City of Huntington Beach The city needs to reconsider its legal posture and stop paying for lawsuits.The city has spent over$4,000,000 in housing law suits since 2021. The Kennedy Commission sued the city over Affordable Housing and was awarded $3,531,000. Now the state of California is suing over the housing element and the city faces over$1,060,000 in fines. Then the sued the State of California to Challenge to Mandates which cost thousands of dollars. If the city started complying with state policy back in 2015 it would be able to meet the housing goals and save money. Unnecessary culture war-related lawsuits are also bankrupting this city.The city council spent$400,000 to pass its idiosyncratic Charter Amendments A,B &C in 2024 and other legislative actions.Then some of these were struck down as illegal. The State of California sued the city over voter ID/ Measure A, costing the city$300,000.And the state sued over the City's violation of the SAFETY Act which protects LGBTQ students. The city continues to fight the State of California, SB54 law or Sanctuary City mandate. In addition, the city fought long and hard against the Southwest Voters Registration Education Project law suit for district voting, instead of coming up with a resolution that would not cost the city millions of dollars in legal fees. Finally,the city's book review committee was challenged by the ACLU, costing the city$960,000. And then the city rushed to have the June Special Election for Measures A& B which cost about $1,200,000. Stop the culture war policies and litigation. Also lawsuits that have their origin in cronyism have added to the city's debt. When employees of Michael Gates sued over Employment Discrimination, the city hired the law firm that employed a previous employee of Gates and paid that firm over$1.5 million for a case that never went to trial.That case settled for($4,000,000). Weird. The city paid Code Four over the Pacific Airshow a monetary settlement of$7,000,000 and a sweet 30-year payout of about$30,000,000 in fees and service waivers.And because the city was so secretive about the deal, it had to pay a private citizen's legal fees because it would not disclosure the settlement Terms$182,000. We are still waiting for fees and penalties from the State Auditor on the matter. The feeds related to the Protect HB law suit over Tony Strickland's sweet heart deal for the Symphony of Flowers are still unknown. How many crony-related law suits until the city is bankrupt. The department expenses include staff, prosecution services, and misc. expenses. In 2022 the MAGA majority took power and increased legal expenditures in 2023. Note from 2021 to 2024,the city attorney dept. budget increases by 72%and new positions are added to handle the litigation. We encourage its prompt implementation. Several forms of ranked-choice voting (RCV) are used by San Francisco and several Alameda County cities, for over two decades in San Francisco's case; recently by Redondo Beach, and Irvine is considering it. The at-large ranked-choice method ordered by the Court would allow nearly all voters to elect a candidate of their choice, from plenty of options. There is no need to divide the city with boundaries manipulated toward predefined outcomes, with noble intent or otherwise. With 7-seat RCV, voters rank their candidates on the ballot. Votes initially count for the first choice. A candidate needs 1/8 of the votes plus one vote to win; this way, a majority of the council represents a majority of voters. For any candidates earning more than that, the extra votes count for the next valid choice on the ballot. Then, the last-place candidate is eliminated, with votes going to lower choices. The process repeats until all winners are determined. Ranking candidates would be new to Orange County voters. We can help the city and county with voter education, as can Cal RCV, FairVote, and the RCV Resource Center. Redondo Beach conducted its recent RCV election using the same voting machines that Orange County uses; their voter education materials could apply with minor edits. We have started a blog with educational information at: https://cfer.org/huntington-beach So far, this features a video explaining the counting process, and interactive charts showing counts of 7-seat RCV elections. This grant money would be spent on much-needed books for the library,which benefits the community at large. It doesn't make sense to fret over the space they occupy at the library(gift shop/used books), since it's those two entities that not only raise significant funds for our city,they are beloved by residents. Plus FOTL is willing to pay rent, so why don't you work out an acceptable MOU? If you're so concerned about paying expensive legal fees,why do you keep pursuing litigation that can't win in the city's favor, whether it involves the library, housing, sanctuary city, etc? You keep proposing ways to make money for the city, such as ending fluoridation of drinking water, merchandising/branding HB, selling liquor at the Sports Complex, Festival of Flowers, etc but you refuse to take a generous donation from a group that has supported the city for decades?You drag out costly lawsuits that can't be won? I urge you to be more fiscally responsible when making decisions that impact Huntington Beach citizens. You are not a political organization, nor is the Friends of the HB Library. I am not surprised at our losses given the makeup of the courts in a one-party state and the reluctance of federal courts to wade into city-state controversies. I support the effort nonetheless as a high priority fight for principle and for our quality of life. I suggest filing a compliant Housing Element under protest, continuing to assert our position as correct. I also suggest that council members who are required to sign the finding or overriding interest under duress file their own challenges to this violation of their first amendment rights as individuals in federal court. It is one thing for the federal courts to ignore these rights if they are seen as the rights of a city against a state and another thing if they are seen as the rights of individual American citizens against a state government.
