On 12-27-21 at approximately 1223 hours, I responded to the area of 7th/Pacific Coast Hwy regarding a call of
an assault with a deadly weapon just occurred. I heard dispatch advise a bicyclist had been shot. It was
reported there was a male in a grey hoodie pointing a gun at the person on the ground. I responded with lights
and siren from the area of Gothard/Ellis to the area of PCH/Warner. At that time, I activated my department
issued body worn camera. I heard dispatch advise the suspect possibly ran towards Warner. I drove east on N.
Pacific and then north on 4th towards Warner when an officer involved shooting occurred. The Orange
County Sheriff`s Department responded to the location and conducted an investigation on the officer involved
shooting.
I responded to the victim`s location at 6th/N. Pacific. The victim, was laying on the grass being
treated by HBFD paramedics. s wife, was in the area talking to paramedics. I
spoke with who told me the following:
said she and were riding their bikes west on S. Pacific. was on her left side. She
saw the suspect come out from the parking spaces on the north side of the street near the disabled parking. He
had his hands in his sweatshirt pockets. He then pulled out his right hand and had something in it. She realized
it was a gun as they rode by and he pointed it at them. As they passed him, she said he fired approximately
five to six shots west towards them. Her husband said he thought he had been shot and went down on the
green belt west of 7th St. She pointed at his bike that was on the grass and said he went down in that location.

The suspect stood in the street near the restrooms and pointed the gun at She said the suspect did not
say anything, but stood there for approximately five minutes pointing the gun at said she
yelled at him several times to put the gun down. It appeared the suspect was focused on because he
was down. took several photos of the suspect standing in the street pointing the gun in s
direction. Using my department issued iPhone, I took a screen shot of the photos using Evidence.com and
uploaded them to Evidence.com. The original photos were obtained by Detective MCCOLOM.
The suspect began coming closer to and said he was "marching." got up and
moved to cover behind a large tree on the greenbelt. The suspect began walking west on S. Pacific. A
bystander yelled at to get out of the way because the suspect was moving in her direction.

I then spoke with a resident in the area, who told me the following:
was inside her apartment when she heard loud voices outside. She went to the small south facing
rectangular window and looked outside through the screen. She saw a white Mercedes with a male in the
driver`s seat. There was a male standing outside the front driver`s door of the Mercedes. The male in the
driver`s seat was yelling it was his car and for the male to get out of there. It did not appear to her that they
knew each other. She said the male walked to the front of the Mercedes and just stood there looking at the
vehicle. The Mercedes backed up and drove off. She said the male continued to stand there and she said he
looked out of it. There were maintenance people that finished cleaning the restrooms and had left and the male
was still standing there.
s boyfriend, looked through the window and said the male looked "really
wasted" and then said he had a gun. At that point, grabbed her dogs and went out into the backyard.
She heard about five shots and heard say the male shot someone. remained in the
backyard and called 911. told dispatch it was at N. PACIFIC and 7th St. in Sunset Beach, someone
has been hit and the guy has a gun and shot someone. never went outside. Based on what she saw
outside the window, she described the suspect as:
White male, possibly Hispanic, in his 30`s, unshaven, longer dark hair, approximately 5`8"-5`9", 145 lbs
wearing a grey hoodie up over his head. She was unable to provide any other clothing description.

firearm, which ultimately led to an officer involved shooting. Upon arrival, I assisted with scene security and

summary of their statements. It is important to note that my interviews were captured on Sgt. Dan Quidort`s

I first spoke with who resides at . stated at approximately
1200 hours, he was sitting on his couch inside of his residence. He heard what he believed to be
approximately three gunshots. He opened the front door of his residence and observed, who he described as a
Hispanic male, approximately 50 years old, bald, wearing a gray sweatshirt, blue jeans, and white shoes
walking southbound on S Pacific St. did not remember if there was anything in the subjects hands.
described the subject`s actions as bizarre in the way he walked. He described the subject waving or
flailing his hands around in an odd manner as he walked. The subject was not walking with anyone at the time
and did not see anyone else out in the area. The subject continued walking southbound and ultimately out of

On 12/27/21, I was working as a Police Detective, in the General Investigations Unit, of the Investigations
Bureau, for the Huntington Beach Police Department.
At approximately 1238 hours, Detective T. Gonzalez and I were monitoring the police radio (Green 1) when
we heard an assault with a deadly weapon just occurred, and a victim sustained a gunshot wound in the area of
7th St and S. Pacific of Sunset Beach. We responded to the area.
Upon arrival, I parked by department vehicle near the area of 5th St and Pacific Coast Highway in Sunset
Beach. As I walked west, I noticed several officers in the area of 7th St and S. Pacific and began walking
toward them.
When I arrived in the area, I noticed several bullet casing on the ground near marked designated parking spots
across from 17001 S. Pacific and 16995 S. Pacific. Several Huntington Beach Patrol Officers on scene told me
witnesses told them this is where a shooting occurred. I then began coordinating and maintaining the crime
scene. When members of the Orange County Crime Lab arrived, they assumed responsibility of the crime
scene and collected evidence.

to the area. We walked to the area of S. Pacific Ave. and 3rd St. where the officer involved shooting occurred.
I arrived at that scene at approximately 1238 hours and advised HBPD dispatch over the police radio.
Detective R. Gonzales left to go to the initial crime scene in the area of 7th St. and S. Pacific Ave. I saw that
the suspect was lying on the ground in the middle of the roadway to the front of 17125 S. Pacific Ave. There
were several HBPD officers around him rendering medical aid. I could also see that HBFD paramedics were
arriving at the scene and parking on N. Pacific Ave. I saw HBPD patrol unit 849 stopped facing westbound in
the middle of the roadway to the front of 17131 S. Pacific Ave. The overhead red and blue lights were
flashing and the driver`s door was open. Officer Jamison #3257 was standing near his patrol vehicle (849)
speaking with Sergeant Munoz #1128.
I was advised that Officer Jamison was the only officer that engaged the suspect in gunfire and that
approximately six (6) to eight (8) rounds were fired at the armed suspect. I asked where Officer Jamison was
standing when he fired his weapon and was told he was standing behind the driver`s door of patrol unit 849. I
asked if the suspect fired any rounds in the area of this scene, and Officer Jamison told me that he was not
sure. Officer Jamison then said, "If the suspect did fire a round, this is where it most likely hit." When he said
this, Officer Jamison pointed to an area on the push bumper of his patrol unit. The push bumper mounted to
the front of the patrol unit has two rails that curve around the lower portion of the front bumper on either side
of the vehicle, and stop at the beginning of the wheel wells. The rails are metal, but are coated with a plastic
material. The rails on the driver`s side of the patrol unit, below the headlight, had damage consistent with a
bullet strike. The lower rail had a deep indentation and a portion of plastic was peeling up. It appeared that a
projectile struck the lower rail and ricocheted upward. I then examined the top rail of the push bumper. It
should be noted that the bottom rail and top rail of the push bumper are only separated by approximately two
(2) inches. I could see a small portion of plastic was peeled up near the upper portion of the top rail. There
was also a light colored graze mark consistent with a projectile ricocheting off of it.
By this time, paramedics were treating the suspect and they wheeled him on a gurney to an awaiting
ambulance (HBFD ET-241). I walked back towards the area where the suspect was being treated initially and
I could see that there was a small handgun, similar to a subcompact Glock, on the ground. I visually estimated
the distance between Officer Jamison`s patrol vehicle and the area the suspect was being treated to be about
15 yards (45 feet). While standing in the middle of S. Pacific Ave. facing Officer Jamison`s patrol unit, I
could see what appeared to be a ricochet mark on the ground approximately 10 yards (30 feet) in front of the
vehicle. As I examined the ground more closely, I could see that the asphalt had a shallow gouge taken out of
it and it was lighter than the surrounding area, as if it had been recently scraped. The direction of the shallow
gouge in the roadway lined up with the strike to the lower rail of the front push bumper of Officer Jamison`s
patrol vehicle. It appears that the suspect fired his weapon at some point after encountering Officer Jamison
and the bullet ricocheted off the ground, struck the lower rail of the push bumper, then ricocheted upward
striking the upper rail of the push bumper. After ricocheting off the upper rail of the push bumper, it is
unknown where the bullet came to rest. I marked the area on the ground where the bullet struck using a field
interview card.
S. Pacific Ave. is a one-way street and the passenger side of Officer Jamison`s patrol vehicle was only a few
feet from the north curb. There is a grass area (greenbelt) that separates S. Pacific Ave. and N. Pacific Ave.
In the grass area on the passenger side of the Officer Jamison`s patrol vehicle, I located eight (8) shell casings
that were silver in color. The duty rounds used by HBPD officers have shell casings that are silver in color. I
marked the location of the shell casings using field interview cards.
It should be noted that rain and windy conditions were forecasted, and since it was unknown when
investigators from the Orange County Sheriff`s Department would arrive on the scene, Officer Ayala #2209

pointed out the bullet strike on the ground, the bullet strike on the push bumper, and where the bullet casings

Tharp #2252 assisted me with guarding the crime scene at S. Pacific Ave. and 3rd St. throughout the afternoon
and evening.
At approximately 0000 hours on 12-28-21, Sergeant Marsh #1229 advised that I could leave the scene since
the Orange County Sheriff`s Department Investigators were still processing it. Officer Tharp remained at the
scene with the crime scene log.

A small hole, which appeared to be an impact from a bullet, was found in the garage of 17001 South Pacific
Avenue. Detective Eskes gained consent from the property owner to enter the location. Once inside the
garage, cardboard boxes were found stacked along the south wall. Adjacent to, and west of the boxes was a
large refrigerator. A portion of the boxes, about three to four feet from the ground, were damaged. A
projectile was found on the ground, between the boxes and the refrigerator. Refer to photos for details.
The perimeter of 17005 South Pacific Avenue was surrounded by a chain link fence with a green tarp covering
it. Two small holes, which appeared to be an impact from a bullet, were found in the green tarp. One
fragment was found in the metal portion of the fence near the northeast corner of the property. Two more
fragments were found on the ground below a metal pipe attached to the structure, also near the northeast
portion of the property.
A small hole, which appeared to be an impact from a bullet, was found on the garage of 17005 South Pacific
Avenue. Detective K. Garcia gained consent from the property owner to enter the location. Refer to his report
for details. Inside the garage of that location was a gray plastic garden hose container located near the south
end of the garage. A small hole, which appeared to be an impact from a bullet, was found on this container.
A projectile was found in the wall, behind the container. Refer to photos for details.
Orange County Crime Lab Personnel processed this scene and collected the evidence. Refer to their report
under for details.
Victim S bicycle was found on the ground of the greenbelt near the southeast corner of South Pacific
Avenue and 8th Street, across from 17011 South Pacific Avenue. S bicycle was found on the
curb, across from 17015 South Pacific Avenue. Officer Dexter eventually collected these bicycles and booked
them into property at the Huntington Beach Police Station.
SCENE 2: This scene is located in the area of the intersection of South Pacific Avenue and 8th Street,
between 17031 and 17071 South Pacific Avenue.
This scene was maintained by Officer Subia #1221. He was eventually relieved by Officer Connor #2245.

pen", a white bottle, and spent round (projectile), and a set of keys. The set of keys included a vehicle key to a
Mazda, which was later determined to belong to These keys were recovered by Detective Eskes.

On 12/28/21, at approximately 0700 hours, I arrived at UCI Medical Center to relieve Officer GILES #2237
who was monitoring the suspect, later identified as who being treated at the hospital. I
monitored who was intubated and sedated while I monitored him. did not made any
statements while I monitored him. I monitored until approximately 1500 hours on 12/28/21, when I
was relieved by Officer LUKEHART #1230.
While at the hospital Officer GILES informed me s underwear had been collected and placed in a brown
paper bag to be picked up by the OCSD for Evidence purposes.
At approximately 0714 hours, OCSD Criminalist C. COVERT #10413, arrived at the hospital photographed
and took possession of s underwear for evidence purposes.
I had no further involvement.

SUSPECT clothing description of a gray hooded sweater and blue jeans. stated that SUSPECT was
wearing white shoes, and declared that one shoe left at 6th and S. Pacific to belong to SUSPECT. She stated
that she could not identify SUSPECT if seen again.

Evidence.com.
For the duration of the investigation, I remained at the corner of 6th and S. Pacific for the purpose of
monitoring items of evidentiary value. The items located were a white shoe, black baseball cap, car keys, and
a fired bullet. I was relieved by Officer Connor #2245 prior to the items being collected.
I cleared the scene and conducted no further investigation.

Pacific Avenue. She said they got out of their car and she heard 5-6 "pops" before hearing a man yell, "I`ve
been shot! Call 911!" said she saw that man (victim) on the ground and believed he had been with
a woman who she saw hiding behind a car. said she and got back into their car and she
backed out, turning up the nearest side street toward PCH to seek shelter. She said she drove out onto PCH,
then made a right on another side street back toward N. Pacific in order to see what was happening. She said
she saw a male in a grey sweatshirt running awkwardly on S. Pacific and she saw him fall to the ground. She
did not yet see police in the area at that time. She said she saw a police vehicle arriving, but she drove out of
the area and did not witness any interaction between the suspect and the police.
