Statement of Issue:
On March 4, 2025, the City Council called for a Special Election to be conducted on June 10, 2025,
for two citizen initiatives. Following that meeting, the Orange Country Registrar of Voters requested
additional clarification regarding the City's request to hold the special election.
Financial Impact:
No fiscal impact.
Recommended Action:
Adopt Resolution No. 2025-27, "A Resolution of the City Council of the City of Huntington Beach,
California, Requesting the Board of Supervisors of the County of Orange to Render Specified
Services to the City Relating to the Conduct of a Special Municipal Election for Two Ballot
Measures Held on Tuesday, June 10, 2025"
Alternative Action(s):
Do not approve, and direct staff accordingly.
Analysis:
On March 4, 2025, the City Council called for a Special Election to be conducted on June 10, 2025,
for two citizen initiatives. The City requested assistance from the Orange County Registrar of Voters
(OCROV) to conduct the special election. OCROV requested additional clarification as to their role in
conducting the special election which is included in the attached Resolution.
Environmental Status:
This action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections
15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change
in the environment) and 15060(c)(3) (the activity is not a project as defined in.Section 15378) of the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON
BEACH, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF
THE COUNTY OF ORANGE TO RENDER SPECIFIED SERVICES TO THE CITY
RELATING TO THE CONDUCT OF A SPECIAL MUNICIPAL ELECTION FOR TWO
BALLOT MEASURES HELD ON TUESDAY, JUNE 10, 2025
WHEREAS, a Special Municipal Election is to be held for two ballot measures in the
City of Huntington Beach, California, on Tuesday, June 10, 2025; and
WHEREAS, for this election involving citizen measures it is necessary for the City to
request services of the County; and
WHEREAS, all necessary expenses in performing these services shall be paid by the City
of Huntington Beach;
WHEREAS,the Orange County Registrar of Voters requested additional clarification
regarding the City's request to conduct the special election.
NOW, THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of
Huntington Beach, as follows:
SECTION 1. That pursuant to the provisions of§ 10002 of the Elections Code of the
State of California,this City Council requests the Board of Supervisors of the County to permit
the County Election Department to conduct the election.
SECTION 2. That the County Election Department is authorized to canvass the returns
of the Special Municipal Election. The election will be held and conducted with the provisions
of law regulating the statewide or special election.
SECTION 3. That the Board of Supervisors is requested to issue instructions to the
County Election Department to take any and all steps necessary for the conducting of the
election.
SECTION 4. That the City shall reimburse the County for services performed when the
work is completed and upon presentation to the City of a properly approved bill.
SECTION 5. That the City Clerk is hereby directed to forward without delay to the
Board of Supervisors and to the County Election Department, each a certified copy of this
Resolution.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions.

WHEREAS,pursuant to authority provided by statute, a petition has been filed with the
legislative body of the City of Huntington Beach, California, signed by more than 10 percent of
the number of registered voters of the city to submit a proposed ordinance relating to selection
and use of library materials; and
WHEREAS,the Orange County Registrar of Voters examined the records of registration
and ascertained that the petition is signed by the requisite number of voters, and has so certified;
and
WHEREAS,the City Council has not voted in favor of the adoption of the ordinance; and
WHEREAS,the City Council is authorized and directed by statute to submit the proposed
ordinance to the voters,
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON
BEACH, CALIFORNIA, DOES RESOLVE,DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to the requirements of the laws of the State of California
relating to charter cities, there is called and ordered to be held in the City of Huntington Beach,
California, on Tuesday, June 10th , 2025, a Special Municipal Election for the purpose of
submitting the following proposed ordinance:

SECTION 3. That the vote requirement for the measure to pass is a majority (50%+l) of
the votes cast.
SECTION 4. That the ballots to be used at the election shall be in form and content as
required by law.
SECTION 5. That the vote centers shall be open at seven o'clock a.m. of the day of the
election and shall remain open continuously from that time until 8:00 o'clock p.m. of the same
day when the vote centers shall be closed,pursuant to Elections Code § 10242, except as
otherwise provided in the Elections Code of the State of California.
SECTION 6. That in all particulars not recited in this resolution,the election shall be held
and conducted as provided by law for holding municipal elections.
SECTION 7. That notice of the time and place of holding the election is given and the
City Clerk is authorized, instructed and directed to give further or additional notice of the
election, in time,form and manner as required by law.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this

A new Section 2.30.090 of Title 2 of the Huntington Beach Municipal Code is added to read as
follows:
2.30.900. Selection and Use of Library Materials
Director and Library Services shall establish policies for the selection and use of library
materials,provided that such policies adopt the following requirements:
A. The Library serves as a center for voluntary inquiry and the dissemination of
information and ideas.
B. Library materials shall not be excluded from the library collection because of the
origin,background, or views of those contributing to the creation of the materials,or
because of the topic addressed by the materials or the views expressed in the materials.
C. Library materials should be provided for the interest, information, and
enlightenment of all people, and should present diverse points of view in thecollection as
a whole.
D. The public has the right to receive access to a range of social,political, aesthetic,
moral,and other ideas and experiences.

2.30.100 Public Operation of Library Services
No public library owned or operated by the City as of March 19, 2024, or
hereafter owned or operated by the City, shall be sold, leased, exchanged or otherwise
transferred or disposed of,nor shall any service provided by the Huntington Beach Public
Library as of March 19, 2024,be operated or managed by a private contractor that
employs library staff to achieve cost savings and/or any proposal that would change the
wholesale management of any Huntington Beach library unless: (1) such service was
outsourced to a private organization or operated pursuant to a managed services
agreement with a private entity during any period from January 1, 2018 through March
19,2024; (2)the City declares a fiscal emergency pursuant to Article XIIIC, Section 2(b)
of the California Constitution; or(3) it is authorized by the affirmative votes of at least a
majority of the total membership of the City Council and by the affirmative vote of at
least a majority of the electors voting on such proposition at a general or special election
at which such proposition is submitted.
Any contract to change the wholesale management or outsource library
management and operations services to a private contractor entered into between March
19,2024 and the adoption of this Section 2.30.100, shall be considered void or shall be
immediately canceled to the extent permitted by law.

I am appalled at the decisions made by this council. First the unanimous decision to destroy our Central Park
because you cannot figure any other way to balance the budget. There are very few citizens who are for this,so it is
clear that you are not on the side of the citizens.
THEN,you turn around and approve,again by a 7-0 vote,to waste a million dollars on an election that could be held
during the general election.We all understand that it is in your best interest to waste the tax payers money simply
because you are counting on a low voter turnout out,that way you can get the result you want. But,again,it is not
in the best interest of the financial stability of the city. Yes,I understand that it comes out of a different fund,a fund
for one time stuff,BUT,that money would be better utilized for something that actually benefits the citizens.
Again,voting for something that does not benefit the citizens or the community.
I am beginning to think,as many citizens are,that this 7-0 is not good for our community. there is no balance and
there is very little common sense. It is as though you 7 have your agenda and it is not an agenda that is for the god
of the community.
You have 2 years to keep up the bad decisions,because on this path,you will not keep the majority. In 2 years our

Statement of Issue:
On January 21, 2025, the City Council adopted Resolution No. 2025-04 accepting the Certificate as
to Verification of Signatures from the Orange County Registrar of Voters for a citizen initiative, "To
Repeal Ordinance No. 4318 by Deleting Huntington Beach Municipal Code Chapter 2.66 -
Community-Parent Guardian Review Board for Procurement of Children's Library materials, and
Adding Section 2.30.090 - Selection and Use of Library Materials." Additionally, the City Council
ordered a "Report of Effect of Proposed Initiative" for the citizen initiative to return for the City
Council's review within 30 days. On February 18, 2025, staff returned to City Council providing the
"Report of Effect of Proposed Initiative" and is now returning to seek direction from the City Council
on how to proceed.
Financial Impact:
Based upon the City Council's recommendation, the estimated cost to submit this initiative to voters
will range from approximately $340,515 to $1,315,402. This cost will be in addition to the amount
already due to the Registrar of Voters to conduct the certified verification of signatures contained in
the petition in the amount of approximately $55,000.
Recommended Action:

Analysis:
On January 21, 2025, the City Council adopted Resolution No. 2025-04 accepting the Certificate as
to Verification of Signatures from the Orange County Registrar of Voters for a citizen initiative, "To
Repeal Ordinance No. 4318 by Deleting Huntington Beach Municipal Code Chapter 2.66 -
Community-Parent Guardian Review Board for Procurement of Children's Library materials, and
Adding Section 2.30.090 - Selection and Use of Library Materials."Additionally, the City Council
ordered a "Report of Effect of Proposed Initiative" for the citizen initiative to return for the City
Council's review within 30 days. On February 18, 2025, staff returned to City Council providing the
"Report of Effect of Proposed Initiative" and is now returning to seek direction from the City Council
on how to proceed.
Cost of the Election:
Should the City Council decide to hold a special election for this initiative, the estimated cost would
range from $1,190,478 to $1,315,405.
The next General Election would be November 3, 2026. Should the City Council elect to submit for
this date, the cost would range from $340,515 to $399,499. If the City Council decides to include the
second citizen initiative ("An Ordinance to Amend the Huntington Beach Municipal Code by Adding
New Section 2.30.100, Entitled "Public Operation of Library Services"), an additional cost of
approximately $8,500 would be incurred for both scenarios.

SECTION 2. That the City Council directs the City Clerk to transmit a copy of the
measure to the City Attorney, unless the organization or salaries of the office of the City
Attorney are affected.
a. The City Attorney shall prepare an impartial analysis of the measure not
exceeding 500 words showing the effect of the measure on the existing law and the operation of
the measure. If the measure affects the organization or salaries of the office of the city attorney,
the city clerk shall prepare the impartial analysis.
b. The analysis shall include a statement indicating whether the measure was placed
on the ballot by a petition signed by the requisite number of voters or by the governing body of
the city.
c. In the event the entire text of the measure is not printed on the ballot, nor in the
voter information portion of the voter information guide,there shall be printed immediately
below the impartial analysis, in no less than 10-point type,the following: "The above statement
is an impartial analysis of Ordinance or Measure_. If you desire a copy of the ordinance or
measure, please call the elections official's office at(insert phone number) and a copy will be
mailed at no cost to you."
d. The impartial analysis shall be filed by the date set by the City Clerk for the filing
of primary arguments.
SECTION 3. That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

HUNTINGTON BEACH PROVIDING FOR THE FILING OF REBUTTAL ARGUMENTS
FOR CITY MEASURES SUBMITTED AT MUNICIPAL ELECTIONS
WHEREAS, § 9282 of the Elections Code of the State of California provides for written
-arguments to be filed in favor of or against city measures not to exceed 300 words in length; and
WHEREAS, § 9285 of the Elections Code of the State of California'authorizes the City
Council,by majority vote, to adopt provisions to provide for the filing of rebuttal arguments for
city measures submitted at municipal elections,

measures. You have managed to slow this entire process down since the petitions were submitted in 2024;sow
doubt as to the veracity of the signatures(falsely)by sending out questionable email surveys and phone calls from
out of state individuals;and used your positions to lie about what these two measures mean to our PUBLIC library.
No doubt tonight you will argue about the cost of a Special Election. If you would stop suing the State of California
over issues you WILL NOT WIN,then,perhaps our Budget forecast wouldn't be so dire and this issue wouldn't have
to wait until 2026.
The fact that you are holding a press conference to lie about pornography in our library now that the ACLU has filed
suit with young HB citizens shows your total disregard for budgetary problems when it suits YOUR agenda. So sad
that all of the press Huntington Beach gets because of your agenda is negative enough to keep people away. When
newspapers like the NY Times write the truth about what's going on at the HB City Council you might want to
consider what your message is doing to tourism.

I would like to join with many in my community to protest the outsourcing of library
operations and the parental review of children's books in the library.
I have lived in Huntington Beach since 1997 and consider the Huntington Beach library
system a stunning resource for our community. Not only is the library beautiful and well
maintained,the selection of resources is outstanding including but not limited to books,
e-books, audio books, movies, music, Maker Space, literacy services and preparation
for US citizenship.
I myself have worked as a volunteer in the Adult and Teen Literacy Services department
both as a tutor and assisting people with use of the learning materials, both books and
computer resources. I was impressed by the competence, knowledge, professionalism,
and kindness of the staff-both paid and volunteer.And also by the dedication of the
students in the adult literacy program.
The library is already working very well. So if it's not broken,why fix it?And so much of
the work is carried out by dedicated volunteers who support library services without
draining the budget.
On the second issue, I find the idea of 21 faceless, nameless unelected persons
overriding the judgement of trained librarians as to which books are appropriate for
children as offensive. If any particular book is troubling to a parent,they can simply not
select that book for their child rather than limiting materials for everyone else.
I used the children's section of the library extensively when my children were young. It
was always a fun outing, bringing home piles of books, sometimes attending a program
by the librarians,watching the fish in the large tank, and always throwing a penny in the
fountain for a wish. I never found any book objectionable.
I would like to have the library operations maintained as they have been and the
permanent dissolution of the 21 parent review board for the children's library.
At least put these issues to a community vote.This certainly seems more fair than
imposing these changes upon all of us when it is clear that so many people are opposed
as evidenced by the petitions you have received.

In light of the severe budgetary concerns facing Huntington Beach,the fiscally responsible thing for city council to
do would have been to adopt both measures.Adopting the measure to repeal the book review committee would also
have avoided potential lawsuits regarding the illegal book review committee.
The options to approve both measures regarding the library petitions were listed on the 2/18/25 agenda as items#22,
25-087 and#23,25-126.Unfortunately the options to approve the measures were not discussed at the 2/18/25
council meeting,were apparently discussed privately among city council members,and have been eliminated from
public view on the current agenda.Your continued lack of transparency is shameful.
I understand peoples'concerns around the availability of pornographic materials in a children's library.However you
have failed to identify any pornographic materials in the HB library and you have succeeded in drawing a great deal
of media attention to Huntington Beach,and to yourselves.It is clear that you fabricated the"pornographic materials
in the children's library"issue and proposed the potential privatization of our library in order to fulfill the your own
political and career agendas.

City Council Members:
I urge you to skip the alternatives of a General Election or a Special Election.
Why?
Because you could simply adopt the Ordinance as contained in the Initiative and rescind the
formation of the Parent-Guardian Book Review Committee (Committee). In doing this (it is
an option),you would save the City the expense of another lawsuit and it would save the City
the cost of an election.
You have had multiple opportunities already to'do this:
1) after the number of signatures were counted by the City Clerk, and meeting a threshold,the
forms were sent to the County Registrar of Voters(OC ROV), or
2)10 days after the OC ROV notified the current City Clerk that the Initiative volunteers
obtained the minimum number of signatures, or,
3) after the "study" was prepared as to the cost of a general election or a special election, or,
4) after the "survey" was repeatedly emailed to people that presumably did not yield your
desired response, and 5) finally, at the 2/18/2025 City Council meeting,you had yet another
opportunity to adopt the Ordinance as stated in the Initiative.
You have had enough time to evaluate and decide what is best for the City and its budget, so
do the right thing for the City and adopt the Initiative's Ordinance rescinding the formation of
the Committee.
