On September 25, 2021 at approximately 1505 hours, I was working uniform patrol for the City of
Huntington Beach. At the time, I was working footbeat patrol in the area of Main and Walnut in the
Downtown area.
I heard Lieutenant Archer advised over the radio that there was a possible suspect of a theft running along the
beach water line from the US Open of Surfing event.
I responded to the area of Main and PCH on foot with Officer ECSEDY. Approximately one hundred feet
from the intersection of Main and PCH, I heard Officer VELASCO advise over the radio that the subject was
possibly armed with a handgun and was reaching into his waistband.
I heard Officers advise they were making contact with the subject approximately thirty seconds later and then
heard Officers advise that there were "shots fired."
I ran to the area where I observed the male suspect lying on his back on the sand. Myself and several Officers
immediately started to administer first aid to the suspect. I noticed entry wounds to the subjects left leg, so I
applied a tourniquet to the area while other officers continued life saving measures.
Once I had applied the tourniquet, I started to canvas the area behind the suspect to make sure there were no
injuries to anyone in the area.
While I was checking, I was contacted by a female subject, My interaction with was
captured on my department issued BWC. Below is a summary of my conversation with reference
BWC footage for further.
told me she was the one that reported the initial incident. works as a supervisor for Outdoor
Events Services, the company responsible for assembling the structures on the sand for the US Open and the
Air Show.
said she was alerted by one of her workers, regarding the suspect.
was assembling tents for the Air Show in the area of PCH and Huntington on the
beach. told that he thought the suspect had a gun and motioned for her to stay
around the corner. started to follow the subject and alert security in the area.
said suspect appeared very agitated and kept looking over his shoulder to see if was still
following him.
said she contacted one of her security guards at the US Open Venue to alert him about the subject
approaching the venue and the crowds.

said she did not see if the suspect had a gun, but said told her that
"something`s wrong with this guy" and that thought he saw a gun.
lost sight of the suspect as he entered the US Open venue area (around Tower 3) and a few moments
later, observed Police "intercept" the suspect near the Pier area.
said she heard the gun shots, which she had thought might have been fire crackers at first.
said she heard what sounded like six rapid shots that sounded like they came from an automatic weapon,
which is why she thought they were initially fire crackers.
During my interview, was visibly shaking and her voice kept fluctuating as she spoke. Based on my
training and experience, these are symptoms common with someone in distress or fear. said she felt
helpless knowing she was following a subject who possibly had a gun and was heading toward children.
I contacted a member of the security team at the US Open venue, My interaction with
was captured on my department issued BWC. Below is a summary of my conversation with

said he received a call from and was alerted to the suspect approaching his venue that
possibly had a gun.
said he kept observation on the suspect from approximately one hundred feet east of the venue as the
suspect walked through the venue and toward the area of the Pier. said the suspect kept holding
something under his shirt with his hand but could not tell what it was. said the suspect kept holding
his other hand on top of his waist and was holding onto some clothing, covering his other hand.
said he momentarily lost sight of the suspect and eventually was able to locate an Officer and flag him
down about the incident.
described the suspect as a male "Latino", 40 to 50 years old. The suspect was wearing a white t-shirt
and was bald.
added it appeared the suspect was acting "agitated" and kept looking back at him as was
following him as well.
I spoke to who was the initial victim. My conversation with was

said the suspect approached him as he was working, and started antagonizing him,
wanting to fight. said he tried to ignore the suspect so he would leave, but the suspect
continued to try and find a reason to fight with him. said the suspect looked "crazy".
said the suspect approached him and stated, "so what`s up!" while he was flexing his
arms in front of his chest. said this body language and the way the suspect spoke is
what made him think the suspect was trying to fight with him.
said the suspect pulled a gun out from inside of a shirt that he was holding in his hands.
said the suspect did not point the gun directly at him and only removed it from the
shirt. said he said to himself "oh that`s a gun" while the suspect was holding the gun in
front of his body.

On 9/25/21, at approximately 1530 hours, I was contacted by Sergeant Shepherd #1132 who informed me an
officer involved shooting had just occurred in the area of the pier at Huntington Beach City Beach. I
responded from my home to assist in my capacity as a Crimes Against Persons Unit Detective. I was directed
to respond to the UCI hospital emergency room where the suspect, later identified as had
been transported by HBFD ET 41 to be treated for several gunshot wounds. When I arrived at UCI at
approximately 1620 hours, I contacted Officer Lewis #2079, who was standing by room "Trauma A" where
had been taken for treatment. Officer Lewis advised me had been declared deceased by
hospital staff with a time of death of 1607 hours.
I saw that s body was laying on a hospital gurney and was covered by sheets. At approximately
1800 hours, I was notified by hospital staff that they needed to move s gurney to another room in
order to free up the trauma room for other patients. I took photos of room "Trauma A" before s
gurney was moved using my department issued cell phone. I later transferred these photos to a USB drive
which I provided to Investigator Cislo of the Orange County Sheriff`s Department Homicide Unit.

On 09-25-21, at approximately 1515 hours, I was on duty as a police officer for the City of Huntington Beach.
My current assignment was uniformed patrol. I was wearing my department-issued HBPD uniform. While I
was in roll call in the briefing room. I heard "shots fired" broadcasted over the radio. I was able to gather that
an officer involved shooting had just occurred.
Officer Rodriguez and I both ran into a patrol vehicle (unit #819) and responded with our emergency lights
and sirens. We drove to the area of where the shooting had occurred.
Lt. Archer had requested that we placed marking cards where we observed spent casings.
Lt. ARCHER then instructed me to go to an area where white tents were being built and tasked me with
interviewing possible witnesses that may have seen the subject prior to the officer involved shooting.

the male to be wearing white socks up to his knees, black shorts, and a white shirt with an orange circle in the

On 09/25/21, at approximately 1507 hours, Officer GUILIANI #1254 and I responded to the area of Pier
Plaza to assist Officers with a possible armed theft suspect. As we were responding, I heard what appeared to
be gunshots coming from the sand area on the south side of the Huntington Beach Pier. Moments later I
heard Officers broadcasted there was an Officer Involved Shooting, which prompted us to run over and assist.
I activated my BWC and the following is a brief synopsis of what was captured:
When I arrived on scene, I saw male subject laying on the sand. I assisted Officers with rendering aide to the
male. I began chest compressions until Huntington Beach Lifeguards arrived on scene. I administered chest
compression for approximately one minute before lifeguards took over.
After lifeguards assumed medical aide, I began searching the beach for any collateral or injured victims,
which I did not locate.
When I returned back to the scene, I was directed by Sergeant DEUL #1006 to shadow Officer REMINGTON
#1043 and to transport him to the Huntington Beach Police Station as he was involved in the incident.
I remained with Officer REMINGTON in a separate room away from the other involved Officers until I was
relieved by command staff.

On Saturday, 9/25/21, at approximatley 1623 hours, I responded to UCI Medical Center located at 101 The
City Drive in Orange to assist with a shooting investigation. The involved suspect, identified by the Orange
County Coroner as was transported to the hospital for medical aid, but was declared
deceased prior to my arrival.
After arriving at the hospital, I found Officer C. LEWS #2079 and Officer D. MORRIS #2126 were also
present, and were standing by with s remains.
I contacted the hospital staff who advised me had been treated by Emergency Room Doctor
and Trauma Doctor and was given the hospital identification number of

I found s clothing had been removed and placed in a brown paper bag by hospital staff prior to my
arrival. s remains, as well as his property were then moved by hospital staff from the trauma center
to the ED Annex building, bed #20 within the hospital. I escorted s remains and his property to bed
#20. At approximately 2325 hours, Orange County Sheriff`s Investigator KENNEDY and Orange County
Coroner L. MARTIN arrived and took custody of s remains as well as his property.
Once relieved by Investigator KENNEDY, I left the hospital and conducted no further investigation.

covered with the white shirt. then heard the officers yell at the subject to "STOP!" and "PUT IT
DOWN!" however, the subject did not obey officer`s orders. stated the Officers then shot, at which
point the subject dropped to the ground. While on the ground, the subject lifted the object in his hand back up
towards the officers, at which point the officers shot again. did not have any further description of
the subject that was involved.
I met with who stated the following in summary:
stated she was at the SURF SHOP T-shirt booth approximately 50 feet south of the incident.
stated she was occupied with looking at t-shirts when she suddenly heard Officers yell at a
Hispanic male subject with tattoos to "DROP IT!" and "PUT IT DOWN". Shortly after, heard
what she believed gun shots, at which point ducked down and took cover. did not
have any further information.

1516 hours, we were dispatched to the area of Huntington Beach city beach north of Tower 1 referencing an

Upon my arrival, I observed the suspect lying on the sand with Huntington Beach Lifeguards and Huntington
Beach Police Officers rendering medical aid to him. Huntington Beach fire department arrived shortly after
and assisted with rendering aid.
Lieutenant Archer #1005 and Sergeant Smith #1077 told me to ride in the ambulance with the suspect. The
suspect was loaded into the HBFD ET41. I rode with the suspect to University of California Irvine Medical
Center (UCI) and Officer Morris followed behind in our patrol vehicle.
We arrived to UCI at 1604 hours. The suspect was taken into the emergency room and was pronounced
deceased at 1607 hours by UCI medical staff.

downtown business district. At approximately 1530 hours I was at the South Substation located at the
intersection of 5th St. and Walnut Ave. Around this time I heard a radio broadcast on the Huntington Beach
Police Department radio of an officer involved shooting underneath the pier (south of).
Officer Diaz #3087 and I were partners for the day and we immediately ran to our patrol vehicle. There were
approximately four Orange County Parole Officers with us due to the fact they were working the US Open
Surf Competition who also jumped inside our vehicle.
Officer DIAZ drove our unit CODE-3 (lights and sirens) to Main St. and Pacific Coast Highway (PCH). We
exited the patrol vehicle and immediately ran down the stairs of Pier Plaza and to the boardwalk. Hundreds of
people were standing nearby due to the surf competition.
Several people flagged us down and pointed towards the sand and indicated the other officers and suspect
were several feet into the sandy beach area.
Upon arriving to the scene, I noticed a male suspect lying on the ground as officers were rendering medical
aid to him. I checked on the welfare of the officers involved and found them all to be unharmed.
I walked north to the pier and checked the surroundings for any other injured subjects and did not locate
anyone. I assisted beachgoers to a safer location and away from the crime scene as crime scene tape was being
set up.
I then responded back to where the officers were rendering aid to the suspect. I approached Officer
VELASCO who indicated he was involved directly with the officer involved shooting. Officer VELASCO
and I did not discuss any details of the incident. I transported him to the Huntington Beach Police Department
per the direction of Sergeant DEUEL, where I remained with him in a secluded room along with trauma
support.

while flashing his gun. Very scary, especially when the beach was crowded as it was. I understand protesting
police violence. But this guy had kept reaching for his gun even after he was shot."
On 9/30/2021 at about 0915 hours, I spoke to over the telephone.
stated he was at the US Open on 9/25/2021. I asked him if he witnessed anyone commit a robbery
that day, and he said he did not. He stated he was in the area of the Officer Involved Shooting (OIS) however
did not witness it. He stated he had heard people around him say the person shot by Police Officers had
robbed a t shirt stand, however he did not witness it. He told me he may have "Embellished" or exaggerated
his Facebook post. did not know the names of the people who had stated the suspect in the OIS had
committed a robbery.

About twenty minutes after called he was able to locate this person and maintain visual
contact with him. met with and eventually reported this person to an HBPD Police Officer
who was in a Police SUV. did not know the name of this officer. believed this person
may be armed with a gun due to the fact the suspect was carrying an unknown object wrapped in a shirt, as
well as the fact he understood the worker (reported by was threatened with a gun.
pointed out the suspect to this Police Officer, and informed him he may be armed with a gun.
I asked if he witnessed this suspect commit a robbery or any other crime prior to the shooting, and
he said he did not.

10/5/2021 at 1520 hours. Interview with
I contacted by telephone on the above listed date and time. On 9/25/2021, was working as
subcontractor in charge of hiring the labor for the operations crew who work on the surf competition and the
air show. On 9/25/21. stated he received a call from who told him of a person who
"Harassed" one of her tent workers. She also indicated this person may have a gun. She stated the person
with the gun was currently walking towards the surf contest venue from the air show venue. stated
he was a male Hispanic, bald wearing a white shirt with an orange ball on it. He was carrying an unknown
object under his arm. said he was, "Easy to spot" due to the fact there were few people on the beach
at that time. observed the subject walk under the pier, then turned north to the seawall. stated
he maintained visual contact with the subject for about five to ten minutes. I asked if he witnessed the
subject commit any crimes during this time, and he said he did not. stated the subject was acting,
"Erratic". He said the subject was looking back and forth and noticed his motions were, "Jerky".
explained as a labor contractor, he has dealt with several individuals who use methamphetamines. He stated
this subject appeared to be under the influence of methamphetamines.
As was following the subject, he saw in the area and contacted him. told
of what had witnessed. asked him if he was sure the subject had a gun, to which
replied that he was not.
and contacted a police officer driving an SUV in the sand. This Officer found the subject,
and drove east towards him. lost sight of the subject for a few seconds until he reemerged east of the
pier. stated he saw about three Police Officers contact the subject. He stated he witnessed the first
volley of fire, however he was looking at the Officers and not the subject. stated he did not witness
the second volley of fire.

located to the front of The Hilton Hotel. was walking behind a row of tents and attempted enter one
from the rear. one of her employees who was already in the tent, held his hand out
prior to her entering, indicating to her not to enter. She was able to hear talking to an
unknown person, however was unable to see who he was talking to. She heard this person say, "Where`s my
fucking brother? You got something to say? You want to go". She eventually heard the person leave, at
which time she entered the tent. appeared extremely nervous. He told the
person to whom he was speaking was holding a gun with a t shirt or a towel over it. He was holding it close
to his stomach. It appeared to as though was in fear of being shot and killed
by this person.

watched this person walk away from them, west, towards the pier. She followed him from a distance and
watched him walking towards the pier (westbound) for approximately ten minutes until she lost sight of him.
She did not actually see this person holding a gun, however saw he was holding what appeared to be a t shirt
or a towel. She described his demeanor as, "confrontational". She said he would, "whip his head around" and
stare at people. She said the way he was walking and looking at people indicated to her that this person was
looking to fight someone.

I asked if she saw this person point a gun at anyone, and she said she did not. I asked her if she saw
this person take anything from anyone on the beach, and she said she did not.

On 09/25/2021 at 1513 hours, I was on duty, wearing a full uniform, and driving a marked Huntington Beach
Police Department patrol vehicle (#832.) My assigned shift for the day was 1S1 working the hours of
0605-1730 and my call sign was 2C.
At the above date / time I was traveling southbound on Newland Street approaching the intersection of Pacific
Coast Highway, City of Huntington Beach, and County of Orange, when I overheard a radio broadcast on the
Huntington Beach Police Department radio of an officer involved shooting. I asked police dispatch for an
exact location of the incident and was informed that it was near the Police Beach Sub-Station which is located
east of the Huntington Beach City Pier near the boardwalk on the sand.
I activated my body worn camera and the following is a synopsis of my involvement.
I drove to the location with lights and siren as this was an immediate emergency. As I was driving I changed
my police radio to the Huntington Beach Lifeguard talk group of 1 Aqua 1 and notified the lifeguard dispatch
of the event and requested immediate assistance from them. I additionally made this request on the
Huntington Beach Police radio talk group.
Upon my arrival I parked my patrol vehicle on the boardwalk near the Huntington Beach Lifeguard
Headquarters which is east of where the incident occurred.
I walked to the scene where I met with Huntington Beach Police Department Lieutenant Archer #1005.
Lieutenant Archer detailed me to canvas the area south of where the incident occurred in an attempt to locate
any potential subjects who may have been struck by gunfire. I did not locate anyone with injuries.
I returned to the scene where I met again with Lieutenant Archer who detailed me to transport Officer
Simpson #3013 to the Huntington Beach Police station as he was directly involved in the original incident.
Officer Simpson and I did not discuss the incident and upon our arrival at the police department I remained
with him in a secluded room until I was relieved by additional police department staff.
No further investigation was conducted by me.

On 09/25/21, at approximately 1515 hours, I was working as the Special Enforcement Team Sergeant in the
downtown Main St. area when I responded to an Officer Involved Shooting (OIS) on the beach. I drove to
Lifeguard Headquarters (LGHQ) and approached on foot as I activated my body-worn camera. The following
is a synopsis of what occurred:
As I approached the Police Beach Substation, I saw Officers and Lifeguards treating the suspect as he lie on
the sand about 40 to 50 yards northwest of the substation. Lt. ARCHER and Sgt. PHAM were already on
scene. I immediately coordinated with them to help secure the scene, treat the injured, and search for any
additional victims.
I requested five Officers to my location to shadow and relieve the Officers involved in the OIS. Sgt. DEUEL
soon arrived thereafter assigned Officers.
Due to the medical needs of the suspect. I assigned Officers to close and clear the service road from the Pier
to LGHQ to allow access for paramedics and an ambulance to arrive on scene. Upon arrival, I assigned
Officer LEWIS to ride with the suspect in the ambulance.
There were several witnesses on scene and I requested Officers standby with them.
I was advised that there was a disturbance and a large group of people at the base of the Pier at the service
road. Officers had just arrested an unruly suspect and I stood by in the area to insure there were no further
problems.
Sgt. SPOOLSTA arrived with the Mobile Command Post (MCP) and I assisted him in setting it up
During this time, numerous subjects came up to me and other Officers stating that they witnessed the incident.
We collected the witnesses` information so they could be contacted at a later time to be interviewed. I
collected information I received as well as from Officers EASTON, HARDMAN, GILES, DIAZ, and
WATKINS and wrote them down on one list that I gave to Det. PRICER. The following is the list of names:

On 09/25/2021 at about 1513 hours, I was assigned to my regular duty as a Patrol Sergeant and my call sign
was 2S. I overheard Sgt. PHAM broadcast over Green 1 radio that officers had been involved in a shooting
underneath the Huntington Beach Pier. I immediately began responding to the location to provide additional
assistance if needed.
I arrived on scene at approximately 1522 hours and parked my unit (#803) near Lifeguard Headquarters. I
walked northbound on the beach bike path towards the area of the crime scene and activated my Body Worn
Camera. I stopped outside the crime scene tape of the scene perimeter and did not enter. I noted Officer
JENSEN was keeping the crime log which I broadcasted over the radio.
Sergeant DEUEL advised via radio that additional units were no longer needed. I subsequently cleared the
call.

Detective PRICER #1185 had given me a list of possible Jack`s Surfboards employees who were working on
the beach in the area of the incident on 9-25-21. I had left phone messages for four of those individuals and
received a call back from . I recorded the call and later uploaded that audio file to
Evidence.com under this case number. The following is a synopsis of the interview:
said she works for Jack`s and was assigned to work inside a temporary retail booth on the sand
beneath the south edge of the pier. The booth had been set up to sell U.S. Open of Surfing merchandise during
the surfing event. She said all of the merchandise being sold at that booth was branded with the U.S. Open
logo.
was familiar with the incident we were investigating and knew the police had been involved in a
shooting with a male suspect. She said she had not seen the male prior to that incident and only first saw him
as police were speaking with the male. said she turned away and then heard gunshots, which
prompted her to duck. She said she heard an additional volley of gunfire, but did not actually witness the

where the Jack`s booth would have been. I uploaded those two images to Evidence.com under this case

I spoke with by phone after receiving a message from her. I had previously left her a
message requesting to speak with her about this case. I recorded the call and later uploaded the audio file to
Evidence.com under this case number. The following is a summary of our conversation:
said she is a Jack`s employee and was also working in the temporary U.S. Open booth on the date
of the incident. She said she believed that booth was the only one selling clothing on the sand area beneath the
pier. said she recalled the incident and had not yet been interviewed.
said she was working in the booth when she heard gunshots. She said she initially was unsure
where the gunshots were coming from and she hid in the area of the booth. She said after the gunfire, she saw
police and paramedics performing CPR on a male in the sand area south of her booth. She did not witness the
shooting and did not recall seeing the involved male prior to that time.
I asked if she had heard anything about someone committing a theft earlier and she said she had.
She said she heard a rumor the involved male had stolen a shirt from the Huntington Surf and Sport booth on
the sand prior to the shooting. She said she heard one of the workers in that booth saw a gun in the male`s
waistband. had no first-hand information about this theft and could not recall where she heard
that information.
said she recorded a video of the police/paramedic response after the shooting. I asked her to share
that video with me and she later emailed me a single video depicting the scene after the shooting from the
position of where the Jack`s booth would have been. I uploaded that video to Evidence.com under this case

On 9/25/21 at 1508 hours, I responded to the area just south of the Huntington Beach Pier to assist with an
officer involved shooting that just occurred. I arrived at approximately 1519 hours, and assisted by
maintaining crowd control and setting up a perimeter with crime scene tape. While on scene, I contacted two
witnesses who are as follows:
Witness one, , said he was sitting at a table located at Sandys
restaurant located at 315 Pacific Coast Highway. table was along the window closest to the
boardwalk. He saw officers in an HBPD beach side by side patrol vehicle in an urgent matter across the
boardwalk. He began using his cell phone to record the officers who approached an unknown suspect on the
sand. Shortly after, the officers fired their guns at the suspect which he showed me via his cell phone video. I
did not collect the video for evidence.
sat back down at his table at Sandy`s after I spoke to him and I advised Detective Pricer #1185 of
the video and statement. Detective Pricer then took a more detailed statements from
Witness two, , told me he is visiting from Europe and was
walking on the pier during the incident. He advised to me what he witnessed he believed to be fireworks. He
used his cell phone to record the incident. He showed me the video on his cell phone which captured part of
the incident. I later provided information and video to Detective Pricer.
This investigation was captured on my body worn camera and later uploaded to Evidence.com. I conducted no
further investigation.
