RESOLUTION NO. 2025-64
A RESOLUTION QF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH IN SUPPORT OF IMMEDIATE
ACTION TO ENSURE A LEGALLY VALID AND TRANSPARENT
2026 GENERAL ELECTION
WHEREAS, Free and fair elections form the cornerstone of the Republic of the United
States. As stated in Reynolds v. Sims (377 U.S. 533, 1964), "the right of suffrage can be denied
by a debasement or dilution of the right of a citizen's vote just as effectively as by wholly
prohibiting the free exercise of the franchise. "; and
Election officials bear the responsibility to ensure elections remain accurate and free from
manipulation. In In re Coy (127 U.S. 731, 1888), the United States Supreme Court affirmed that
election officials must strictly adhere to federal and state laws governing process, defining
election misconduct as follows: "The evil intent consists in disobedience to the law."; and
Our constitutional system of representative government relies on four fundamental
principles for validity in our elections:
1. Accurate Voter Rolls: Election officials must maintain voter registration lists that are
current and correct, which includes facilitating the registration of eligible citizens as
well as preventing the registration of noncitizens, fictitious names, and ineligible
applicants (National Voter Registration Act, 1993).
2. Eligible Votes Only: Election officials must only count votes case by eligible citizen
voters (U.S. Constitution, Fourteenth Amendment, Section 2).
3. Vote Reconciliation: Election officials must ensure that the number of votes counted
matches the number of participating voters.
4. System Accuracy: Voting systems must achieve accuracy standards set by Congress
by limiting ballot counting errors to no more than one error per 125,000 ballots (Help
America Vote Act, 2002). Election officials must substantiate assertions of accurate
outcomes with transparent records; and
Unite 4 Freedom conducted an independent audit of the California 2024 General
Election and uncovered alarming irregularities:
• 9,539,574 material errors and omissions in the voter registration database.
• 5,588,594 votes improperly counted from these ineligible or uncertain registrants.
• 77,085 excess votes counted beyond the number of voters who participated, with
no explanation for their origin.
• 5,588,484 voting violations exceeding the legal error threshold, where only 130
errors were allowed under federal law.
The audit findings indicate severe violations of state and federal election laws and
potential fraudulent certification; and
RESOLUTION NO. 2025-64
Election accuracy is defined as the ability to capture and report voter selections without
error. By definition, only eligible citizens are voters. Election officials violate civil rights,
undermine public trust, and jeopardize national security when they certify an election that fails
to reach this standard; and
The irregularities in the official records of the 2024 General Election call into question
the validity of the election,threatening the guaranteed protection of our natural rights under a
republican form of government. This emergency inflicts immeasurable harm upon our families,
our way of life, and the fabric of these United States. It raises the specter of false representation
in US Congress and state governments—an allegation that election officials are currently unable
to disprove,
NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby
resolve as follows:
SECTION 1. Immediate action is necessary to ensure a legally valid and transparent
2026 General Election by implementing the following measures:
a. Infrastructure Compliance: Election officials must ensure that all voting
systems meet Federal Information Security Modernization Act (FISMA) standards and maintain
compliance throughout the election process; and
b. Voter Verification: Verify that all voters are legally eligible U.S. citizens
before their votes are counted. If a voter's eligibility is in question, their vote must be held as
provisional until legally verified; and
c. Ballot Security: Enforce all issued and counted ballots to comply with
robust chain-of-custody protocols to secure ballots from forgery,tampering, coercion,
destruction, or injection; and
d. Accurate Counts: Ensure all voted ballots are received, and every valid
ballot is accurately counted, with any material questions resolved through unlawful adjudication
procedures and oversight; and
e. Proven Outcomes: Election officials must investigate and resolve, or if
necessary, re-administer any election that cannot be proven accurate and compliant. In every
jurisdiction, officials must provide records substantiating election and initiative results to
citizens. Additionally, officials must securely store all ballots and operational records—
including electronic records—to protect them for auditing purposes from tampering or alteration.
SECTION 2. That the Huntington Beach City Council calls upon the state of California
and federal legislators, law enforcement agencies, prosecutors,judges, and election boards to
uphold these principals, ensure legal compliance and restore public confidence in our electoral
system.

ISSUE STATEMENT
Free and fair elections are the cornerstone of representative democracy, ensuring that government
remains accountable to the people it serves. California election law provides the framework that
protects voter access, ballot integrity, and transparent administration, but ongoing scrutiny is
necessary to maintain public trust. When voters believe their voices are heard and their ballots are
secure, confidence in the legitimacy of outcomes grows. Conversely, any perception of unfairness—
whether in how votes are cast, counted, or districts are drawn—undermines faith in the process.
A critical component of election integrity is the assurance that voting systems remain transparent,
secure, and resistant to manipulation. California has enacted laws aimed at balancing access with
accountability, such as requiring voter verification and mandating audits of election results. These
safeguards are vital to reassure citizens that elections are conducted with accuracy and fairness.At
the same time,the state must guard against measures that unintentionally weaken oversight or create
opportunities for errors, as even minor lapses can erode trust in outcomes.
Equally important is the role of the California Citizens Redistricting Commission,which was created to
draw legislative and congressional district maps independently of lawmakers.This body was designed
to prevent gerrymandering and promote fair representation.
We need to strengthen public confidence and safeguard the principle of free and fair elections by
upholding transparent election laws and maintain vigilance over redistricting.
RECOMMENDED ACTION
Adopt Resolution No.2025-64, "A Resolution of the City Council of the City of Huntington Beach in
Support of Immediate Action to Ensure a Legally Valid and Transparent 2026 General Election."

unsubstantiated and unaudited data by a group of conspiracy
theorists. I would expect people like you to place credibility to this
group entitled Unite4Freedom.
If you can read, please review the Is Voting Integrity Alive
and Well in Orange County? Jan 1, 2025. Page 19 states;
FINDINGS:
In accordance with California Penal Code Sections 933 and 933.05,
the Grand Jury requires responses from each agency affected by the
findings presented in this section. The responses were submitted to
the Presiding Judge of the Superior Court.
1. There was no evidence of fraud or election interference
ascertained in the 2024 general election in Orange County.
2. Voting in Orange County is fair, secure, and transparent.
3. The ROV communications and outreach programs promote
transparency and public confidence in the voting process. Orange
County eligible voters can feel secure in
knowing that the ROV provided an election of the highest recognized
standards.
In addition, I attended a meeting on May 15, 2024 at the ROV in which
OC District attorney Todd Spitzer said, and I quote "Many people talk
about voter fraud, but don't provide evidence to support their
theories".
Huntington Beach has fallen under the control of individuals who
stand for neither truth nor the best of our community. But we believe
in something better. As Bruce Springsteen sings in "Land of Hope
and Dreams," there is a vision of a place where everyone belongs,
where freedom and diversity thrive, and where community means
opportunity and respect for all. That is the Huntington Beach we are
fighting to restore—a city rooted in fairness, compassion, and shared
progress. Together, we will reclaim our town and build a future
worthy of hope and dreams.
Your so-called leadership, combined with the reckless insults you
have spewed on hot mics, stands for the most toxic stew of ignorance

Dear Mayor Pat Burns and City Council members,
I am writing in opposition to the wording of Resolution No. 2025-64, agenda item 18.
Although I appreciate your interest in ensuring that elections are safe and secure in Huntington
Beach, your use of data from the highly partisan group, Unite 4 Freedom, is misleading. You
state that Unite 4 Freedom is an "independent" group, but that is inaccurate. Although their
website claims they are non-partisan, their founders are clearly right-wing activists who
pushed Trump's "Stop the Steal" movement regarding the 2020 presidential election. Unite 4
Freedom has tried to sue several states for election fraud (even Texas), but has been
unsuccessful in all cases. They claim to be experts in election systems, but they are not.
By using their weak data as support for the resolution, you are spreading misinformation to
voters. There are no court filings, audits, or government reports affirming the figures you cite.
Your figures are made up by partisan volunteers who donate time and money to this
organization, which is based in a strip mall in Missouri. This reminds me of the tobacco
industry years ago relying on data from so-called "experts" on the link between smoking and
health!
Here are some specific concerns related to the data you included in the resolution:
California has approximately 22 million registered voters. A claim of over 9 million
"material errors and omissions" in registration suggests nearly half the voter rolls are flawed,
which is an extraordinary claim that requires proof. Without transparent methodology or
forensic audit data, numbers of that magnitude are implausible.
To validate your claim of 5,588,594 improperly counted votes, you would need to show
ballot-by-ballot audits, chain-of-custody logs, cross checks with voter intention, reconciliation
of vote totals, etc. There are no credible post-election audits that yield numbers remotely close
to 5.5+million improper votes.
Regarding 77,085 excess votes,you would need a binding ledger of"number of voters who
participated"and tie each counted vote to a participating voter record. There is no audit or
court finding showing unexplained surplus votes of that magnitude in California.
Please provide the source of the data and methodology that Unite 4 Freedom used to obtain
these results. Were these results vetted by an objective, non-partisan third party? Where were
the results published besides right-wing podcasts and social media platforms?
Finally, it's important to note that a comprehensive review of the 2024 general election in
Orange County found no evidence of fraud or interference, according to a recent 25-page
report made by the Orange County Grand Jury, and our voting system was rated one of the
best in the nation for integrity and security. It currently maintains ISO 9001:2015 certification,
which meets international standards for organizational efficiency, customer service, and
regulatory compliance. This audit process was conducted by a third-party ISO 9001 specialist.
We are fortunate to have such a safe and secure election system in Orange County!

Dear Mayor Burns and Members of the City Council,
I am deeply concerned about the resolution proposed in Item 18. It includes false and
misleading claims that millions of omissions and errors exist in voting records. The
source of these claims is United Sovereign Americans, Inc. and its Unite 4 Freedom
program —the same organization presenting tonight.
The resolution refers to an "audit" of voter records. However, this is not a legitimate
audit. A true audit follows a transparent, documented, and verifiable methodology and
is reported to the auditee. None of that applies here.
The methods used by United Sovereign Americans are seriously flawed. According to
Protect Democracy, they:
• Use only names and birth years to claim "duplicate registrations," ignoring reliable
identifiers like driver's license or Social Security numbers.
• Label legitimate addresses as "invalid" for trivial reasons —such as missing
apartment numbers or punctuation.
• Flag voter registrations submitted on Sundays or holidays as "problematic," even
though online systems process applications automatically.
Protect Democracy concludes that this organization's data and methods are
unreliable, yet this resolution appears to rely on that information. Why are you
promoting these lies?
The Orange County Grand Jury, Registrar of Voters, and District Attorney have
confirmed that our local election systems are secure, transparent, and professionally
managed. In fact, the Registrar's office has requested a copy of United Sovereign
Americans' "study" and has not received it— a clear breach of standard audit
practice.
I urge the Council to reject this resolution and to rely instead on credible, transparent
sources — including the findings of the Orange County Grand Jury, which reaffirmed
the integrity of our local election systems.

Agenda Item No.18 (25-795) Resolution in Support of
Immediate Action to Ensure Valid 2025 Election
Once again more performance politics, this time to reinforce
the ongoing MAGA GOP efforts to sow doubt among v:'ters
about the security and transparency of our election process.
It is a goal of the MAGA GOP to undermine public confidence
in the voting process by constantly casting doubt on the
process itself.
To this effort, our council now invites "Unite For Freedom", a
member of the far- right cottage industry of election deniers,
to present its own unaudited election analysis using its own
questionable methodology.
Only MAGA believes in bogus election stories. A thorough
investigation by the Orange County Grand Jury found that
there was no fraud or election interference in the 2024
general election and that voting in Orange County is fair,
secure and transparent
Vote "NO" on this unnecessary time-wasting item.

I have no doubt that all of you hold your offices through appropriate appointment or through
appropriate election. I have read Unite 4's website and its mission to alert the public to
inaccuracies in elections. Are you suggesting that there were inaccuracies in the elections you
won? Additionally your resolution calls upon federal,state and county authorities to do their

copy of the studies, including their methodology, conducted by United Sovereign
Americans/Unite4Freedom. They have posted the results of their studies on their

"Their claim that about 20% of voters are non-existent or not eligible does not align
with Orange County Registrar of Voters data that shows 99.9% of the 1.9 million
active registered voters in Orange County have provided proof of identity in order to
vote in federal elections.

under penalty of perjury that they are eligible to vote. Pursuant to state law, they are

Unite4Freedom is a program of United Sovereign Americans, Inc., a 501(c)(4)
organization based in Missouri. Contributions are not tax-deductible. This
organization promotes election denial and conspiracy theories, primarily by suing
jurisdictions for alleged election fraud and inaccuracies in voter registration and ballot
counts. They claim large-scale errors without providing verifiable evidence.
While they reference nine lawsuits alleging election fraud, none have been settled,
and California is not among them. Their data and conclusions are presented without
transparency regarding their methodology, and the group's analyses are deeply
flawed. Their methods include:
• Using only names and birth years to claim "duplicate registrations," ignoring reliable
identifiers such as driver's license or Social Security numbers.
• Labeling addresses as "invalid" for trivial reasons such as missing apartment
numbers or non-alphabetical characters (like apostrophes), even when the addresses
are legitimate.
• Flagging voter registration dates that fall on Sundays or holidays as "problematic,"
even though online registration systems can process applications automatically on
those dates.
IN CONCLUSION
Protect Democracy, a non-partisan, anti-authoritarian group, concludes that United
Sovereign Americans' data and methodology are unreliable, yet our City Council
members seem ready to base policy discussions and possibly a resolution on
Unite4Freedom's information.
Meanwhile, Supervisor Janet Nguyen brags about co-authoring a measure that
requires the Orange County Registrar of Voters to investigate whether its voter rolls
contain animals by comparing thousands of pet licenses to the names and addresses
of their potential owners. This follows recent criminal charges against a woman who
registered her dog to vote and cast ballots in two elections (though the second one
was rejected). What a massive waste of staff time and tax dollars. How many people
are stupid enough to register their pets to vote, plus this woman has now been
charged with five felonies. Are there really enough dogs voting fraudulently to skew
an election? What a joke.

You are supposed to represent the people of Huntington Beach, the majority of whom
are not MAGA. You seem to exist in a silo of skewed and incomplete information
selected in a highly partisan manner by Fox and Newsmax, which in many ways does
not truly reflect reality.
You need to broaden your horizons. Perhaps even call the Orange County Registrar
of Voters (714-567-7600) to request a behind-the-scenes tour of the facility and
explanation of the process to see what actually goes on there, rather than inviting a
conspiracy theory group to give a biased and inaccurate presentation at a City
Council meeting.
That's right up there with promoting the Patriot Academy's Biblical Constitution
classes, rent free, in our public library. And proposing a Charlie Kirk memorial. And
putting MAGA on the library's 50th anniversary plaque. And attacking our public
library and its librarians. And wasting millions of our taxpayer dollars on endless
lawsuits against the State.
If our elections are so suspect that you need to require voter ID right here in
Huntington Beach, how did the "Fab 4" win in 2022 and the "HB 3" win in 2024? We
need an investigation!!!
You people are so transparent we can see right through you.

Please don't waste any more of the taxpayer's money on frivolous nonsense. I read
this agenda item and was looking for the background materials to understand the
need for this, but there was none. There was only Mayor Burns's statement agreeing
with unfounded numbers stated by a biased organization. But I dug a little further, I
went to the Unite 4 Freedom website to try to understand the issue.
The Unite 4 Freedom website cites some alarming numbers, claiming almost 8.5
million apparently illegal votes in the 2022 national election. The problem is, when
you look at the webpage entitled, "reports", there is no actual source data. It is just
these huge numbers stated as fact. If there really were these kinds of discrepancies
in our elections, you council members should be very concerned about the legitimacy
of your own elections. But, you're not!
Even though you council members are not concerned about the legitimacy of your
own elections, the only source I see questioning elections is from this Council, using
bogus means such as this resolution.
Finally, I strongly encourage you to take a free tour of the OC Registrar of Voters
office. Meet with Registrar Bob Page. Ask him to clarify all your concerns. I think
you will find that you were, indeed, legitimately elected, just like all other electeds in
our county and state. Maybe then, you'll stop all this fear-mongering.

The Orange County Grand Jury conducted a study in 2024-2025 on the Orange County
Registrar of Voters (OCROV) in response to concerns about voter integrity. The Grand Jury
found that "every aspect of the election process—from voter registration and ballot counting to
post-election audits and the final certification of the votes—adheres to the highest standards of

In this report,the Grand Jury identifies the concern, states their methodology, states their
findings, and they include five pages of references. By comparison, Unite4Freedom does not
show methodology or references on their media. Unite4Freedom does show their lawsuits
(https://unite4freedom.com/litigation/) and it shows that eight out of nine lawsuits have been
dismissed. An 88%failure rating does not inspire confidence in a company. Allegations of
election fraud are serious, and they deserve more transparency and research vigor than
Unite4Freedom is offering.
