NARRATIVE
Telephone Interview with
On Tuesday, October 26, 2021 at about 09:40 hours, I spoke on the phone to
at,. had previously called into Huntington Beach Police Department (HBPD) Dispatch
and identified herself as a witness of the HBPD officer involved shooting (OIS) on Saturday, September 25,
2021.
The following is a summary of statement and my conversation with her, which I digitally recorded. It is
not verbatim, nor necessarily in order of conversation, and is organized for purposes of clarity. This report is
not meant to take place of the actual recording. It is just a synopsis. For complete details, refer to the
recording of the interview.
On Saturday, September 25, 2021 at about 15:04 hours, parked her car near the Huntington Beach Pier.
parked her car south of the pier in the lot closest to where the OIS occurred. was parked in the
very front row facing the beach. exited the car with her daughters (8 and 10 yrs old) and paid the
parking meter. was about 50' feet from where the OIS occurred. looked towards the beach and
saw about 3-4 HBPD officers standing around a male, Hispanic on the beach. The male was holding a white
t-shirt. did not hear the officers or the male subject say anything. The subject pointed the white shirt
directly at the officers and and her children. could see the barrel of what was, "obviously" a gun
pointing at officers. saw the gun barrel and the way the shirt was hung long and thin over the object
which she knew for sure was a gun. remembered thinking, "why are they not shooting him." was
afraid the male was going to shoot the officers. initially heard one gunshot and she was not sure if the
male subject shot or the officers. screamed in fear, grabbed her daughters, and pushed them behind the
car for safety. heard about 10-12 more shots and saw the male subject fall to the ground. saw the
male subject's legs moving while he was on the ground, but because of where he fell and the officers positon
between them, she could not see the male subject's hands. After the shooting, officers approached the
subject and kneeled next to him, but she could not tell what they were doing. About two minutes after the
shooting, saw lifeguards arrive and perform CPR. young daughters did not witness the shooting.

On Saturday, September 25, 2021, at about 1512 hours, an Officer Involved Shooting [OIS] occurred
in the area of 285 Pacific Coast Highway in the City of Huntington Beach. A short time later,
Investigators with the Orange County Sheriff’s Department responded to investigate the OIS. For

Beach Police Department (HBPD) Case Number 21-012353.
On Tuesday, October 26, 2021, I conducted a phone interview with
who was identified as a possible witness in this investigation. I recorded the interview. Below is a
synopsis of the interview, for complete details refer to the recording.
On Saturday, September 25, 2021, was at the beach in the City of Huntington Beach near where
the incident occurred. was with her friend, . arrived at the US Open
event at about 1505 hours. walked down the stairs from the parking lot near Sandy’s Beach
Shack located at 315 Pacific Coast Highway in the City of Huntington Beach. explained turning
right (north) walking on the sidewalk and ending up about 100 to 200 feet away from where the
incident occurred and was facing south or southwest.
After about three minutes of arriving, then heard about two to three gunshots. turned
around and saw three or four police officers facing a male who she believed had his hands up.
described the male as unknown race, wearing a white t-shirt and tan shorts. The male then went to
the ground and she heard about five to seven additional gunshots which she described as being
quick gunshots. did not see the male moving on the ground after he went to the ground and did
not see the male with a weapon.
stated an unknown amount of time passed but she felt like it was a “couple” minutes before the
officers approached the male. explained she felt like the officers were observing or assessing
the male. the stated about four to five minutes later lifeguards responded and began performing
CPR.
stated she had video of the time surrounding the incident which she agreed to provide to me. I
provided with my contact information and told her to contact me with any additional details.
I placed the recorded interview onto a CD with another recorded interview. I later booked the CD into
the Orange County Sheriff’s Evidence Lockers located in the City of Santa Ana.

On September 25, 2021, at about 2002 hours, Investigator J. Larson #1377 and I responded to Lifeguard
Headquarters located at 103 Pacific Coast Highway in the City of Huntington Beach [County of Orange, State
of California] to interview Marine Safety Captain Todd Bartlett reference his response to an officer
involved shooting that occurred near the US Open of Surfing. Also with us was Huntington Beach Police
Detective Richard Eidlhuber.
The following is a synopsis of our interview with Todd. It is not verbatim, nor necessarily in order of our
conversation, and has been organized for the purpose of clarity. This report is not meant to take place of the
actual recording. It is just a synopsis. For complete details, refer to the recording of the interview.
Todd said he was scheduled to work today from 0600 to 0000 hours. The first part of his shift he was
assigned to the US Open of Surfing, and the second part of his shift he was assigned to work as the night shift
supervisor.
At some point, Todd said he was driving back from refueling his vehicle when he heard an officer involved
shooting go out over the Aqua 1 radio frequency. At the time, Todd said he was near Atlanta Avenue & First
Street in the City of Huntington Beach. Right after the call went out, Todd saw an officer going Code-3
towards the direction of the call so he followed officer's car to the scene. Todd estimated his arrival to the
scene to be about two minutes after hearing the call go out over the radio.
Upon his arrival, Todd said he saw approximately 3 to 4 police officers performing CPR on a man who was
lying on his back. Todd said three of his partners [Tony Villalobos, Sean Cahill, and Payton Thomas] also
arrived about the same time and that they took over lifesaving measures from the officers. For his part, Todd
said he assisted with placing the AED pads and gave ventilations to the patient with a bag valve mask. Todd
believed he and his partners worked on the patient for about 5 to 7 minutes prior to the ambulance going on
scene.
Todd said the patient’s clothes were removed prior to his arrival, and that he remembered seeing about 8
different gunshot wounds to the patient’s chest, abdomen, legs, arm and hand. I asked Todd if the patient
ever showed any signs of life while they were working on him. Todd said the AED never advised there was a
shockable rhythm, and that the patient never regained a pulse or started to breath. I asked Todd if he helped
apply any of the occlusive bandages that were used and he said he did. Todd said they also used some
gauze to try and stop some of the bleeding from one of the patients shoulders, and that they applied a
tourniquet to one of the patient’s legs.
Todd also told us he remembered seeing a gun near the patient when he first got on scene. He said it looked
like a black semi-automatic handgun and that there was an officer standing by with it.

On September 25, 2021, at about 1934 hours, Investigator J. Larson #1377 and I responded to Lifeguard
Headquarters located at 103 Pacific Coast Highway in the City of Huntington Beach [County of Orange, State
of California] to interview Lifeguard III Supervisor Sean Cahill reference his response to an officer
involved shooting that occurred near the US Open of Surfing. Also with us was Huntington Beach Police
Detective Richard Eidlhuber.
The following is a synopsis of our interview with Sean. It is not verbatim, nor necessarily in order of our
conversation, and has been organized for the purpose of clarity. This report is not meant to take place of the

Sean said his shift started at 0700 hours and that he was assigned as a shift supervisor for a surfing contest
near “Tower 22.” Sean said his day was scheduled to end at 2000 hours after closing “Tower 0” near the
Huntington Beach Pier.
At some point in the afternoon, Sean said he was finishing a break at their headquarters when he heard over
the “Aqua 1” radio frequency that a large sailboat was struggling off shore and needed assistance. At about
the same time, Sean said another radio transmission went out that said the Huntington Beach Police
Department was tracking a suspect. At the time, Sean said his focus was the struggling sailboat so he went
downstairs to get ready to take a jet ski out to help the sailboat. As he prepared, Sean said the sailboat call
was updated to “Code-4” and almost immediately after dispatch put out that there was a person down near
their substation.
Sean said he missed some things that occurred on the radio while he was getting ready, so he did not know
the person down call was in reference to an officer involved shooting. Sean said he immediately responded
with Captain Tony Villalobos, Captain Todd Bartlett, and Lifeguard III Payton to their substation to
assist with the person down call. As they neared their substation, Sean said he could see the Huntington
Beach Police Department was dealing with something so he stopped short and waited for the okay to proceed
into the area. Once it was safe, they were waived in to the area of where there was a person down.
Sean said the Huntington Beach Police Department was conducting CPR on a man whose clothing had
already been mostly removed. Sean said they immediately hooked up an AED to the man and assumed
responsibility of CPR. Sean believed they completed about two rounds of CPR prior to the ambulance’s
arrival. During that time, Sean said the AED they hooked up to the man did a few analyses but no shock was
ever advised.
I asked Sean if he remembered seeing any expended firearm shell casings near where the man was lying and
he said he did not. Sean said he did see a weapon though. I asked Sean to describe the weapon he saw.
Sean said it looked like a semi-automatic 9mm handgun similar in size to a 9mm Glock and that an officer was
standing by the gun the whole time.
Inv. Larson asked Sean if he heard any gunshots related to the officer involved shooting and Sean said he did
not. Inv. Larson asked Sean what injuries if any he remembered seeing on the man down. Sean said the
man had multiple gunshot wounds to his upper torso, lower torso, legs and arms. Inv. Larson asked Sean if
he spoke to any of the officers about what happened and Sean said he did not.

On October 13, 2021, I attempted to call using the phone number provided to
Investigator J. Cislo by the Huntington Beach Police Department - Upon my phone call being
answered, I identified myself as an investigator with the Orange County Sheriff's Department and asked if I
could speak with The person who answered my phone call told me they did not know who was
and told me I had the wrong phone number. I told the person on the other end that was not in trouble
and that she had been identified as a possible witness to an officer involved shooting. The person on the
other end said they did not know who was and hung up on me.
I attempted to locate better contact information for using her name and date of birth in law enforcement
databases but could not locate any. I also checked law enforcement databases to see if the phone number
provided by the Huntington Beach Police Department did in fact belong to a and it did not.

On October 13, 2021, at about 1321 hours, I contacted via telephone. Upon her
answer, I identified myself as an investigator with the Orange County Sheriff’s Department and told her she
was identified by the Huntington Beach Police Department as a possible witness to an officer involved
shooting that occurred in Huntington Beach, California at the US Open of Surfing on September 25, 2021.
told me she did witness the incident and agreed to speak with me about what she saw.

said she was working for “Event Next,” which is a third party agency that was doing a marketing
campaign for Jeep at the US Open of Surfing. At some point during the event, noticed a man wearing
a white t-shirt being semi-surrounded by about 4 to 5 police officers. said the officers were facing
toward her, and the man wearing the white t-shirt was between her position and where the police officers were
standing. said the man wearing the white t-shirt began backing up towards her direction, and as he
did he lifted up his hands and pointed something white out toward the officers. said at that point, she
heard a “couple of pops” but could not tell if the pops were fireworks or gunshots. After the pops, the man
wearing the white t-shirt “staggered” slowly to the ground and began “writhing around” and moving “quite a
bit.” As the man moved on the ground, said he flipped over to reach towards something.
said that’s when she saw/heard another 12 to 20 more shots. After those shots, said the man
stopped moving.
said an officer approached the man and appeared to check him. said the officer then rolled
him over like he was going to put handcuffs on him, but then quickly rolled onto his back again and started
CPR. estimated the officers did CPR on the man for about 15 minutes until he was put on a stretcher
and carried away. Once the man was gone, said the officers started “roping off the entire beach” so
she and her co-workers began packing up their booth to leave. As they did, an officer came over and asked
them if any of them got injured during the shooting. said they told the officer nobody in their group
had been injured and added that none of their vehicles at the event had been hit by gunfire either.
said she never saw the man in the white t-shirt holding a gun, but did see something white in his
hands pointed out towards the officers. I asked if she remembered the officers in the semi-circle
around the man yelling anything at him. said, “Oh yeah, they were definitely yelling at him.”
said she couldn’t tell what the cops were yelling but said she was positive they were yelling. said the
yelling continued even after the second volley of shots but could not say for certain what the officers were
yelling.
I asked if she remembered firemen ever arriving and assisting. said within about 5 minutes,
she remembered seeing other police officers and lifeguards but didn’t ever see an ambulance make it onto the
beach. I asked if she took any video and she said she did not. However, after saying that,
said she thought her friend [NFD] took one video and then thought she might have taken a video while
officers were trying to revive the man. I provided with my county email address and asked here to
email the video if in fact she did take one and asked her to also provide me with whatever contact information
she had for her friend agreed to do so but as of January 6, 2022, I’ve yet to receive any
emails or further phone calls from

she thought would be helpful for this investigation. said she believed the police did what they had to

Dispatch and identified himself as a witness of the OIS.

On Saturday, September 25, 2021 at about 15:00 hours, was eating at the Sandys Beach Shack
located at 315 Pacific Coast Highway, Huntington Beach, CA 92648. was on the outside lower
seating area next to the glass partition. was with his friends
. saw a Male Hispanic, 40's wearing a white tank top, long shorts, and long white
socks walking on the beach from underneath the pier. About four or five police officers approached the male
and stood in a half circle around the male subject. thought the male drew something, but he was
no sure. did not see if the male was holding anything. The policer officers were yelling, "Stop" at
the male subject. The male turned and, "aimed" at the officers. The male subject was standing like someone
who was going to shoot a gun. The male subject's arms were extended and together pointed towards the
officers. The officers shot a couple of times at the male subject and he fell to the sand. On the ground, the
male was still moving and appeared to roll to his right and reach for something. thought the male
drew another weapon and pointed at the officers, and that was when the officers shot at the male again.
About 5 to 10 seconds after the shooting, the officers started CPR and attempting to revive the male subject.
had not seen the male subject prior to the OIS. never saw the male subject holding a
weapon.
stated that amongst his group he was the only one to reach out to law enforcement as a witness.
agreed to pass on my contact information to , and Mile and ask them to speak
to me.

Family Telephone Interviews:
On Wednesday September 29, 2021 at about 18:00 hours, the City of Huntington Beach held a community
meeting to discuss the Huntington Beach Police Department (HBPD) Officer Involved Shooting (OIS) that
occurred Saturday, September 25, 2021. The meeting was held at the Lifeguard HQ located at 103 CA-1,
Huntington Beach, CA 92648. During the meeting, several people came forward and identified themselves as
witnesses of the OIS. HBPD Detective Zack Pricer #1185 and I interviewed the witnesses in a private office
on the 2nd floor of the Lifeguard HQ. (DOB
09/01/2004), and were present and came forward as witnesses of the
OIS, but they were unable to stay and be interviewed in person at that time. For details of the other interviews,
see my supplemental report for this case (DR #21-032545).
I made several attempts to call and left messages for her to return my calls, but I was unable to
reach her. I also sent messages to but I was unable to schedule a time to speak to her. On one
occasion, I spoke briefly on the phone with but she was working and unable to speak. told
me she would return my call, but she did not do so.

On Monday, November 29, 2021 at about 10:10 hours, I called at, and interviewed
her about the OIS.
The following is a summary statements and my conversation with her which I digitally recorded. It is
not verbatim, nor necessarily in order of conversation, and is organized for purposes of clarity. This report is
not meant to take place of the actual recording. It is just a synopsis. For complete details, refer to the
recording of the interview.
On Saturday, September 25, 2021 at about 15:00 hours, was with her children and
at Huntington Beach. and her children were just leaving the area of the U.S. Open of Surf and
walking towards Sandy's Beach Shack. About 50' feet away, saw a white male, with a bald or
buzzed hair style, wearing a white t-shirt and baggy shorts, and carrying a towel or shirt inside of his right
hand. The male subject had his back facing to About 5-6 police officers were standing in a semi-
circle around the male. The male's right hand was up, but from Angelina's perspective his arm was more out
to the side than pointed directly at the officers. The clothing item was balled up, but could not see
anything concealed underneath of it. never saw the male subject holding a weapon at any time. The
officers were telling the subject to, "Stop," but he continued to back up slowly without stopping. The officers
fired, "Three or four, but no more than five" shots at the male subject who fell to the ground. The male
dropped whatever clothing he was holding, but did not see him drop a gun. On the ground the male
was, "Convulsing," but did not see him reach for anything. The officers shot at the male again about,
"Fifteen to Twenty" more times. Less than a minute after the shooting, the police officers approached the
male subject and remembered one of the officers kicking the clothing item away as the officers
began CPR on the male subject. Although never saw a weapon, after the shooting, heard
other people saying they were afraid the male could have shot them.

I also spoke on the phone to (Recorded same as above). On Saturday, September 25, 2021 at about
15:00 hours, was at Huntington Beach with her mother and brother. was also about 50' feet
from where the incident occurred, but she was walking slightly in front of her family. saw a ,"Latino"
male with a large build and short hair standing on the beach with his back turned towards her. saw
police officers standing around the male subject. never heard the police or the male subject say
anything. The male subject was walking backwards holding what appeared to be a towel. turned to
see where her mother was and she heard, "Maybe ten" gunshots that she initially thought were fireworks.
turned and she saw the male subject on the ground. immediately saw and heard the police
officers shoot at the male subject, "Less than ten," more times. never saw the male subject holding
any weapons. The only movement saw from the male subject, was his arm briefly up in the air as he
was being shot. About two minutes after the shooting, the officers approached the male, checked his pulse,
searched him for weapons, and began giving him medical attention. felt that most likely saw
less of the incident, because after the shooting started, shielded him from view.
At the time of telephone interviews with and was at school and unable to be
interviewed. and stated they would have call me when he was able to.
I copied my interviews to a CD. I booked the CD into Sheriff's Evidence, Santa Ana.
I made several phone calls to both and and left messages for to contact me,
however he did not attempt to contact me.

On Tuesday, December 21, 2021 at about 09:45 hours, Investigator D. Womack #7933 and I went to
residence located at . I spoke to and he told me the following

On Saturday, September 25, 2021, at about 15:00 hours, around the closing of the U.S. Open of Surf,
was walking with his mother and sister on the beach near the Huntington Beach boardwalk. heard
about 2-3 loud bangs he called, "Gunshots" although he initially thought the bangs were fireworks. The sound
caught attention and he turned towards the noise. About 200 yards away, saw 7-8 uniformed
police officers. The officers had their guns drawn and pointed at a male Hispanic, in his 20's wearing a white
tank top and black pants. Because of the distance and circumstances, could not remember more
about the male subject's appearance. The male was crawling on the beach and reached out. The officers shot
again about 17 more times. thought the police officers were shooting at the male because he could
see sand flying up from the beach and the male twitching. About 10 minutes after the shooting, the officers
performed CPR on the male subject. never saw the male holding any weapons. never heard
the officers or the male subject say anything. When saw the male reaching out, he could not see what
if anything he was reaching for.

On Tuesday, October 12, 2021, I conducted a phone interview with
was identified as a possible witness in this investigation. I recorded the interview. Below is a
synopsis of the interview, for complete details refer to the recording.
On Saturday, September 25, 2021, rode his bicycle to the area of the beach where the incident
occurred. was about 12 feet away, facing southwest, securing his bicycle near a small wall
when the incident happened. saw an officer driving an all-terrain vehicle (ATV) fast near the
beach and come close to people on the beach. then saw a male whom he described as
looking like “trouble.” further explained the male appeared to have negative energy and was
walking awkward.
described the male as being about 5’09” tall to about 5’10” tall, weighing about 160 pounds,
wearing a white shirt, shorts, with white socks. saw officers approach the male and heard an
officer tell the male to stop. The male continued walking backwards. heard an officer tell the
male to put his hands down. heard the male reply by saying, “Don’t come any closer.”
explained the male was holding something in his hands which was covered by a shirt which
believed to be a gun. heard the male say, “If you come any closer, I’ll shoot you.”
then heard about two to three gunshots and saw the male go to the ground. saw the
male reach for the object on the ground which he could see was a gun. heard “a lot” of
gunshots, possibly about ten from four to five officers. saw officer performing CPR on the
male.
stated he had videos of the incident and photographs. I gave my contact information
and asked him to send me the videos and photographs of the incident. I told to call me if he
remembered anything else about the incident.
I hung up the phone with and attempted to review the recording. I realized my digital recorder
did not record our conversation. I called again and confirmed his statements on recording.

department email. I placed the audio recording onto a CD with other recordings, the two videos from

Telephone Interview with Witness
On Friday, October 8 2021 at about 1300 hours, I spoke on the telephone to witness at,
regarding the Huntington Beach Police Department (HBPD) officer involved shooting (OIS) that
occurred on Saturday, September 25, 2021 at about 15:11 hours.
The following is a summary of statement and my conversation with him, which I digitally recorded. It is
not verbatim, nor necessarily in order of conversation, and is organized for purposes of clarity. This report is
not meant to take place of the actual recording. It is just a synopsis. For complete details, refer to the
recording of the interview.
and his girlfriend were walking northbound under the pier on the beach walking path. noticed
a Hispanic male subject that immediately stood out to him. The Hispanic male was wearing some type of white
shirt or jersey and was wearing socks on the beach. The male subject was holding an object wrapped in some
type of cloth and had it clutched to his chest. The male Hispanic subject was headed southbound
and appeared to be walking quickly away as if he was paranoid or trying not to be seen. The male subject kept
looking back over his shoulder. saw two police officers walking down the steps north of the pier and onto
the walking path. He also saw a police vehicle drive up from the beach with another officer. watched as
all three officers followed after the suspicious male subject. As the officers got closer to the male subject they
began to run to close the distance. Believing something bad was about to happen, guided his girlfriend
up the stairs that led up from the walking path. Once out of harm's way, turned and watched the incident,
which was about 40 to 50 feet away from him. heard the officers yelling commands to the male subject,
but he could not remember what they were saying. The male subject did not comply and walked backwards
away from the officers with his hands close to his chest and still clinched around the cloth and whatever was
under the cloth. When the male subject did not comply, the officers fired 9-12 rounds and the male subject fell
to the ground, dropping whatever was in his hand. There was a slight delay and then the male
subject scrambled to grab the item that he dropped. The officers fired their guns at the male subject
again. Realizing what was happening, took his girlfriend across the street and out of view of the officer
involved shooting. had not seen or had any interaction with the male subject prior to witnessing the
officer involved shooting. had no further details to provide.

works for Huntington Surf & Sport (HSS) at 300 Pacific Coast Highway in the City of
Huntington Beach, CA. On Saturday, September 25, 2021 he was assigned to start work at 1500
hours at the temporary store booth located on the beach just north of HBPD sub-station. He arrived
at the booth a few minutes after 1500 hours and started working just prior to the shooting, which
occurred at approximately 1510 hours. provided the following statement.
had just arrived to work and began helping a customer on the side of the booth furthest away
from the OIS scene. While he was facing away from the OIS scene, he heard some yelling and
shouting similar to what he described as some sort of altercation but he could not hear what was
being said. then heard a few gun shots and turned around towards the scene of the OIS
which he believes was approximately fifty (50) feet away from his location. He initially observed a line

the temporary store booth located on the beach just north of HBPD sub-station. He was still waiting
for his replacement and working in the booth when the shooting occurred at approximately 1510
hours. provided the following statement.
was working in the HSS booth on the side closest to the pier and approximately 10 to 15 feet
from the location of the OIS. initially heard some yelling but he could not completely understand
what they were saying. He did describe the yelling as someone giving commands that sounded
similar to “get on the ground”. Once he heard the yelling, he looked in the direction of the yelling and
observed the subject identified as had a clear side view of and was able to see the

right side of his body. He observed with his arms up in what he described as a “surrendering
position”. He could not see the left hand but observed holding a white t-shirt in his right hand.
He described clinching the t-shirt draped over his hand but didn’t think he could have been
holding anything else in his right hand. also saw three police officers, two of which were partially
blocked by the temporary posts placed in the sand for the US Open of Surfing. The third officer he
said was the closet one to him. He observed this officer with his pistol out, shooting in the direction of
He knew the officer was shooting because he saw smoke coming out of his gun and heard
the gun shots. After hearing approximately ten (10) shots, turned away to look at his co-workers
who were on the ground inside the booth. When he turned, heard a few more gun shots as he was
dropping to the ground. remained on the ground until the incident was over. believes he
heard a total of approximately fifteen (15-18) shots during the entire incident. At the time of the
shooting believes there were approximately fourteen (14) people in line or shopping at the
booth. did not recognize and did not see him prior to the shooting. He remembered
seeing tattoo’s during the shooting and is positive he would have remembered him prior.
Investigator Arburua copied the audio recording of the interview onto a disc and booked it into the
OCSD evidence locker in Santa Ana, CA.

On Saturday, September 25, 2021, was eating at Sandy’s Beach Shack located at 315
Pacific Coast Highway in the City of Huntington Beach. was with her daughter,
her three year old granddaughter, her 5 year old granddaughter and her
six year old grandson. and arrived to Sandy’s at about 1430 hours and were
seated in the patio area near the beach.
stated she saw a male she described as being Hispanic or black wearing a white shirt
walking around on the beach. went to the bathroom and she heard about six or eight
gunshots. looked and saw the male from earlier fall. got under the table and
later crawled to the bathroom of the restaurant. did not hear any additional gunshots and
returned to the patio area. stated they left the restaurant through the back door.
stated took a photograph of the officers doing CPR. did not see the
male with a weapon but heard people talking at the scene. stated people were saying the
male had a gun. did not have video or photographs.
I told to call me if she had any additional information or if she remembered any additional
details.

On Saturday, September 25, 2021 at about 15:00 hours, was at Sandys Beach Shack Restaurant
located at 315 Pacific Coast Highway, Huntington Beach, CA 92648. was with her six-year old son
and who was previously interviewed as a witness on this case.
was sitting at the last table on the patio area close to the glass on the bottom floor. heard someone at
a nearby table, "Dude did that guy have a gun?" looked up and saw several HBPD officers, but she
did not see what they were doing or if they were interacting with anyone. heard about three loud pops
she thought was gun fire. grabbed her son and pulled him to the floor. On the floor, and out of view,
heard multiple gun shots. never saw anyone doing the shooting. After the shooting,
saw the HBPD offices performing CPR on a male subject on the beach. had never seen the male
subject before nor did she see what lead up to the shooting.
After our conversation, emailed two short videos (17 seconds and 23 seconds) and a still photograph
she took. The first video only showed the male subject being loaded into the ambulance. The second video
was about 23 seconds in length, but only about 4 seconds of the video showed the beach area, with what
appeared to be police officers, lifeguards, and paramedics performing CPR on the male subject. The still
photograph was an image of the same scene. I copied the videos, photograph, and my recorded conversation
with to a CD. I booked the CD into Sheriff's Evidence, Santa Ana.

On Tuesday, October 12, 2021, I conducted a phone interview with who was
identified as a possible witness in this investigation. I recorded the interview. Below is a synopsis of
the interview, for complete details refer to the recording.
On Saturday, September 25, 2021, was at the beach in the City of Huntington Beach near
where the incident occurred. was with her friend, was
making her way to the entrance of the US Open event. was standing near the booth area about
30 feet north of where the incident occurred near the pier.
heard about two shots which she described sounded like rubber bullets. turned around
and saw about six officers surrounding a male who was on the ground. described the male as
being Hispanic, wearing a white shirt, dark colored shorts and white socks. could not hear what
was being said. saw the male moving around on the ground, then heard about six or seven
more shots. later stated she could not remember if she saw the male standing prior to the
shots. stated she was close enough to the incident where she was able to see the officer ’s
guns but did not see the male with a weapon.
After about five minutes, and others were moved out of the area by US Open security.
went back to the area where the incident took place and saw lifeguards performing CPR on the
male. About 15 minutes later, an ambulance arrived and took the male away on a gurney.
stated she did not have video of the incident. I told to call me if she had any additional
details or remembered anything else.
I placed the recording onto a CD with another recording and a video related to this case. I later
booked the CD into the Orange County Sheriff’s Evidence Lockers located in the City of Santa Ana.

Saturday, September 25, 2021.
The following is a summary of statements and my conversation with them which I digitally
recorded. It is not verbatim, nor necessarily in order of conversation, and is organized for purposes of clarity.

On Saturday, September 25, 2021 was eating outside on the lower patio of Sandys Beach Shack
restaurant located at 315 Pacific Coast Highway, Huntington Beach, CA 92648. estimated she was
about 40' feet from where the incident occurred. Initially heard only a few gun shots that got her
attention, followed by a brief pause and about ten more gun shots. stated it was, "Chaos" and at first
she could not tell who was shooting or where the shots were coming from. saw HBPD officers facing the
beach. saw the HBPD holding their guns and figured the shots had come from them. Initially,
could not see the male subject on the beach because the police officers were standing in a position that
blocked her view. When did see the male subject, HBPD officers were performing CPR on him.
never saw the male subject prior to the shooting. thought she heard police officers yelling prior to the
shooting, but she could not make out anything that was said. saw a video of the shooting afterwards,
which showed the male subject holding a gun, but she never witnessed him holding a gun at the time she saw
the incident.
On Saturday, September 25, 2021 was eating outside with on the lower patio of Sandys Beach
Shack restaurant located at 315 Pacific Coast Highway, Huntington Beach, CA 92648. estimated he was
about 25 yards from where the incident occurred. heard three, "Pop, pop, pop" and he initially thought it
was fireworks going off. heard someone say, "Shots fired" and people starting jumping to the floor for
cover. saw HBPD officers surrounding a male subject on the beach. The male subject was holding a
white towel on his hand. The male subject went to the ground and started to get back up and heard
multiple gunshots. thought at least two HBPD officers had fired their guns at the male subject. Bill's view
of the subject on the ground was partially obstructed by a tree. After the shooting, the officers started CPR
and then they were assisted by lifeguards. did not see what the male subject did prior to the shooting.
could see if the male was holding a weapon at any time during the incident.

object on the ground. saw the officers shoot the male while he was reaching for the item on the
ground. told me it looked like the male subject was trying to "commit suicide by cop." saw the
officers perform first aid on the subject that they shot. had not seen or had any interaction with the
male subject prior to witnessing the officer involved shooting. had no further details to provide.

On Saturday, September 25, 2021, was eating at Sandy’s Beach Shack located at 315 Pacific
Coast Highway in the City of Huntington Beach. was with her mother,

inside of the restroom of Sandy’s when she heard about four or five gunshots.
ran out of the bathroom and onto the patio area where they were seated. saw
and the three children under the table. saw three or four officers trying to resuscitate a male
subject. described the male as being Hispanic, having dark hair and wearing a white shirt.
paid for the meal and left the restaurant through the back door towards the parking lot.
did not have video of the incident but stated she took a photograph. later text me the
photograph. I emailed the photograph to my department email. I placed the photograph onto a CD
with another photograph related to this case and recordings. I later booked the CD into the Orange

On Saturday, September 25, 2021, was at the beach in the City of Huntington Beach near
where the incident occurred. was with his girlfriend, ) and her friend,
arrived to the area near Sandy’s Beach Shack located at 315 Pacific
Coast Highway sometime between 1430 and 1530 hours, just before the incident occurred. was
standing in an area he described as being about 35-40 feet away from the incident. stated it
was near a boardwalk area where there were vendor booths set up to his right.
and stopped to take a photograph and he heard an officer say, “Freeze.”
saw about four or five officers. looked and saw a male who he described as looking like a gang
member, wearing a white shirt, dark colored shorts and long white socks. explained the
description of the male being a gang member by saying the male had his white socks were high
white socks. saw the male grab something which he described as being covered by a white and
dark shirt and turn towards the officers. thought the male had something in his hands but could
not see what it was.
then heard one to two “pop” sounds which he described as sounding like a cap gun. saw
the male go to the ground. saw the male reaching for something on the ground and saw the
male raise his arm. After the male raised his arm, heard eight to ten more “pops” which he
believed were gunshots. did not see the male with a gun initially but believed he saw a gun
after the incident. stated the officers began rendering aid by doing CPR to the male.
initially thought the male had been tazed by officers. thought the incident looked like some
sort of “drill” which he described as training. believed people were saved by the officer’s actions
and he considered the incident a victory for public’s safety.
I gave my contact information and told him to contact me with any additional details.

On Saturday, September 25, 2021 at about 15:00 hours, was with his wife
and his two children (2 and 4 yrs old) at Huntington Beach. parked the stroller about 50'
feet from the beach were the incident was to occur. and his wife were walking along the paved
sidewalk and he saw an HBPD officer draw his gun from the holster. He saw a second officer with his gun
drawn approach a bald Hispanic male. The male was holding what a white t-shirt. The male subject noticed
the 2nd officer, and with his hands covered with the t-shirt he turned towards the officer and raised his hands
out at him. The male subject, "Raised his hands as if he was holding a firearm." It looked like something was
underneath the t-shirt. The way the shirt was draped over the object and outline of the object was consistent
with a gun. It, "Looked like he had a grip as if he was holding a gun." The male subject took a few steps and
the officers shot at him. heard the officers shoot about 4 times. grabbed his wife and kids and
took cover behind a concrete wall. After hiding behind the wall, he heard about 6 or 7 more gunshots.
peeked up from the wall and saw officers with their guns pointed at the male subject on the ground.
quickly gathered huis family and left the area. As they left the area a few minutes later, saw
emergency personnel performing CPR on the male subject.

On Tuesday, October 26, 2021 at about 10:59 hours, I spoke on the phone with
(RECORDED SAME AS ABOVE). On Saturday, September 25, 2021 at about 15:00 hours, was

took cover behind a wall. heard about ten shots. After the shooting, and her family
quickly left the area. memory of the events were not good because she had a, "meltdown."

had initially called the Huntington Beach Police Department (HBPD) directly, but she was referred to
the Orange County Sheriff's Department (OCSD) because OCSD was the investigating agency for the OIS.
On Saturday, September 25, 2021 was having lunch at Sandy's Beach Shack located at 315 Pacific
Coast Highway, Huntington Beach, CA 92648. was sitting on the back lower patio of the restaurant
on the west side of the building. The patio has a small pony wall and glass partition with a view of the
walkway, beach, and ocean. was sitting at the last table at the far south end of the patio and close to
the glass. attention was drawn to the beach area because it was not as crowded as usual.

saw a Hispanic male on the beach wearing blue or grey Dickeys pants and white t-shirt.
saw officers from HBPD approaching the male subject. heard the HBPD officers yell, "Stop, stop,
stop." The male subject was, "Completely erratic" and ignoring the officer's commands to stop. The male
subject, "drew something" from underneath his shirt that could, "clearly tell was a gun of some kind."
It was at this point that the male subject "looked like he was going to shoot." screamed because she
was afraid she and a seven-year old child with her would be shot by the armed male subject. heard
the officers shoot about five shots and the male subject went down to the sand. However, "With the last
breath in the man's life, you know straight up, he grabbed for the weapon in one last plea to shoot at the
officers." When the male reached for the gun the officers fired about thirteen more shots at him. After the
shooting the officers gave him medical attention and CPR for about twenty minutes.
expanded on the moment she saw the male subject holding a gun. initially saw the subject
holding a bundled up white t-shirt, but then he drew out a weapon from an unknown area on his person. The
gun was, "black" and it was a "45 and square." initially thought the male subject shot at the police
before they shot at him. thought that the male subject fired several shots because of the way he was
standing and she thought the first gunshots sounded different than all of the other shots fire by the HBPD
officers. noted that the officers shot at the subject, but paused after he went to the ground, and only
shot at him again after he grabbed the gun.
told me she video recorded the incident. told me she would send the video to my
department email address. As of Thursday, October 7, 2021 at about 13:15 hours, I had not received any
video from despite, multiple calls, voicemails, and an email sent to her.
On Friday, October 15, 2021 at about 09:35 hours, I spoke briefly on the phone with

On Thursday, October 7 2021 at about 13:16 hours, I spoke on the telephone to witness
regarding the Huntington Beach Police Department (HBPD) officer involved
shooting (OIS) that occurred on Saturday, September 25, 2021 at about 15:11 hours.
The following is a summary of statement and my conversation with him, which I digitally recorded. It is

was riding his electric bike on the bike path near the Huntington Beach Pier. heard what sounded
like one gunshot followed by a brief pause and at least ten more shots. did not see the shooting. After
the shots were heard, saw HBPD officers performing CPR on a male subject on the beach. Another
male witness (NFD) who did not know, showed him a video of the shooting. used his phone to
video record the CPR and some of the events after the shooting. had not seen the male subject prior to
the shooting or any police interaction before he saw them performing CPR.
sent me five videos he recorded of the incident. stated he used his phone to make the recordings
and he had not altered them; a video showing the male subject being loaded into an ambulance, a video of
HBPD officers set up crime scene tape, a video of HBPD officers and lifeguards performing CPR, a video of
an HBPD officer asking people to clear the crime scene area, and a video of HBPD officers effecting an arrest
of an unrelated male who appeared to be refusing to leave the crime scene.

On Friday 10/1/21, I had been contacted by Lead Investigator J. Cislo #3318 to assist in contacting potential
witnesses to the Officer Involved Shooting that occurred in the City of Huntington Beach on Saturday 9/25/21.
I was tasked by Inv. Cislo to attempt to contact an individual identified as at the telephone
number of . I first attempted to contact this individual on Monday 10/4/21 at 1435 hours by
calling the telephone number I had been provided. No one answered the call and it went to an automated

On Wednesday 10/4/21 at 0907 hours, I again called the number of in an attempt to contact
the individual identified as The call was not answered and again was sent to the automated
voicemail box confirming the number I had called. I left a similar message requesting they contact me at their
earliest convenience to provide any additional information. As of the date and time of this report, I have not
received any call back regarding my request for additional information.

The following is a summary of statement and my conversation with him, which I digitally recorded. It is

On Saturday, September 25, 2021 at about 15:00 hours, was eating outside at the Sandys Beach Shack
Restaurant located at 315 Pacific Coast Highway, Huntington Beach, CA 92648. was seated near the
glass on the lower level outside patio. looked over toward the beach and saw a male subject standing on
the beach. There were about four Huntington Beach Police Department (HBPD) standing in a half circle
around the male subject. The male held his hands out in front of his body with his hands pointed toward the
HBPD officers. The male was holding a white shirt and pointed an unknown, "concealed" object at the HBPD
Officers. heard about three or four gunshots and the male fell to the ground. On the ground the man
scrambled for what he dropped, which assumed was a gun. was afraid that if the male subject was
able to fire the gun, someone at the restaurant would have been shot. The male subject grabbed the weapon,
and the HBPD fired about twelve shots at the male. The male feel to the ground. As the male feel to the
ground he dropped the weapon. When the weapon fell, could clearly see it was an, "Automatic" handgun
with a black handgrip. During the incident, only heard indistinct shouting and could not tell who or what
was said. The incident happened quickly and did not record it.

identified as a possible witness in this investigation. I recorded the interview. Below is a synopsis of
the interview, for complete details refer to the recording.
On Saturday, September 25, 2021, was at the beach in the City of Huntington Beach near
where the incident occurred. was with her friend, ( and
( and rode their bikes to the beach area near where the incident
happened. decided she wanted to take a photograph of them at the beach. noticed
about five or six police officers forming what she described as a semi-circle around a male subject.
described the male as being possibly white, short height, wearing a white shirt and blue
shorts.
believed the police were protecting her and the people at the beach. believed the
officers were focused on the male. stated the actions by the officers made her feel calm.
described the male as possibly being on drugs and not in his right mind. explained her
statements as the male did not have any fear for his life, was not complying with commands and she
believed she heard the officers tell the male to, “Freeze” or something similar but was not sure.
also stated the male did not show the officers he was not a threat to anyone.
stated the male turned and she heard what sounded like a “cap gun” or a taser.
explained she did not see any blood and the male did not fall to the ground. stated she had
never heard anyone fire a gun and the sound she heard was just her opinion. then stated
what she heard could have been a rubber bullet. believed the male was stunned but did not
stop moving. then described hearing about three more shots and then about six more shots
which she believed to be rubber bullets.
saw the male go to the ground after hearing the additional shots. stated the male
continued to move around and specifically saw his arm move on the ground and she heard several
more shots. assumed that the officers shot at the male to prevent the male from getting a
weapon. did not actually see a gun or weapon but assumed the male had a weapon.
admitted she was not actually looking for a weapon and stated she was in a state of shock.
saw officers go to the subject and roll the male to the side. possibly saw the male vomit
at that time. thought the male had a heart attack because she did not see any blood from his

body. also described not seeing an entry or exit wounds to the male’s body. stated she
was not sure who responded to do first aid but described them as, “First responders” and stated they
put on gloves and provided aid quickly. saw the male getting CPR but was confused because
she believed it would not be proper to do CPR on a subject who was shot.
stated she believed the officers involved did “Wonderful” and believed the officers saved her
life. also stated she felt safe during the incident and believed if the male had a weapon she
could have been shot. thought the male could have had a weapon in his waistband but was
not sure.
stated she did have video of the incident and she would provide me the video. sent me
a text message with the video included. I emailed the video sent to me to my Department
email. I placed the video onto a CD with this recorded interview and other recorded interviews. I
later booked the CD into the Orange County Sheriff’s Evidence Lockers located in the City of Santa
Ana.

On Saturday, September 25, 2021, was at the beach in the City of Huntington Beach near
where the incident occurred. was with her friend, and her
boyfriend, . just arrived to the area and was standing off to
the side of where the incident happened. and were going to take a photograph
with each other and she saw a male who was acting weird. described the male as being
possibly Hispanic, bald, wearing a white shirt and blue shorts near the boardwalk area of the beach.
described the male as being weird and described him as being “wobbly” or unsteady.
then saw a police officer walking slowly towards the male and believed he was directing the
male to stop doing something. explained she could not hear what was being said but
believed the officer was warning the male. took the photograph with her friends and did not
see what happened until after the photograph.
After the photograph, saw the male had moved about 10 to 15 feet from the boardwalk area
in the sand and was moving his arms around. believed the male was communicating with
the officers because his hands were moving but could not hear what was being said. then
saw the male being hit with what she believed to be pellets because of the sounds she heard which
sounded like pellet guns.
saw the male go down to the ground and reach for what she believed was a gun.
did not actually see a gun at the time. stated she believed the male was attempting to pick
up something to possibly shoot the officers but she did not see what it was. then heard the
sounds of more pellets or gunshots and believed at least two officers were shooting because she
thought it was from different angles. believed the officers shot the male in defense.
did not believe that the male was being shot with bullets because she did not see any blood.
believed there were about four officers initially involved then saw what she described as a
“flood” of officers who responded afterwards. saw two of the officers provide medical aid
which she described as CPR. believed the incident was part of some sort of training
because of how the officers responded and reacted. felt protected by the police and thought

On Saturday, September 25, 2021, was eating at Sandy’s Beach Shack located at 315
Pacific Coast Highway in the City of Huntington Beach. was with her friend,
and two of her friends. was sitting at a table near the boardwalk area
which she describe as being close to where the incident happened.
saw about four officers in a half circle with their guns drawn. saw a male she
described as being Hispanic, bald, wearing a white shirt with dark shorts, white socks and a white
towel or shirt over his hands. saw the male had his hands in front of him, directing his hands
towards the officers but could not see what he was holding because it was covered with the towel or
shirt. stated she could not hear what was being said by the officers or the male.
heard about three or four shots which she described as sounding like a “Firecracker.”
then saw the male fall to the ground. saw the male moving around and digging
around in the sand. believed the male was looking to find what he was holding in his hands.
heard about three or four more shots and ducked down.
When looked up, she saw officers doing chest compressions on the male. also saw
several Lifeguards respond and do chest compressions to the male. saw an ambulance
arrive and take the male away in the ambulance. did not have video of the incident. I told
to call me with any additional details or if she remembered anything else.
I placed the recording onto a CD with another recording and a video related to this case. I later
booked the CD into the Orange County Sheriff’s Evidence Lockers located in the City of Santa Ana.

On Saturday, September 25, 2021, at approximately 1605 hours, I was notified by Orange County
Sheriff’s Department (OCSD) Homicide Sergeant A. Abdelmuti #5428 of an officer involved shooting
(OIS) involving officers from the Huntington Beach Police Department (HBPD) and a deceased male
subject who was later identified as, At approximately 1730 hours, I
arrived at the incident command post located east of the HBPD sub-station, 285 Pacific Coast
Highway in the City of Huntington Beach [County of Orange, State of California]. For additional

Details
At approximately 1905 hours, OCSD Investigator T. Arburua #8815, HBPD Detective J. Lewis #1182
and I spoke with at the HBPD sub-station located at
285 Pacific Coast Highway in the City of Huntington Beach. The interview was conducted reference
the OIS investigation.
The interview was audio recorded with a department issued audio recorder. The following is a
synopsis of the conversation. It is not verbatim, nor necessarily in order of conversation, and is

works for Huntington Surf & Sport (HSS) at 300 Pacific Coast Highway in the City of
Huntington Beach, CA. On Saturday, September 25, 2021 she was assigned to work from 0700 to
1500 hours at the temporary store booth located on the beach just north of HBPD sub-station. She
was still waiting for her replacement and working in the booth when the shooting occurred at
approximately 1510 hours. provided the following statement.
was working at the cash register facing the parking lot and restaurants with her back to
the beach when she glanced over to her left in the direction of the pier. She said nothing drew her
attention to her left, nor did she hear anything, but she just randomly happened to look in that
direction and saw three police officers start shooting. She then quickly looked over at the subject,
later identified as who she is positive his hands were up. She does not believe he had

anything in his hands. She also stated that she looked very quickly and is only positive about his
hands being up but not as positive his hands were empty. Immediately after hearing the shooting,
she dropped down into the booth and stayed down with her co-workers until the incident was over.
She was unable to observe anything while hiding in the booth. She did hear approximately five shots
initially as she dropped down into the booth with a short break, then approximately three more, and
then she thinks maybe a few more. did not recognize and did not see him prior
to the shooting.
Investigator Arburua copied the audio recording of the interview onto a disc and booked it into the
OCSD evidence locker in Santa Ana, CA.
