A. PHAM AND LT. T. ARCHER NARRATIVE Initial Response: On Saturday, September 25, 2021 at about 16:05 hours, I was notified by Orange County Sheriff's Department (OCSD) Homicide Sergeant A. Abdelmuti #5458 of an officer involved shooting (OIS) involving officers from the Huntington Beach Police Department (HBPD) and a deceased male subject who was later identified as, . Sgt. A. Abdelmuti requested that I respond and assist with the OIS investigation as the lead investigator for the incident. At about 17:45 hours, I arrived at the incident command post located in the parking lot just east of the HBPD sub-station located at 285 Pacific Coast Highway (PCH), Huntington Beach, CA 92648. For additional information, see the related reports associated with the following case numbers: OCSD DR #21-032545, HBPD DR # 21-012353, Orange County Crime (OCCL) Lab FR #21-52599, and Orange County Coroner's Office #21-05698-TA. Upon arrival I attended an initial briefing held by HBPD Sergeant Anthony Pham #1183 to obtain background / initial information about the incident. The following is a summary of the information I obtained. The officers involved in the OIS were HBPD Detective Read Parker #1041 , HBPD Detective Charles Remington #1043, HBPD Officer Damian Velasco #2045, HBPD Officer Christopher Simpson #3013, and HBPD Officer Nicholas Koehler #2263. Sergeant A. Pham was also present at the OIS as a witness only. At the time of the briefing, had not been positively identified. The following is a brief timeline of the events surrounding the OIS as given during the briefing. At about 15:08 hours, HBPD personnel received a phone call from U.S. Open staff members. The U.S. Open of Surf event was currently being held in Huntington Beach. The staff stated a male subject was possibly intoxicated and he may have committed a theft. The information regarding the male subject was broadcasted over the HBPD encrypted radio channel (Green-1). At about 15:09 hours, Officer D. Velasco radioed that he was flagged down by a citizen and the citizen disclosed information about the subject possibly being armed with a knife or gun. At about 15:10 hours, the shooting occurred. Sgt. A. Pham indicated the shooting occurred just north of the HBPD sub-station on the beach near lifeguard tower #3. Interview of HBPD Sergeant Anthony Pham #1183: At about 19:47 hours, Investigator C. Hunt #7612 and I interviewed HBPD Sgt. A. Pham about the OIS. The interview was conducted at the HBPD sub-station mentioned above. Also present during the interview was HBPD Professional Standards Unit Sergeant Brian Jones #1018 and HBPD Detective Zack Pricer #1185. The following is a summary of Sergeant Pham's statement and my conversation with him, which I digitally recorded. It is not verbatim, nor necessarily in order of conversation, and is organized for purposes of clarity. This report is not meant to take place of the actual recording. It is just a synopsis. For complete details, refer to the recording of the interview. On Saturday, September 25, 2021 at about 15:08 hours, Sergeant A. Archer. The broadcast stated event staff called and reported a male walking along the waterline was possibly under the influence and possibly wanted for a theft. Sergeant A. Pham, Detective Read Parker #1041 , Detective Charles Remington #1043, Officer Damian Velasco #2045, Officer Christopher Simpson #3013, and Officer Nicholas Koehler #2263 responded to the area. The Detectives and Officers were all assigned to the event as well. Sergeant A. Pham heard Officer D. Velasco broadcast that the male subject was seated on a concrete wall near the pier. Officer D. Velasco also broadcasted that he had been flagged down and told the subject was possibly armed with a knife or gun. Officer D. Velasco then clarified the male subject claimed to have a gun. Sergeant A. Pham heard a broadcast that the male subject was walking southbound away from officers. Sergeant A. Pham exited the HBPD sub-station and saw the male subject walking away from the other officers. Sergeant A. Pham heard one of the officers order the male subject to, "Stop," and, "Stop Police." Sergeant A. Pham observed the male subject, "Did not look in his right mind." Based on his training and experience, Sergeant A. Pham believed the male subject was possibly under the influence of alcohol and / or drugs. The subject was animated, but had a blank stare in his eyes. The subject ignored all of the officers commands. The male subject raised his arms and hands into a shooting stance / position and pointed his hands at the officers. The subject was holding a white t-shirt. The officers shot at the suspect a few seconds after he took the shooting stance towards them. Sergeant A. Pham radioed the shots fired call and requested paramedics. The suspect fell to the sand and officers started to approach him. The suspect tried to get up, reached for an grabbed the white t-shirt. Sergeant A. Pham noticed the shirt had a heavy object inside, but he could not determine what it was. The male subject pointed the weapon at officers. In addition, the area behind the officers and also in the potential line of fire from the suspect, were numerous innocent bystanders and beach patrons. The officers shot again at the male subject. The suspect stopped and dropped what Sergeant A. Pham later saw was a gun. The officers approached the male subject, handcuffed him, and began to administer medical aid to him. Sergeant A. Pham stated that although he did not initially see the subject holding a gun, the fact that the subject took a shooting stance towards the officers with a weighted item concealed inside the t-shirt, made Sergeant A. Pham believe the subject was armed with and pointing a gun at the officers. Sergeant A. Pham estimated that he was about 30' feet away from the subject when the shooting occurred, and the other officers were about 15'-20' feet away. Sergeant A. Pham did not hear the male subject say anything. Sergeant A. Pham had never seen the male subject prior to the shooting. Based upon initial safety statements given to Sergeant A. Pham from the officers, he estimate about 15 rounds were fire in total. I copied my interview with Sergeant A. Pham to a CD. I booked the CD into Sheriff's Evidence, Santa Ana.
