ISSUE STATEMENT
Over the last few years, we have become increasingly aware that certain "nonprofits" and other
organizations and individuals have been operating in the City, to help provide valuable services
to the City and its residents at little or no cost. These groups such as the Friends of the Library,
Central Park Collaborative, Shipley Nature Center, American Legion, and the Tree Society, to
name a few, often operate in a "quasi agency" relationship with the City, meaning the group or
individual operates with government and private characteristics, performing public functions but
not fully controlled by the City. While the City Council and staff appreciate these free(or low cost)
services that are provided, in many cases there is no written agreement between the City and the
group or individual. In part, not having an agreement can increase liability and lead to unintended
cost and consequences where liability cannot be managed.
We propose an ad hoc committee consisting of three Council Members to work with staff and the
City Attorney to identify all the groups/individuals that are acting on behalf of or in conjunction
with the City, then define the roles and responsibilities to create better lines of
communication and coordination to maximize efficiency of city resources and determine
whether a formal agreement is needed. The committee will return to the City Council within six
months with recommendations.

A) Approve and authorize the Mayor and City Clerk to execute the"License Agreement
between the City of Huntington Beach and G&M GAPCO LLC, to Provide Installation and
Maintenance of Landscaping and Hardscaping Improvements in the Public Right-of-Way"
on State Route 39(Beach Boulevard)for the G&M Convenience Store project(Attachment
2), and instruct the City Clerk to record the agreement with the Orange County recorder;
and,
B) Approve and authorize the Mayor and City Clerk to execute the Landscape
Maintenance Agreement between the City of Huntington Beach and State of California
(Caltrans)for improvements within State Highway Right-of-Way on State Route 39(Beach
Boulevard)for the G&M Convenience Store project(Attachment 3).

Hello,
The issue statement and intention of the proposal is unclear. I sense some unstated intentions,which I wish I did
not need to do-but insufficient explanation requires it.
Support Groups and Organizations should have as much independence from city council as possible. City Council
should not be spending their time on this. Because I oppose formalizing the relationships between friends groups
and the government, I don't think the ad hoc committee should go ahead. The beauty of a friends group is the
informal relationship it has with the city government and the independence granted by that informality. Council
should table this idea.
If support groups want to voluntarily form their own ad hoc committee to decide whether they need a formal
agreement, let them. City Council should focus on their core responsibilities.

With all of the budgetary issues looming over Huntington Beach,the fact that you would choose to fabricate some
ridiculous rationale for forming an"ad-hoc"committee of City Council members to evaluate non-profits is just
another one of your power-grab attempts.
The groups listed in the item include those already attacked and vilified by the lot of you. The"Friends of the
Library",for example,has been attacked repeatedly as you have also attacked the library. I guess the fact that it
generates several hundred thousand dollars a year which is PUT BACK INTO THE LIBRARY means nothing.
If these non-profits feel their relationship to the City needs to have a"formal agreement",I trust they can make that
determination. Considering their contributions to making Huntington Beach culture richer,I,again,question the
rationale for this ad-hoc committee.

I am blown away at your suggestion of an ad hoc committee to oversee volunteers in our
community. I cannot remember a single time where I have read of litigation regarding a
volunteer. So this sounds to me, and many in the community, as retribution against
volunteers who spoke against you.
Strange that it is all coming about after volunteers spoke out about the destructive
proposals at both Central Park and Edison.
Volunteers are the backbone of our community. They give freely of their time and efforts
hour after hour, day after day,week after week, month after month and year after year.
AND now you guys want to stifle them and take away their desire to give back to the
community after all they have given, and over what,they do not agree with you. I am
curious as to how much volunteer time each of you have given to the community of •
volunteers you sit in judgement of?
As we know with this council, no different than the Carr council,that it is a forgone
conclusion. Just as in Carrs day,the public has no say,the closed minds are already
made up. Pretty darn sure this will be a 7-0, unless you have pre planned a couple of
dissenters just to put a facade on the vote.
I say NO to a stifling ad hoc committee don't we have a budget to to balance rather
than wasting time punishing outspoken volunteers? As a conservative, I have never
been more disappointed in those I thought I aligned with. Vote after vote,you prove that
you are not inline with many conservative voices in our city.

An ad hoc committee to familiarize and evaluate various entities that contribute to, support or
involve the city—but are not necessarily governed or compensated by the city—is a good
practice. This can highlight the many advantages the city and its residents gain from
traditional community and volunteer efforts and organizations. It may also reveal where city
governance and outside organizations may overlap or fail to operate in concert.
19. #25-295
A better organized, collaborative association between Charter Cites in California is long
overdue. Done properly such effort could strengthen the unique rights grated to Chater Cities
under the California State Constitution.
Such association may support better local governance such areas as:
• Zoning,Planning and Development
•Law Enforcement
• Municipal election administration
This collaborative association might also serve as a resource for other California cities
attempting to become charter cities or considering such option for their municipalities.

Huntington Beach and its residents.

On the face of it,the current proposal to have formal contracts with non-profits providing services to the
city seems makes sense. However,the timing of this proposal is extremely suspicious.
The two groups singled out by the council members are The Friends of the Shipley Nature Center and the
Friends of the Huntington Beach Library. Both groups have been in operation for decades providing
valuable services and support to the city and its residents.
So why this sudden need to have a contract in place?
Could it be because both of these organizations have taken stands against pet projects of the city
council?
Could it be because The Friends of the Shipley Nature Center opposed Tony Strickland's Symphony of
Flowers proposal?
Could it be because The Friends'of the Huntington Beach Library opposed Casey McKeon's attempt to
privatize the library?
And let's face it, if it were really a serious proposal to protect the city,why would all the deliberations
occur behind closed doors?

Rather than being a serious proposal to protect the city, it looks like this proposal is really an attempt to
punish any organization that stands on principle and opposes any council member's pet project,
Just more of the council's autocratic posturing.

I am a lifelong resident of Huntington Beach and homeowner for 30 years.
I am writing in regard to agenda item 25-313 to form ad hoc committee.Stated intent is to reduce risk and liability due to
non-profit and volunteer organizations operating in quasi-agency" roles.The key phrase in your issue statement is"not
fully controlled by city".
The legal agreements you are proposing seek to exert control over volunteer groups that have been operating in our city
for decades, some longer than you have even been alive: Groups like the Boy Scouts,American Legion and all other non-
profits will be examined examined along with the true targets of your ire- Friends of the Library,CPC and Tree Society to
name a few.
Casey McKeon's embarrassing diatribe from the dais at February 18th council meeting seems to be one catalyst for this
motion. Berating a private citizen in a public forum was clearly a breach of council decorum, but who's gonna pursue
that?
Will these proposed agreements attempt to regulate how groups communicate with public or in any way restrict
messaging? Based on Mr. McKeon's comments that seems to be intent-council didn't get positive social media posts
they hoped for so he lashed out at an individual.
A comment was made in Voice of OC yesterday that city is just looking to these agreements and oversight to "tighten up
operational inefficiencies".
Here's an idea to save on some costs-Stop Getting Sued!The issues regarding SOF show raised by outgoing council
members last October,the public comments presented in person and via supplemental communications,the direct
interaction online with Mr.Williams were all ignored and city is now facing legal action over those exact same points.
$15K on a competent environmental attorney to review this project before proceeding would have saved city a lot of
grief.
