later checked video surveillance at the California Girls. During the ti me fra me provided, he did not see anyone matching the description of or the described driver and the vehicle. See his report for further details ( P P D # 20-00677). At approxi mately 1515 hours, Detective T U N S T A LL and I intervie wed Officer B A C H M A N. See Detective T U N S T A L L` S report for further details. O F FI C E R H A N E Y #1253 I N T E R VI E W At approxi mately 1600 hours, Detective T U N S T A LL and I intervie wed Officer H A N E Y in the upstairs conference roo m. She was willing to give a voluntary state ment. Officer H A N E Y started her nor mal patrol shift on Tuesday , 2-18-20 at 2005 hours. She wore her H B P D patrol unifor m co mplete with a badge, shoulder patches and gun belt. Her H B P D patrol vehicle was a marked black and white with H B P D markings on the sides and an overhead e mergency light bar with for ward facing red and white lights. Prior to her shift, she sa w that everything was in working order. Officer H A N E Y said at approxi mately 0300 hours, she was on routine patrol in the area of Ada ms Avenue and Brookhurst Street. As she drove westbound on Ada ms she sa w a vehicle, later involved in the pursuit, "dip" into the Kohl`s parking lot at 9811 Ada ms. She believed they sa w her and were avoiding her because every business in the shopping center was closed. Officer H A N E Y sa w the vehicle drive eastbound through the lot to ward the Yogurtland at 9961 Ada ms. Yogurtland is at the east end of the parking lot. She lost sight of the vehicle and they later reappeared near the west end of the lot after driving through the rear of Kohl`s. She believed they were trying to hide fro m her, especially since they drove behind Kohl`s. She said they had no real sense of direction. Based on her training and experience, she believed their actions were suspicious. P oll y `s Pies is at the west end of the lot. Officer H A N E Y was just east of the m, on Ada ms. Although they had the opportunity to turn onto Ada ms, Officer H A N E Y said it appeared the vehicle tried to let her drive past the m. She did not. Officer H A N E Y said the vehicle then turned right and traveled westbound on Ada ms in front of her. Based on the suspicious activity and the fact that the vehicle did not have a rear license plate ( C V C 5200(a)), she decided to conduct a traffic stop. Based on the suspicious activity , she i m mediately requested an additional officer. Officer H A N E Y activated her overhead e mergency light bar with takedo wn lights and the vehicle i m mediately sped up. She then activated her siren and based on the vehicle`s actions, notified Dispatch she was in pursuit. They continued to speed up and traveled at approxi mately 97 mph throughout all lanes. At a red signal at Beach Blvd., Officer H A N E Y esti mated that they ran through the intersection at 100 mph. Westbound Ada ms at Beach, has a dip and slight uphill grade fro m the intersection. Officer H A N E Y said the vehicle was going so fast, the back end sparked and started s moking. She thought the vehicle was possibly disabled. At that point, Officer H A N E Y felt the driver had no regard for their safety and the safety of the public in atte mpts to flee. As they continued westbound on Ada ms, the driver made several "brake checks." She believed the driver was looking for an opportunity to "foot bail" to continue to get a way. At the red signal at Lake Street, Officer H A N E Y esti mated the driver drove through the intersection at 60 mph. After L ake Street, Ada ms turns into a residential area. At a red signal at Main Street, the driver drove through the intersection at approxi mately 60-70 mph. At the 4 way stop at Ada ms and 17th Street, the driver ble w through the intersection and made a right turn. As they drove back to ward Main, the driver made a right turn to travel southbound on Main. At that point, Officer H A N E Y said Officer M O S S B R O O K S #2086 entered the pursuit as the 2nd vehicle. Officer H A N E Y was finally able to see that there were t wo occupants in the suspect`s vehicle. As they continued do wn Main, Officer H A N E Y said there were pedestrians. She also said there were a mple opportunities for the 2 occupants to thro w ite ms out of the vehicle during the duration of the pursuit. Officer H A N E Y said the driver ble w through the stops signs on Main at Orange Avenue, Olive Avenue and Walnut Avenue at a high rate of speed. At P C H, the vehicle made a right turn at approxi mately 60-70 mph to travel westbound and collided and then drove over the raised center median. I responded Code-3 (lights and sirens) to the area to assist. As I was driving to the scene, I heard over police radio that the pursuit had ter minated on the beach near lifeguard to wer 6. When I arrived on scene, the suspect ( was already in handcuffs. Officer C O N N O R and I then placed in the back seat of Officer C O N N O R`s police vehicle. At that point, I started and maintained a cri me scene log. While I was maintaining the cri me scene, Beach Maintenance worker approached me. stated he found an A S P Collapsible Baton laying on the beach service road in front of the public restroo ms that are approxi mately 50 yard north of the pier. I took possession of the A S P Collapsible Baton. I later learned the A S P Collapsible Baton belonged to Officer H A N E Y and she had lost it during the course of the pursuit. I later returned the A S P Collapsible Baton to Officer H A N E Y. I maintained the cri me scene log until Officer V A N M E T E R relieved me at 0635 hours. Officer V A N M E T E R took over the cri me scene log at that point. I later heard Officer H A N E Y advice the vehicle was fleeing fro m her westbound on Ada ms Avenue. Officer H A N E Y follo wed behind the vehicle as it continued to flee fro m her westbound on Ada ms Avenue. She ulti mately advised that the vehicle had made a turn and was no w driving northbound on 17th Street fro m Ada ms Avenue. The vehicle then made a southbound turn onto Main Street fro m 17th Street. I monitored the pursuit southbound on Main Street then westbound turn onto Pacific Coast High way ( P C H). I was no w traveling southbound P C H at Golden west when I heard that the suspects had crashed and a foot pursuit ensued. I heard the officers broadcast they were running on the beach at the water line and a shooting had occurred. I arrived on-scene and sa w flashlights e mitting fro m the area of to wer 6. I drove my police car across the sand and arrived at the officers and suspect. The suspect was in custody and I assisted in seeing if the suspect or officers were injured. I then escorted Officer Bach man fro m the scene to the station assisting hi m until I was relieved. I conducted no further investigation. When entered the vehicle, there were a couple credit cards in the center cup holders. He moved the m to the glove co mpart ment. He did not kno w who m they belonged to and he did not ask if they belonged to hi m. Detective Burton told a meth pipe was found in the vehicle. said it did not belong to hi m. But he did ad mit there was a needle in the car that belonged to hi m. He said his blood was in there, because "he did a little, but left so me in the there. I didn`t do the whole shot." I asked what he was injecting and he said, " meth". said he assu med the Kia Opti ma belonged to but he was not sure. He had never seen hi m in the Opti ma before. He did not notice the rear plate was missing fro m the vehicle. He did not re move the plate and did not kno w if had re moved the plate. said he never sa w the bolt cutter or ha m mer in the car. He did not kno w they were in the car and they did not belong to hi m. He was ada mant he did not steal the credit cards and did not co m mit any thefts or burglaries. said he did not have a knife on his person or in the vehicle. He did not kno w if had a knife or any other weapon on his person or in the vehicle. Specifically, he did not see an ar my green ca mouflage knife in the car or on s person. gave us consent to search his cell phone. He said the code was " ". He could not re me mber his phone nu mber. This location is at the waterline, north of the Huntington Beach Pier. Upon arrival, I was tasked with securing the scene of the shooting until it could be photographed. I arrived on the sand, near To wer 6 at approxi mately 0500 hours. Around this ti me, I relieved Ofc. Villareal who had been standing at the scene, ensuring that no evidence was disturbed. Ofc. Villareal sho wed me a set of tire tracks that led to wards the water. He told me that Ofc. Bach man had fired his weapon approxi mately 20 feet beyond these tracks. I measured off the location in relation to To wer 6 by step-count. I counted fifty steps to wards the water fro m the front of To wer 6 and then 15 steps to wards the Pier as the approxi mate location of where the shooting occurred. I also checked the area to see if any shell casings or evidence was in the area. I noted the tide had co me in covering a significant part of the area. No evidence was located at this ti me. Later, C S O A. Cozad arrived to take pictures of the scene and area. At this ti me, I related the infor mation of where the shooting occurred to her. After she co mpleted the photographs, I received notification that I could leave the area. I was later directed to coordinate with Ofc. La mas to respond with me mbers of the H B P D Search and Rescue tea m to look for the expended shell casing and a "vape pen" that was believed to have been dropped during the incident. Ofc. La mas responded with four Search and Rescue " Explorers" and a metal detector. While on scene, they recovered a 9 m m shell casing that had been found by a citizen. See Ofc. Gance, #3110) was working on duty as a Police Officer in the Cit y of Huntington Beach, County of Orange. I was driving a marked, black and white police vehicle and was wearing a full police unifor m. At approxi mately 0248 hours, I was in the area of Slater Avenue and Beach Boulevard. At that ti me, I heard over the radio that Officer M. Haney (#1253) initiated a vehicle pursuit in the area of Ada ms Avenue and Bushard Street. Upon hearing this, I began responding southbound through the city to assist Officer Haney when and where possible. At approxi mately 0251 hours, I heard that the vehicle pursuit ter minated on Pacific Coast High way, west of Main Street. I m mediately after, a foot pursuit was initiated by Officer Haney and other involved H B P D Officers. The foot pursuit continued fro m Pacific Coast High way onto the beach/sand, bet ween lifeguard to wers 4 and 6. At approxi mately 0253 hours, an officer involved shooting occurred. Please refer to the main cri me report for co mplete details regarding the previously mentioned incidents. At approxi mately 0255 hours, I arrived to the incident scene on the beach to assist. This was on the sand bet ween to wers 4 and 6, south of the 6th Street Parking lot. Upon arrival, I observed that a male suspect was handcuffed near the ocean/ waterline, and being walked to a nearby patrol vehicle parked on the sand. At that ti me, I observed a pocket knife on the sand, exactly where the suspect was taken into custody. I further inspected the knife, and it is described as follo ws: - One folding pocket knife. The knife was folded closed at that ti me, and re mained that way for the duration of the investigation. The pocket knife`s handle had a green, ca mouflage design with a " U S A R M Y" logo on the side. The other side of the knife had a metal clip. To properly secure the evidence at the incident scene, I stood next to the knife and ensured it was not touched or ta mpered with. I used my Body Worn Ca mera ( B W C) to take video footage of the knife at the scene as it lay, and also used my depart ment issued cell phone to take photographs of the knife on the sand. I was monitoring the police radio when I heard Officer H A N E Y #1253 conduct a traffic stop on a vehicle with no license plates on it in the area of Bushard Street and Ada ms Avenue. I later heard Officer H A N E Y advise the vehicle was fleeing fro m her westbound on Ada ms Avenue. Officer H A N E Y follo wed behind the vehicle as it continued to flee fro m her westbound on Ada ms Avenue. She ulti mately advised that the vehicle had made a turn and was no w driving northbound on 17th Street fro m Ada ms Avenue. I drove to the area of Main Street and Utica Avenue and waited for the vehicle. Fro m Main Street and Utica Avenue I was able to see the vehicle co ming northbound, while Officer H A N E Y was follo wing closely behind it. I could hear Officer H A N E Y`s siren and I was able to see the solid overhead light on her vehicle as they both drove to wards me. The vehicle then made a southbound turn onto Main Street fro m 17th Street. I activated my siren and e mergency overhead lights, displaying a solid for ward facing red light, and drove behind Officer H A N E Y and the suspect vehicle. I broadcast my involve ment in the pursuit using my police radio. It should be noted that the suspect vehicle lost control mo mentarily as it turned southbound onto Main Street. I was able to see the rear end of the vehicle sliding through the turn. I then follo wed Officer H A N E Y and the suspect vehicle southbound on Main Street. The vehicle was accelerating rapidly and we reached speeds of approxi mately 70 miles per hour. Main Street in this area is pri marily residential and has a posted speed li mit of 35 M P H. The vehicle continued southbound on Main Street at a consistent speed of approxi mately 70 miles per hour. The vehicle continued southbound through multiple curves in the street before reaching the do wnto wn Huntington Beach area. The vehicle slo wed to approxi mately 50 miles per hour, ho wever did not stop for the four way stop signs at Main Street and Orange Avenue, Olive Avenue, and Walnut Avenue. The vehicle continued southbound before making a right westbound turn onto Pacific Coast High way ( P C H). The vehicle atte mpted to negotiate the turn at such a high rate of speed that the driver was unable to maintain the vehicle during the turn. The vehicle drove over the median separating westbound and eastbound P C H, ulti mately driving westbound in the eastbound lanes of P C H. I located Officer Gance who was with Witness located on the south side of Zack`s located on the beach service road, adjacent to and east of the 6th Street parking lot. He stated he was belo w pier plaza about half way do wn the a mphitheater on the west steps looking in the trashcans when he heard a loud crashing sound. He said he did not see a car collide with any thing ho wever stated, "It sounded like a car hit so mething." walked up the a mphitheater to wards P C H and sa w a car, which he described as a " Ca maro" across the street on P C H stopped, with a police car, " Right behind it." He said the driver`s side door of the " Ca maro" was open, ho wever was unable to see anyone inside. He also stated the siren to the police car was still turned on. He sa w one police officer who was with the cars. He then sa w a male running westbound, through pier plaza to wards the 6th Street parking lot. He described the male running as tall, with long hair wearing a bro wn jacket. He said there was a police officer running after the male. They entered the 6th Street parking lot, then turned south, to wards the beach. They ran do wn a slope, located on the east side of the 6th Street parking lot, and then entered the beach area. I asked if he heard anyone say anything, and he said he did not. He stated he only heard the officer breathing heavy. walked south do wn the steps of the a mphitheater, then walked west to the south side of Zack`s. He walked to the west side of Zack`s to see what else was happening. He was unable to see where the male and the police officer who was chasing hi m ran to. He said he sa w about four or five other police cars enter the 6th Street parking lot, and drive to wards the beach. At that point he heard what he believed was one, " Gun shot". He was unable to see anything, ho wever stated the gunshot sounded like it ca me, " Straight fro m the beach." He said he used " Speed" (crystal metha mpheta mines) on Sunday evening or Monday morning. He re mained a wake all day and night Monday, then fell asleep on Tuesday while he was in Santa Ana. He a woke Tuesday evening and has re mained a wake since. He said he uses metha mpheta mines about t wo ti mes a week. He did not appear under the influence of drugs or alcohol during our conversation. No further at this ti me. The follo wing is a synopsis of the intervie w: Detective P H A M asked Officer B A C H M A N to recount his actions and observations fro m this incident. Officer B A C H M A N said he had been on patrol at approxi mately 0300 hours when Officer H A N E Y #1253 broadcast a traffic stop over the radio and he heard her "i m mediately call for a back" (backup officer). Officer B A C H M A N was driving marked police unit #832 at the ti me ( Ford Cro wn Victoria). Officer B A C H M A N said he had worked with Officer H A N E Y for the past t wo years and recognized fro m her voice that she was "a little bit spun up, a little bit excited." Officer B A C H M A N said he was approxi mately one mile south of Officer H A N E Y at the ti me and he began responding to assist. Officer B A C H M A N said before he was able to reach Officer H A N E Y`s location, he heard her state over the radio she was no w in pursuit of the vehicle westbound on Ada ms Avenue at Bushard Street. Officer B A C H M A N said he was near Bushard and Ha milton Avenue at that ti me (approxi mately 1.5 miles to the south). Officer B A C H M A N said he drove to Atlanta Avenue (t wo streets south of Ada ms) and began to drive westbound parallel to the pursuit. He said the vehicle drove near the police station (2000 Main Street) and he heard Officer M O S S B R O O K S #2086 advise over the radio that he was joining the pursuit as the suspect vehicle fled southbound on Main. Officer B A C H M A N said he was still try ing to catch up to the pursuit at that ti me and kne w the suspect was driving to ward the do wnto wn area (near Main/ P C H). He said he heard Officer VI L L A R R E A L #2103 advise over the radio he had also joined the pursuit and heard the location updated as being northbound on P C H fro m Main. He said officers then advised over the radio that the suspect vehicle had crashed. Officer B A C H M A N recalled he was in the area of Main and Acacia Avenue at that ti me and had not been involved in the pursuit. He said he reached Main/ P C H, sa w the collision, and heard Officer H A N E Y advise she was in "foot pursuit" to ward the beach. Officer B A C H M A N said he drove northbound past the collision to assist the officers in foot pursuit and turned into the 6th Street parking lot. That parking lot entrance road ter minates at the beach service road and sand area. Officer B A C H M A N said he drove into the sand as far as he could and sa w Officer H A N E Y chasing the suspect on the sand to ward the water. He said he only sa w Officer H A N E Y and the suspect at that ti me, but recalled hearing voices "not in the i m mediate area." Officer B A C H M A N said he ran through the sand to ward Officer H A N E Y and the suspect and heard Officer H A N E Y telling the suspect to "stop." He said he also y elled, " Police, stop!" at the suspect while they ran. Officer B A C H M A N said he ran in a north west direction at an angle to catch up to Officer H A N E Y as she pursued the suspect northbound near the ocean waterline. He said he was able to catch up and passed Officer H A N E Y on her right side. He said, " At that point, the suspect had made a couple turns back while he was running. I noticed his hands were in his - his waistband area while he was looking back but continuing to run. I felt he was, at that point, holding onto so mething in his pocket or his waistband, but he continued to run." Officer B A C H M A N said he got closer to the suspect and ordered the suspect, " Sho w me y our hands!" but the suspect did not react and did not present his hands. He said he yelled again, " Sho w me your fucking hands!" at which point the suspect stopped and "bladed" back to wards hi m. Officer B A C H M A N explained and de monstrated this move ment as the suspect turning to his right to ward Officer B A C H M A N, but keeping his upper body angled a way. He said the suspect`s left hand was still near his waistband. He said, " At that point I figured he was taking a shooting stance and he was - he was turning to - to present a weapon or to shoot me or - to shoot me or Officer H A N E Y." Detective P H A M asked if Officer B A C H M A N could see any thing in the suspect`s hands at that ti me and Officer B A C H M A N said only one of the suspect`s hands was visible while the other was concealed by the suspect`s jacket or pants near his waistband. He said, "I could not see what his hand was doing or what it was holding." Detective P H A M asked if the suspect had co mplied with any of his or Officer H A N E Y`s co m mands up to that point and Officer B A C H M A N said the suspect had not. Officer B A C H M A N said, " At that point, I feared that he was turning back to gauge a target to shoot either me or ( Officer H A N E Y)." He said he dre w his depart ment-issued handgun ( Glock, model 17, 9 m m) and fired one shot at the suspect. Officer B A C H M A N said the suspect "i m mediately" dropped to the ground, at which point Officer B A C H M A N stopped firing, "assessed the situation," and gave the suspect additional verbal co m mands to present his hands. He said the suspect then co mplied and, once he could see both of the suspect`s hands, he and Officer H A N E Y handcuffed the suspect behind his back. He said he advised over the radio what had occurred and kne w para medics were requested to respond to that area. Officer B A C H M A N said he did not collect any evidence fro m the scene and was driven back to the police station by Officer C A O U E T T E # 1021 after the scene was secured and additional officers had arrived. This is standard practice in officer-involved shootings and Officer B A C H M A N said he did not discuss his role in the incident with anyone else. I asked Officer B A C H M A N ho w he felt after everything had cal med do wn and he said, " At that point, we had a high-speed pursuit through residential areas, through a business district where people are out at all hours of the night. Not only that, but when they had - the vehicle pursuit ter minated, this guy was so desperate to get a way that he foot-bailed and started running a way to ward the beach. When I had caught up to it, it was dark. I mean, it`s pitch black out there on the beach. And ( Officer H A N E Y) at that point was the only one that I sa w was within close range of hi m. And so, when I ca me up on hi m and he bladed to wards me in a way that he was going to present a weapon or he was going to take a gun out because he had been sho wing signs that he was holding onto so mething in his waistband or his pocket, I felt at that mo ment that he was going to shoot - that he was turning back to wards us and he was going to shoot me or ( Officer H A N E Y). And he had, y ou kno w, miles of beach and pitch black to get a way at that point, so if there was a ti me for hi m to, you kno w, give up or engage us, that was the ti me. I felt scared that he was going to shoot and try and kill me or Officer H A N E Y." Officer B A C H M A N said the area where they finally took the suspect into custody was "right at the waterline" and they had to pull the suspect back up the beach after he was handcuffed in order to prevent the tide fro m reaching the m. I asked if it appeared to hi m the suspect had essentially run out of places to go at that point and he said, "I feel like he had exhausted his options." Officer B A C H M A N said the suspect did not stop when he and Officer H A N E Y repeatedly told the suspect to "stop" during the pursuit, but the suspect had looked back several ti mes. He said when the suspect finally did stop, it was "different" than the way he had looked back the other ti mes. He said the suspect`s knees were bent, his body was "bladed" to ward the m, his right hand had "s wung out" a way fro m his body as he turned, and his left hand was still near his waistband. Officer B A C H M A N said, " He looked back not to see ho w far he could run still. It was a look back to engage us with a gun." Officer B A C H M A N said it was dark in the area where the suspect was taken into custody and there is no a mbient lighting. He also said it was loud near the ocean and he did not hear the suspect say anything during the encounter. Officer B A C H M A N said he has no prior military experience and has not worked for any other la w enforce ment agencies other that Huntington Beach P D. He has been an officer since March 2018. He currently works the gravey ard shift and began his shift at 2005 hours the previous night, which was the final shift of his work week. He said, prior to this incident, the shift had not been particularly busy, but he had made so me unrelated proactive car stops during the night. At the ti me of this incident, Officer B A C H M A N had been patrolling the south end of the city. Officer B A C H M A N carries a Glock, model 17, 9 m m handgun as his depart ment-issued duty weapon and wears it on his right side. He is right-handed and has a Surefire X300 Ultra flashlight mounted to the gun with an attached grip pressure s witch asse mbly to activate the light. He carries a fully-loaded, 17-round magazine in the gun with one additional round cha mbered in the gun for a total of 18 rounds. He also carries t wo additional fully-loaded, 17-round magazines on his duty belt. He was not carry ing a backup gun at that ti me of this incident. Officer B A C H M A N`s attorney asked hi m if the suspect would have been able to open up more options to flee if he had shot Officers B A C H M A N and H A N E Y. Officer B A C H M A N said he believed the suspect could have escaped into the darkness and nearby neighborhoods if he had shot the officers. His attorney asked if the suspect had ti me to discard any drugs or s mall contraband during the pursuit and Officer B A C H M A N said the suspect had "a mple" ti me during the vehicle and foot pursuits to discard those t ypes of ite ms. He said this made hi m feel the ite m or ite ms the suspect was continuing to grab near his waistband during the foot pursuit was then most likely to be a gun or other weapon. Officer B A C H M A N said he slept for approxi mately 7 hours prior to his shift, which is a nor mal a mount of sleep for hi m. He said he had not taken any prescription medications nor consu med any alcoholic beverages prior to or during his shift which would have affected his motor skills or thought process. Regarding his body - worn ca mera syste m ( B W C), Officer B A C H M A N said he was wearing his B W C on the front of his duty belt at the ti me of the incident. He said his B W C had been "buffering" (passively recording) during the incident, but he had not had ti me to activate the recording until after the suspect was on the ground. He said because he was in foot pursuit and because he believed Officer H A N E Y was pursuing the suspect alone ahead of hi m, his focus was on his safety and Officer H A N E Y`s safety, not on activating his ca mera. He said he also did not kno w where any other suspects were at that ti me. He said he activated the B W C as soon as he had the opportunity after the suspect was on the ground. Due to the buffering feature, this activated the video and recorded the previous 30 seconds without audio, including the ti me of the shooting. Officer B A C H M A N said he has previously responded to calls for service on the beach and kno ws citizens frequent that sand area through all hours of the night. As alternate force options, Officer B A C H M A N carries a Taser Conducted Electrical Weapon ( C E W) device on his duty belt and keeps O C spray and a baton in his vehicle. He said he typically re moves his baton fro m the vehicle and places it in the baton ring on his duty belt when he exits the car, but in this instance he did not have ti me to grab his baton. He said he also carries his pacset radio and t wo sets of handcuffs on his duty belt during his shift. At the ti me of this incident, he was wearing a long-sleeve unifor m shirt with a concealable vest underneath, unifor m pants, and boots. He said those ite ms are heavy and difficult to run with. He said he was fatigued when he reached the suspect after running through the sand (approxi mately 200 yards) and believed the suspect possessed a weapon which could be used against hi m or Officer H A N E Y. Officer B A C H M A N said when he fired his gun he kne w the ocean was behind the suspect and there were no other citizens in the area, to his kno wledge. Officer B A C H M A N said using his C E W was not a reasonable option due to his distance fro m the suspect, the darkness, the suspect`s baggy clothing, and the windy conditions near the ocean which would have likely made the C E W cartridge darts ineffective. He said this sa me reasoning would have applied to his O C spray , had he been carrying it at the ti me. He said he also felt the suspect was a "lethal threat" at the ti me, which made hi m decide not to use other force options. His attorney asked Officer B A C H M A N if he would have elected to use his baton had he been able to grab it fro m the car prior to pursuing the suspect and Officer B A C H M A N said he would not have. Officer B A C H M A N said none of those force options would have been effective against a suspect with a gun. For further detail, refer to additional reports and the audio recording of the intervie w. ---- I revie wed video fro m Officer B A C H M A N`s body- worn ca mera (serial # which had been uploaded to Evidence.co m and began at 0252 hours on 2-19-20. The video is 3 minutes, 44 seconds long. Again, the first 30 seconds of the video does not have audio. The video begins as Officer B A C H M A N is running across the beach. I t is dark, blurry, and difficult to see, but it is apparent he is running on the sand with the lights of P C H to his right. At approxi mately the 22-second mark, Officer B A C H M A N stops and illu minates the suspect with his weapon- mounted light. The suspect, identified as is wearing dark clothing and is first seen on the ca mera at that mo ment as his right side is turned to ward Officer B A C H M A N with his knees slightly bent and his torso slightly hunched for ward. s right hand is raised to approxi mately shoulder height and his left hand is not visible. Muzzle flash is apparent fro m Officer B A C H M A N`s gun at that sa me ti me and i m mediately falls to the ground. At the 30-second mark, Officer B A C H M A N circles to the left while still illu minating on the ground with his flashlight as the audio activates. He appears to order to "freeze" (or so mething si milar) as Officer H A N E Y approaches 2-3 seconds later fro m Officer B A C H M A N`s right. Officer H A N E Y orders " Put y our hands out!" (or possibly "up") t wo ti mes as she contacts on the ground and Officer B A C H M A N advises over the radio, " Three Nora, nine-nine-eight," to indicate a shooting had occurred. Officer B A C H M A N then asks " Do you have any weapons on you?" and says he does not. Officer B A C H M A N asks, " Are you shot?" and responds, "I don`t kno w." The tide can be seen washing right up to where and the officers are, so officers appear to drag several feet a way fro m the water. Officer B A C H M A N is heard multiple ti mes asking if he`s been shot and if he`s okay as officers visually and physically check for injuries. Officer B A C H M A N asks for his na me and identifies hi mself as " Christopher (last na me inaudible)" at 1 minute, 57 seconds into the video. Officer B A C H M A N continues to phy sically check for injuries as additional officers arrive and begin to secure that scene. Officer B A C H M A N makes a public safety state ment to Sergeant A L T E N B A C H #1032 and then ends the recording. Refer to that video for reference. I heard Officer H A N E Y #1253 atte mpt to make a traffic stop of a gray four-door vehicle over H B P D Radio. Officer H A N E Y then advised the vehicle was fleeing fro m her, westbound on Ada ms Ave fro m Bushard St. I responded Code 3 (lights and sirens) fro m the area of Bushard St and Ha milton Ave. While monitoring Officer H A N E Y`s pursuit updates, I heard Officer M O S S B R O O K S #2086 advise that he was the second unit in the pursuit, which was no w traveling southbound Main St fro m 17th St. Around this ti me, I was driving westbound on Orange Ave to wards Lake St. As I continued westbound on Orange Ave, I sa w the gray four-door sedan, Officers H A N E Y and Officer M O S S B R O O K S pursuing the vehicle southbound on Main St through Orange Ave. I joined the pursuit as the third unit southbound on Main St. fro m Orange Ave. I had the siren and overhead lights, including a for ward facing solid red light, activated on my police vehicle. As I turned southbound on Main St., I could see Officer H A N E Y and Officer M O S S B R O O K S turn northbound on Pacific Coast High way ( P C H) fro m southbound Main St. As I approached Walnut Ave fro m southbound Main St, I heard Officer M O S S B R O O K S advise over H B P D Radio that the suspect vehicle had collided with the center median of P C H. As I turned northbound onto P C H fro m Main St, I noticed Officer H A N E Y and Officer M O S S B R O O K S police units were stopped in the northbound lanes of P C H, just south of 5th St. I also noticed Officer H A N E Y running southbound across the southbound lanes of P C H. I heard Officer H A N E Y advise over H B P D Radio that she was in foot pursuit of a male black suspect, who was wearing all black clothing. I parked my police unit and began running to wards Officer H A N E Y to assist her with the foot pursuit. As I exited my police unit, I could see that Officer H A N E Y was running southbound through the western most area of Pier Plaza. I ran southbound across the southbound lanes of P C H to wards Officer H A N E Y. As I reached the western most area of Pier Plaza, I could see Officer H A N E Y was no w running southbound through the eastern most area of the 6th St parking lot, which connects to Pier Plaza, to wards the beach service road. As I reached the eastern most area of the 6th St parking lot, I could see Officer H A N E Y running southbound across the beach service road, to wards the sand line, on the north side of Zack`s, which is located at 405 P C H.
